AN'ORDINANCE OF THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT.(R-2) TO PUBLIC DISTRICT (P-1) R-286-79
WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton"; as
amended, and the maps and reports adopted In conjunction therewith,: the,property
hereinbelow described has heretofore been zoned as Residence District (R-2); •and
WHEREAS a proper petition for change of zone classification of said property
has been filed with the Planning Department on or about. January 22; 1979, which
Petition was duly referred to the Hearing Examiner for investigation, study and.public
hearing, and a public hearing having been held thereon on or about February 20, 1979,
and said matter having been duly considered by the Hearing Examiner and said zoning'
request being in conformity with the City's Comprehensive Plan; as amended, and the
City Council having duly considered all matters relevant thereto, and all parties having
been heard appearing in support thereof or in opposition thereto, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property in the .City of Renton is
hereby rezoned to Public District(P-1)as hereinbelow specified; subject to the findings,
conclusions and decision dated February 22, 1979; the Planning Director is hereby
authorized and directed to change the'maps of the Zoning Ordinance, as amended, to
evidence said rezoning,'to-wit: •

SW 12th & SW' 13th of filing fee. Refer to the Public Works Department, Board of
Public Works, Transportation Committee and Ways and Means Committee
for verification of petition, determination re advisability,
easement and vacation fee; also resolution setting public hearing
date of 6/11/79. Concur.
Park Equipment Bid Opening 4/5 Redwood play equipment for Gene Coulon Memorial
Bid Acceptance Beach Park and Tiffany Park; 3 bids received. See attached tabula-
tion. Letter from Director of Parks and Recreation Webley reported

Easement for Letter from Public Works Director Gonnason requested a resolution
Park and Ride Lot be prepared authorizing the Mayor and City Clerk to execute a quit
claim deed to the State of Washington regarding sewer easement for
the Park and Ride Lot. Future use of the easement not anticipated.
MOVED BY STREDICKE, SECOND CLYMER, COUNCIL CONCUR IN THE RECOMMENDA-
TION. City Attorney Warren noted a resolution not needed. CARRIED.

Public Meeting - Loma Linda Annexation - Continued
Persons Present: Don Tatro, 3211 Talbot Rd. S. , expressed belief that area should
meet City standards. Curt Collier, 1932 NE 20th, favored the
annexation. *MOTION CARRIED. Time: 8:90 p.m.
AUDIENCE COMMENT Mrs. Manning, 17004 Springbrook Rd. , asked Mr. Westlund for
lot by lot rating survey, the Mayor advising questions may be asked
at the public hearing following presentation of 75% petition.
OLD BUSINESS Councilwoman Shinpoch announced request of Assistant Attorney
Kellogg that an Executive Session be held regarding possible law-
suit.
Ways and Means Ways and Means Committee Chairman Clymer presented committee report
Committee Report recommending Council concur fn the request of the Administration
Comp Time to pay off the comp time that has been accrued by fire fighters
Pay Off
with payment authorized no later than 12/31/79 (to be funded from

unanticipated revenues rather than loan from Firemen's Pension
Fund) . The Committee further recommended a resolution be drafted
stating that future comp time be used within 30 days and may be

Public Meeting This being the date set and proper notices having been posted,
Loma Linda published and mailed according to law, Mayor Delaurenti opened
10% Petition the public meeting to consider the 10% petition to Annex property
Letter of Intent to the City of Renton filed by Earl Westlund, 16530 So. 43rd St. ,
to Annex to Issaquah, property owner and developer of Loma Linda plat located
the City south of Victoria Park between Talbot Rd. S. and the proposed
SR-515. Attorney Michael Rodgers, lll NE 3rd, representing WestPac
Development Corp. and Mr. Westlund, presented additional petition
for annexation bearing two signatures and claiming 28 acre parcel
for annexation. Mn Rodgers requested sewers for the Loma Linda
plat, recalling his earlier request to Council (2/26) and explained
County approval of the preliminary plat, claiming hardship.
City Clerk Mead explained the City had received petition filed by
Mr. Westlund, signatures certified by Planning Dept. as 36.89% of
assessed value of area; noted need of Legislative body to determine
acceptance of the letter of intent, requirement of adoption of
Comprehensive Plan, Zoning Ordinance and any pre-existing bonded
indebtedness and determination re authorization to circulate 75%
petition. Upon inquiry by Councilman Perry regarding acceptance
of Comprehensive Plan, Zoning and indebtedness of City, Mr. Rogers
explained the Loma Linda plat meets County plat regulations, that
lot size includes those of 7,200 sq.ft. (16 of 37 separate lots
are 7,200 s.f.) . Upon inquiry Planning Director Ericksen explained
the zoning would be determined by adjoining property, Victoria Park
being SR-1 with minimum lot size of 7,500 sq. ft.
Councilman Stredicke inquired re agenda item of annexation by
Cascade Sewer District of area adjacent to the Loma Linda plat,
area confirmed by the Public Works Director who noted matter would
be referred to him for further study. (See Consent Agenda)
Mr. Rodgers, upon questioning by Councilman Stredicke, answered
Yes" on behalf of Mr. Westlund for acceptance of City's Comprehen-
sive Plan, Zoning Ordinance and any pre-existing bonded indebtedness .
MOVED BY STREDICKE, SECOND SHINPOCH, COUNCIL ACCEPT THE 10% LETTER
OF INTENT TO ANNEX CARRYING THE CONDITIONS OF REQUIREMENT OF ADOPTION
OF COMPREHENSIVE PLAN, ZONING ORDINANCE AND ANY PRE-EXISTING BONDED
INDEBTEDNESS, AND AUTHORIZE CIRCULATION OF THE 75% PETITION.*(CARRIED)
Annexation Persons present: Felicia Manning, 17004 Springbrook Road, presented

SUMMARY OF REQUEST: Applicant seeks approval of a rezone from R-2 to P-1 and a
special permit to allow construction of a medical clinic on
property located on Talbot Road South between S.W. 43rd
Street and the Renton city limits.

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on February 16, 1979. •
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the .
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on February 20, 1979 at 9:12 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens., Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. 'Deak indicated his •concurrence in the report, and deferred further comments to the
designer of the project. Responding was:

Mr. Zanoni reported agreement with staff recommendations contained in Exhibit #1, and
indicated his ,intent to conform to all requirements outlined in the report.
The Examiner requested testimony in support or opposition to the application. There was
no response. He then referenced Section L.3 (Rezone) regarding previous allowance of
professional office use in .the R-2 zone, and inquired if the current zoning .code reflects •
the amendment to, delete the use. Mr. Clemens indicated that codes had been updated to
remove professional office use previously allowed by special permit. ,

The Examiner referenced Section 'L.4 (Special Permit) pertaining to provision of a minimum
aisle width of 24 feet between parking spaces adjacent to the southerly property boundary
and the area immediately north; and Section L.7 (Special Permit) requiring a minimum 10-
foot setback between the northern property line and the stairs of the proposed structure,
and inquired if the conditions can be readily approved. Mr. Clemens responded affirmatively.
The Examiner referenced Section L.9 (Special Permit) pertaining to requirement of a 15-foot
utility easement adjacent to the south and west property lines, and inquired if the lines
would conflict with, proposed landscaping designated on Exhibit #7. .Mr. Clemens advised
that discussion of the matter with the Engineering Division had concluded that 10 feet
of property would remain after installation of a five-foot landscaping strip and would'
provide an acceptable space for. location of utility lines.
The Examiner inquired regarding the existing King County zoning and Comprehensive Plan
designation for abutting property to the east of the subject site. Mr. Clemens indicated
that prior to annexation .of the property to the City of Renton in January, 1979, King
County zoning designation was medium density multifamily, but had been revised to a "G"
zoning category upon annexation as required for all annexed property. He advised that
public use designation would appear to be the proper land use district for the property
in the future.
The Examiner requested a final recommendation from the Planning Department. Mr. Clemens
indicated the Planning Department recommendation contained in Exhibit #1 would remain
as submitted.
The Examiner requested additional comments. Since there were none, the hearing on File
No. R-286-79 and SP-287-79 was closed by the Examiner at 9:37 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a rezone of .72 acres from R-2 to P-1 and a site plan
of construction of a medical clinic adjacent to an existing medical clinic.
2. The Planning Department report accurately sets forth the issues, applicable policies •
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen,' responsible official.
4. ' Plans for the proposal have been reviewed by all city departments affected by the
impact of •this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the requirements of Section 4-710 (P-1) and 4-2206
Parking and Loading Ordinance) of Title IV, Ordinance No. 1628, Code of General
Ordinances, except for:
a. Compliance with the five-foot side yard setback along the northerly property line.
b. Compliance with the 24-foot aisle width requirement. The Building Division required
a 10-foot setback from the' northerly property line of the northerly external
stairway '(Exhibit #1) .
8. A medical clinic exists. on the property in a converted residence. An existing garage
will be removed pursuant to approval of this application (Exhibit #4) .
9. The staff, recommended revisions to the landscape plan (Exhibit• #7) were acceptable •
to the applicant.
10. The Public Works Department requested a 15-foot utility easement along the southern
property line. Within this easement the northerly 10 feet can be used for landscaping

11. The previous zoning analysis of the property occurred in 1972 when the property was

rezoned 'to the existing R-2. At that time medical clinics were permitted in the R-2
zone, but since that time the use has been prohibited. Area land use analysis is
currently occurring for this area of the city.
12. The Comprehensive Plan Land Use Map indicated the property to potentially be P-1
Section .4-3014. (B) ) .
13. Medical clinic construction has substantially consumed the' general area surrounding
Valley General Hospital. The subject site is located at the southern boundary of
this medical clinic: node.. A medical clinic is located abutting and northerly of the
property. Testimony did, not address timing of this development trend relative to
the subject site (Section 4-3014. (C) ) .
14. The property easterly and across Talbot Road South from the subject site was annexed
into the City of Renton in January of 1979 and given G zoning. ..The public use
designation of the Comprehensive Plan was viewed by staff as most appropriate for
that property.
15. Staff found the submitted legal description to be incorrect.
16. Off-site improvements are required per Ordinance No. 3214.
CONCLUSIONS:
1. The proposed rezone, site plan and building design appear to conform to the goals '
and objectives of the Comprehensive Plan (Section 4-3014. (B) ) and are an appropriate
extension of the development pattern in the area (page 9, Summary, Comprehensive
Plan, Renton Urban Area, 'July, 1965) . The development plan will, protect the .
southerly residential. property (page 17, Objective No. 1, Land Use Report, -
Comprehensive Plan, July, 1965) . Additional employment opportunities will be
provided to the area residents (page 17, Objective No. 3, Ibid.) . Appropriate
land use controls are being exercised (page 17, Objective No. 4, Ibid.) . The
proposal will make a positive contribution to the community (page 18, Objective
No. 6, Ibid.) .
2. The ". . .general design and development conform with the adjacent surroundings. . . "
Section 4-10.3) as suggested to be changed by staff. (Exhibit #7) .
In order to fully comply with this section and the Comprehensive Plan as much as
possible of the southerly 15 feet of the property should be a landscape screen to
adequately buffer the proposal from the southerly abutting single family property.
The landscaping plan recommended by staff (Exhibit #7) is appropriate.
3,. Non-compliance with setback and aisle width requirements (Finding No. 7) can be
satisfactorily resolved by-the Planning Department with the applicant.
RECOMMENDATION: (Rezone)
City Council approve the reclassification to P-1 subject to submission of a correct
legal description of the property as required by the Planning Department.
DECISION: (Special Permit)
Approval of. the site plan, Exhibits #6 and 7, subject to:
1. Compliance with building setback and parking aisle width requirements per review
and approval of the Planning Department.
2. Submission. of corrected legal description per requirements of the Planning Department.
3. Completion of off-site improvements per approval of the Planning and Public Works
Departments,
4. Except for the area required for utilities, the southerly 15 feet is to be an
effective landscape buffer per Exhibit #7 and per approval of the Planning and
Public Works Departments.
5. City Council approval of a reclassification to P-1 (File No. R-286-79) .
6. Compliance with all other applicable ordinances and regulations of the City of Renton.

The subject site was annexed into the City by Ordinance #2394
datled March 26 , 1968 . It was rezoned from "G" to R-2 by Ordinance
27111 dated June 16 , 1972 .
D . PHY;SICAL BACKGROUND :
1 . Topography: The site slopes downward from east to west at
just under a 10% slope.

2 . Soils : Alderwood (AgC ) . Permeability is moderately
rapid in the surface layer and subsoil . Runoff is slow to
medium and the erosion hazard is moderate . This soil is used
for timber , pasture , row crops , and urban development .
3 :_ Vegetation : The site has been asphalted for parking and
s.ome : handscapi;ng . is included . The westerly boundary contains
some small shrubs and a few evergreen trees . The same pattern
is found in the northerly and southerly property lines .
4 . Wildlife : Existing vegetation on the site provides suitable
habitat for birds and small mammals .
5 . Water: No surface water was evidenced on the subject site .
6 . Land Use : An existing structure in the westerly portion of
the subject site is presently used as a medical clinic for
dermatology. Other medical clinics are located to the north
and east of the property . Valley General Hospital is to the
north along S . E . 43rd Street . An attorney ' s office is to the
east across Talbot Road South and two single family residences
are located on the properties to the south .
E . NEIGHBORHOOD CHARACTERISTICS :
The surrounding area is developed into a medical -professional
complex with some scattered single family residences on the
fringes .
F . PUBLIC SERVICES :
1 . Water and Sewer: A 12" water main extends north-south
on Talbot Road South adjacent to the subject site . An 8"
sanitary sewer is located on Talbot Road approximately
100 ' north of the subject site .
2 . Fire Protection : Provided by the Renton Fire Department
per ordinance requirements .
3 . Transit: Metro Transit Route #145 operates along S . W . 43rd
Street within 1 /8 of a mile to the north of the subject site .
4 . Schools : The subject site is not in close proximity to any
existing schools and the proposed project will not have an effect
on existing schools .
5 . Recreation : The subject site is slightly over one mile
south of Talbot Hill Park . In addition , the grounds of Valley
General Hospital may provide some recreational opportunities .

social interaction on the site as well as in the ' s:urrounding

5 . Traffic : The proposed development will generate approximately
600 ( 75 weekday trips/1000 square feet of gross floor area
times 7 ,820 square feet) additional vehicle trips . On Talbot
Road South , the 1978 traffic counts indicate 6 ,016 trips .
Therefore , the development will result in approximately a 10%
traffic increase in the immediate area . The Traffic
Engineering Division advises that the existing street and
circulation system will satisfactorily handle the greater
volumes .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a Aeclaration of non-significant impact has been prepared based
upon the proposed minor addition to existing use of the property ,
and subject to adequate screening and landscaping treatment .

with adjoining activity of this nature .

Permit application .

M . DEPARTMENTAL RECOMMENDATIONS : (REZONE )
Based upon the foregoing analysis , recommend approval of the
proposed rezoning as being compatible with the Comprehensive Plan
and increased medical /clinic development in the area , and subject
to the following conditions :
1 . Submission of a revised and corrected legal description
prior to final City Council action .
2 . Provision of a sight obscuring landscape screen along the
south property line to separate any proposed use from the
adjoining single family residence .
L . PLANNING DEPARTMENT ANALYSIS : (SPECIAL PERMIT)
1 . Although the subject site is presently ned for professional
service office use , a rezone to P-1 ( Public Use ) would allow
for such a development by Special Permit . Together with
appropriate design treatment regarding landscaping , screening ,
and setbacks , the site could be suited for such a use .
2 . The subject proposal is compatible with the existing land
uses and zoning in the general area . Similar clinic-type
structures and medical -dental facilities exist in the area
on the property or are proposed for future development .
3 . The existing building on the northwest portion of the site
currently houses a medical clinic . The applicant proposes
to construct a 2-story facility to the east which will accommodate
a dermatology clinic . The structures will have to meet all
code requirements of the Building Division .
The proposed building is two stories (daylight basement)
with the lower story currently proposed for storage .
The existing building will remain . If the lower story
of the new building is used for office/clinic purposes ,
additional parking will be required . The proposed building
conforms to all requirements of the P-1 District .
4. The conceptual site plan meets ordinance requirements
for the following :
a . Parking. required : 41 spaces
Parking Provided : 42 spaces
b . The minimum aisle width of 24 ' between the spaces
adjacent to the southerly property boundary and the area
immediately north may not have been provided . One additional
foot may need to be provided to meet the standard of the
Parking and Loading Ordinance .
5 . The Engineering Division of the Public Works Department
advises that off-site improvements such as curb , gutter ,
sidewalk and additional paving will be required along Talbot
Road South as part of site development. In addition , storm
water detention will need to be provided (see attached
comments . )
6 . The Fire Department indicates that additional hydrants and
watermains will have to be installed and serviceable for
adequate protection of the existing and proposed structures .
Provision of a turnaround at the end of the western parking area
and satisfactory aisleway grades will be required by the Fire
Department (see attached comments ) .
7 . A minimum 10-foot setback is required between the north
property line and the stairs of the proposed new building (see
Building Division comment ) .

8 . A 5-foot wide landscape strip is required adjacent to the public
right-of-way of Talbot Road South and 10 ' is provided .
Additional screening and landscaping may be necessary along
the perimeter and throughout the interior of the subject site .
The conceptual landscape plan appears to address shrubbry in
these areas adequately. Specific requirements of
size , spacing , number , and types of tree planting to be
provided will need to be included in submittal of the
detailed landscape plan . The minimum landscaping depth
should be increased to 5 ' .
9 . , The Utilities Engineering Division advises that an
easement will be necessary at 15 ' adjacent to the south and
west property lines . A sewer extension will also be required .
A portion of this may have to be pumped . Standard hookup
charges for water and sewer also apply (see attached comments ) .
10. ' The site is near the hospital and other clinics in the area .
The building elevations appear to be consistent with contemporary
northwest architecture and in harmony with similar structures
in the area . Together with these and other criteria , the site
is very appropriate for the proposed clinic use .
M . DEPARTMENTAL RECOMMENDATIONS : (SPECIAL PERMIT)
Recommend approval of the special permit request for a proposed
clinic subject to the following conditions :
1 . Final Hearing Examiner' s and City Council approval of the
rezone request (R-286-79 ) .
2 . Correction of the deficiencies regarding parking stall
layout as addressed in number 4 of the analysis .
3 . Provision of off-site improvements including curb , gutter ,
sidewalk and landscaping along all the public right-of-way
adjacent to the subject site .
4 . Final Public Works Department approval of detailed drainage
plans including adequate storm water detention .
5 . Final Fire Department approval of hydrant locations
and adequacy of the proposed turnaround .
6 . Final Planning Department approval of detailed landscape plans
to be submitted at the time of building permit application .
7 . Provision of adequate utilities and payment of standard hookup
fees as per Utilities Engineering Division requirements .
8 . Final Planning Department approval of exterior building
elevations .

Introduction The State Environmental Policy Act of 1971. Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
