SHINPOCH, MAYOR • PLANNING DEPARTMENT 235- 2550 P 094TED SEP1 .�� February 20, 1980 MEMORANDUM TO: Board of Public Works FROM: Planning Department RE: DEFERRAL OF OFF-SITE IMPROVEMENTS FOR LOT #2, PROPOSED VALLEY OFFICE AND INDUSTRIAL PARK SHORT PLAT BACKGROUND: • The applicant is requesting a deferral of off-site improvements on S.W. 16th Street to allow the filing of the subject short plat . The Board of Public Works does not have the authority to grant a deferral based on the filing of covenants. The Subdivision Ordinance (Section 9-1108(21) ) specifically says that improvements shall be installed or a deferral can be granted subject to the posting of a bond of other security. Therefore, the request is inappropriate. In addition, Puget Power, the owner of Lot #1, has obtained a deferral in the past at the time of the construction of a sub- station. However, the short plat is a new matter entirely, and all the improvements will be required on Lot #1 also. Therefore, the action by Valley Office and Industrial Park will not allow the filing of the short plat. One lot would still have to be bonded for it . Presently, the City is formalizing LID 314. This would include S.W. 19th Street and a portion of S.W. 16th Street. Since this is not finalized, there are no commitments by Valley Office and Industrial Park as a participant in LID 314. Therefore, all necessary improvements on S.W. 19th Street and that portion of S.W. 16th Street that are included in the LID proposal will have to be bonded. However, the Austin Company representing Vallet7 Office and Industrial Park can bond for all of the improvements for the approved short plat. This would include the Puget Power property. • Board of Public Works February 20, 1980 Page Two RECOMMENDATION: The Planning Department recommends that the deferral be granted for a period of two years subject to the posting of appropriate bonds for the construction on S.W. 16th Street and S.W. 19th Street bordering the short plat. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Responding was: Jacob Fox Austin Company 800 S.W. 16th Street Renton, WA 98055 Referencing Section F.1. , Public Services, of Exhibit #1, which states that storm sewers are not available in the area, Mr. Fox advised the existence of storm sewers on Raymond Avenue S.W. which will service the site, as well as facilities under construction on Lind Avenue S.W. and an existing open drainage facility on S.W. 19th Street. He stated that discussion had previously been held with Puget Power representatives, owner of Lot No. 1, to proceed with the requested short plat in the same manner which would have occurred two years earlier when the property was owned by the Metro Industrial District. He also noted that the Affidavit of Ownership, submitted with the subject application, states that the legal description of the property owned by Puget Power is in accordance with the deed. The Examiner inquired if the proposal to dedicate a portion of the property owned by Puget Power was acceptable. Mr. Fox responded affirmatively. The Examiner requested testimony in support of the application. There was no response. He then requested testimony in opposition to the application. Responding was: Dick Causey Land Planner, Puget Power Puget Power Building Bellevue, WA 98009 Mr. Causey advised that although he concurred in the short plat proposal, he objected to lack of notification of the public hearing by the Planning Department as well as requirements for dedication of 10 feet of property on S.W. 16th Street. He noted that a deferral of off-site improvements had been granted in 1978 at the time of building permit application, but if installation of the improvements had occurred at that time, Sh, 431rn f79 Page Two removal would now be required; and he felt that compensation should be made for the dedication either by the City of Renton or the Austin Company. The Examiner advised that dedication of property must be addressed during the short plat process. Mr. Causey deferred further comments to his associate. Responding was: Bob Boyd Property Management Department Puget Power Puget Power Building Bellevue, WA 98009 Mr. Boyd advised the existence of previously executed restrictive covenants on property owned by Puget Power which require a minimum setback of 60 feet on 153rd Street (S.W. 16th Street) , noting that requirement of additional dedication would violate the restrictions of the covenants. He indicated that the impending short plat had been reviewed with representatives of the Austin Company early in September at which time minor disagreements had occurred, but since then no further contact had been made. Mr. Boyd advised that the original warranty deed from Metro Industrial District received upon conveyance of the property to Puget Power did not specify that the property is a vacated plat and did not contain information that a short plat is required. He stated that the short plat should have been required by the sellers two years ago since platting at this time would disallow disposal of the property for a five year period. The Examiner inquired if representatives of Puget Power in objecting to a short plat were proposing a long plat instead. He advised that approval of a long plat would require approval of the City Council and would entail. application for both preliminary and final plat processes. Although Mr. Boyd stated that the proposal had not been considered, Puget Power had proposed that its property be divided into two parcels in lieu of the current proposal for one lot. The Examiner confirmed that if division into two lots is proposed, application for preliminary and final plats would be required, and he suggested that to allow negotiation between all owners of the property, the application be withdrawn and resubmitted at a later date, Mr. Fox requested comments from the Examiner regarding the effect of the Affidavit of Ownership signed by original owners of the property. The Examiner advised that although the affidavit is signed by prior owners, Metro Industrial District, Puget Power is the current owner, and because of differences between equitable and legal ownership, agreement of all parties to the short plat would be required prior to proceeding. Both Mr. Fox and Mr. Causey expressed the desire to continue the hearing to allow resolution of the matter rather than withdrawal of the application. The Examiner concurred in the request, and the hearings regarding File. No. Short Plat 431-79 as well as a concurrent application, File No. SP-424-79, were continued to 9:00 a.m. on November 6, 1979. Mr. Blaylock reiterated the purpose for continuation of the previous hearing, and explained the applicant's request for a second continuance in order to formalize a tentative agreement between all participants in the short plat. The Examiner requested testimony by the applicant. Mr. Jacob Fox confirmed that although a tentative agreement has been prepared by Puget Power and Metro Industrial District, an additional week was requested to provide a final, written agreement. He also advised that representatives of Puget Power may be willing at this point to withdraw their objections. Responding for Puget Power, Mr. Bob Boyd advised that an agreement had been prepared but was being processed through normal channels for a final commitment of approval. He indicated that at this point a commitment for ultimate approval was not possible. The Examiner requested testimony by parties other than property owners or applicants in the matter. There was no response. He then inquired if an agreement could be expeditiously reached to allow continuation of the matter for one week. Responding was: Raymond Hemstreet Austin Company 800 S.W. 16th Street Renton, WA 98055 Regarding differences between Puget Power and Metro Industrial District, Mr. Hemstreet advised his belief, that the Austin Company can negotiate and resolve all differences with the exception of providing Puget Power a guarantee of approval of a variance on S.W. 16th Street if conditions of previously executed restrictive covenants are violated by requirement of a 10-foot dedication. Mr. Hemstreet indicated that although such guarantee is not possible, it had been suggested by city staff that Puget Power can retain Sh. P1. 431-79 Page Three ownership of the 10-foot setback while providing the City of Renton an easement in order to improve the roadway. The Examiner inquired if the applicants had been informed of a possible request for dedication along Lind Avenue. Mr. Blaylock advised the difficulties in resolving the issue since this particular property had already been acquired by sale from Metro Industrial District to the City of Renton. However, he noted that the function of the short plat process is to proceed with the proposal in the same manner as would have occurred at the time of the original sale. The Examiner advised that the City Attorney is reviewing the question regarding right-of-way along Lind Avenue which was part of the subject parcel prior to the sale, but since the property should have been short platted and right-of-way dedicated at that time, the possibility exists that the contract may be null and void. The Examiner concurred in the request for additional time to finalize the agreement between Puget Power and Metro Industrial District, and continued the matter for one week to November 13,. 1979. He also noted that a concurrent request for special permit approval on the same site would be continued to the same date. The Examiner requested further comments. since there were none, the hearing regarding File No. Short Plat 431-79 was closed by the Examiner at 9:25 a.m. CONTINUANCE: The hearing was opened on November 13, 1979 at 9:45 a,m. in the Council Chambers of the Renton Municipal Building. The Examiner inquired if all property owners were in agreement to enable proceeding with the short plat request. Mr. Bob Boyd, Puget Power, advised that Puget Power would require ' additional time to contact appropriate personnel in order to approve proceeding with the application. The Examiner indicated his desire to continue the public hearing to December 4, 1979, which would allow the applicants the opportunity to reach an agreement as well as review .a legal opinion received from the City Attorney in response to a request from the Planning Department regarding the required dedication of street right-of-way on Lind Avenue. Mr. Blaylock read into the record the letter to the City Attorney from the Planning Department, dated November 8, 1979, and advised the attorney's verbal opinion that the LID procedure may not be modified two years after formation, although the dedication should be included in the subject short plat.. Mr. Blaylock advised receipt of a revised drawing from the applicants which reflects compromises which have been effected. The Examiner noted that according to Mr. Boyd's testimony no definite agreement has been reached. Mr. Jacob Fox advised that the Austin Company has complied with initial offers from Puget Power, and no disagreement regarding property lines exists. However, he noted that the remaining conflict pertains to the 10-foot dedication on S.W. 16th Street required of Puget Power. The Examiner requested further testimony. There was no response. Mr. Blaylock advised receipt of staff comments from the Building Division, Traffic Engineering Division, and Engineering Division which he supplied to the Examiner and the applicants. The Examiner closed the public hearing at 9:55 a.m. to be continued to December 4, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. CONTINUANCE The hearing was opened on December 4, 1979 at 9:10 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Mr. Blaylock advised that the application has been delayed because of negotiation between the two property owners involved - Puget Power & Metro Industrial. He entered a map - revised date November 30, 1979 - as the map of agreement between the two parties and also between the city officials concerning the additional right-of-way question on S.W. 16th. The Examiner admitted short plat submitted November 30 as Exhibit 4. Mr. Blaylock described the property as being in the Green River Valley south of S.W. 16th and north of S.W. .19th and to the west of Lind Avenue S.W. , stating it is presently zoned H-1 and that the Comprehensive Plan designates the area as manufacturing park. A portion of the site has been filled under a previous fill permit. The Special Permit is in addition to that previous permit. The property was annexed in 1959 and rezoned in 1962. He stated that the staff report and Sh, P1. 431-79 Page Four analysis, as presented on October 30, has been modified slightly because of this revision, basically in two areas - dedications and lot sizes. He entered the Supplemental Staff Report, dated December 4, 1979 as Exhibit 5. Mr. Blaylock pointed out changes on point ;#1 - the dedication on both Lind S.W. and Raymond S.W. - that the property was obtained by LID from the Austin Co. and that it would be appropriate to require dedication on the face of the short plat in these areas to assure conformance. He stated that there is a question of legality of the sale and a possibility there should have been a short plat at that time, that if they are taken as a dedication it would clear up this problem. In the staff report of October 30 it was recommended that an additional 10 feet of drive- way be obtained along the northern boundary of Lot 1. Mr. Blaylock stated that in the staff report of October 30 it was recommended that an additional 10 feet of driveway be obtained along the northern boundary of Lot 1. Instead of a right- of-way, the Public Works Department has accepted the concept of a sidewalk easement for the northern six feet of the northern 10 feet and utility easement for that entire northern 10 feet. He explained that the reasoning for this is that last year an electrical vault was installed 6 feet off the right-of-way and that this 10 feet would be used for sidewalks and utilities. , It is felt that instead of moving the utility box, easements could be used. However, because it is an ease- ment and not public right-of-way, according to the way the ordinance is written regarding landscaping between the right-of-way and the parking, it would be possible to bring parking up within 10 feet and not have any landscaping between the parking and the sidewalk. The additional 10 feet of landscaping would assure that the code is met. He stated that the modification reduced Lot 3 to 2.3 acres as the result of negotiation between Metro Industrial District and Puget Power. He recommended, based upon the analysis and the analysis in the staff report of October 30, that the short plat application 431-79 be approved subject to the filing of the appropriate easements for sidewalk, utilities, and landscaping designated above and the dedication of Lind and Raymond Avenues S.W. He pointed out further that there will be a slight dedication of the northwest portion of Lot 2, a distance of 32.54 feet. The Examiner questioned whether there would be any further landscape or sidewalk easement. Mr. Blaylock replied that there would not be as there is 90 feet of right-of-way, and that Lind Avenue has 8 feet of right-of-way purchased. The Examiner requested testimony by the applicant. Responding was: Jacob Fox Austin Company 800 S. W. 16th Street Renton, WN. 98055 Mr. Fox advised that the Short Plat has been revised with the November 30 date to include the utility easement, sidewalk easements, etc. and that the only thing left on the revised short plat is the dedication of streets. He stated that they would be happy to put the dedication of streets in the form described by the City of Renton. The Examiner requested clarification of lot sizes. Mr. Blaylock explained that Lot 1 would remain the same and that Lot 3 would be reduced by .2 acres. He asked how Lot 2 would increase by .2 of an acre. Mr. Fox responded that Lot 2 increased because of shifting 'of the east boundary of Lot 1 by approximately 15 feet so that from the original plat layout, the north dimension is reduced by 15 feet, increasing Lot 2, Lot 1 remaining the same acreage by taking a little bit of land from Lot 3. The Examiner responded that Lot 1 is 2.5 acres, Lot 2, 5.3 acres, Lot 3 is 2 .3 acres and Lot 4 is still 15 acres. Mr. Fox affirmed that this is correct. Mr. Blaylock questioned why there is still .2 of an acre more. Mr. Fox responded that property was shifted from Lot 2 to Lot 3. The Examiner questioned the pro- cedure. Mr. Blaylock responded that they moved a line approximately 15 feet to the west and moved the line between 1 and 3 ten feet to the south. The Examiner asked whether that would leave enough side yard for the sub-station between Lots 1 and 3. Mr. Fox responded that it would. The Examiner requested further comments from the applicant or property owners. Mr. Boyd responded that he was satisfied at this point and had no further questions. The Examiner requested testimony in support of the application. There was no response. He then requested testimony in opposition to the application. Responding was: 4111 Sh. Pl. 431-79 Page 5 Leonard Steiner Representing East Lake Washington Audubon Society 13239 N,E. 100th Kirkland, Wn. 98033 Mr. Steiner expressed concern over what is going on in the total area. He stated that Raymond Avenue is going to have to cross a creek and that is going to involve a bridge. He questioned who would be responsible for paying for the bridge. He remarked that 19th Avenue is in the middle of a marsh, and on the other side of 19th there is a marsh pond. This area drains and is a wild life habitat area. He stated that the Soil Conservation Service, in connection with the City of Renton,' is trying to develop'a drainage plan in connection with the Green River, but that the plan has not yet been formalized. The Examiner responded that most of Mr. Steiner's comments should be addressed to the Special Permit and filling grade rather than the Short Plat itself and that there are two applications pending for this applicant. The Examiner requested. further testimony. There was no response. • The Examiner closed the Public Hearing at 9:25 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request. is for approval of a 4-lot short plat of 25.1 acres of land for commercial and industrial Use. 2, The Planning Department report sets forth the issues, ,applicable policies and pro- visions, findings of fact, and departmental recommendation's in this matter and is hereby attached as Exhibit #1. . • 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined exempt from the threshold determination by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. • 5.. Special Permit SP-424-79 was held in conjunction with the proposal. 6. All existing utilities are available and in close proximity. • 7. The proposal is compatible. with the required setbacks, lot coverage and height re- ' quirements of Section 4-713 (Heavy Industry) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. This request was initiated when it was discovered that a portion of the subject property was sold into separate ownership without benefit of an approved subdivision. 9. The subject property is at. the north end of the Green River Valley Comprehensive Planning • Area and is in the extreme northern end of the large area given over to industrial and manufacturing park needs. . The subject site is just south of I-405 at the intersection of Lind Avenue S.W. and S.W. 16th Street. • 10. The site has been partially filled under an approved special permit (File No. SP-063-77) and the need for more fill resulted in an application for a new special permit (File No. SP-424-79) . • . 11. A substation owned and operated by Puget Power is located on proposed Lot 1, the north- westernmost lot of the proposed subdivision. This was the lot which had been sold without benefit of a recorded plat. This lot would be ±2.5 acres in size. 12. Proposed Lot 2, at the intersection of Lind Avenue S.W. and S.W. 16th Street,would be approximately 5.3 acres. The applicant also proposes a ±2.3 acre lot located on Raymond Avenue S.W. (Lot 3) . The proposed Lot 4, now containing four office buildings leased by The Boeing Company, is ±15 acres and it .is located between Raymond Avenue S.W. and Lind Avenue S.W. , just north of S.W. 19th Street. O Sh. P1. 431-79 Page Six • 13. The applicant proposed to construct a temporary parking lot on portions of Lots 2 and 3 to serve the Boeing facility. The lots would eventually be used for construction of commercial and/or industrial uses. • 14. A portion of the subject property was sold to the. City of Renton for use in the Lind Avenue LID. The City Attorney indicated that the status of that sale is questionable. The Attorney therefore recommends a formal dedication on the face of the subject plat • of the property involved in that sale. The applicant has agreed to such a dedication. 15. The Planning Department has recommended that an easement for sidewalk and utilities be . provided on the northern 10 feet of proposed Lot 1 to permit the expansion of the S.W. 16th Street right-of-way. A jog in the right-of-way would be eliminated by the dedication of the northern 10 feet of the extreme western 32.54 feet of the proposed Lot 2. 16. Restrictive covenants running with the land requires landscaping buffer all public right-of-ways. The sidewalk and utility easement would eliminate the landscaping buffer. Therefore, an additional landscape easement of 10 feet was also recommended by the Planning Department. The applicant agreed to provide the recommended sidewalk (northern 6 feet of the 10 foot utility easement) easement; the 10 foot utility easement, and the 10 foot landscape easement. They will also dedicate that small ±325 square foot corner of proposed Lot 2. CONCLUSIONS: 1. The subject short plat appears to serve the public use and interest. The proposed lots will each be used in accordance with the designation of manufacturing park under the Comprehensive Plan. The properties currently are used for an electrical substation, and an office complex for Boeing, with accompanying parking. The parking lots will eventually be developed with further commercial or industrial uses. 2. The applicant has agreed to provide the necessary portions of the subject property to permit the expansion and construction and improvement of needed right-of-way in the area surrounding the subject property. Such provision will permit establishment of needed streets and sidewalks in the area and in addition permit the area to be sufficiently landscaped. 3. The subdivision will also acknowledge the separate ownerships of. the subject parcels. The dedication of property for the Lind Avenue S.W. and S.W. 16th Street LID will clarify the status of those projects and ownership of the dedicated right-of-way. RECOMMENDATION: The short plat as contained in Exhibit #4 should be approved subject to: 1. The dedication of those parcels which were the subject of sale for the Lind Avenue S.W. and S.W. 16th Street LID; 2. The creation of easements in favor of the City for sidewalks along the north 6 feet of the north 10 feet of proposed Lot 1; 3. The creation of easements along the northern 10 feet of proposed Lot 1 for installation of utilities; 4. The creation of a 10 foot landscape easement immediately south of the above-described utility easement; and • 5. If the short plat had been accomplished in 1977, the City would have required dedications for all streets. This would have included Lind Avenue, Raymond Avenue, S.W. 16th and S,W. 19th. However , in between the proper time of short platting and now, an LID has been formed for the construction of Lind Avenue. In that LID process, the applicants , the Austin Company, sold to the LID the property that would have been required to be dedicated. Was that sale another illegal sale? Would that property have to be formally dedicated on the short plat to the City of Renton, even though we presently hold a deed which may be illegal? A substantial amount of money was involved in the transaction, and the result would be that other property owners involved in the LID would be subsidizing the cost normally attributed to the short plat application . Should the City be involved in recourse to become financially equitable? It is critical that we receive a response as soon as possible, as the public hearing is scheduled for November 13th. Water : No natural drainage features exist , and no standing water was observed on the site. 6. Land Use : The subject site borders on the south side of S.W. 16th Street . There is a mixture of commercial and light industrial uses located along S.W. 16th Street between the Valley Freeway and Longacres. The Austin Company's main headquarters is located on the north side of S.W. 16th Street , just west of the subject site. The new Group Health warehouse and laboratory complex is located directly west of the subject site'. E . NEIGHBORHOOD CHARACTERISTICS : The general area is in a transitional area from pasture and unde- veloped land to various industrial and commercial uses. Glacier Park Company is presently conducting filling operations- approxi- mately half a mile to one mile south of the subject site and has plans for future platting and development of that area. Filling and/or development have occurred directly adjacent to the subject site. F. PUBLIC SERVICES : 1. The subject site was rezoned from G to H-1, Heavy Industry District , on May 7 , 1962 , by Ordinance No. 1955. Certain restrictive covenants were established at the time of the rezone to run with the land. These covenants deal with permitted uses , setbacks, landscaping areas, and other site development requirements. Perme- ability is slow and seasonal high water table is at or near the surface. Runoff is slow to ponded, and erosion hazard is slight. The soil is generally used for row crops and pasture. 3. Vegetation : Due to the previous filling of the site and cur- rent construction activity related to the Boeing office build- ing, only limited scrub grasses remain on the site. 4. Wildlife: Due to the conditions noted above, no significant wildlife habitat remains on the site, although birds and " rodents may be present . 5. Water : No natural drainage features exist , and no standing water was observed on the site. 6. Land Use : The subject site borders on the south side of S.W. 16th Street. There is a mixture of commercial and light industrial uses located along S.W. 16th Street between the Valley Freeway and Longacres. The Austin Company's main headquarters is located on the north side of S.W. 16th Street , just west of the subject site. NEIGHBORHOOD CHARACTERISTICS : The general area is in a transitional area from pasture and unde- veloped land to various industrial and commercial uses.
