HomeMy WebLinkAboutAddendum - 4AMENDMENT NO. 4 TO AGREEMENT FOR KIWANIS PARK SITE IMPROVEMENTS THIS AMENDMENT, dated for reference purposes only as _______________________, 2023, is by and between the City of Renton (the “City”), a Washington municipal corporation, and Bruce Dees & Associates, LLC. (“Consultant”), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-20-011, dated January 13, 2020, to provide necessary services for the Kiwanis Park Site Improvements (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the time for performance and change the compensation in order to extend the professional services to complete the project. NOW THEREFORE, It is mutually agreed upon that CAG-20-011 is amended as follows: 1.Time of Performance: Section 3, Time of Performance. All Work shall be performed by no later than May 31, 2023. 2.Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $_13,205.50_ from $_382,111.00_ to, $_395,316.50_, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit A-4, which is attached and incorporated herein. 3.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Wyatt, RLA, ALSA, LEED-AP Job No.: 175-01-03 City of Renton 1005 S Grady Way RE: Kiwanis Park Improvements Renton, WA 98057 Amendment Request #4 Dear Alan, During construction in late December, 2022, the design team was contacted regarding President’s Neighborhood abutting the westerly property line of Kiwanis Park which was experiencing stormwater flooding issues. It was determined through drawing research and field investigation, by the design team and City of Renton, that a drainage pipe was discovered to have historically carried stormwater into the Kiwanis Park Site from President’s Neighborhood. This unforeseen downstream network was not encountered during site topographic surveys or indicated on COR Maps. Additionally, the Kiwanis Park contractor did not encounter any storm drainage piping which could be construed as this historical connection across the park. To resolve the issue the City has asked the design team to study the drainage area, contributing stormwater flows, and the feasibility of a new stormwater drainage connection between President’s Neighborhood and the Kiwanis Park drainage systems. We have completed a conveyance analysis using AutoDesk Storm and Sanitary Sewer Analysis (SSA), and determined that the current design of downstream storm drainage piping on the Kiwanis Park site is capable of conveying the additional load from President’s Neighborhood, based on the contributing drainage basin and pipe network information from COR Maps. Minor revisions will be made to the storm drainage plan by BDA and Sitts & Hill to make a connection between existing and proposed storm networks, and eliminate aging/failed pipe on the Kiwanis Park site. An amendment will also be prepared for the previously approved TIR to reflect the proposed connection to facilitate passing the President’s Neighborhood drainage through the Kiwanis Park system.
