REPORT AND RECOMMENDATION .
APPLICANT: Tino Cugini, Short Plat' I FILE NO. Short Plat' 382-79,

LOCATION: S.W. corner of Jefferson Avenue N.E. and N.E. 4th Street.
SUMMARY OF REQUEST: The applicant requests approval of a three-lot short plat to be
used for future commercial purposes and a waiver of off-site
improvements.
•
SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive
covenants.
Hearing Examiner Decision: Approval of short plat with conditions;
Denial of waiver.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on August 7, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property ,and surrounding area, the Examiner
Conducted a public.hearing on the subject as follows:
The hearing was opened on August 14, 1979 at 9:25 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and. the applicant had received and reviewed the
Planning Department report, and the report was entered into the record as Exhibit #1.
Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional
exhibits into the record:
Exhibit#2: Short Plat as submitted
Exhibit #3: Short Plat with staff .comments.
Mr. Blaylock corrected Exhibit #1, Section L.3, Planning Department Analysis, .line 2, which
states, "It should be 50 feet since it. . ." and should be corrected to read, "It should be
56' feet since it. . . ".

Referencing Section L.4 of Exhibit #1, the Examiner requested clarification of the
recommendation for landscaping of a triangular section of public right-of-way in the
intersection of N.E. 3rd and N.E. 4th Streets. Mr. Blaylock confirmed the recommendation.
Referencing Section L.5 which states that a substandard three-inch water line exists in the
western boundary of the proposed short plat, the Examiner inquired if the department
recommends improvement 'of the line. Mr. Blaylock advised that requirement for off-site
improvements would include improving the existing line to standard specifications.
The Examiner requested testimony by the applicant. Responding was:

Mr. Peretti requested clarification of. standard requirements for the water line. Mr. Blaylock
advised that he was uncertain and deferred the inquiry to the Public Works Department. Mr.
Peretti indicated his understanding that an eight-inch line had recently been installed,
and connection to the existing line could occur to meet the 'requirement. David Clemens,
Senior Planner, clarified that the Planning, Department recommendation 'required consistency
with the city's Water Master Program and plans could be reviewed upon submission at a later
date.
The Examiner referenced Section M.2, Departmental Recommendations, which states that the
requested waiver is denied and restrictive covenants are required to ensure participation
by the property owners in a future LID if a deferral is granted by the Board of,Public
Works., and inquired if the applicant concurred in the recommendation. Mr. Peretti indicated
his concurrence.

The Examiner requested testimony in support or opposition to the request. There was no
response. He then requested final comments from the Planning Department. Since there were
no further comments, the hearing on File No. Short Plat 382-79 and W-383-79 was closed by
the Examiner at 9:37 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a three-lot short plat to be used for the development of
future commercial uses together with a waiver of the required off-site improvements.
2. The Planning Department report sets forth the issues, 'applicable policies and provisions,
findings Of fact, and departmental recommendations in this matter, is uncontested, and
is hereby attached as Exhibit #1 and incorporated in this report by reference as set
forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act Of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been
determined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. There was no opposition to the proposal expressed.
6. Utilities are available and may be extended and expanded to meet the needs of the subject
short plat.
7. The proposal is compatible with the required setbacks, lot coverage and height requirements
of Section 4-711 (B-1, Business) of Title IV, Ordinance No. 1628, Code of General
Ordinances.

8. The subject property is located at the southeast corner of Jefferson Avenue N.E. and
N.E. 4th Street. The site is level, vacant and contains scrub grasses.
9. The streets in the area are substandard for commercial areas but meet the requirements
for residential streets. Both N.E. 3rd Street and N.E. 4th Street are' developed to
50 feet widths.
10. The sewer main located on N.E. 4th Street comes to within 500 feet of the subject:
property.

The water mains in the area are generally developed to provide the level of servi'ce
needed to provide adequate fire flow, with the exception•of the three-inch,main located
along the subject property in N.E. 4th Street. The Public' Works Department indicated
that this main is insufficient to provide for adequate fire flow !requirements and
recommended that the applicant install an adequate water main.

11. Pursuant to Section 9-1105.6.B the, applicant has requested a waiver of the required
off-site improvements. The applicant indicated that the, city had agreed to install
adequate water and sewer service when the subject property was annexed into the city.
12. The area is in transition from generally undeveloped. and low intensity land uses Ito
a mixture of multiple family, commercial and light industrial uses. There are also
a number of single family uses established north of the subject property.
13. The Comprehensive Plan indicates that the area in which the subject property is located
is suitable for commercial development.
CONCLUSIONS:
1. The proposed short plat appears to serve the public interest. The subdivision will
provide three additional lots for commercial development and thereby expand the tax
base of the City of Renton.
2. The proposal is compatible with both the zoning and the Comprehensive Plan. The use
of this property for commercial purposes also appears compatible with the surrounding
uses and by conditioning the ultimate use and the site plans to scrutiny via a public
hearing the nearby residential properties will not be adversely impacted by detrimental
uses.

3. While the roadways are not developed to commercial standards, they do appear capable
of handling the anticipated traffic loads which may be generated by the proposal.
4. Because of the substandard water mains in the vicinity of the subject property it would
be inappropriate to grant the applicant a waiver of the required off-site improvements.
Sewer service must also be provided for the property before development can occur. It
would be more appropriate for the applicant to apply to the Board of Public Works for
a possible deferral of the off-site improvements.
DECISION:
•
Exhibit #2 is approved subject to approval by the Hearing Examiner of the site and landscaping
plans for the development of Parcels 1 through 3.
The waiver is denied.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before August 31, 1979. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen
(14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall, or same may be purchased at cost in
said department.

of June' 22, 1966. It was rezoned from "G" to B-1 by Ordinance #2655
on August 20, 1971 .

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposed short plat is consistent with the Comprehensive
Plan designation of commercial for the site .
2. The final design of the proposed businesses occpying this site
will determine if they are compatible with the neighborhood
of single family residences and public service facilities.
A careful review of each site plan should be conducted by the
City to assure compatibility of the development with the
adjoining residences.
3. The triangular piece .f property is bounded by substandard
streets. NE 3rd is :1: feet wide. It should be 50 feet since it
is a curve in this location ; however, expansion of the roadway
is limited by the 124 KV electrical line. NE 4th is improved
to a residential standard. There are no curbs or sidewalks
on the south side of NE 4th.
4. Located between Lot 1 and the intersection of NE 3rd and NE 4th
is a portion of right-of-way which is unuseable because of
the angle of the intersection. However, it is very important
to the screening of Lot 1 from automobile glare and movement .
The area should be bermed and landscaped irrespective of what type
of commercial development is placed on the site .
5. A major water line (16" ) is located along NE 3rd Street . A 12"
water line will be installed on NE 4th Street in front of
the Highbury Park single family residential development as
required in the approval of the preliminary plat . That will leave
only the segment along the proposed short plats with a substandard
3" water line connected with a 12" in the western boundary
of the short plats and a 16" segment at the intersection of NE
3rd and NE 4th Streets .
6. The applicant has requested a waiver of off-site improvements
because the extent of those improvements and the final designs
had not been ascertained at the time of the application for the
short plat . The basic off-site improvements will not vary whether
it is a clothing store or restaurant and it is not necessary
to wait to provide the off-site improvements. Those improvements
should be linked directly to the short plat .
M. DEPARTMENTAL RECOMMENDATIONS :
The staff recommends that the short plat request be approved
and the .vaiver request of off-site improvements be denied subject
to the following conditions :
1. Site and landscaping plan approval of each commercial
development by the Hearing Examiner in public hearing to
assure the neighborhood the opportunity to express their
views on the compatibility of the commercial development
with the single family residential development .
2. Bonding and/or filing of restrictive covenants running with
the land which states that the property owners shall parti-
cipate in an LID for off-site improvements, if a deferral is
granted by the Board of Public Works.
3. Landscaping of the triangular portion of public right-of-way
west of the intersection of N.E. 3rd and N.E . 4th Streets at
the time of development . Landscape plans to be reviewed by
the Hearing Examiner as part of the intent of Condition #1.

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposed short plat is consistent with the Comprehensive
Plan designation of commercial for the site.
2. The final design of the proposed businesses occpying this site
will determine if they are compatible with the neighborhood
of single family residences and public service facilities.
A careful review of each site plan should be conducted by the
City to assure compatibility of the development with the
adjoining residences.
3, The triangular piece of property is bounded by substandard
streets. NE 3rd is 50 feet wide. It should be 50 feet since it
is a curve in this location ; however, expansion of the roadway
is limited by the 124 ITV electrical line. NE 4th is improved
to a residential standard. There are no curbs or sidewalks
on the south side of NE 4th.
4. Located between Lot 1 and the intersection of NE 3rd and NE 4th
is a portion of right-of-way which is unuseable because of
the angle of the intersection . However, it is very important
to the screening of Lot 1 from automobile glare and movement .
The area should be bermed and landscaped irrespective of what type
of commercial development is placed on the site .
5. A major water line (16” ) is located along NE 3rd Street . A 12"
water line will be installed on NE 4th Street in front of
the Highbury Park single family residential development as
required in the approval of the preliminary plat . That will leave
only the segment along the proposed short plats with a substandard
3" water line connected with a 12" in the western boundary
of the short plats and a 16" segment at the intersection of NE
3rd and NE 4th Streets.
6. The applicant has requested a waiver of off-site improvements
because the extent of those improvements and the final designs
had not been ascertained at the time of the application for the
short plat . The basic off-site improvements will not vary whether
it is a clothing store or restaurant and it is not necessary
to wait to provide the off-site improvements. Those improvements
should be linked directly to the short plat .
M. DEPARTMENTAL RECOMMENDATIONS :
The staff recommends that the short plat request be approved
and the waiver request of off-site improvements be denied subject
to the following conditions :
1. Site and landscaping plan approval of each commercial
development by the Hearing Examiner in public hearing to
assure the neighborhood the opportunity to express their
views on the compatibility of the commercial development
with the single family residential development .
2. Bonding and/or filing of restrictive covenants running with
the land which states that the property owners shall parti-
cipate in an LID for off-site improvements, if a deferral is
granted by the Board of Public Works.
3. Landscaping of the triangular portion of public right-of-way
west of the intersection of N.E. 3rd and N.E . 4th Streets at
the time of development . Landscape plans to be reviewed by
the Hearing Examiner as part of the intent of Condition #1.

We are asking to ,exclude the off site improvements until we know
what has to be done so that the off site improvements will be in
the right place.
Mr. Oyler is in the process of drwining the sewer lines showing
the man holes lines and depths.
It is for this reason that we are asking that the off site impr
ovements be excluded at this time,on the Cugini short Plats 1 & 2.
