HISTORY/BACKGROUND : The subject site was annexed into the City by Ordinance #156 dated in 1909 . The subject "G" General zoning has existed since adoption of the zoning ordinance in 1953 . D . PHYSICAL BACKGROUND : 1 . Topography : The site is essentially level . 2 . Soils : Urban Land (Ur) . This is soil that has been modified by disturbance of the natural layers with additions of fill material several feet thick to accommodate large industrial and housing installations . The erosion hazard is slight to moderate . No capability or woodland classification . PLANNING DEPARTMENT . Vegetation : The site is landscaped along Shattuck Avenue with a variety of shrubs and some medium growth deciduous species . The remaining open space consists of lawn. 4. Wildlife : Existing vegetation may provide some habitat for birds and small mammals . 5 . Water : No water was observed on the subject site . 6 . Land Use : The north one-half of the subject site consists of a single family residence and the south half contains a duplex . Commercial uses are adjacent to the westerly boundary with either duplexes or apartments situated on other sides . E . NEIGBORHOOD CHARACTERISTICS : The area is primarily low-density multiple family with scattered light commercial . F . PUBLIC SERVICES : 1 . Water and Sewer : A 16" water main runs north-south on Shattuck Avenue South adjacent to the subject site . 8" water mains are located on S . .6th Street, Shattuck and along the westerly border of the property . 2 . Provided by the 'Renton Fire Department as per Ordinance requirements . 3 . Transit : Metro Transit Route #107 operates on S . 3rd Street approxi - mately 4 mile north of the subject site and Route #155 operates along Rainier Avenue South within 2 mile to the west . 4. Schools : The Talbot Hill Elementary School is approximately 12 miles south of the subject site while the Nelsen Junior High School is about 12 miles southeast and the Renton Senior High School is within 2 mile to the north . 5 . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C , a negative declaration of environmental impact has been prepared for the subject rezone only. The proposed rezone to R-4 is consistent with the land use element of the Comprehensive Plan which designates the site as high density multiple family residential . 2 . The proposal is generally consistent with existing zoning and land uses of adjacent properties (i . e . B-1 , L-1 , R-4 zones and the apartment and/or duplex residences to the north , east and south ) . 3. The fact that the subject site has remained zoned "G" since adoption of the Zoning Ordinance in 1953 appears to demonstrate that the classification has not been specifically considered in a previous area zoning or land use analysis (Section 4-3014-A) , other than the Comprehensive Plan adoption of 1965 . 4. Existing zoning , neighborhood Comprehensive Plan designations , and the land use of the subject site and surrounding properties would seem to indicate that the applicant' s property is potentially zoned for the R-4 classification requested . (Section 4-3014-B) 5 . The applicant ' s letter of April 23 , 1979 (copy attached ) lists a number of recent private developments in the subject area . The Building Division confirms these developments have occured as stated . (Section 4-3014-C ) 6 . Suitable utilities are available to the subject site . However, any future development will require approved water and sewer plans and payment of standard hook-up fees . 7 . The Fire Department advises that a hydrant must be located within 150 feet of structures on the site and if one does exist , it must be a 3-part hydrant . Any hydrant and/or water main installation will be as per water engineering requirements ,and occupancy as per the Uniform Fire Code . Additional comments of the other departments are attached for consideration . M . DEPARTMENTAL RECOMMENDATIONS : Recommend approval of the requested rezone to R-4 based upon items 1 -4 of the analysis and subject to the following conditions : 1 . Final Public Works Department approval of detailed water and sewer plans and payment of fees for any future development. 2 . Final Fire Department approval of any necessary hydrant on water main installations . The Act also requires that an EIS be prepared for all major actions significantly affecting the quality of the environment. The request is for approval of a change in classification of +12,000 square feet from General (G) district to R-4 district to permit future development of apartment buildings on the site. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject site is located at the southwest corner of the intersection of Shattuck Avenue S. and S. 6th Street. A single family dwelling and a duplex currently occupy the site, and the applicant proposes to maintain those structures for the present. 8. The G zoning was imposed on the subject site by the original zoning ordinance in 1953. The site was annexed into the city by Ordinance No. 156 in 1909. 9. The land use element of the Comprehensive Plan designates the area in which the site is located as high density multi-family residential. 10. Zoning in the area consists of L-1 zoning to the north, B-1 zoning to the west, and R-4 zoning to the south and east. The area to the east consists of a large area of R-4 zoning and this parcel and one small parcel further to the south are the only remaining G zoned properties in the immediate vicinity. 11. The subject site which is only about 12,000 square feet in area is below the minimum 40,000 square foot lot area required of a lot in the G zone. 12. The applicant in a letter included within Exhibit #1 and verified by the Building Division indicated a number of changes which have occurred in the area of the subject site. Approximately eight new buildings have been built with as few as two and three units and as many as 32 units. 13. There is a three-port fire hydrant within one hundred feet from the subject site which may adequately serve the site per the Fire Department's concern. CONCLUSIONS: 1. The proponent of a rezone must demonstrate compliance with the criteria of Section 4-3014, which provides in part that: a. The site has not been considered in a previous area rezone; b. The subject site is potentially zoned for the new classification per the Comprehensive Plan; or c. There have been changes in circumstances in the area. The applicant and the Planning Department have shown that the criteria necessary to permit a rezone of the subject property have been met. 2. The site was originally zoned G in 1953 when the original zoning of the city was initiated. The only other time this area was considered was when the Comprehensive Plan was adopted in 1965. The Comprehensive. Plan in fact designated this area for multi-family residential use. Neither the applicant nor any other party acted upon that potential designation until the filing of this application. R-339-79 LOCATION: West side of Shattuck Avenue South at intersection of South 6th Street. SUMMARY OF REQUEST: Applicant requests a rezone of the subject site from G to R-4 to permit future apartment development while continuing uses of the existing dwelling for single and multiple family residences. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with restrictive covenants. PLANNING. DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 16, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field Checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 22, 1979 at 9:15 a.m. in the Council Chambers of the Renton . Municipal Building. Parties wishing to testify were affirmed by the Examiner. Steve .Munson, Planning Department, entered the Planning Department report into the record as Exhibit #1. During review of the report, Mr.' Munson also entered the following exhibit into the record: Exhibit #2: King County Assessor's Map The Examiner requested testimony by the applicant. Responding was: Bill Schwartzenberger 601 Shattuck Avenue South Renton, WA 98055 The Examiner inquired if the applicant had received and reviewed Exhibit #1, and if he concurred in the Planning Department recommendations. Mr. Schwartzenberger indicated his . concurrence in the report. The Examiner requested the applicant to designate the existing structures on the property.which will remain upon development. Mr. Schwartzenberger advised that an existing duplex and single family residence are located on the property requested for rezone for future apartment development. He indicated that he owns the entire block south of the subject site. The Examiner referenced Section L.7 of. Exhibit #1 which indicates that' the Fire Department will require location of a fire hydrant within 150 feet of structures on the site, and if one does exist, it must be a three-part hydrant, and inquired if an existing hydrant on the southeast corner of the intersection is located within the required 150 feet. Mr. Schwartzenberger advised that the hydrant is located within the required distance, and Mr.' Clemens reported that it may, be necessary to provide an additional or separate fire hydrant if fire flow requirements of the proposed future use on the site warrant additional facilities. The Examiner inquired if sidewalks exist in the surrounding area. Mr. Munson indicated that no improvements exist in the area. The Examiner requested testimony in support or opposition to the application. There was no response. He then requested further comments from the Planning Department. Since there were no further comments, the hearing on File No. R-339-79 was closed by the Examiner at 9:25 a.m. R-339-79 Page Three 3. As noted above, the Comprehensive Plan designates this area containing the subject site as potential multi-family residential. While the map element alone does not indicate how each individual parcel should be zoned, it is an indication of the possible zoning. The map element combined with the surrounding zoning is a strong indication that the best use of the parcel is R-4 so that it is compatible with its neighbors. 4. The development of the area in the last five years has been following a trend toward redevelopment of the area for multiple unit residences. There have been• at least eight such developments in the area, demonstrating a change in use of the area. 5. Under the circumstances \enumerated, it would appear that the rezone of this relatively small G parcel to R-4 is warranted.. Besides meeting the criteria necessary for a rezone, the property is presently less than the minimum lot area necessary for a lot in the G zone and is therefore non-conforming. Both proper planning and zoning require the elimination of non- conforming uses from an area and this rezone would also accomplish that purpose. 6. The classification of the subject property as R-4 would enable the applicant to eventually develop uses On the property which would be compatible with other uses permitted and developing in the area. RECOMMENDATION: The application, for the rezone should be approved subject to the following: 1. Final Public Works Department approval of detailed sewer and water plans and payment of the standard fees for future' development. 2. Final approval of the Fire Department of any necessary hydrant or water main installations. 3.
