The Hearing Examiner had denied it because in the vicinity is the new subdivision of Fernwood and Leisure Estates Mobile Home Park. Leisures Estates has not completed their off-site improvements but will have to almost immedi- ately based upon the attorney' s opinion that those improvements cannot be deferred. Therefore, it would be logical for the improvements in the area to be constructed at the same time for both the McCaslin Short Plat and Leisure Estates. HARDSHIP REQUEST Request for Deferral Dear Sirs : Pursuant to the preliminary report of the Hearing Examiner, dated July 1 , 1980, and the recommendations set forth therein, I now, most respectfully request your reconsideration of the recommendations for the denial of the request for waiver , under applicati,on number 036-80. Denial o.f the requested waiver would cause an undue hardship and would bean unnecessary burden upon the property owner. I , fully agree, that the plat of FERNWOOD EAST has installed the required off-site improvements consistent with City of Renton Ordinances . I further submit that the Planned Unit Development of Liesure Estates Mobile Home Park was also established consistent with required City Ordinances, for off-site improvements . The common link between these plats is their TOTAL DEVELOPMENT OF AN APPROVED PROJECT. The Short Plat , which I have submitted is an isolated plat and the waiver would be on isolated off-site im- provements. The immediately adjoining and surrounding properties have not installed the required off-site improvements or are they required to install any such improvements until such time as there is an assessment for local improvements. . Again the manner of strict compliance with the City Ordinance would be disproportionate and premature, since only one lot fronts on Union Avenue N.E. . The development of the easement area as required would not be beneficial to any other property owners. These improvements may be required to be destroyed when full development of the Total Right-of Way would be required along with the underground installation of all the utilities. I , reaffirm as I have expressed in your hearing, that the installa- tion of the off-site improvements would be premature and create a severe hardship on both the property owners and the City of Renton in absence of complete development plans establishing the public rights-of-way .and the completion of the comprehensive Zoning Plan for the area. The property owners would be abused by the constant disruption of excavation, repairs, improvements and a continued harrassment to the City because of construction hazards. JOEPETE MC CASLIN HARDSHIP REQUEST Page - 2 I , NOW THEREFORE, sincerely pray for your consideration to provide for deferral of the off-site improvements , in favor of a later TOTAL PROJECT for the development of the area. This type of project would allow participation by the property owners in an assessment program in which they are allowed to participate, and a project that will minimize the inconveniences of construction, and lend harmoniously with the desired develop- ment of the area, which is also consistent with zoning needs. A deferral of the off-site improvements to be controlled through a Covenant which would require the land owner and all future land owners to participate in any off-site which may be deemed required by the City of Renton. Participation through the use of the Improvement Covenant running with the land would provide fewer objections from the local resedents and less resistance for the City required improvements, whatever they may be at the time of installation. A TOTAL DEVELOPMENT would lend favorable to environmental considera- tions in limited pollution by gases from equipment , noise from the said equipment rather than, the piecemeal disruptive and noisy. in- stallation of the projects through later subdivisions and zoning adjustments . HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance #3143 of June 13, 1977 at which time the present zoning classification was applied . D. PHYSICAL BACKGROUND: 1 . Topography: The subject site rises from west to east at approximately a 5-6% slope. 2 . Soils : Alderwood Gravelly Sandy Loam (AgCO . Permeability is moderately rapid in the surface layer and subsoil and very flow in the substratum. Runoff is slow to moderate and the erosion hazard is moderate. This soil is used for timber , pasture , berries , row crops and for urban development . 3. Vegetation: The site is densely wooded with medium growth Alder in the easterly one-third and the remainder consisting principally of blackberries and scrub grass . 4. Wildlife : Existing vegetation on the site provides suitable habitat for birds and small mammals . 5 . Water : No surface water was observed on the subject site (June 17 , 1980) . 6. Land Use : The subject site is undeveloped at this _ time. Scattered single family residences are located to the west, south and north. To the., east a new subdivision (Fernwood East) is being developed . E . NEIGHBORHOOD CHARACTERISTICS : : The surrounding properties are a mixture of large-lot and platted single family residential and a mobile home park . F. PU4 LIC SERVICES : 1 . Water and Sewer: A 12" watermain extends north-south on Union Avenue adjacent to the subject site while an 8" sanitary sewer runs along the same route for approximately 250 ' south of NE 4th Street . 2 . Fire Protection : Provided by the Renton Fire Department per ordinance requirements . 3. Transit: Metro Transit Route #142 operates along Edmonds Avenue NE approximately one mile northwest of the site . 4. Schools : The site is located approximately one mile south of the Honeydew Elementary School and one mile southeast of the Renton Vocational School . McKnight Junior High School is approximately 12 miles to the northwest while Hazen Senior High School is '12 miles to the northeast . 5 . The proposed short plat is consistent with the Comprehensive Plan designation of single family for the site and surrounding area. 2 . The proposal is compatible with the existing single family residences in the area. 3. The lots of 'the proposed short plat meet the minimum size requirement of 7500 square feet in the SR-1 zone. 4. Due to the existing configuration of the subject site, it has been necessary for the applicant to request an exception to the Subdivision Ordinance to allow access by easement . At the present time , tax lots 72 and 106 use the existing roadway of this proposed easement as previously established access. 5. . Tax lot 102. (adjacent to the south) has a potential for f6 lots . Sufficient width exists for future full street access to this property. To accomplish this , 50 ' of right-of-way should be dedicated to the City with 32 ' curb-curb improvements. The. Union Circle Plat located at Union Avenue NE and NE 7th is a nearby identical development configuration . 6. A waiver of the required off-site improvements has also been requested. Immediately to the east across Union Avenue. NE the new plat of Fernwood East has installed such improvements . Leisure Estates Mobile Home Park (to the south) was also required to install similar improvements . These developments would suggest that a waiver in this area may not be appropriate. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on June 25, 1980. PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 1 , 1980 at 9:20 a.m. in. the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Steve Munson, Planning Department, reviewed the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department• report and other pertinent documents Exhibit #2: Short Plat Survey Exhibit #3: King County Assessor's Map Mr. Munson corrected Section L.4, fifth line, from Tax Lot 72, as denoted, to Tax Lot 75. The Examiner requested testimony by the applicant. Responding was: Joepete McCaslin 17637 S.E. 123rd Place Renton, WA 98055 Mr. McCaslin generally concurred in the recommendations contained in the report with the exception of the requirement to dedicate a 50-foot right-of-way and install 32 feet of curb to curb street improvements on the southerly side of the subject site. He advised that upon installation of utility lines, the street would be torn up, and cost of the improvement project was prohibitive for development of a single lot. He offered to participate in expense of development of the street at a future time when Tax Lot 75 located to the south and west of the subject site, owned by George Pasco, is developed. The Examiner requested clarification of the Planning Department recommendation for dedication and improvement of a roadway currently serving as an easement. Utilizing Exhibit #2, Mr. Munson indicated the proposed street. Mr. McCaslin advised that the 60-foot easement, which is graded and graveled, extends to Leisure Estates Mobile Home Park, and currently serves only one family as access. The Examiner requested testimony in support or opposition to the application. There was no response. He then invited comments from the Planning Department staff . Since no further comments were forthcoming, the hearing was closed by the Examiner at 9:27 a.m. 110 Sh. Pl . 80 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a +.79 acre two-lot short plat together with an exception for an access easement and a waiver of the required off-site improvements. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #l . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5• All existing utilities are available and in close proximity. 6. The proposal is compatible with the required setbacks , lot coverage and height requirements of Section 4-704 (SR-1 ; Single Family Residence; Minimum lot size - 7500 square feet) of Title IV, Ordinance No. 1628, Code of General Ordinances. 7. The subject site is located on the west side of Union Avenue N.E. approximately 1820 feet south of N.E. 4th Street. The subject site is in the east central portion of a large superblock in which there are a number of interior lots which have no frontage on a public right-of-way. 8. The subject site was annexed into the city in June of 1977 at which time the site was classified as G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) . Concurrently with this application for a short plat the applicant has petitioned to reclassify the site to SR-1 . The Hearing Examiner in a separate report has recommended that the City Council approve that rezone request. 9. The subject site rises from west to east at approximately a 5-6% slope. The site is densely wooded with alder on the easterly one-third. The remainder of the site is covered with blackberry bushes and scrub grass. 10. The site is surrounded by scattered single family dwellings on the north, west and south. Fernwood .East, a new single family subdivision, is being developed on the east across Union Avenue N.E. Heather Downs, an existing single family subdivision, is also located east of the site. 11 . The zoning in the area is a mix of G, the site's current classification, to the north, south and west of the site; T (Mobile Home/Trailer Park) to the west of the site; SR-1 , the zoning recommended for the site by the Hearing Examiner, to the east of the site; and R-3 (Medium Density Multifamily) to the north of the site along N.E. 4th St. 12.' A high school , middle school and elementary school as well as Kiwanis Park are all located within one to one and one-half miles of the subject site. 13. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family dwellings. 14. The applicant has applied for the short subdivision pursuant to Section 9-1105, and has also applied for an exception to permit access by private easement pursuant to Section 9-1109, and for a waiver of the required off-site improvements pursuant to Section 9-1105.6(B) . The proposal will create two lots of approximately .40 acres each. One of the lots would front on Union Avenue S.E. , and the other, an interior lot, would, pursuant to the requested exception, provide access via an easement. 15. The Planning Department has recommended that the applicant dedicate the southerly 50 feet of property for a public right-of-way for access to both the interior lot the applicant proposes and for future access to other interior properties in this large superblock. This would obviate the need for the access exception. 16. The Planning Department has recommended that the request for waiver of off-site improvements be denied as improvements to Union Avenue S.E. are underway. h ~ A 4 Sh. ! O31 _80 Page Three 17. The applicant 's lot is approximately .79 acres. The other interior lots in the area which would be served by the proposed public right-of-way account for approximately four acres. CONCLUSIONS: I . The proposed short plat appears to serve the public use and interest. Essential public services are available for single family development. Public schools are located within one to one and one-half miles of the subject site. Kiwanis Park offers recreational opportunities within one and one-half miles of the site. 2. The division of this relatively large lot will permit the development of two single family dwellings, thereby increasing the available housing stock in the city. It will also increase the tax base of the city. 3. The proposed lots will be consistent with the recommended zoning of SR-1 ( if approved by the City Council) . The lots and proposed uses will also be compatible with the general uses in the area, that is, single family residences and single family mobile homes located north, east and west of the subject site. 4. The requested exception is unnecessary as the dedication of a public right-of-way can serve the same purpose. Granting the exception in this case would grant the applicant a special privilege when another reasonable means of accomplishing access for the proposed interior lot is available. The public right-of-way will also provide access to other interior -lots in this large superblock permitting the eventual further subdivision of the large interior lots in this vicinity. • 5. The dedication should permit the establishment of a 50-foot right-of-way on the south side of the subject lot, and certain improvements should be installed so that the roadway is compatible and consistent with the other public improvements proposed. along Union Avenue S.E. Therefore, the request to waive required off-site improvements along Union is denied. The applicant, though, should not be required to bear the entire cost of providing an improved road which will conceivably serve acreage four times that which the applicant proposes to improve. Therefore, the applicant should be required to improve one-half of the entire driving surface and provide curbs, gutters and sidewalks for only the north side of the proposed roadway adjacent to the subject property. DECISION: Exhibit #2 is approved subject to the dedication of the southerly 50 feet of the subject property for a public right-of-way which shall be provided with an improved surface and improvements of the northern portion of the right-of-way with, but not limited to, curbs, gutters and sidewalks. Gentlemen: I , Joepete McCaslin, again most respectfully request your con- sideration for an exception to use an easement for ingress , egress and utilities , as follows : 1. Prior to the annexation to the city of Renton the legal parcels were subject to the sixty (60) foot easement for ingress , egress and utilities . 2. One owner of improved property is now using the easement roadway and any denial of use would create an undue hardship or reasonable use of the property. 3 . Creation of additionally owned access to adjoin the ease- ment area would be only adding to a burdensome situtation in road way widths . 4. The exception would only insure equal use of land as enjoyed by other properties within the neighborhood and immediate vicinity. 5 . The requested exception will not be detrimental, to Public welfare and safety and will not be injurious to other property owners or their parcels of property in the immediate vicinity. I have searched the development of the parcels and have found that prior to annexation into the City of Renton, the parcels faced the easement area now requested as an exception. For unknown reasons the parcels were taxed under one parcel because of merger into com- mon ownership.
