PROJECT DESCRIPTION: The applicant, City of Renton Public Works Department Transportation Design
Engineering Division (“Transportation Division”), is requesting a Tier 1 Temporary Use Permit (TUP) to work
non-consecutive nights beyond the hours permitted in Renton Municipal Code (RMC) 4-4-030C.3 in order to
begin construction on the Rainier Ave S Corridor Improvements – Phase 4 project. The proposed night time
work along Rainier Ave S would be from approximately S 3rd St to NW 3rd Pl (Exhibits 1 and 2). The night time
work is being proposed for safety purposes and to minimize congestion impacts to drivers, businesses, and
residents during the day within this busy traffic and commerce corridor. It is anticipated that the night time
work would be required at various times throughout the duration of the 500 working days needed to complete
the project by March 2025. The project contractor, Pivetta Brother’s Construction, Inc., is anticipating that
night work would begin during the 12th week 2023 with items identified in the five (5) week lookahead
schedule (Exhibit 3). Examples of proposed night time work activities would include potholing, tree removal,
median removal, temporary striping, and Joint Utility Trench (JUT) installation. As part of the construction
management contract, the City is working with a public outreach firm.
The project goals include the following:
• Improvement of transit mobility, pedestrian accessibility, and safety.
• Benefits to the overall traffic flow and safety through access management, traffic signal upgrades and
coordination.

• Improvement of the pedestrian environment and safety resulting in an aesthetically vibrant
transportation corridor.
• Intersection improvements at S 3rd St and S 2nd St in preparation of the two-way conversion.
• Extension of the southbound Business Access Transit Lane (BAT Lane) from S 2nd St to S 3rd St.
• Construction of a segment of a regional pedestrian/bike path trail (Lake Washington Loop Trail) from
Airport Way to 1,000 feet north of Airport Way.
• Installation of pedestrian activated traffic signals (HAWK) at SW Victoria St and NW 3rd Pl.
• Sidewalk widening with streetscaping, decorative roadway and pedestrian-scale illumination,
landscaped buffers and median.
• Improvement of the city water and wastewater systems concurrently with the transportation project
improvements.
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions:
*CONDITIONS OF APPROVAL:
1. All vehicles shall be equipped with broadband backup warning devices.
2. All trucks performing export haul shall have well maintained bed liners to reduce noise impacts.
3. During construction cleanup operations, all material spilled within the work zone shall be removed by hand
methods or sweeping when feasible.
4. Truck tailgate banging is prohibited. All truck tailgates must be secured to prevent excessive noise from
banging.
5. Any unwanted material shall be removed by sweeping. No scraping type equipment shall be used during
nighttime work to clean up unwanted materials in lieu of hand or street sweepers. Other normal
construction uses of front-end loaders, track hoes, and dozers are allowed.
6. Construction equipment operating under stationary conditions, such as but not limited to; saw cutters,
front loaders, light plants, jackhammers, and generators, are allowed provided temporary noise shields are
used. The Contractor shall use accepted acoustic noise blankets, or other means available for noise
shielding as approved by the Engineer.
7. The applicant shall provide to the City of Renton, contractor contact information: name(s) and email(s) to
respond to night time noise complaints.
8. The applicant or contractor shall provide a live person to address any complaints during the night time
work. Complaints shall be responded to promptly by the designated contact person.
9. The applicant or contractor shall notify residents of night work if work is within a 500-foot radius of the
night work.
10. Contractor vehicles and construction equipment shall be parked only in city approved designated areas.
11. Idling vehicles are not allowed.
12. If the same resident continues to have complaints about excessive noise levels, the contractor or applicant
shall provide additional mitigation, such as, but not limited to, shielding of noise source, reducing use of
certain types of equipment, providing ear plugs, providing white noise machines, or providing motel
accommodations.
13. The applicant shall apply for a Hearing Examiner Noise Variance Application for the Rainier Ave S Corridor
Improvements - Phase 4 Project night work by April 20, 2023, unless otherwise determined by the
Community and Economic Development Administrator.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable
prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the
Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there
will be no further extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on April 3, 2023. Appeals
must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor
Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be
collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be
paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-
110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: The Temporary Use Permit is valid for up to six (6) months from the effective date of the permit.
The applicant can request that a permit be valid for up to five (5) years at time of application or prior to permit
expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing to the
Community and Economic Development Administrator.
