Dear Mr. Messo:
This is to notify you that the above referenced request, which was
approved subject to restrictive covenants as noted on the Examiner's
report of May 7, 1981 and modified in response to a request for
reconsideration on May 21 , 1981 , has not been appealed within the
time period established by ordinance. Therefore, this application
is considered final and is being submitted to the Planning Department
effective this date for permanent filing.
Please contact the Planning Department for information regarding
preparation of the final short plat mylar which will be filed along
with required restrictive covenants with King County.

Dear Mr. Messo:
I have reviewed your request for reconsideration and revisited the
subject site and surrounding properties. Your request is justified
as it pertains to the setback required along Whitman Court ; and
therefore the decision is modified as indicated below.
The property at Whitman Court located south of the subject property
is set back about 45 feet because of the location of a parking
facility, and is not in the true sense a building setback line, but
rather a parking bay. Condition No. 2, which currently reads :

Dear Mr. Kaufman :
We hereby request reconsideration of Item #2 of Decision on Sh. P1 . 038-81 .
Upon inspection of the southerly properties we found that Whitman Court N. E.
actually ends at our south property line and at that point enters the parking
areas of the Honeydew Apartment complex. Due to the parking arrangement at
the apartment complex the building to our south is actually about 45 feet to
the west of our east property line. Inasmuch as Whitman Court N. E. actually
ends at our south property line, we feel that the 20' set back is sufficient
on that street.
The apartment complex set back on Union Avenue N.E. is approximately 20' and
therefore is the same as our proposed set back from our west property line.
We therefore are requesting that the words "whichever distance provides the
greater setback" be deleted from the Declaration of Restrictive Covenants"
and that just the 20' setback remain.
If the deletion we request is not granted we would lose one entire building
of our condominium project.

WHEREAS, Wall and Redekop Corporation is the owner of the following real property
in the City of Renton, County of King, State of Washington, described as follows:

WHEREAS, the owner of said described property, hereinafter "the property,"
desires to impose the following restrictive covenants running with the land as to
use, present and future, of the property;
NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes
restrictions and covenants running with the land as to the use of the land hereinabove
odescribed with respect to the use by the undersigned, their successors, heirs and
assigns, as follows:

SETBACK
Provision of either a 20-foot setback or maintenance of the existing building line
established southerly of the subject property along Union Avenue N.E. , whichever
provides the greater setback; and the provision of a 20-foot setback along Whitman
Court N.E.
DURATION
These covenants shall run with the land and expire on December 31 , 2025. If at any
time improvements are installed pursuant to these covenants, the portion of the covenants
pertaining to the specific installed improvements as required by the Ordinances of the
City of Renton shall terminate without necessity of further documentation. Proper legal
procedures in the Superior Court of King County may be instigated by either the City
of Renton or any property owners adjoining subject property who are adversely affected
by any violation or breach of these restrictive covenants. Reasonable attorneys ' fees
incurred during an enforcement proceeding will be borne by the parties whom the court
determines are in error and shall be entered as a judgment in such action.

LOCATION: East side of Union Avenue N.E. and the west side of Whitman Court
N.E. , approximately 400 feet south of Sunset Boulevard N.E.
SUMMARY OF REQUEST: The applicant requests approval of a two-lot short plat .
SUMMARY OF ACTION:Planning Department Recommendation: Approval with conditions .
Hearing Examiner Decision: Approval with restrictive covenants.
PLANNING D :PARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on April 22, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report , examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows :
The hearinq was opened on April 28, 1981 at 9:50 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report, and entered the following exhibits into the record:

Exhibit #2 : Short Plat Map
Responding to the Examiner 's inquiry regarding the inclusion of the site in a previously
established moratorium for sewer connection in the vicinity, Mr. Blaylock advised that the
subject si _e had been exempted from the moratorium. Mr. Blaylock also reviewed the
departmental recommendation for provision of an access easement from the parking lot of
Lot 2 to Lot 1 to assure dual emergency access to Union Avenue N.E. and Whitman Court N.E.
The Examiner requested testimony by the applicant . Responding was :

Mr. Nesso advised that requirements of the Fire Department will be met by the applicant ,
and an existing power pole located 28 feet south of the north property line will be moved
by Puget Sound Power and Light Company to the northeast portion of the site.
Mr. Nesso requested clarification of the Planning Department recommendation for provision
of an access easement. Mr. Blaylock reiterated the purpose of the request, and noted that
the requirement can be shown on the face of the plat.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a two-lot short plat on +2.3 acres.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been
determined exempt from the threshold determination by the Environmental Review
Committee, responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. Water service is available in the area. While the property is included within the
moratorium area for sewers, the subject property is exempt from the moratorium
Resolution No. 2392) .
7. The subject property is located approximately 400 feet south of Sunset Boulevard N.E.
between Whitman Court N.E. and Union Avenue N.E. The entire parcel is about 165 feet
wide by about 598 feet long.
8. The applicant proposes dividing the parcel into two parcels to facilitate construction
financing. Lot 1 would be about 165 feet wide by 299.81 feet deep (1 . 145 acres) and
Lot 2 would be about 165 feet wide by 297.89 feet deep (1 . 12 acres) . Lot 1 would
have frontage onto Union Avenue N.E. and Lot 2 would provide frontage along Whitman
Court N.E.
9. The Comprehensive Plan indicates that the area in which the subject property is located
is suitable for the development of medium density multifamily housing.
10. The property is currently zoned B-1 (Business/Commercial) . The site was annexed into
the city by Ordinance No. 2000 in December of 1962.
11 . The site is undeveloped. Areas to the south are developed with apartments, while to
the north there are a mix of commercial uses. There are also apartments and single
family dwellings to the east.
12. The applicant proposes constructing two multifamily apartment complexes on the subject
site. The two lots would be developed as one complex. Development of the subject site
with the proposed 75 condominium units could potentially increase the population of
the city by approximately 190 persons (2.5 person/unit) ; increase the school age
population by about 20 students (.25 students/unit) ; and increase the traffic on the
roads in the area by about 425 vehicle trips per day (5.6 trips per unit) .
13. Whitman Court N.E. is a residential access street while Union Avenue N.E. is an arterial
and collector street. For this reason, the Planning Department recommended that access
to Whitman Court N.E. be limited to emergency access only.
14. The property to the south of the subject site is R-3 (Medium Density Multifamily
Residential ) which requires a 20-foot front yard setback.
CONCLUSIONS:
1 . The subject short plat appears to serve the public use and interest as conditioned
below. The division is necessary to permit financing of construction.
2. Two aspects of the proposal should be conditioned so that the project will be in
the public interest. The use of Whitman Court, a minor residential access street
for the proposed multifamily development, will cause too great an impact on that
street and on the residents of the single family homes located along it. The
applicant can alleviate this situation by providing an easement serving Lot 2 through
Lot 1 so that all access, save emergency access, is via Union Avenue N.E. , an arterial
collector in this area. This would avoid the possibility that the current ownership
connection between the two separate lots will be severed in the future by a sale of
Lot 2, separate and apart from Lot 1 . A divided ownership could close off access of
Lot 2 to Union Avenue N.E.

3. The second issue is the fact that the B-1 zoning would permit construction to intrude
into the established building line that is already established south of the subject
site. Therefore, restrictive covenants should be executed which require either a
20-foot setback from the streets or maintenance of the existing building lines along
both Whitman Court N.E. and Union Avenue N.E. , whichever provides the greater setback.
This would also move potential residential units further off the street permitting
quieter enjoyment of those units. The close proximity of residences to streets is not
conducive to residential living and is not in the public use and interest. The
policies element of the Comprehensive Plan (Sections 4C(7) and 4D(2)) requires that
multifamily sites achieve the same basic amenities as are achieved within single family
units, and this includes setbacks which promote privacy.
4. The emergency access should be gated, and discussion about emergency access should be
held with the Fire and Police Departments.
DECISION:
Exhibit #2 is approved subject to the following conditions:
1 . The provision on the face of the plat of an easement running in favor of Lot 2 for
through access to Union Avenue N.E. and the restriction of access onto Whitman Court
N.E. of all but emergency vehicles.
2. The execution of restrictive covenants which provide a setback either of 20 feet
or the existing building line maintained on the southerly properties along both
Union Avenue N.E. and Whitman Court N.E. whichever distance provides the greater
setback.

The subject site was annexed into the City by Ordinance
No. 2000 of December 17 , 1962.
D. PHYSICAL BACKGROUND:
1 . Topography: The subject site is generally level
except for a slight downslope to the northeast.
2. Soils : Alderwood gravelly sandy loam (AgC) . Per-
meability is moderately rapid in the surface layer
nd subsoil is very slow in the substratum. Runoff
is slow to medium and the hazard of erosion is
moderate. This soil is used for timber , pasture,
berries, row crops and for urban development. Everett
gravelly sandy loam, 5 to 15 percent slopes, (ErC) .

and pasture and for urban development.
3. Vegetation: The site is largely overgrown with
weeds and scrub brush.
4. Wildlife: The existing vegetation may provide
some habitat for birds and small mammals. .
5. Water: No surface water was observed on the subject
site (April 14 , 1981 ) .
6. Land Use: The subject site is undeveloped at this
time.
E. NEIGHBOttOOD CHARACTERISTICS:
The surrounding properties are a combination of apartments ,
some commercial, undeveloped properties, and single
family residences.
F. PUBLIC SERVICES:
1 . Water and Sewer: A 12 inch water main and 8 inch
sanitary sewer extends north-south on Union Avenue
N.E. adjacent to the subject site.
2. Fire Protection: Provided by the City of Renton
as per ordinance requirements.
3 . Transit: Metro Transit Route No. 107 operates
along Union Avenue N.E. adjacent to the westerly
border of the subject site.
4 . Schools : The Honeydew Elementary School is within
one-fourth mile to the south of the subject site
while McKnight Junior High School is approximately
11 miles west and Hazen Senior High School is one-
half mile to the east.
5. Recreation: The subject site is within one-fourth
mile of Kiwanis Park to the south and approximately
11 miles south of the proposed King County park
west of Sierra Heights Elementary School.
