Old Business - Continued
Comprehensive Councilman Perry reported meeting of the Planning and Development
Park Plan Committee with the members of the Park Board and Consultants re
11/7/77 referral of the Comprehensive Park Plan. Perry noted the
Park Board and Consultants will revise plan to include requested
items :Cedar Center Park and Cedar River Trails, noting Seattle City
Light property being top priority.
Street Banners Mayor Delaurenti explained for previous Council inquiry, that cloth
signs over public right-of-way require Council permission, plus
25 fee unless waived by Council, noting one Christmas banner O.K. ' d,
one placed without Council approval and therefore removed.

Ways and Means Ways and Means Committee Chairman Stredicke presented committee report
Committee [eport recommending second and final reading of an ordinance rezoning
Ordinance 3194 property located on the east side of Kennewick Pl . NE near NE 30th
Werstiuk Rezone from General Classification G to SR-2, R-1 and R-2. First reading
of the ordinance 1/16/78. Following readings , MOVED BY STREDICKE,
SECOND CLYMER, COUNCIL ADOPT THE ORDINANCE AS READ. ROLL CALL : ALL
AYES. CARRIED.
Street Vacation The report recommended first reading of an ordinance vacating a
Thomas Ave. SW portion of Thomas Ave. SW near FAI-405, noting $9,000 vacation fee
has been received. Following reading, MOVED BY CLYMER, SECOND
PERRY, COUNCIL REFER ORDINANCE BACK TO THE WAYS AND MEANS COMMITTEE.
CARRIED.
Resolution #2160 The committee report recommended reading and adoption of the following
Fund Transier resolutions: A resolution was read borrowing $900,000 from Street
Forward Thrust Fund pending receipt of tax monies due the City.
Following reading, MOVED BY CLYMER, SECOND PERRY, COUNCIL CONCUR
IN THE RESOLUTION AS READ. CARRIED.
Resolution #2161 A resolution was read declaring surplus two vehicles within the Equip-

CONSENT AGENDA The following consent agenda items are studied by each Council
Member, are considered routine and are enacted by one motion without
discussion unless -requested:
Housing Rehab Letter from Planning Director Ericksen reported that pursuant to the
Loan Program Housing and Community Development Act of 1974, King County has
312 established a housing rehabilitation loan program, which is available
to residents of King County, including incorporated areas ; that the
City would be eligible for the program upon concurrence of the City
Council and signing of an interlocal agreement authorizing King
County to work within the incorporated limits of the City for resi-
dential inspections and administrative duties. The letter explained
the proposed loan program would enable low and moderate income home-
owners to obtain low cost loans for rehabilitation of older housing.
Refer to the Community Services Committee for review and recommenda-
tion. Council concurrence.
Fire Station Bids The 1/17/78 re-bid opening for the Main Fire Station construction
received three bids; known as EDA-LPW Project #07-51-23907 Phase II .
See attached tabulation. Refer to the Public Safety Committee.
Appointment Letter from Mayor Delaurenti appointed Sanford E. Webb, 264 Chelan
Ave. SE to the Planning Commission effective through June 30, 1980,
replacing Logan Garrison who does not wish to be reappointed. Refer
to the Ways and Means Committee.
Damages Claim Claim for Damages was filed by Vitali Chonin, 10204 SE 8th, Bellevue,
for damage to property located at 3322 NE 6th, alleging sewer back
up causing damage in amount of $56.25. Refer to City Attorney and
Insurance Carrier.

Fire Station Bids Letter from Mayor Delaurenti recommended Council acceptance of
the low bid for the Main Fire Station of John Maples (see attached
Architect Present tabulation) . The letter explained total cost of the project as
Cichanski & Assoc. $906,701 which is $94,555 over budget. The letter recommended
the additional money be borrowed from the Street Forward Thrust Fund
and a percentage of the Utility Tax be set aside in 1979 to repay loan.
The letter noted meeting with the architect and Fire Station
Advisory Committee. MOVED BY CLYMER, SECOND THORPE, COUNCIL REFER
THE MATTER TO THE WAYS AND MEANS COMMITTEE. MOVED BY THORPE, SECOND
CLYMER, AMEND MOTION TO INCLUDE PUBLIC SAFETY COMMITTEE REFERRAL.
MOTION CARRIED, MOTION AS AMENDED CARRIED.
Renton Hill and Letter from Kathy Keolker, President of the Renton Hill Community
Transamerica Association, notified Council of the unanimous decision of the
Court Case Renton Bill Community Association and Board of Directors to author-
ized and encouraged their attorney, Bob McBeth, to petition the court
for permission to intervene in the pending lawsuit which the Trans-
america Corporation has filed against the City. The letter ex-
plained the association and Mr. McBeth would assist the City and
defend the City' s actions in changing the City' s Comprehensive •
Plan to single-family-use designation on Cedar Ave. S. MOVED BY
PERRY, SECOND THORPE, COUNCIL REFER THE MATTER TO THE CITY ATTORNEY
FOR ADVICE TO COUNCIL. CARRIED.
Council Agenda . Councilman Clymer presented a letter from Washington Natural Gas
Scheduling Co. received after the closing of agenda scheduling. Clymer Moved,
Thursday Noon seconded by Shinpoch, that the matter be referred to the Ways and
Deadline Means Committee as action was needed by the time of the next Council

Speed Limit Councilman Shane asked that the speed limit be raised from 35 mph
to 40/45 mph on the Maple Valley Highway, Cemetery Road (NE 4th St. ) ,
Lake Washington Boulevard and Sunset Boulevard. Moved by Stredicke,
Second Shane, council refer the matter to the Administration to
check speed limit on these streets and report back. ROLL CALL :
3-AYE: SHANE, STREDICKE, THORPE; 4-NO: CLYMER, TRIMM, SHINPOCH AND
PERRY. MOTION FAILED.

Werstiuk Rezone The committee report recommended first reading of an ordinance
R-105-77 rezoning certain properties located East of Kennewick NE at NE 30th
from "G" to SR-2 and R-1 and R-2, known as the Westiuk Rezone.
Following reading, MOVED BY STREDICKE, SECOND THORPE, REFER THE
ORDINANCE BACK TO THE WAYS AND MEANS COMMITTEE. CARRIED.
Ball Rezone Ways and Means Committee Chairman Stredicke noted the Ray Ball
rezone will not be presented until signed covenants filed with
the City Clerk.
Student Councilwoman Shinpoch called attention to Lindberg High School
Vistors students present; Mayor Delaurenti noted students have also been
visiting the various City Offices and Departments.

Medic I charge for services would affect elderly, especially heart patients,
that they will think twice before using the service. Mrs. Bales re-
lated her father is a heart patient with low retirement income and
noted Medicare does not cover medical bills, asking reconsideration
on charge. MOVED BY PERRY, SECOND SHINPOCH COUNCIL REFER THE LETTER
TO THE COUNCIL PRESIDENT TO REPLY. Upon inquiry, Fire Chief
Geissler reported City Aid Car charge of $25 for transporting to
hospital , no charge for other service; and explained Valley Medic
I deficit of $140,000 and that the Valley General .Hospital Medic I
Provider group recommended the user fee. Councilman Shane complained
the hospital advised the Medic I would be service granted upon pass-
age of bond issue. MOTION CARRIED.
Complaints of Councilman Clymer reported complaints have been received of dirt
Dirt on Streets on old cemetery road near Group Health Hospital . Councilwoman
and Thorpe also noted high speed of trucks on Petrovitsky and SW 43rd.
Speeding Trucks Mayor Delaurenti asked that the Public Works Director and Police
Chief report, respectively. MOTION BY SHANE, SECOND STREDICKE,

Burning Permits Letter from Fire Chief Geissler reported increasing difficulty
in denial of Residential Burning Permits except for the limited
period during Spring and Fall Clean-up;, that the permits could
be issued at several periods without problems for the Fire Depart-
ment and be in compliance with the Puget Sound Air Pollution
Control Agency' s Regulations and aid in eliminating hazards from
yard debris. The letter requested authority to issue Residential
Burning Permits at the discretion of the Fire Chief between 10/1
and 4/30 each year, being in compliance with Puget Sound Air. , Pol- .

Human Rights Letter from James V. Medzegian, President of the Renton Chamber.
Ordinance of Commerce pointed out the proposed Human Rights ordinance is
a duplication of existing Federal and State laws and suggested
the ordinance is not needed by the City. The letter also stated
the duplication would impose further burdens and expense on the
City and on the business community and recommended against adop-

WHEREAS under Chapter 7, Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances
of the City of Renton", as amended, and the maps and reports adopted
in conjunction therewith, the property hereinbelow described has
heretofore been zoned as GENERAL CLASSIFICATION DISTRICT (G) ;

WHEREAS a proper petition for change of zone classification

LANDSCAPED AREAS

SETBACKS
All buildings or structures shall be set back to 30 feet from the westerly boundary
and 15 feet from the northerly boundary„of Parcel B and 25 feet from prior southerly
boundary of Parcel C, now consisting of a 20-foot setback from the new southern
boundary of Parcel C and dedication of the former southerly 25 feet of Parcel C
for public right-of-way purposes. .
BUILDING DESIGN
The architecture of all buildings shall be single family residential .in character
featuring appropriate and compatible materials.
DURATION -
These covenants shall run with the land'and,expire on December 31, 2025. If at
any time improvements are installed'purSuant. to these covenants, the portion of
the covenants pertaining to the specific-Installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton
or any property owners adjoining subject' property who are adversely affected by
said breach. Reasonable attorneys' fees incurred during an enforcement proceeding
will be borne by the parties whom the court determines are in error and shall be
entered as a judgment in such action.

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: ' Examiner on November 8, 1977.•
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on November 15, 1977, at 9:45 a.m. in the Council Chambers of
the Renton Municipal Building.
Parties wishing to testify were sworn.
It was reported that the Hearing Examiner and .the applicant had received and reviewed.
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Responding to the Examiner's inquiries regarding density, establishment of a Planned
Unit Development, preservation of the ravine and hillside, and recommended setbacks,
Mr. Smith reported that under the department's recommendation, density could approach
29-30 units but could be limited to 22 units if SR-1 zoning rather than GS-1 were
approved for certain parcels. He also indicated that the department recommended a .
reduced rezone utilizing a P.U.D.. and imposed,other conditions established as covenants
running with the land. Regarding preservation of the ravine, Mr. Smith stated that
development should not occur on the sloped hillside and ravine' area at an elevation
below 215 feet and that a slight encroachment on the break of the hillside would be
beneficial to the site design. He explained setback requirements and indicated that .
the topography on the south property line of Parcel C extended the setbacks beyond the
minimum requirement of 20 feet and that a 25-foot dedicated strip on the southern
property line was included in addition, to ,the setback requirements. He also reported
that if property south of Parcel C were developed' in the future, an additional 25-foot
right-of-way would be required for dedication to provide a standard residential street.
In res'ponse. to the Examiner's inquiry regarding an existing easement shown on Exhibit
2, Mr. Smith advised that it was a storm sewer easement located on the adjacent
property directly west and extending to the northern portion of the subject site. The
Examiner asked if the designations on the topographic map attached to Exhibit #1
conformed to those designations in Exhibit #3. Mr. Smith "stated that the maps were
sufficiently similar to arrive at a recommended limitation for development.

The Examiner referenced the Comprehensive Plan Land Use Report, 1965, page 17, and
asked Mr. Smith if the proposed rezone met Objective No. 1. Mr. Smith stated that
although the applicant's original proposal did not meet the objective, the department's
recommended proposal provided for development of orderly growth patterns and met
objectives of the plan. In response to the Examiner's inquiry regarding zoning
transitions, Mr. Smith explained transition from the park to the single family
residential areas to the south and felt that theproposal would exclude further
multiple family zoning in the area. He noted that the property is designated as
R-3 on the Comprehensive Plan, but such zoning would be incompatible for the subject
site with the surrounding area. Further discussion ensued regarding Planning
Department criteria for land use changes and Mr. Smith advised that a need exists in
the area for additional condominium or townhouse development which would allow the
property owner a reasonable use of his land and protect adjacent properties from
adverse impacts from a major density development allowed in the present zoning
according to the Comprehensive Plan. He also stated that the site is located in close
proximity to the freeway and utilities are available. He felt that recommendation
created a situation in which low density multi-family zoning is surrounded with single
family residences establishing a pattern for only single family residence zoning in
the future. In response to the Examiner's inquiry regarding influence for a zoning.
change on the westerly portion of Parcel B because of the existence of the elementary
school adjacent to the site, Mr. Smith indicated;that schools exist in many other
residential and R-2 areas within the city.
The Examiner asked Mr. Smith if circumstances listed in Chapter 30, 4-3014, of Title IV,
Code of General Ordinances, applied to the subject rezone. Mr. Smith indicated that
although he did not recall the date of the last area land-use analysis, other
circumstances listed in the code applied to the requested rezone.
The Examiner called for a recess at 10:25 a.m. The meeting was reconvened at 10:50 a.m.
and the applicant was asked to testify. Responding was:

The Examiner asked the applicant if he concurred, in Exhibit #1. Mr. Werstiuk indicated
his concurrence in the report and felt that the proposal was consistent with the
Comprehensive Plan for the area. He reported his intent to properly develop the site
under the P.U.D. requirements to maintain the park-like setting. In response to the
Examiner's inquiry regarding the easement on the northern boundary of the site, Mr.
Werstiuk confirmed that it is a City of Renton storm sewer easement which cuts across
the north end of the property to May Creek. ThelExaminer asked the applicant if he
felt the proposal conforms to Comprehensive Plan objectives and criteria for a rezone
referenced in Chapter 30, 4-3014. Mr. Werstiuk responded affirmatively.
The Examiner asked for testimony in favor of the application. Responding was:

Mrs. Werstiuk expressed a concern regarding the ,recommended dedication of 25 feet along
the south property line and reported that negotiations with the King County Park
Department had resulted in an agreement to dedicate 10 feet of property at that
location to provide a fenced walkway into the King County May Creek Park. She felt
that the proposed 25-foot easement would create a dead-end street into the park which
would become a public nuisance. In response to he Examiner's question regarding the
negotiations, she reported that the park department had surveyed the property and
established a price, although no documents had been produced to date.
The Examiner asked for testimony in opposition to the application. Responding was:

Mrs. Millhuff reviewed past history of zoning recommendations by the Planning Commission
and City Council regarding the Kennydale area, and recalled a resolution adopted by the
Council which precluded further rezoning in the area until the Comprehensive Plan was
reviewed by the Commission. She requested a moratorium on the requested rezone until
such a review was accomplished. The Examiner advised that the subject of the hearing
was not the Comprehensive Plan and that it was not in his jurisdiction to declare a

moratorium in the area. Mr. Smith reported that the Comprehensive Plan had been revised
in 1976 for the area west of the freeway in Kennydale but was unsure of the status of the
east Kennydale area. The Examiner indicated that the record would be reviewed to
clarify the city's position on the matter. Mrs. Millhuff further objected to the
development because of the existence of the school and cited safety problems with
school children walking and curved roads creating sight reduction and traffic hazards.
The Examiner asked for further testimony in opposition. Responding was:

Mr. Moje indicated that he is the owner of the property south of the subject site. He
clarified that the intent of the county is to create a bridle trail and walkway on the
southern boundary of the property into the park. The Examiner asked Mr. Moje if King
County had requested a 10-foot strip on his property. He indicated that the county had
not made such a request. Mr. Moje asked for clarification of the access easement into
the property and the Examiner explained that the easement would not be considered a
public street until such time as property on the south side of the site was developed
and an additional 25 feet dedicated. Mr. Moje indicated his concurrence with comments
made by Mrs. Millhuff in previous testimony.
The Examiner asked for additional testimony. There was no response. He requested the
applicant to make final comments. Mr. Werstiuk emphasized, in response to Mrs. Millhuff's
comments, that the request conformed to the Comprehensive Plan and that the previous
owner of the property had provided substantial improvements in the area such as
sidewalks and wide streets. He stated that because of the nature of the site, a
Planned Unit Development was preferable to establishment of single family residences,
and felt that the number of residents in single homes would probably exceed that of
multi-family development. He noted that dedication of 10 feet of property on the
south property line would provide walkway access to residents in the area.
Mr. Smith indicated receipt of City Council Meeting Minutes of December 20, 1977. The
minutes were labeled Exhibit #6 by the Examiner, who read excerpts into the record.
It was noted that the discussion at the City Council meeting related only to the general
area of N.E. 30th and Park Street, the area west of the freeway in Kennydale.
Mrs. Millhuff requested further research relating to the Comprehensive Plan in the
Kennydale area, recalling several meetings held on the subject. She questioned the
timing and conditions related to purchase and development of the site by the applicant.
Mr. Werstiuk clarified items of inquiry by Mrs. Millhuff.
The Examiner asked Mr. Smith for additions, corrections or modifications to Exhibit #1.
Mr. Smith requested review of alternative zoning for Parcels B and C to SR-1 to reduce
density on the site, but indicated his recommendation for a Planned Unit Development
in either alternative zoning. He opposed single family zoning on the total site which
he felt would destroy the character of the area.
There were no objections to the Examiner's request to enter research findings from
City Council minutes relating to Comprehensive Plan review of the subject Kennydale
area into his final report and recommendation.
The Examiner asked for further comments. Since there were none, the hearing on
Item #R-091-77 was closed by the Examiner at 11:35 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a rezone from G and GS-1 to R-2 (Duplex) .
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference'
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.

4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required lot area requirements of Section 4-708
of Title IV, Code of General Ordinances.
7. A steep ravine containing a small stream extends from north to south through the
approximate middle of the site. This ravine begins at the ground elevation of
215 feet and rapidly falls northward to MaylCreek and King County Park property.
The greenbelt designation on the Comprehensive Plan Land Use Map was applied to
this ravine area. Approximately one-half of the site consists of the heavily
wooded ravine.
8.. The western portion of the site is designated Medium Density Multiple Family and
the remainder of the site is indicated as Single Family Residential on the
Comprehensive Plan Land Use Map.
9. Development of the site is proposed to be townhouse condominiums through the P.U.D.
process. The western portion of the site will consist of R-2 (duplex) density
townhouses, and townhouses of SR-1 and GS-1 (as staff recommended) density will be
located on the remainder of the site.
10. Access to the property is proposed to be along the southern portion of the property.
11. A ten-foot fenced walkway easement is currently being negotiated by the King County
Parks Division with the applicants for public access to the King County Park
property in the adjacent former Pacific Coast Railroad right-of-way and west of the
site. The site contains evidence of the desirability of public access across the
site to the park property in that several random trails exist on the site.
12. The minutes of the City Council meetings of, late 1976 and early 1977 revealed no
consideration by the City Council of the Comprehensive Plan for the subject site
or immediate area during that period. A record of actions which would restrict
rezones in this vicinity east of FAI-405 could not be found.
13. Existing zoning of GS-1 and G would permit approximately 6 single family units. The
R-2 classification would yield about 55 dwelling units. A zoning configuration of
R-2 and SR-1 on Parcel B, SR-1 on Parcel C and no reclassification of Parcel A
GS-1) would produce around 30 dwelling units (staff recommendation in Exhibit #1) .
If only Parcels B and C are rezoned to SR-1; a density in the vicinity of 22 units
would result.
CONCLUSIONS:
1. The Comprehensive Plan Land Use Map indicates conformance with the proposed R-2
zone for the western portion of Parcel B. Otherwise, Single Family Residential or
Greenbelt is shown for the site. However, the goals and objectives of the
Comprehensive Plan prevail over the Map.

In view of the physical topography and characteristics of the site, a rezone to
R-2 for the entire site would produce too great a density. This would constitute
overcrowding which is to be discouraged (Summary, pages 9 and 10, Comprehensive
Plan) . The ravine and stream area should be preserved in its existing state as
open space for the benefit of the future development, the adjacent King County
Park, and the community (Paragraph 2, page 1T; Objective No. 2, page 17;
Objective No. 6, page 18, Land Use Report, Comprehensive Plan) .
Some R-2 along Kennewick Place N.E. seems appropriate in view of the close proximity
to FAI-405 and the adjacent B-1 zone (Paragraph 3, page 11; Objective No. 6, page 18,
Land Use Report, Comprehensive Plan) . Single family residential seems appropriate
for the remainder of the site (Paragraph 3, page 11; Objective No. 1, page 17, Land
Use Report, Comprehensive Plan) . However, some restrictions appear warranted at
this location (Objective No. 1, page 17, Land Use Report, Comprehensive Plan) .
2. All but the easterly 200 feet of Parcel B should be rezoned to R-2. This would
divide Parcel B at approximately the middle of the ravine (along the stream) ,
thereby providing a minimum of around 120 feet of buffer (ravine area) between
development on the westerly and easterly portions of Parcel B.
To accomplish buffering of the R-2 from the properties south of the site, Parcel C
should be rezoned to R-1. Development on Parcel C should set back from the
south property line, which would occur via dedication of the south 25 feet for
public right-of-way. Access to the total development of the site should utilize
this right-of-way which would be enlarged to 50 feet upon future development of

5. Buildings will be set back 30 feet from the western property line, 15 feet from
the northern property line, and 20 feet from the southern property line (as
established by the aforementioned dedication) .
6. Architecture of buildings to be single family residential in character featuring
appropriate and compatible materials.
7. Retention of as much of the existing vegetation as possible. No clearing or
grading to occur beyond that approved in review of the P.U.D. unless approved by
the Planning Department.

the southerly properties. This right-of-waylwould serve the proposal as well as
the southerly and southeasterly properties which are zoned G-7200.
Parcel A should retain the existing zoning olf GS-l. As a transition between this
parcel and the westerly Parcel B, the intervening easterly 200 feet of Parcel B
should be rezoned to SR-2. The ravine provides sufficient buffering from the
more intensive R-2 on the western portion of Parcel B to not require a more intense
single family zone buffer to the GS-1 property. The SR-2 would provide the
appropriate density transition.
3. The findings of Section 4-3014.A, B and C apply to this property.
4. Due to the physical characteristics of the site which pose physical limitations
upon development, the P.U.D. process should be utilized (Section 4-2702, Purpose,
P.U.D. Ordinance) . This site and its surrounding land uses present an ideal
situation for application of the P.U.D. ordinance which will provide development
flexibility for the applicant, development control by staff, development review
and comment by citizens through a public hearing, and development according to
the existing natural constraints.
5. In order to protect the ravine and stream, development should not occur beyond
the 215-foot elevation level unless unusual circumstances are present. Deviation
from this condition can be reviewed during the P.U.D. process.
6. A single access from the site onto Kennewick Place N.E. is desirable from the
standpoint of traffic engineering and safety. It appears that this will also
assist the Public Works Department in preserving pedestrian safety in this area
of the Kennydale Elementary School.

7. Owing to the unique and sensitive physical characteristics of the site, as much
as possible of the existing vegetation should be retained. Clearing, grading, or
cutting should not occur beyond the 215-foot elevation level unless unusual
circumstances are found.
8. Additional landscape buffering is required along the west and south property lines.
This buffer should be a 15-foot sight-obscuring, heavily landscaped area which
includes as much of the existing vegetationias possible.
9. Buildings should be set back 30 feet from the western property line to accommodate
the 15-foot landscape buffer and parking and circulation. This setback also will
produce a lower building profile respectiveito Kennewick Place N.E.
To more adequately buffer the R-2 units from the northwesterly B-i zone, these
units should not be constructed closer than 15 feet from the northern property
line. The normal single family 20-foot front yard setback should be adhered to
along the southern property line.
10. Since the proposal is to be developed as a P.U.D. for the entire site, the
architecture of the buildings should be single family residential in character
featuring appropriate and complimentary materials. The design should be reviewed
during the P.U.D. process.
RECOMMENDATION: Based upon the testimony, record, findings and conclusions, it is the
Examiner's recommendation to the City Council that a rezone be granted as follows:
1
Parcel B (easterly 200 feet) to SR-2;
Parcel B (westerly portion)1 to R-2; and
Parcel C to R-1.
l
Furthermore, it is recommended that the rezone be conditioned upon the following:
1. Any development on Parcels A, B or C to be accomplished through the P.U.D. process
of Section 4-2702, which shall enforce the remaining conditions.
2. No development in the ravine beyond the 215-foot elevation. No clearing, grading
or cutting in the ravine area.
3. Dedication of the southerly 25 feet of Parcel C for public right-of-way which is
to be the only access to the development on Parcels A, B or C from Kennewick
Place N.E.
4. A sight-obscuring landscape buffer of 15 feet along the westerly and southerly
property lines.

By Memorandum received., by my' office November 23 , 1977 , I: was
abked to review. the report and Declaration .of Restrictive
Covenants on 'the above property.
With respect to the Declaration of Restrictive' :Covenants , the
same -are approved as to legal form. However, I would suggest
that some additional language. be added in' the paragraphs entitled
Setbacks" and "Building. Design" . In particular in the "Setbacks"
paragraph. I would suggest that the language be modified to read
starting in the middle of line 2 " . . .and 45. feet_ from the prior
southerly boundary of Parcel C, now consisting of a 20 foot setback
from the new southern boundary of Parcel C and dedication of the
former .southerly 25feet of Parcel C for public right-of-way purposes . "
By the way,; I.. believe the reference to. Parcel B in the' last sentence
of "Setbacks" in your proposed Covenants should have been Parcel C.
With respect:to the paragraph labeled"Building Design" I would
suggest that' there 'be - some mention that ,while low density multi-
family dwellings will be permitted on a portion of the subject
property, the architecture of all buildings shall be single family
residential in character;

During the public hearing today of the proposed Werstiuk rezone, a
citizen asserted that during the period of about November, 1976 to
January, 1977 the City Council passed a resolution regarding the
Comprehensive Plan immediately east of FAI-405 and along N.E. 30th '
Street or Kennewick Place N.E. The content of this resolution
allegedly was to disallow rezones in this area until the then
existing Comprehensive Plan was reviewed and updated.
Do you records indicate any such resolution? If so, please forward
a copy to me. I have minutes from the December 20, 1976 City Council
meeting which show an action regarding property west of FAI-405. We
would appreciate any information or action regarding the property
east of FAI-405 since November of 1976 to date.

D . HISTORY/BACKGROUND :
The majority of the site was annexed to the City by Ordinance #2292
November 30 , 1966 . The westerly portion of the site was annexed
to the City on an earlier date by Ordinance #1835 , June 23 , 1960 .

The property has .. retained its respective G zoning : classification
since annexation .
E . PHYSICAL BACKGROUND : 1
1 . Topography : The yuesterly one quarter of the subject site is
relatively level as is the area within the old pacific coast
railroad right-of-way on the southerly portion of the property
and the area immediately around the existing single family
residence located in the easterly one third portion .of the
property. A steep revine extends from north to south in the
mid portion of the property with steep slopes of approximately
60% along within the majority of the northerly and easterly
portions of the site . The steep hillside should be retained
in greenbelt as part of site development.
2. Soils : Indianola loamy fine sand ( InC ) , permeability is rapid ,
available water capacity is moderate , run-off is slow to medium,
and erosion hazard is slight to moderate. This soil is used
for timber and for urban development.
3 . Vegetation : The majority of the site is heavily wooded with
significant evergreen and deciduous trees as well as tipical
northwest woodland type shrubs and.. vegetation . This vegetation
especially on the steep slope area should be retained and
preserved within the site development as much as possible.
4. Wildlife': The existing vegetation on the site may provide
some habitat for birds and small mammals .
5 . Water : The existing ravine cutting through the middle of the
site contains a year-around stream which would eventually flow
into May Creek located north of the site further within the
ravine area .
6. Land Use : There is an existing single family residence located
in the easterly one third portion of the site . The proposed
King County-May Creek Park is located north and east and also
within a portion of the Pacific Coast Railroad Right-of-way
east and south of the subject site . There are existing single
family residences located south of the subject site along
Kennewick Place N . E . and other single family residence in
the vicinity of N . E . 27th Street approximately one quarter
mile south of the subject site . Kennydale Elementary School
is located across Kennewick Place N . E . west of the site and an
existing Exxon Gas Station is located west of the site on the
north side of N . 30th Street. The existing freeway interchange
for FAI-405 is located just west of the subject site a distance
of approximately 300 ' . May Creek is located directly north
of the subject site within the ravine area .
F. NEIGHBORHOOD CHARACTERISTICS :
The area is characterized by a mixture of single family residences ,
public uses , businesses , and park and greenbelt uses together with
undeveloped area .,. .
G. PUBLIC SERVICES :
1 . Water and- 'Sewer :- ; A- 12 inch water main ' is located along Kennewick
Place N . E . A 12 'inch sewer main is located at the corner of
N . E . 28th street and Kennewick Place N . E . However , given the
topography of the subject site and_ the depth of the main gravity
flow is noa possile . Either a private lift stationlor connection
to the proposed May Creek interceptor would be required . An

of track 56 and a 15 inch storm sewer is located along
Kennewick Place N . E .
2 . Fire Protection : Provided by the Renton Fire Department as
per Ordinance requirements . Any future development of the
site will be subject to City of Renton standards .
3 . Transit : Metro Transit route 42 operates along Kennewick
Place N . E .
4. Schools : The site is directly across the street and. east of
the Kennydale Elementary School , is within one mile of
McKnight Junior High School , and within two miles of Hazen
High School .
5. Parks : The subject site is directly adjacent to the King
County-May Creek Park and is directly across the street
from certain open space and recreation area provided by the
Kennydale Elementary School . Kennydale Lions ' Park is located
approximately one! half mile south of the subject site.

Rezoning the subject site will not have a direct impact on the
natural systems . However , eventual development of the site will
disturb soil and vegetation , increase storm water. run-off, and
have an effect on traffic and noise levels in the area , however ,
these can be mitigated with proper development controls and
procedures .
K. SOCIAL IMPACTS :
Changing the use from its present low density undeveloped state
to low density multiple family residential useage may result in
additional social interaction at the site as well as the surround-
ing area .
L . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the Cityiof Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , ' as amended , RCW 43 . 21C , a
Declaration of' Non-significance has been issued for the subject
proposal (see attached ) . This declaration is based on the
application of suitable development standards and controls so that
the site will retain as _niuch as possible its - natural character
and provide a density compatible with surrounding area and the
King County Park.

0. PLANNING DEPARTMENT ANALYSIS :
1 . The Comprehensive Land Use plan indicates medium density.
multiple family residential useage for the approximate
westerly 350-400 feet of the subject site ..north of the old
Pacific Coast Railroad right-of-way. , The remaining easterly
portion of the site is designated as greenbelt which corres-
ponds to the existing zoning (GS-1 ) . The old Pacific Coast
Railroad right-of-way is designated single family residential .
Therefore , ; parcel1B is the only portion of the site designated
for multiple family purposes . Given the topography of the
site , existing vegetation , and the surrounding park , elementary
school , and single family land uses , limited R-2 zoning appears
to be the Oghlst' possible intensity for parcel B at this time.
2 . Suitable utilities are available to the site or in close
proximity. Sewer will require a lift station or connection
to the proposed May Creek interceptor. Detailed requirements
and changes shall be coordinated with the Utilities Division .
3 . Suitable access is available to the site via the freeway
approx. 300 feet west of the subject site) , N . 30th Street
and Kennewick Place N . E .
4 . Existing B-1 , Business zoning is adjacent to the northwest
corner of the subject site .
5 . The King County May Creek Park is directly adjacent north and
east of the subject site . Care should be taken in rezoning
the site s'o that a proper interface is provided between the
two uses . This would include the provisions of limiting the
amount of R-2 zoning in the area , excluding the steep hillside
and ravine from development for structures and parking , and
preserving it in its natural state as well as the provision for
suitable setbacks , site design , and development controls .
6. The existing topography and vegetation on the site warrants
proper provisions for development controls similar to those
stated in #5 above. According to topographic maps , the
steep slopes begin at about the 210 to 215 elevation , level .
Development should not occur on the sloped hillside and ravine
area at an elevation below 215 as shown on the attached copy
of the City ' s Topographic map for the area .

7 . Rezones hale been permitted in the past with provisions
for protecting ravine and hillside areas , and existing
significant trees and vegetation ,—together with zoning
density controls, development by P . U . D . ( Planned Unit Development) ,
and other developmental controls . (See Stoneway Concrete
rezone , file number R-891-76 and Stewart Pope rezone , file
number R-816-75 ) .
8 . No site development plans have been submitted at this time .
If the R-2 rezone were granted for the entire site as
requested , townhouses or duplexes could be constructed by
Special Permit to a maximum eleven dwelling units per acre
or a total1of approximately 55 dwelling units on the entire
site . If the portion of the site west of the ravine and
small strum were; rezoned to R-2 , and the easterly 200 feet
of parcel rezoned to SR-1 , single family residential , with
the ravine! as the easterly boundary for multiple family zoning ,
and parcel C rezoned to SR-1 , and the entire parcel A left
in its present GS!-1 to correspond with the Comprehensive Plan ,
the site could be; developed as a P . U . D . (Planned Unit Develop-
ment ) utilizing these underlying zones to attain a total
site density of approximately 30 dwelling units . If the
property were zoned and platted single family residence (SR-1 )
approximately 10 to 15 buildable lots could be created on the
site.
9. There may be a need for right-of-way dedication along the
old Pacific Coast1Railroad Right of way for future access
to the park site ,Ond other properties east of Kennewick
Place N . E .
P . PLANNING DEPARTMENT RECOMMENDATION :

Recommend approval of R-2 rezone for that portion of Parcel ' B '
west of the bottom of the ravine and stream , SR-1 for the remaining
easterly 200 feet of parcel ' B ' , SR-1 for Parcel ' C ' , and GS-1
for all of parel ' A ' Ibased on the above analysis , and the con-
sistency of the R-2 zone with the Comprehensive Plan , existing
zoning and existing uses , provided further that certain conditions
are necessary and must be established as covenants to ensure
proper development ofl .the site consistent with adjacent park ,
greenbelt , single family residential , and elementary school uses . ' I ,
These conditions are p,s follows :
1 .. Natural Areas : The existing ravine and hillside shall be
preserved in its natural state , and no structures , parking ,
or traffic, circulition shall be constructed within the ravine
area1unlesls otherwise approved by the Renton Planning Department.

a ) Detailed landscape plan including existing vegetation to
remain , shall be submitted to and approved by the Renton
Planning Department prior to development on the site .
b) Minimum 15 foot landscape buffers shall be provided 1

PUBLIC MEETING This being the date set and proper notices having been posted, published
Talbot Hill and mailed, Mayor Delaurenti opened the preliminary meeting with theIslandinitiatingpropertyownerstoconsiderthe10% letter of intent to annex
Annexation properties to the city in the area of Talbot Hill known as the island.
Letter from City Clerk Mead recalled the petition was presented to Council
on 1/24 at which time meeting date of 2/14 was set. The letter also ex-
plained the legislative body at this time needs to determine whether to
accept the letter of intent; require assumption of the pre-existing bonded
indebtedness , if any; and whether to authorize circulation of the 75%
petition. Letter from Public Works Director Gonnason reported Water
District No. 78 in the Talbot Hill Island in good condition and compatible
and equitable with the city' s present systerr,that following annexation
the City Council has the authority to elect by resolution or ordinance
to assume jurisdiction. John Torlai , 15860 Springbrook Road, acted as
spokesman for the petitioners and acknowledged acceptance of the Comprehen-
sive Plan, zoning and any pre-existing bonded indebtedness , asking for
annexation of the entire area. James Nolen, 15644 Springbrook Road, asked
assurance that the city would assume responsibility and maintenance of
the water district, that residents would not be reassessed for mains. Mr.
Nolen reported water district balance of $640. Alice Sounders, 15641
Springbrook Rd. , inquired regarding the Comprehensive Plan, and was advised
by Planning Director Ericksen that single family residential status would
continue following annexation. Both Public Works Director Gonnason and
Planning Director Ericksen answered questions regarding the annexation.

Letter from the Planning CommissionParkAve. N. explained their recommendation that the multi-family designation on both
the north and the south side of N. 30th extending from the freeway to ParkAve. be reduced by approximately one-third. Letters from area residents

of N. 30th adjoining property owners . Albert V. Miller, 3108 Park Ave. N. , noted
his father's estate within proposed area to be downgraded, with his prop-
erty to the north, asked Comprehensive Plan be unchanged as it would be
an injustice to the property owners in the area at this late date, that
protests are from people a mile away not adjoining. Petition from J.B.
Spoor, Gene Craig, Barbara Millhuff, W.C. Hicklin, Roberta Hodge asked
further review of the area and appealed the Planning Commission recommenda-
tion as unsatisfactory as the area has developed as a single family resi-
dential area. Letter from David 0. Biggar of the Kennydale Community
Club, 2525 Aberdeen N.E. , reported membership vote opposing further
multiple housing development and favored preserving single-family develop-
ment status in vicinity of N. 30 and Park Ave. N. in contradiction to the
Planning Commission' s recommendation. Letter from Mr. and Mrs. R. M.
Millhuff, 1213 N. 33rd, protested Planning Commission recommendation and
proposed a buffer street directly behind the commercial zone as prefer-
able to low-density buffer or apartment buffer, or suggested a greenbelt
zoning. Letter from Susan & Gary Spoor, 3210 Park Ave. N. , opposed the
Comprehensive Plan which would allow apartments adjacent to community
businesses along 30th St. between 405 and Park Ave. N. Letter from Gene
and Norma Craig, 3204 Park Ave. N. , reviewed events regarding the Kenny-
dale area and reiterated opposition to the proposed Comprehensive Plan
proposed by the Planning Commission. Letter from Gertrude & Clayten J .
Julien, 1225 N. 33rd St. , opposed any plan which would allow change to
area by allowing multi-family type housing. Letter from Mr. & Mrs . Geo.
Sidebotham, 1404 N. 30th St. , one of three residents maintaining their
home in the affected area, asked that the present Comprehensive Plan be
maintained, explaining the increased taxes paid due to potential zoning
and surrounding businesses (property located between 7-11 Store, gas
station and 8-unit apartment) .
Planning Director Ericksen recalled the history of review, being initiated
by the city council at the time of Knutsen rezone in June, 1976, and
further explained Planning Commission hearings, that arterial street plan
was not considered. Ericksen used wall maps and made maps available to
the audience and council , explaining the Planning Commission recommenda-
tion, giving comparison to present plan which reduces by 1/3 the multiple
dwelling area. Ericksen explained proposed R-2 low density multiple
zoning and explained Commission's determination that new single family
residences next to service station and 7-11 store would be undesirable.
Councilman Perry explained proposed ordinance changes regulating commun-
ity-oriented type businesses. Councilman Clymer noted need for inclusion
of the arterial street plan study and noted similarity of Comprehensive
Plan to zoning map. Councilman Stredicke asked for clarification between
neighborhood business or regional business at that intersection. Gene
Craig, 3204 Park Ave. N., objected to buffer zone between business and
single family. James Kirkman, 1002 N. 35th, urged council to consider
impact on community, noting his understanding of Miller, Ault andSide-
botham situation, asking community agencies work together for bridge
solution. Upon inquiry of Councilman Perry, Mr. Kirkman noted he was
not on the Commission during study of area; Asst. City Attorney Warren
advising of commission members' citizen rights . MOVED BY STREDICKE, SEC- ----

Proposal for Co. has been filed for vacation of a portion of 100th Ave. SE and
Portion of Talbot Rd. S. , $100 filing fee received and the petition has been
100th Ave SE & certified valid by the Public Works Department. The letter reported
Talbot Road S. the Public Works Department also certified that the petition represents

letter recommended referral to the Board of Public Works and Public
Services Committee for determination regarding appraisal and payment

Boeing Water Line the contract. The agreement provides for the City to extend Boeing ' s
Extension 8-inch water main to the northwest corner of Renton Municipal Airport
for the water supply of the new restaurant site and to improve fire
protection. The report noted City Attorney Shellan has reviewed agree-
ment, asking minor changes be incorporated, which has been accomplished.

ci Plan Land Use Planning and Development Committee Chairman Perry presented
Designation committee report recommending that the Comprehensive Plan land
N. 30th St. use designation on both sides of N. 30th Street from FAI-405 to
Park Avenue North remain commercial (approximately 125 feet
in depth) and that the multi-family residential designation
be deleted. The committee report further explained that though
the Council went on record indicating that a public hearing
would be held prior to any further change in the Kennydale
Comprehensive Plan, it was the consensus of all interested
parties and representatives of both sides of the issue that met
with the committee, that another public hearing was not desired.
The report further recommended referral to the Ways and Means
Committee for appropriate legislation. MOVED BY GRANT, SECONDED
BY SHINPOCH, COUNCIL CONCUR IN THE RECOMMENDATION OF THE COMMITTEE,
President Perry introduced Kennydale Community Club spokesman,
Gary Spoor, 3210 Park Ave. N. (representing Kennydale residents
against multi-family zoning) who stated agreement to the Comp,
rehensive Plan changes as outlined and that np additional pub-
lic hearing was desired. The presence of Mr. George Sidebotham
was noted. The City Council requested the City Clerk to notify

Talbot Roadway Councilwoman Thorpe inquired about an item on the 3/28/77 Consent
Construction Agenda re Final Payment on the Talbot Roadway Construction requested
Final Payment by Public Works Director Gonnason and was concerned about the cost
overrun, change order and authorized extra work and why an item
like that was put on the Consent Agenda. Mr. Gonnason said the
department would prepare a report on all the expenditures and what

Hearing Examiner Moved by Thorpe, Seconded by Stredicke, those items which are Hearing
Reports Examiner recommendations concerning matters over which the Council
has legislative authority, be placed under Correspondence and Current
Business on the Agenda and packets relative to those be handed out
in advance and not be placed on the agenda until one week after Council
has received the materials. MOVED BY THORPE, SECONDED BY GRANT, SUBSTI-
TUTE MOTION, THOSE ITEMS FROM THE HEARING EXAMINER BE PLACED ON THE
CONSENT AGENDA ONE WEEK AFTER RECEIPT OF INFORMATION PACKETS AND BE
REFERRED TO THE WAYS AND MEANS COMMITTEE WHEN APPROPRIATE. Councilman
Perry explained the Council members names will be placed on list with
Hearing Examiner for receipt of materials. MOTION CARRIED.
