WHEREAS under Chapter 7, Title IV (Building Regulations) of
Ordinance No . 1628 known as the "Code of General Ordinances of the City
of Renton" , as amended, and the maps and, reports adopted in conjunction
therewith, the property hereinbelow described has heretofore been
zoned as General Classification District (G-1) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Building and Zoning Department
on or about September 23, 1983, which petition was duly referred to
the Hearing Examiner for investigation, study and public hearing,
and a public hearing having been held thereon on or about November
1 , 1983, and said matter having been duly considered by the Hearing
Examiner and said zoning request being in conformity with the City' s
Comprehensive Plan, as amended, and the City Council having duly
considered all matters relevant thereto, and all parties having been
heard appearing in support thereof or in opposition thereto , NOW
THEREFORE,
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS :
SECTION I: The following described property in the City
of Renton is hereby rezoned to Business District (B-1) as hereinbelow
specified; subject to the findings , conclusions and decision of the
Hearing Examiner dated November 10, 1983; the Building and Zoning
Director is hereby authorized and directed to change the maps of the
Zoning Ordinance, as amended, to evidence said rezoning, to-wit:

AGREEMENT, made this 1/ 'day of May, 1984, by and between
BROAD1.CRES, INC., a Washington corporation ("Broadacres"), and the CITY OF
RENTOI' , Washington ("City").
RECITALS
1.B•oadacres is the owner of part of the real property depicted in Exhibit "A"
attached hereto (the "Property").
2. The Washington Horse Breeders Association desires to rezone and to construct
b irns and other improvements on part of the Property.
3. The Environmental Review Committee of the City of Renton has required as an
environmental condition that Broadacres reserve for twenty-five (25) years that
portion of the property described in Exhibit "B" attached hereto (the "Restricted
Froperty"), which constitutes the proposed site of the westerly extension of S.W.
27th Street.
4.I roadacres will accomplish this reservation by agreeing not to construct for
t?+ twrenty-five (25) years any permanent structures on that portion of the property
described in Exhibit "B" or within the setbacks established by the adjacent zoning
designations.

5.lroadacres has agreed to enter into such restrictive covenants on the condition
that the City agree, during the term of this agreement, that such covenants do not
in any way preclude Broadacre's right to receive full value for any of the
Restricted Property taken in any condemnation proceedings.
6.3roadacres does not dispute the need of the major east-west arterial, S.W. 27th
street, nor its intended location, provided that Broadacres reserves all rights in any
subsequent condemnation action.
NOW, YHEREF ORE, Broadacres and the City agree as follows:
1.Che City of Renton cannot deny access to or between either of the parking lots.
Access shall be designed and controlled by City standards in effect at the time of
street construction.
2.If either of the two parcels abutting the right-of-way depicted in Exhibit "A"is
rezoned and developed in any use incompatible with recreational horse racing,
Broadacres will dedicate and construct upon some portion or all of the property
described in Exhibit "B", a local access road (not a major arterial) according to
City of Renton street standards for local access roads.

3. If and when the r of Renton constructs any west extension of S.W. 27th
Street beyond its rent terminus, any assessments o: her charges allocated to
Bioadacres to pay for some portion of the cost thereof shall be reduced by no less
than the full cost expended by Broadacres in designing and constructing the local
access road pursuant to paragraph 2 hereof. Further, as to that portion of the
westerly extension of S.W. 27th Street which is constructed by the City of Renton
w.thin the boundaries of L.I.D. 314, i.e. between the current terminus of S.W. 27th
Street at Broadacres' eastern property line and a point 200 feet east of the
B•irlington Northern East right-of-way, Broadacres allocated share of the cost of
st.ch portion of the extension, including water and sewer improvements, if any,
sl all not exceed 30 percent.
4.Broadacres covenants that it will not construct any permanent structures on the
Restricted Property nor construct any buildings within the then applicable street
setbacks for the zoning adjacent to the Restricted Property for twenty-five (25)
years from the date hereof.
5. The City agrees that in any action to condemn the Restricted Property, or any
pircel including any portion of the Restricted Property, the unimproved value of
such property should be determined without reference to the covenants contained
ii. paragraph 4 hereof, and such property shall be valued as if unencumbered or
benefited by such covenants.
6. Frior to the commencement of any construction of the proposed extension of S.W.
27th Street upon the Restricted Property during the next twenty-five (25) years,
tle City shall present Broadacres with engineering, architectural and other plans
necessary for the construction of the extension and other improvements including
O Flans concerning access turn-offs, sidewalks, walls, fencing, lighting, signing, and
cther amenities to be put in place along the extension. Broadacres shall have
Gthirty (30) days to review these improvement plans and comment to the City.

7. 7 he City of Renton agrees in designing S.W. 27th Street, that it cannot physically
deny access to the Longacres parking lot lying south of S.W. 27th Street extension
from the racetrack or northern parking lot. If the City determines that a traffic
signal, underpass, or overpass is necessary to functionally connect the two parking
l)ts, then the City shall include one or more of such physical improvements in the
c esign of the street extension.
8.hese covenants and agreements shall run with the land and shall be binding on all
parties having or acquiring any rights, title, or interest in the land described herein
or any part thereof unless both parties agree to release said covenants as a
condition of a future rezone or unless Broadacres or their successors actually
dedicate or construct said public street.

BROAD.CRES, INC., a Washington corporation ("Broadacres"), and
RENTON, Washington ("City").
RECITALS
1.E roadacres is the owner of part of the real property depicted in Exhibit "A"
attached hereto (the "Property").
2. 7 he Washington Horse Breeders Association desires to rezone and to construct
t arns and other improvements on part of the Property.
3. The Environmental Review Committee of the City of Renton has required as an
environmental condition that Broadacres reserve for twenty-five (25) years that
portion of the property described in Exhibit "B" attached hereto (the "Restricted
Property"), which constitutes the proposed site of the westerly extension of S.W.
27th Street.
4.Broadacres will accomplish this reservation by agreeing not to construct for
twenty-five (25) years any permanent structures on that portion of the property
described in Exhibit "B" or within the setbacks established by the adjacent zoning
iesignations.
5.Broadacres has agreed to enter into such restrictive covenants on the condition
that the City agree, during the term of this agreement, that such covenants donotinanywayprecludeBroadacre's right to receive full value for any of the
Restricted Property taken in any condemnation proceedings.
6.Broadacres does not dispute the need of the major east-west arterial, S.W. 27thStreet, nor its intended location, provided that Broadacres reserves all rights in any
subsequent condemnation action.
NOW, THEREFORE, Broadacres and the City agree as follows:
1. The City of Renton cannot deny access to or between either of the parking lots.
Access shall be designed and controlled by City standards in effect at the time of
street construction.
2. If either of the two parcels abutting the right-of-way depicted in Exhibit "A"is
rezoned and developed in any use incompatible with recreational horse racing,
Broadacres will dedicate and construct upon some portion or all of the property
described in Exhibit "B", a local access road (not a major arterial) according to
City of Renton street standards for local access roads.

If and when the City Renton constructs any westerly nsion of S.W. 27th
Stre et beyond its current terminus, any assessments or other charges allocated to
Bro idacres to pay for some portion of the cost thereof shall be reduced by no less
than the full cost expended by Broadacres in designing and constructing the local
acc:ss road pursuant to paragraph 2 hereof. Further, as to that portion of the
westerly extension of S.W. 27th Street which is constructed by the City of Renton
wit'.iin the boundaries of L.I.D. 314, i.e. between the current terminus of S.W. 27th
Stru;et at Broadacres' eastern property line and a point 200 feet east of the
Burlington Northern East right-of-way, Broadacres allocated share of the cost of
suc z portion of the extension, including water and sewer improvements, if any,
sha 1 not exceed 30 percent.
4.Brcadacres covenants that it will not construct any permanent structures on the
Re:tricted Property nor construct any buildings within the then applicable street
set sacks for the zoning adjacent to the Restricted Property for twenty-five (25)
years from the date hereof.
5. Thi: City agrees that in any action to condemn the Restricted Property, or any
pal cel including any portion of the Restricted Property, the unimproved value of
suc h property should be determined without reference to the covenants contained
in paragraph 4 hereof, and such property shall be valued as if unencumbered or
be:tefited by such covenants.
6.Pr or to the commencement of any construction of the proposed extension of S.W.
27:h Street upon the Restricted Property during the next twenty-five (25) years,
thy: City shall present Broadacres with engineering, architectural and other plans
ne:essary for the construction of the extension and other improvements including
pl,uns concerning access turn-offs, sidewalks, walls, fencing, lighting, signing, and
of ler amenities to be put in place along the extension. Broadacres shall have
th sty (30) days to review these improvement plans and comment to the City.
7. Tl.e City of Renton agrees in designing S.W. 27th Street, that it cannot physically
deny access to the Longacres parking lot lying south of S.W. 27th Street extension
fr)m the racetrack or northern parking lot. If the City determines that a traffic
signal, underpass, or overpass is necessary to functionally connect the two parking
lots, then the City shall include one or more of such physical improvements in the
cif sign of the street extension.
8. T:iese covenants and agreements shall run with the land and shall be binding on all
parties having or acquiring any rights, title, or interest in the land described herein
o:. any part thereof unless both parties agree to release said covenants as a
c,)ndition of a future rezone or unless Broadacres or their successors actually
d;dicate or construct said public street.

The L and Use Hearing Examiner originally recommended approval of the rezone request
from G-1 to B-1, Business Use, on November 10, 1983. Since that time, several
discus;dons have taken place between the City and yourself concerning an agreement as
outlined in my letter of January 12, 1984. There has been no response from you
concerning that correspondence. It is impetative that a decision be reached so that the
request, which is presently in the Ways and Means Committee for ordinance preparation,
can be finalized. The agreement has been looked at several times by our administrative
people, your attorneys and yourself, and we believe that a decision should be reached. If
we care provide any assistance or if you wish to submit another proposal to us concerning
the ag-eement, we would be happy to evaluate it. We would appreciate a specific reply
from you within the next fifteen (15) days to assure a timely reconsideration of the rezone

Fred Foy of the Washington Horse Breeders Association has requested
through our office that the Council delay adoption of the formal rezone
ordinance until Mr. Alhadeff returns to Renton. There appears to be
a problem with the lease and the requirement of the Environmental
Review Committee to reserve the right of way for the extension of
S.W. 27th Street.
Therefore, we would request that the item be held for four weeks and
reported out on January 9th to the whole Council . This will give the
staff sufficient time to resolve the problem.

Attached is Broadacres response to the ERC's requirement to reserve the right-of--way
for S.W. 27th Street. Both the Public Works Department and Building and Zoning
Department reviewed the document and suggest major modifications in the form of the
second attachment. As you can see, Mr. Aihadeff wants everything his way without giving
the City any concessions.
The oriinance considering the rezone of subject property has been submitted to Ways and
Means Committee, but should not be approved until the actual agreement between the
City and Broadacres is clarified.

AGREEMENT, made this day of January, 1984, by and between
BORAT ACRES, INC., a Washington corporation ("Broadacres"), and the CITY OF
R ENT CN, Washington ("City").
RECITALS
1.Broadacres is the owner of the real property described in Exhibit "A" attached
iereto (the "Property").
2.The Washington Horse Breeders Association desires to rezone and to construct
barns and other improvements on part of the Property.
3.The Environmental Review Committee of the City of Renton has required as an
environmental condition that Broadacres reserve for twenty- five (25) years that
portion of the property described in Exhibit "B" attached hereto (the "Restrict
Property"), which constitutes the proposed site of the westerly extension of S.W.
27th Street.
4.Broadacres will accomplish this reservation by agreeing to covenant said property
not to construct for twenty- five (25) years any permanent structures on that
portion of the property described in Exhibit "B" or within the setbacks established
by the adjacent zoning designations.
5.Broadacres has agreed to enter into such restrictive covenants on the condition
that the City agree, during the term of this agreement, that such covenants do not
in any way preclude Broadacre's right to full land valuation of the Restricted
Property in any friendly condemnation proceedings.
b.Broadacres does not dispute the intent or need of the major east-west arterial,
S.W. 27th Street, nor its location. It does dispute the value of the land and
reserves all rights under a friendly condemnation.
7.The City of Renton cannot deny access to either of the parking lots. Access shall
be designed and controlled by City standards in effect at the time of street
construction.
8. If either of the adjacent parcels is rezoned and developed in any use other than
recreational horse racing, Broadacres will dedicate and construct that portion of
S.W. 27th Street adjacent to the subject property according to City of Renton
street standards.
9.Broadacres will bear the cost of any redesign or reconstruction of any adjacent
structures or parking lots as a result of the extension of S.W. 27th Street within the
property described in Exhibit "B".

NOW, THEREFORE, Broadacres and the City agree as follows:
1.Broadacres covenants that it will not construct any permanent structures on the
Restricted Property nor construct any buildings within the then applicable street
setbacks for the zoning adjacent to the Restricted Property for twenty-five (25)
years from the date hereof.
2.The City agrees that in any action to condemn the Restricted Property, or any
parcel including any portion of the Restricted Property, the unimproved value of
s•ich property should be determined without reference to the covenants contained
in paragraph 1 hereof, and such property shall be valued as if unencumbered or
benefited by such covenants.
3.I rior to the commencement of any construction of the proposed extension of S.W.
27th Street upon the Restricted Property during the next twenty (20) years, the
City shall present Broadacres with engineering, architectural and other plans
necessary for the construction of the extension and other improvements including
plans concerning access turn-offs, sidewalks, walls, fencing, lighting, signing, and
other amenities to be put in place along the extension. Broadacres shall have
ninety (90) days to review these improvement plans and respond to the City.
4. The City of Renton agrees in designing S.W. 27th Street, that it cannot physically
deny access to the Longacres parking lot lying south of S.W. 27th Street extension
from the racetrack or northern parking lot. If a traffic signal, underpass, or
overpass is necessary to functionally connect the two parking lots from Broadacres'
or the City's viewpoint, then the City shall include one or more of such physical
mprovements in the design of the street extension.
5. These covenants and agreements shall run with the land and shall be binding on all
parties having or acquiring any rights, title, or interest in the land described herein
or any part thereof unless both parties agree to release said covenants as a
condition of a future rezone or unless Broadacres or their successors actually
dedicate or construct said public street.

Dear Mr. Foy:
After you hand delivered the Broadacres, Inc. proposal to reserve the right-of-way for
S.W. 2;th Street in the form of a restrictive covenant for a 20-year period, I circulated
the information for staff comment. The concept of the restrictive covenants are
generally acceptable to the Public Works Department. The language has been reviewed
and approved by the City Attorney. However, some of the specific statements within the
agreement are unacceptable to the City. Please find attached a revision of that
agreement which has separated some of the points and delineated some of the conditions
and res onsibilities.
The acl.ual alignment for S.W. 27th Street would be in correspondence with the proposed
plans provided by U.R.S. I have attached a copy of that general plan at this point and
specific legal descriptions prepared by the Public Works Department. We believe that will
take several days for yourself and Broadacres to review the counter proposal. The
document attempts to protect both the City and F3roadacres in the future without severe
limitations on either one. Hopefully this will be acceptable to you and Broadacres.

AttaLhed is Broadacres' response to the ERC requirement to reserve the right-of-way for
S.W. Vith Street. Instead of a reservation they are suggesting an agreement and
restrictive covenants. The proposal has one major advantage, along with several technical
problems and obvious omissions. I am submitting this to you first since Public Works will
be the focus of any implementation.
The primary advantage is that Mr. Alhadeff is willing to "reserve" the total alignment of
S.W. 27:.h across Longacres instead of just the +600 feet adjacent to the present rezone.
The language and their attorney's comprehension of the land use decision is
unbelie'ieable. I have preliminarily analyzed each point for possible conflicts with the
City's interests.

3.The language, "the CITY," suggests that there is the possibility for negotiation. It
s not "the CITY" or City Council; it is the ERC. The condition was imposed, and
the City Council has no authority to negotiate. The ERC has the authority of
approving the documentation.
I would suggest that point 3 be divided into the following two points:
A.Tne Environmental Review Committee of the City of Renton has required
as an environmental condition that Broadacres reserve for twenty (20)
years that portion of the property described in Exhibit "B" attached hereto
the "Restrict Property"), which constitutes the propc-ed site of the
westerly extension of S.W. 27th Street.

B. Broadacres will accomplish this reservation by agreeing to covenant said
property not to construct for twenty (20) years any permanent structures
on that portion of the property described in Exhibit "B" or within the
setbacks established by the adjacent zoning designations.
4. This point is a major cost liability. First, "full valuation" could include
improvements, i.e., water lines, sewer lines, loss of parking - revenue to
Longacres, and asphalt paving. Longacres could pave the parking lot; then when we
wanted to build S.W. 27th Street, the City might have to pay for reconstruction of
the parking lot. The second part of this point appears to give all authority for
design and access of S.W. 27th Street to Broadacres. This is totally unacceptable.
A series of concise points are nccded here; I would suggest the following:
A. Broadacres has agreed to enter into such restrictive covenants on the
condition tha". the City agree, during the term of this agreement, that such
covenants do not in any way preclude Broadacre's right to full land
valuation of the Restricted Property in any friendly condemnation
proceedings.
3. Broadacres does not dispute the intent or need of the major east-west
arterial, S.W. 27th Street, nor its location. It does dispute the value of the
land and reserves all rights under a friendly condemnation.
The City of Renton cannot deny access to either of the parking lots.
Access shall be designed and controlled by City standards in effect at the
time of street construction.
D.If either of the adjacent parcels is developed in any use other than
recreational horse racing, Broadacres will dedicate and construct S.W. 2"th
Street according to City of Renton street standards.
E. Broadacres will bear the cost of any redesign or reconstruction of any
adjacent structures or parking lots as a result of the extension of S.W. 27th
Street.
NOW, THEREFORE, Broadacres and the City agree as follows:
1. Broadacres covenants that it will not construct any permanent structures
on the Restricted Property nor construct any buildings within the then
applicable street setbacks for the zoning adjacent to the Restricted
Property for twenty (20) years from the date hereof.
2. The City agrees that in any action to condemn the Restricted Property, or
any parcel including any portion of the Restricted Property, the
unimproved value of such property should be determined without reference
to the covenants contained in paragraph 1 hereof, and such property shall
be valued as if unencumbei.d or benefited by such covenants.

3 Prior to the commencement of any construction of the proposed extension
of S.W. 27th Street upon the Restricted Property during the next(wenty
20) years, the City shall present Broadacres with engineering,
architectural and other plans necessary for the construction of the
extension and other improvements including plans concerning access
turn-offs, sidewalks, walls, fencing, lighting, signing, and other amenities
to be put in place along the extension. Broadacres shall have ninety (90)
days to review these improvement plans and respond to the City.
4. The City of Renton agrees in designing S.W. 27th Street, it cannot
physically deny access to the Longacres parking lot lying south of S. J. 27th
Street extension from the racetrack or northern parking lot. If a traffic
signal, underpass, or o-,erpass is necessary to functionally connect the two
parking lots from Broadacres' or tl.e City's viewpoint, then Lie City shall
include cne or more of such physical improvements in the design of the
street extension.
5. These covenants and agreements shall run with the land and shall be
binding on all parties having or acquiring any rights, title, or interest in the
land described herein or any part thereof.

PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application and field checking the property and surrounding
area, the Examiner conducted a public hearing on the
subject as follows:
The hearing was opened on November 1, 1983, at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.

Roger Blaylock, Zoning Administrator, presented the staff report, noting that the
Compre 7ensive Plan and the Green River Plan are applicable and the Comprehensive Plan
designal ion for that area is recreational. He also noted that the Longacres racetrack adjacent
to this subject property existed prior to any of the current zoning laws and that area is in a
transitory state awaiting streets and utilities.
Further Mr. Blaylock pointed out that the ERC has issued a declaration of non-significance
subject to the dedication of a right-of-way for the extension of S.W. 27th Street along the
southern boundary of the subject site.
Mr. Blaylock stated the subject property has been leased by the Washington Horse Breeders
Association from Longacres for a period of 25 years; that in the past, the existing barn areas at
Longacies had been used by Washington Horse Breeders Association for their sales. However,
with the growth of Longacres activities, they can no longer use those barn areas and are now
desirous of constructing their own upon the land being leased from Longacres.
Discussion was held regarding the potential flooding problems in this area. It was noted by Mr.
Blaylock that the parking surface at this facility would probably not be a paved surface and
would not contribute to runoff.

Mr. Blaylock stated the staff recommends approval of the rezone request. Further, that there
would be some concern on the city's part regarding the future use of the subject site because
the rezone could allow other business activities in the future. Also, the city is trying to resolve
the flood problem in that area with construction of the P-1 Channel.
The Examiner then called for testimony from the applicant or representative. Responding was:

Mr. Rousso stated that all of the surrounding property in the subject area will be developed over
the next 15 - 25 years, and they are proposing a low-key development of the site with lots of
grass, trees, and walkways for the horses, and nothing will be over a one-story structure.
Further, Washington Horse Breeders Association has a 25-year lease with Longacres for the
properti with several 5-year renewable options. Therefore, they feel there should be no
restrictive covenants running with the land as a condition to the rezone. Mr. Rouso also noted
there would be no additional traffic impact since they are already operating the same business
on Longacres property now and would simply be moving the operation to a new location on
adjacent property.
The Examiner expressed concern about the flood zone and the B-1 zone. He called on the
Engineering Supervisor to address the flood zone issue. Testimony was then heard from:

Mr. Bergstrom summarized the facilities already in place at the site and noted the property
owner should provide the city with a topographic map to indicate that precautions have been
taken to provide for flood control.

Association and head of the committee established to arrange for the reality of this
construction, and quite possibly the contractor for the project if approved. Mr. Foy discussed
the alt.( rnative solutions to the storm water runoff problem, with one possibility being to dig a
pond in the area; with reference to the electrical outlets possibly being in a location where they
could bt flooded, Mr. Foy pointed out that the only electricity needed in the barn areas would
be for electric lights, which would all be located high on the facility and not subject to flooding.
The Examiner noted the requirement for a 5-year storm water retention system would probably
be a problem that must be worked out with Public Works; and that the city is still concerned
about the flooding potential.
Mr. Bergstrom noted the city might work with the contractor to scoop out a pond in that area.
The Examiner called for further testimony in support or opposition to the application. There
was nore.
The Examiner closed the hearing at 9:40 a.m. and announced he would make his
recommendation to the Council within 14 days; that the Council would then take action based
upon the Examiner's recommendation.
FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this
matter, the Examiner now makes and enters the following:

FINDINGS:
1. The applicant, Washington Horse Breeders Association, filed a request for approval of a
re'7.1assification of approximately 5.436 acres of property from G-1 (General;
Single-Family Residential) to B--1 (Business/Commercial).
2. Tie application file containing the application, the State Environmental Policy Act
documentation, the Building & Zoning Department Report, and other pertinent documents,
wf.s entered into the record as Exhibit #1.
3. Ptrsuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of
Non-Significance has been issued for the subject proposal by the Environmental Review
Committee (ERC), responsible official.
4. Pins for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. Tie subject proposal met with no opposition from the public.
6. Tie subject site is located adjacent to 2600 Oaksdale Avenue, just south of the southeast
corner of Longacres Racetrack.
7. Tie subject site is level and is covered with native grasses. The site is currently vacant,
although it is utilized as an overflow parking lot for the adjacent racetrack.
8. Tie subject site was annexed into the city by Ordinances 1745 in April of 1959, as
amended by Ordinance 1764 of May, 1959, and 1928 in December of 1961. The site was
classified for general purposes at the time of annexation.
9. North of the subject site is Longacres and its associated parking. East of the subject site
is an oil tank farm while undeveloped property is located south of the site. West of the
sit e is another racetrack parking lot.
10. Tie proposed P-1 Channel runs along the east side of the subject site and the site is
subject to the flood zone criteria and permit process of the city.
11. Tie site is subject to inundation and potential structures on the site would be subject to
flood damage.
12. Tie Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of recreational uses. The Comprehensive Plan does not
provide further insight into which zoning category might provide suitable development
guidelines.
13. Tie applicants have proposed reclassifying the subject site to B-1 which would permit a
wide range of commercial uses including the stables proposed by the applicant.
14. Tie applicants propose constructing seven (7) low rise barn buildings to serve in
conjunction with an existing adjacent sales pavilion.
15. Tie City has just completed the S.W. 27th Street LID and recently completed the Lind
Avenue LID. The State proposes widening the Lind Avenue Bridge over I-405.
16. Tie Parking and Loading Ordinance does not specify the number of parking spaces
re'iuired by the proposed use, but the applicants propose utilizing the parking available for
th! racetrack.
CONCLUSIONS:
1. Tie proponent of a rezone must demonstrate that the request is in the public interest, will
not impair the public health, safety, and welfare, and in addition, is in compliance with
one of the three criteria found in Section 4-3010, which provides in part that:

a. The subject site has not been considered in a previous area-wide rezone or land use
analysis; or
b. The subject site is potentially deisgnated for the new classification per the
Comprehensive Plan; or
c. There has been a material and substantial change in the circumstances in the area in
which the subject site is located since the last rezoning of the property or area.
2. The proposed use more closely approximates a commercial use of the subject site than a
recreational use as envisioned by the Comprehensive Plan. The barn is to be used in
conjunction with sales of the horses rather than in conjunction with racing at the track,
but the sales operation is an extension of the track operations and should be located close
to the track.
Therefore, the requested B-1 zoning appears appropriate for the subject site, especially
s:.nce the track itself is zoned B-1. The request would permit the logical extension of B-1
z ming to the south.
3. A. number of street improvements will serve the subject site and the commercial nature of
the operation will not unduly burden the roads in the area.
4. The Council should be aware that reclassifying the subject site will increase the
development potential and thereby increase the risk of damages if a disasterous flood
mere to occur. While the proposed buildings will be open to flood waters and oriented to
permit easy passage the B-1 zoning would not restrict the use to only barns and stables
al(' other structures could incur greater damage.
The site is below the currently estimated safe elevation and the applicant proposes no
filling because of the nature of the proposed use and the costs of filling.
5. With the potential liability in mind, the City Council should approve the reclassification
o" the site as requested by the applicants.
RECOMMENDATION:
The City Council should approve the reclassification of the subject site from G-1 to B-1.

The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
communizations may occur concerning land use decisions. This means that parties to a land use
decision may not communicate in private with any decision-maker concerning the proposal.
Decision-makers in the land use process include both the Hearing Examiner and members of the
City Council.
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to openly
rebut the evidence. Any violation of this doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.
Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed
in writing on or before November 28, 1983. Any aggrieved person feeling that the decision of
the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the

C. I-ISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #1745 of April 14, 1959,
which was later corrected by Ordinance #1764 of May 19, 1959 and Ordinance
111928 of December 12, 1961, at which time it was zoned "G". This zoning
classification was changed to the G-1 designation with the adoption of the new
zoning map by Ordinance #3634 of June 13, 1982.
D. PHYSICAL BACKGROUND:
1. 1 opography: The subject site is relatively level.
2. Soils: Woodinville Silt Loam (Wo), slopes are less than 2%. Permeability is
moderately slow. The available water capacity is high. Runoff is slow, and
the hazard of erosion is slight. Stream overflow is a severe hazard unless
flood protection is provided. This soil is used for row crops, pasture and
urban development.

3. Vegetation: The subject site is covered with native grasses.
4. Wildlife: The existing vegetation provides little habitat for birds or small
mammals.
5. Water: No surface water was observed.
6. Land Use: The subject site is currently vacant. During the racing season it is
used as a parking lot for any parking overflow which might occur on race days.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding area consists of Longacres Race Track and parking lot to the
north; an oil tank farm to the east; undeveloped property to the south; and a
parking lot for Longacres Race Track to the west.
F. PUBLIC SERVICES:
1. Utilities:
a. Water - A ten (10) inch water line extends along a portion of Jackson
S.W. approximately 2,500 feet (.47 miles) northwest of the subject site.
b. Sewer - A METRO trunkline extends along the Henry Meader Donation
Claim No. 40 adjacent to the northern boundary of the subject
property. There is also a twelve (12) inch city sewer line on S.W. 27th
Street adjacent to the southeast corner of the subject property.
b. Storm Water Drainage - Storm water detention needs to be provided
together with a flood storage area. Public Works is asking for flood
profiles and/or the flood tolerance of the site.
2. Fire Protection: Provided by the City of Renton as per ordinance
requirements.
3. Transit: METRO Transit Routes #154, 158 and 159 operate along West Valley
Road South approximately 2200 feet (.4 miles) west of the subject site.
4. Schools: Not applicable.
5. Recreation: Not applicable.

Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 19/1, as amended, RCW 43-21C, a final declaration of
ncn-significance was issued by the Environmental Review Committee on October
5, 1983. The appeal period expired on October 24, 1983.

L. DEPARTMENT ANALYSIS;
1.The applicant, Washington Horse Breeders Association, is requesting for a
rezone of 5.436 acres from G-1, General Use, to B-1, Business, to allow the
construction of seven (7) commercial stables that will be used in conjunction
with the adjacent horse sales pavilion.
2.The Comprehensive Plan Map designates the subject site as Recreational.
There are no specific goals or policies dealing with "private recreation" in the
1965 Comprehensive Plan, the 1975 G reen River Valley Comprehensive Plan,
or the 1978 Comprehensive Park and Recreation Plan.
The only reference that is made to "recreation" is the Land Use Descriptions
Section (page 29, Compendium; June 1983), which states "an area intended
for active or passive recreational activity or other leisure time pursuits."
3.The Environmental Review Committee has issued a declaration of
non-significance subject to the dedication of a right-of-way for the
extension of S.W. 27th Street along the southern boundary of the subject site.
4. The Land Use Hearing Examiner must review four specific criteria under
Section 4-3014(C) to determine that the circumstances surrounding the
rezone request are adequate to recommend approval of the reclassification.
The following evidence clearly demonstrates the rezone request is
appropriate.
a. That substantial evidence was presented demonstrating the subject
reclassification appears not to have been specifically considered at the
time of the last area land use analysis and area zoning.
The subject property has remained in a G, General Use, zoning
classification since the time of annexation in 1959. Both the 1965
Comprehensive Land Use Plan and the 1975 Green River Valley
Comprehensive Plan designated the site as "Recreation." Therefore,
complying with this criteria.
b. That the property is potentially classified for the proposed zone being
requested pursuant to the policies set forth in the Comprehensive Plan
and conditions have been met which would indicate the change is
appropriate.

The City of Renton does not have a recreational zoning classification or
specific goals and policies dealing with private recreation. Longacres
Race Track has been zoned B-1, Business Use because of commercial
activities such as restaurant, cocktail lounges and retail sales on-site.
The request for a rezone to B-1, Business Use, was based on the fact
that the facility will support the retail sales of race horses on a
seasonal basis. Part of the time the facility may provide boarding
space for horses from the race track.
It appears that in past, policy rezones were granted to B-1, Business
Use, because of the commercial nature of the private recreational
activity.
c. That since the last previous land use analysis of the area zoning of the
subject property, authorized public improvements, permitted private
development or other circumstances affecting the subject property
have undergone significant and material change.
The subject property has been used continuously for years as parking for
Longacres. With the construction of the Washington Horse Breeders
Sales Pavilion on the parcel adjacent to the east, the general use
changed. Last year temporary stables were installed for the annual sale.
In addition, the City just completed S.W. 27th Street to the subject
property. This substantially improves access to the Longacres site.
These two points demonstrates substantial compliance with this criteria.
d. The final test to determine whether a rezone is appropriate is to
address the question of timeliness.
This criteria applies in a very unique way to the subject site. Longacres
has operated since the 1930's and has been zoned B-1, Business Use,
since 1961. The annual horse sales by Washington Horse Breeders
Assoction has occurred at Longacres for many years; this is an
upgrading of the facilities. The parking had been considered existing
non-conforming at the time of annexation and the proposed change in
use requires the rezone. Therefore, the proposal could be considered
timely.
5. The subject site is located in the flood fringe and prior to construction, a
flood control permit will be required. The project does not include any filling
or excavating. Some leveling will be done, but no modification in flood
storage capacities will be made. Non-habitable structures are ideal for such
areas.
6.The Parking and Loading Ordinance does not address required parking for
commercial stables. The sales pavilion has parking provided for retail sales.
The adjacent non-conforming parking, Longacres, has provided the parking in
the past.
7. Department comments have been attached for the Hearing Examiner and
public's review.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the rezone request,
R-066-83, be recommended for approval to the City Council.

The Environmental Review Committee issued a declaration of non-significance on the
proposed rezone for Washington Horse Breeders' Association, File No. R- 066- 83, on
October 5, 1983. The document was published on October 10, 1983, with a final appeal
period of October 24, 1983. Hopefully, you have read the document very carefully
because it includes one condition which you should be aware of. It is specifically located

property to be used for the construction of sales barns.
Building & Zoning Staff:
The WHBA proposes to construct seven low rise barn buildings to contain
276 stalls plus related facilities. These structures will be used in
conjunction with an existing sales pavilion located at the adjacent
property. In order to proceed with this project, rezoning of the prop-
erty is required. The present zoning is "G", residential with a minimum
lot area of 35,000 square feet. The proposed zonimg is "B-1", business
district. This zoning would allow for the proposed use.
The use proposed for this property complies with the comprehensive use
anticipated for the general area. I understand that when this property
was annexed to the city of Renton (Ordinance #1745, April 14, 1959) , it
was zoned "G" along with all other property annexed at that time.
This zoning was meant only as an initial overall classification and the
intent was for the property to be rezoned at 'the time of development.
This application represents a timely rezoning request. Much of the
surrounding property has previously been rezoned to allow for more
intense uses and this request is in keeping with past and probable
future development.

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
