With the increases, the City of Renton will be Ordinance recovering approximately 60% of the cost for staff review and evalu- ation of any application. Committee Chairman Rockhill commented on the lack of interest at the Public Hearing for this fee increase, reporting that the last increase took place in 1976. Street Councilman Stredicke questioned if the Consent Agenda item for the Vacations proposed street vacation was a logical vacation (being a half-block vacation request) or if others in the area, at a later date, will request inclusion, noting similar problem with prior street vacation. Mayor Shinpoch reported that this matter would be discussed at staff meeting. CHG/Sunpointe Councilman Stredicke requested information regarding a report that Development the CHG/Sunpointe development had been denied by the State in their Requirements attempt to install a traffic signal on Sunset Blvd. SW (a City-imposed requirement on the developer) . Stredicke questioned how often this situation occurred. SUMMARY OF REQUEST: The applicant seeks a rezone of the subject site from R-1 to L-1 to construct a warehouse on the property. SUMMARY OF Building & Zoning Department: Approval with restrictive RECOMMENDATION:covenants. Hearing Examiner: Approval with restrictive covenants. BUILDING & ZONING The Building & Zoning Department report was received by the DEPARTMENT REPORT:Examiner on August 17, 1982. PUBLIC HEARING: After reviewing the Building & Zoning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 24, 1982 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Building & Zoning Department report and other pertinent documents Exhibit #2: King County Assessor's Map Exhibit #3: Zoning Map Mr. Blaylock corrected Section M.2 of the staff report which concerns required landscaped areas and noted that in addition to landscaping on the first 10 feet adjacent to the southern property line, the same landscaping shall be required on the eastern property line. The Examiner requested testimony by the applicant. Responding was : J. Clifford Gray 15437 S.E. 132nd Place Renton, WA 98056 Mr. Gray indicated concern regarding required setbacks of 20 feet on the south and 10 feet on the east property line. Since the entire parcel consists of only 7500 square feet, imposition of setbacks of that dimension will reduce the lot size by approximately one- fourth and make construction of the proposed facility on site infeasible. He felt that those setbacks are not typical of the L-1 zone and inconsistent with other developments in the area. Mr. Blaylock indicated that the setback requirements establish a compromise between the Manufacturing Park and Light Industrial zones since the Comprehensive Plan designates the entire area as appropriate for M-P zoning and from 15 to 20 other rezones in the general vicinity from S.W. Grady Way to S.W. 16th Street have been granted to provide a consistent policy in the city over the past 12 to 15 years. The Examiner suggested that 10 feet of the 20-foot southern setback can be utilized for parking purposes with the other 10 feet landscaped. Further discussion was held regarding a proposed site plan submitted with the application and compliance with city codes for required setbacks. It was also advised that the Parking and Loading Ordinance requires separate setbacks than those required in the L- 1 zone, and further review of site plans will be required to determine compliance with all codes. The Examiner noted that an established and well-maintained single family home abuts the site, and city policy would require a minimum six-foot setback to protect the residence which is on a lot zoned R-1 . Responding to Mr. Blaylock's inquiry regarding proposed building height, Mr. Gray advised that the height would be approximately 20 feet. He then inquired regarding setbacks on the alleyway. Mr. Blaylock stated that a setback would be required R-051-82 Page Two on an alley only if a residence is located adjacent to it or if needed for parking or access. Water and sewer facilities to the subject site were discussed, and it was noted that a deferral of off-site improvement requirements on Lind Avenue S.W. could be granted by the Board of Public Works until an LID is formed. Mr. Gray inquired regarding the definition of a con itional use permit recommended by the staff report for the proposed development. Mr. Blaylock indicated that a conditional use permit would require review of a specific site pla and include details regarding water, sewer, parking configurations and building plans. I The Examiner requested final comments. Mr. Blaylock stated that staff would have no objectio to reduction of the eastern sideyard setback to six feet if a limitation is placed o the height of the structure to lessen bulk of the building. Mr. Gray reiterat d his support of a 10-foot setback on the southern boundary in lieu of staff's recommen ation for a 20-foot setback and a five foot setback on the eastern property line. Since th re were no further comments , the hearing regarding File No. R-051-82 was closed by the E aminer at 9:35 a.m. FINDINGS CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS 1 . The pplicant, J. Clifford Gray, filed a request for a reclassification of approximately 7,50 square feet of property from R- 1 (Single Family Residential ; Minimum lot size - 7,20 square feet) to L-1 (Light Industrial ) . 2. The Opplication file containing the application, SEPA documentation, the Building and Zoning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Purs ant to the City of Renton's Environmental Ordinance and the State Environmental Poli y Act of 1971 , RCW 43.21C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC) , responsible official . 4. Plane for the proposal have been reviewed by all city departments affected by the impa. t of this development. 5. The - ubject property is located between Maple Avenue S.W. and Lind Avenue S.W. on the orth side of S.W. 12th Street. 6. The .ssentially level lot is occupied by an existing single family home which the applicant proposes to remove. Vegetation on the site consists of grass , medium sized shru.bery and a large cedar tree. 7. West of the subject site is an office building owned by the applicant. The subject site would be redeveloped in conjunction with the westerly development. 8. Nort of the subject site is an abandoned single family home which is separated from the -ubject site by an alley. East of the site is a single family home which is in good repair and is well maintained. The properties to the south across S.W. 12th Stre=t are generally undeveloped. The . rea is generally in transition from older single family uses to light industrial and arehousing uses. 9. The slubject site was annexed into the city by Ordinance No. 1745 in April of 1959. The ite was automatically classified G-6000 at the time of annexation. The "G" clas ification was changed to R- 1 in 1982 by Ordinance No. 3634. 10. The •omprehensive Plan designates the area in which the subject site is located as suit-ble for the development of manufacturing park uses. 11 . Similar reclassifications have been approved in the area, including rezones to L-1 and :-l . The ordinances approving same include 3270, 3308, 3338, 3469 and 3482. Thes. approvals were generally coupled with restrictions imposing landscape and building setbacks somewhat compatible with the manufacturing park designation of the Comp ehensive Plan and the Green River Valley Comprehensive Plan. Since many of the lots in the area of the subject site are not large enough to accommodate the full setbacks required in the M-P zone, setbacks have been required adjacent to public right-of-ways and along property lines abutting single family or other residential uses. The setbacks imposed have been twenty foot building setbacks of which the first r R-051-82 Page Three ten feet must be landscaped along street right-of-ways and a ten foot setback adjacent to single family uses. The L-1 zone requires a minimum six foot setback from single family uses and a twenty foot front yard setback (Section 4-712 (C) - back referencing Sections 4-711 (D) and 4-706(C) (4) (a) and (c) ) . 12. The staff indicated that inaccuracies in the site plan submitted by the applicant should be reviewed pursuant to a site plan review which process is used to review all structures in M-P zones and would therefore treat the subject site in a manner faithful to the Comprehensive Plan designation of the site for manufacturing park. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate the the request is in the public interest and will not impair the public health, safety and welfare. In addition, the rezone must comply with at least one of the three criteria listed in Section 4-3014 which provides in part that: a. The subject site has not been considered in a previous area rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the necessary criteria have been met to permit the approval of the rezone to L-1 subject to the conditions indicated below. 2. The size of property involved in the request would make the setbacks of the M-P zone infeasible, and an L-1 classification would permit many of the same uses. L-1 has been the classification granted on similar properties in the areas surrounding the subject site and would permit the applicant to make reasonable use of the subject site. 3. At the same time, a single family residence is located immediately adjacent to the subject site to the east, and this home should be entitled to reasonable protection. Therefore, the requirement that the applicant provide landscaping and setbacks compatible with the adjoining uses is not unreasonable and is , in fact, required by the standards of development for yards in an L-1 zone and must be adhered to by the applicant. The Comprehensive Plan indicates that incompatible uses should be adequately screened from one another, and, additionally, arterials and streets should be buffered from certain uses. Therefore, the applicant will have to execute restrictive covenants requiring a twenty-foot setback from S.W. 12th Street of which the southerlymost 10 feet must be landscaped. The entire six-foot setback required on the east to buffer the single family home must also be landscaped. All landscaping should be subject to the approval of the city's landscape architect. 4. In order to assure compatible development of the subject site with the surrounding uses and the Comprehensive Plan, site plan approval should be required. 5. The applicant will have to provide adequate water, sewer and storm water treatment subject to the approval of the Department of Public Works. RECOMMENDATION: The City Council should approve the reclassification of the subject site from R-1 to L-1 subject to the following conditions: 1 . No building shall be constructed within 20 feet of S.W. 12th Street and the southerly 10 feet of the setback shall be landscaped. 2. A minimum setback of six feet which is landscaped is provided on the east property line. 3. All landscaping shall be approved by the city's landscape architect. 4. Soils : Urban Land (Ur) is soil that has been modified by disturbance of the natural layers with the addition of fill upto several feet thick to accommodate industry or housing. 3. Vegetation: The bulk of the site consists of grass with some medium growth shrubbery and one large cedar tree. 4 . Wildlife: The existing vegetation provides some habitat for birds and small mammals. 5. Water: No surface water was observed on the subject site (August 12 , 1982) . 6 . Land Use: The subject site is undeveloped at this time. An office building is adjacent on the west while to the north is an abandoned single family residence and another office structure. A second single family dwelling is located to the east and the properties to the south remain undeveloped. NEIGHBORHOOD CHARACTERISTICS: The neighborhood is a mixture of residential and business uses along with interspersed vacant lots. Some transition of uses from a former residential character to business uses is in evidence with concentrations of non-residential uses primarily along Grady Way. PUBLIC SERVICES: 1 . Water and Sewer: The water line adjacent to the subject site are undersize. A 10-inch water main exists approximately 600 feet away on S.W. Grady Way. The proposed rezone to L-1 , Light Industrial, is not directly in conformance with the Comprehensive Plan Land Use Element designation of Manufacturing Park for the subject site. However, the City has approved a number of rezones in the vicinity to Light Industrial subject to restrictive covenants designed to be compatible with the objectives of the Valley Comprehensive Plan. These rezone include Ordinances #2425 (August, 1968) ; #2559 (April, 1970) ; #2590 (October, 1970) ; #2594 (October, 1970) ; 3053 (August, 1976) ; #3270 (December, 1978) ; #3308 April, 1979) ; #3338 (July, 1979) ; #3469 (September, 1980) ; and Ordinance #3482 (November, 1980) . In addition, immediately adjacent to the subject site have been two previous rezones to L-1 . The first to the north in 1965 (Ordinance #2146) , and immediately to the west (Ordinance #2590) in 1970. In fact, the proposal will be utilized in conjunction with the previous rezone to the west and development of the commercial structure. These actions which indicate that the subject site is potentially zoned in compliance with the policies of the Comprehensive Plan as required under Section 4-3014B. 2 . The subject site is located in an area which is in transition from older single family residential developments and vacant land to commercial and industrial uses. Older single family residences are located to the southeast and west. The residence to the north has been abandoned. Commercial and industrial activities are located also to the north- east, west and southwest. 0- PRELIMINARY REPORT TO THE HEARING EXAMINER J. CLIFFORD GRAY AUGUST 24 , 1982 PAGE FOUR Strict application of the setback requirements in the Manufacturing Park zone precludes functional development of these small lots and blocks. Therefore, in the past, design review and minimal setback requirements have been considered as necessities. 3 . The applicant has submitted a proposed site plan along with the rezone request. The site plan does not comply with required City codes dealing with parking and landscaping. In addition, special covenants associated with rezones to L-1 in a Manufacturing Park zone have typically required twenty (20) foot setbacks along all public streets and ten (10) foot setbacks along all other property lines. The site plan clearly does not follow the general intent specified in past rezone requests. 4 . The public Works Department advises that : (1 ) a solution to the handling of storm drainage, (2) off street improvements required by ordinance on both the S.W. 12th Street and Lind Avenue S.W. , and (3) alley improvements including the extension of the existing 8-inch sanitary sewer from the western property line and pavement will be required. 5. The Water Utilities Division advises that water main extension will be required to meet fire flow for commercial warehouse purposes. 6. Policy Development Department believes that because of the apparent inaccuracies of the site plan that the site plan be approved subject to conditional use permit. 7. The evidence indicates that the subject site was not considered during the last reclassification of the area thus complying with Section 4-3014 (A) (1 ) of the Land Use Hearing Examiner Ordinance. M. DEPARTMENTAL RECOMMENDATI : Based upon the foregoing analysis, it is recommended that the Hearing Examiner recommend approval of the rezone application request, file R-051-82, from R-1 , Single Family Residential, to L-1 , Light Industrial Use, with the following conditions imposed by restrictive covenants : 1 . SETBACKS: No building or structure shall be permitted as meted: a. Within twenty (20) feet of the southern property line along S.W. 12th Street. b. Within ten (10) feet of the eastern property line. 2 . From our records, there has never been a street use permit issued to allow youtoutilizethepublicright-of-way for parking. There were discussions originally backin1977, concerning the use but no permit was actually issued or lease payments made. It should also be pointed out that the parking that was proposed to be allowed onthestreetright-of-way did not meet the parking requirements for an office building. Infact, the office building did not have to have associated parking because it wasaremodelingofanexistingstructure. Your present proposal contemplates adding 6,000 square feet of warehouse. UnderSection4-2203(1), an addition in excess of 33% of the original square footage ofthebuildingrequiresthatallparkinglotsbebroughtuptoCitycode. Based uponyoursiteplan, that would require a total of thirteen (13) parking spaces. The office structure would need nine (9) spaces while the 6,000 square feet of warehouse would require four (4). All of this parking must be provided on private property. It should also be noted that the City is planning to widen Lind Avenue S.W. and will requiretheright-of-way that you presently use for parking. Therefore, your entire siteplanshouldbere-evaluated to provide adequate parking and design on-site. The Environmental Review Committee wishes to see a revised site plan that would comply with the parking requirements of the Municipal Code. The application willbeheldforfifteen (15) days awaiting submission of a revised plan.
