This is to notify you that the above referenced request, which was
approved subject to restrictive covenants as noted on the Examiner's
report of April 11, 1980, has not been appealed within the time
period established by ordinance. Therefore, this application is
considered final and is being submitted to the City Clerk effective
this date for permanent filing. Restrictive covenants will be
filed by the City Clerk with King County.
If you have not already done so, please contact the Planning
Department for information regarding preparation of the final
short plat mylar for filing with King County.

WHEREAS, Jack R. Ring and his wife Dorothy M. Ring ,

are the owners of the following real property in the City of Renton ,
County of King, State of Washington, described as Exhibit 'A'
attached hereto.
WHEREAS, the owner(s) of said- described property desire to
impose the following restrictive covenants running with the land as
to use, present and future, of the above described real property.
NOW, THEREFORE , the aforesaid owner(s) hereby establish ,
grant and impose restrictions and covenants running with the land
• hereinabove described with respect to the use by the undersigned,
their successors , heirs , and assigns as follows :
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal , and pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving, sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting. •

These covenants shall run with the land and expire on
December 31, 2025. If at any time improvements are

shall terminate without necessity of further documentation.
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoining
subject property whp arm dyer ely affected by said breach.

REPORT AND RECOMMENDATION.

• SUMMARY OF REQUEST: The applicant seeks approval of a 3-lot short plat together
with exceptions for lot width and street width and a waiver
of the required off-site improvements.

. PLANNING DEPARTMENT . The Planning Department preliminary report was received by

PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The, hearing was opened on April 8, 1980 at 9: 30 a.m in the Council Chambers of the
' Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed.
the Planning Department report. Steve Munson, Planning Department, reviewed the report
and entered the following exhibits into the record:

The Examiner confirmed with Munson that the rear yard of the existing house on Lot 1
would have the required 25 foot depth-
At the conclusion of the Planning Department report, the Examiner confirmed that there
are now exceptions being requested that had not been asked for in the initial request.
Mr. Munson responded that that was correct,• that exceptions for less than the 60 foot '
lot width were now,requested.
The Examiner requested testimony by the applicant. Responding on behalf of the appli-

Chastain contended that 24th Avenue for more than two blocks has only a 30 foot right
of way taken off the north side of the subdivision line, that there is no right of
way available on the south side, and that 24th Avenue is the only access to Garden
Ct. N. He questioned the 40 foot right of way in an area which he claims could never
be widened. He maintains that sidewalks, curbs and gutters at the end of the cul-de-sac
in an area such as this are unnecessary.
The Examiner asked if there was further testimony regarding this application. Respond-
ing was:

Mrs. Ring submitted an exhibit for record:
Exhibit #9 - Storm Drainage Plan for Keefer Short Plat
approved by the City of Renton
Mrs. Ring indicated that these plans were approved by the City of Renton but that
these improvements were never made.
The Examiner asked for further testimony in support or opposition of the short plat
application.
Mr. Munson chose to comment on the recommendations for improvements claiming that the
Planning Department contends that if the improvements are not required at this time,
they may never occur on the property in question.
The Examiner requested comments in support or opposition to the application. There
was no response.
The Examiner stated that his decision would be entered within 21 days if there was no
objection to that waiting period. There were none.
The public hearing regarding File No. Sh. Pl. 014-80, E-015-80, W-016-80 was closed
at 9:40 by the Examiner.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
•
1. The request is for approval of a 3-lot short plat on +.66 acres together with excep-
tions for lot width and street width and a waiver of off-site improvements.
2. The application file containing the application, SEPA documentation, the Planning '
Department report, and other pertinent documents was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been deter-
mined exempt from the threshold determination by Gordon Y. Ericksen, responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 (G-6000; General; Single Family Residential; Minimum
Lot Size - 6,000 sq. ft.) of Title IV, Ordinance No. 1628, Code of General Ordinances.
7. The subject property is located in the vicinity of 2413 Meadow Avenue N. . The subject
lot is a pipestem lot of approximately 25,000 sq. ft.
8. The subject property is currently developed with a single family residence located
on the eastern portion of the pipestem lot. The remainder of the subject lot is
undeveloped and is covered with lawn grasses and some trees and shrubs.

9. The subject lot is a through lot with frontage on Garden Ct. N. as well as the pipe-
stem frontage on Meadow Avenue N. Garden Ct. N. has a right-of-way that varies in
width from about 25 feet to about 42 feet. Garden Ct. No. also is effectively a
320 foot cul-de-sac because a single family unit is located in what would be its
northerly right-of-way at about 2420 N. It also is not a through street south of
24th St.
10. The applicant proposes subdividing the subject property into three lots. Each lot
would be at least 6,000 sq. ft.
11. Because of the substandard width of Garden Ct. N., the applicant has requested,an
exception from Section 9-1108.7 (H). which provides that residential access streets
have a minimum 50 foot right-of-way.
12. The applicant has also requested an exception to Section 9-1108.23(F) (3) (a) , 'which
requires lot width to be at least 60 feet. The applicant proposes a lot width of
55.1 feet and 52.71 feet respectively and the Planning Department has recommended
lot widths of +56 feet and +52 feet respectively.
13. Both of the exceptions are being requested pursuant to Section 9-1109.
14. The Planning Department has recommended that the exceptions for both roadway width
and lot width be approved subject to certain modifications. The Planning Department
has recommended that the right-of-way width be developed to 40 feet rather than the
required 50 feet because of the anticipated limited demands on the roadway and the
fact that the roadway is located on a terrace of an otherwise steep hillside. In
order to facilitate even the 40 foot right-of-way width, lot lines would have to be
adjusted to prevent proposed Lot l's rear yard from becoming non-conforming.
15. Lot 1, the pipestem lot with the existing residence situated upon it has access to
Meadow Avenue N. This lot would be approximately 13, 590 sq. ft. per the appli-
cant's request and somewhat less per the Planning Department proposal.
Lot 2, the northerly of the two new proposed lots would have access onto Garden Ct. N.
It would be approximately 6,135 sq. ft. as proposed by the applicant and about 6,500 sq.
ft. under the Planning Department's recommendation.
Lot 3, the southerly lot would also have its access via Garden Ct. N. and it would
be just over 6,000 sq. ft. under either proposal.
16. N. 24th Street is 30 feet in width. Under terms of previously approved short plats
along both N. 24th Street and Garden Ct. N. no additional property is available for
dedication to the City. Previously granted exceptions also preclude widening of
these respective roadways. (Shook Short Plat - File No. Sh. P1. 199-78; Keefer
Short Plat - File No. 16-75) .
17. The area is developed primarily with single family units. Lot sizes vary from the
larger lots similar in size to the subject property to smaller lots approaching the
6,000 sq. ft. requirement of the zoning ordinance.
18. There are no apparent off-site improvements in the area. The Planning Department
has recommended that the requested waiver of the required off-site improvements be
granted subject to restrictive covenants to participate in an LID.if one is formed
to install off-site improvements in the future for this area.
CONCLUSIONS:
1. The proposed subdivision appears to serve the public use and interest. The appli-
cant's proposal will create two additional lots and provide needed housing oppor-
tunities in an established and pleasant residential environment.
2. The proposed lots will meet or exceed the zoning requirements of the area's
G-6000 district. The lots are in conformance with the Comprehensive Plan and com-
patible with its goals of developing and utilizing land to its highest and best
use. (Pg. 18, Renton Land Use Report.)
3. The two additional houses proposed by the applicant will not tax available city
services and the additional development on Garden Ct. N. will not create any
unreasonable burden on traffic and roads in the area.
4. The exception request to allow deviation from the subdivision ordinance requiring
a 50 ft right-of-way .is justified in light of the, existing development and the
established street pattern in the area. Due to the topography of the area, both

to the south and the west, Garden Ct. N. will not serve as access to any additional
streets or areas. Nor can Garden Ct. N. be extended in a northerly direction because
of the development of a single family dwelling in what would be its right-of-way.
Garden Ct. N. effectively serves as a cul-de-sac off of N. 24th Street.
Further, because of the existing physical development, prior dedications and prior •
approved exceptions, Garden Ct. N. south of the subject site cannot be widened.
N. 24th St. which is the only exit from Garden Ct. N. also cannot be widened beyond
its current 30 foot width for the same reasons.
5. It would serve no purpose to require only a small portion of Garden Ct. N. to be ;
40 feet wide when its southerly terminus and only link to the street system is
permanently and legally limited to a 30 foot right of way.
6. As indicated above therefore, the approval of the exception to allow access on a
30 foot right-of-way will not be a detriment to the public welfare, nor will it
injure neighboring property, and it will permit development of the subject property
in a manner similar to other property in the area.
7. The applicant should be required to dedicate to the city, if necessary, land along
the western property line sufficient to provide a 30 foot right-of-way along
.Garden Ct. N. . The 30 foot right-of-way will. continue current road widths in the
area and provide sufficient room for construction of a safe roadway.
8. There are no apparent improvements in the area; therefore, it would serve only a
' limited purpose to require this small area to provide off-site improvements at
this time. In the event that such improvements are indicated by changing conditions,
the applicants will be required to take part in their installation and, therefore,
the applicants should execute restrictive covenants to participate in such installa-
tion if an LID is created to accomplish that purpose.
9. The only method by which the applicant can achieve reasonable division of this
property and still create lots which meet the minimum requirements of the zoning
code is to create lots which are less than the 60 foot width required by
Section 9-1108.23 (F) (3) (a) . Approval of an exception to permit the reasonable
development of the subject property will not be detrimental to the public welfare
nor will it injure neighboring property. Due to the nature of the lot and its
prior development, there is no other reasonable alternative to the requested
exception.
DECISION:
Exhibit #2 is approved subject to the dedication of sufficient land along the western
property line to provide a 30 foot right-of-way along Garden Ct. N.
The exception to provide access by a right-of-way. of less than 50 feet is approved sub-
ject to access by a right-of-way of no less than 30 feet and improved to city standards
and subject to approval of the Public Works Department.
The exceptibn to provide two lots of less than 60 feet in width is approved subject
to meeting the requirements of zoning code.
The waiver is approved subject to the lexecutionof restrictive covenants to participate
in an LID for the installation of off-site improvements.

3 . The pipestem lot was created prior to the enactment
of the Short Subdivision Ordinance in 1971 . In
1976 , Doug Weston short platted the parcel to the
east (File No . Short Plat 31-76 ) .
4. The property to the west was short platted in
1,975 by Mr . James Keffer (File No . Short Plat 16-75 )
and Garden Court North was constructed by the new
owners which according to the available record
was to standards specified by the Public Works
Dept . because there were no streets with curbs
and sidewalks in the general area. None of the
lots in Keffer ' s Short Plat have been constructed
upon . Garden Court North was constructed as a
half street on a right-of-way varying from 24 feet
to 42 feet in width .
The Public Works Department advises that the right-of-way
should be a minimum of 40 feet in width . The applicant
has applied for an exception to the Subdivision
Ordinance , Section 9-1108-23-A(5 ) that requires
a minimum right-of-way width of 50 feet .
5 . Compliance with the 50 ' street width specified
in the Subdivision Ordinance would create a non-
conforming lot with respect to rear yard setback
for the house on lot #1 and reduce the lot sizes
for both lots below. the 6000 sq . feet minimum of
the zoning district . A 25 foot deep rear yard
is required . The existing single family residence
would be only 15± feet from the modified property

6 . If the streett width recommended by the Public
Works Department is approved by the Examiner , the
useable portion of the lots #2 and #3 will be reduced
in total depth by an average of 7t feet . If this
amount is equally divided between lot 2 and. 3 ,
they will be 116*, and. 107* feet in depth by 521
and 56* feet in width . This provides a total lot
area of just over 6000 square feet conforming to ,
the Subdivision Ordinance . It would also appear
from the available documents that the rear yard
for the existing house would be 25*. feet . Prior
to recording of the short plat , all of 'these dimensions
should be verified by surveys .
7 . The applicant has requested a waiver of the improve-
ment requirements for the short plat . Approval
and recording of this subdivision along with the
adjoining subdivision for Mr . Ray Aliment Ring
will leave only 130 ' of the street right-of-way '
to be improved . The Public Works Department recommends
approval of the waiver subject to restrictive covenants
providing for future installation of the street
improvements .
8 . As noted previously , the improvements on Garden ,
Court North are less than the normal subdivision '
standards . Ufsing the 40 ° street width recommendation ,
a 121/2 foot travel lane plus curb and sidewalk would
require approximately 18. feet in width (within '
the 20 foot half street) . It is recommended that
the improvements for the street consist of a 121/2
foot travel lane street section , curb , gutter ,
sidewalk , undergrounding storm drainage , street
lighting and other normally required subdivision
improvements .
9 . As noted in #6 above , the lot widths for the proposed
lots #2 and #3 are less than the 60 foot minimum
specified in the Subdivision Ordinance . Due to
the existing lot configuration it is not possible
to achieve two lots facing Garden Court North ,
each with the minimum lot width . The exception
requested appears to be the minimum variation of
the standard which will provide for 3 lots within
the site .
M . DEPARTMENTAL RECOMMENDATIONS:
Based upon the foregoing analysis , it is recommended
that the Ring Short Plat , File No . 014-80 be approved
subject to the following conditions :
1 . Dedication of an area at the westerly extreme of
the property providing for a 40 ° street right-of-way
width .
2 . Revision of lots 2 and 3 to conform to the right-of-way
width dedication and 6000 sq . ft. minimum lot size .

rear yard of the existing residence on lot 1 .

width consisting of a 122 foot travel lane width, curb and
gutter with contiguous sidewalk and all remaining normal

Gentlemen:
We are requesting the approval of a three lot short plat
with an exception for street width on Garden Court North.
Please see City of Renton Subdivision Ordinance, Section
9-1109 : Exceptions.
Garden Court North is a 321.26 ft. long cul-de-sac with no
additional potential access and varies in width from 42.67
ft. to 25.00 ft. It was platted and approved as a half-street
in the L. James Keffer short plat on October 5, 1976.
It has been determined that it would not be feasible to provide
additional right-of-way to Garden Court North since moving the
easterly lot line for lots two and three would reduce the back
yard from an existing house to less than the 25.00 ft. requirement.
This backyard requirement would place an undue hardship on the
owner by forcing him to eliminate an income producing lot since
he does not own any adjacent property.
The Ring property has legal access to Garden Court North and
short platting would increase the access requirement by one lot.
This exception is necessary to insure that our client ' s property
will retain the same rights and privileges enjoyed by other
properties adjacent to the easterly right-of-way of Garden Court
North.
We believe granting our client this street width exception would
not be detrimental to the public welfare or injurious to other
property in the vicinity.

On Monday, March 10th the City Council approved a latecomer' s
agreement for the Keefer Short Plat located east of Garden -'
Court North. The Planning Department presently has two proposed
short plat applications immediately adjacent to the east.
Today the property owner, Mr. Richard Houghton , has transferred
the title of the one-foot reserve strip to the City of Renton
so the reserve strip no longer exists . The documentation has
been filed with King County and the Planning Department will
process the two short plat applications as required by ordinance.

The Planning Department has received two applications for
short plats immediately east of Garden Court in the Kennydale
area . However , between Garden Court and these properties
a private reserve strip has been excluded by the property
developers and filed as a portion of the Keefer Short Plat
in direct conflict with Section 9-1108 (23) (A) (9) of the Subdivision
Ordinance .
The property developers are Mr . Richard Houghton and Mr .
Ron Olson. I have discussed the problem with Mr . Houghton
and he has stated that he has been in contact with you concerning
the apparent violation . The developers are requesting through
the City Council a latecomer ' s agreement for the connection
of sewer and water to any properties to the east of Garden
Court . This request has not been approved by the City Council
at this time . Mr . Houghton has stated that he has the documentation
ready to deed the 1-foot reserve strip to the City of Renton
at any time .
The two proposed short plats show access directly on Garden
Court ; however , there is this 1-foot reserve strip . The
Planning Department has been reluctant to begin processing
the application until the question of access has been resolved .
Even though the reserve strip- appears to be illegal , the
fact remains that the property in question does not border -- _
directly on_Garden -Court-. SLould the legal matter of the _
1-foot dedication be concluded prior to the City continuing
the processing of the short plat applications?

Subject : Request for Exception (Ring Short Plat)
Gentlemen:
We are requesting the approval of a three-lot short plat with
an exception to allow two lots with less than 60 feet in width
on the Ring property. Please see the City of Renton Subdivision
Ordinance, Section 9-1109: Exceptions .
The total area is 25,738 sq. ft._ Lot one contains 13,591 sq. ft.
and an existing house. The remaining area for lots two and three
contains 12, 147 sq. ft. and is 107.81 ft. wide. We propose to
create two lots from this area in compliance with the G-6000
zoning requirements. Lot two would be 52.71 ft. wide and lot three
would. be 55. 10 ft. wide. The City of Renton Subdivision Ordinance,
Section 9-1108 : Plat Improvements and Development Standards in
Paragraph 23F,. 3 (C) states that lots shall not be less than sixty
feet in width exclusive of those areas considered as part of the
front and rear yard requirement.
It has been determined that it would not be feasible to subdivide
lots two and three on a North-South basis with a pan-handle shaped
access from Garden Court N. since both lots could not comply with
the G-6000 zoning requirements. The total area will easily support
three lots within the existing zoning and our client does not own
any adjacent property. Thus , the minimum 60 ft. width restriction
would place an undue hardship on the owner by forcing him to elim-
inate an income producing lot.
We believe granting our client this lot width exception would not
be detrimental to the public welfare or injurious to other property
in the vicinity.

Subject : Request for Waiver (Ring Short Plat)
Gentlemen:
We are requesting the approval of a three-lot short plat
with a waiver of offsite improvements (curbs , gutters and
sidewalks) to Garden Court North within the L. James Keffer
short plat.
The L. James Keffer short plat was approved on October 5,
1976 without curbs, gutters and sidewalks. These improve-
ments have not been constructed as of this date.
Garden Court North is less than the 50 ft. width required
for a residential access street. It varies from 42.67 ft.
to 25.00 ft. which is inadequate to construct these improve-
ments. Please see. City of Renton Subdivision Ordinance,
Section 9-1108 : Minimum Standards for Residential Design.
We believe granting our client this offsite improvement
waiver would not be detrimental to the public welfare or
injurious to other property in the vicinity.
