In this case it is untenable to allow the lot reconfiguration to change a currently legal and conforming lot line into one that is non- conforming. Allowing this lot line adjustment to proceed in its current configuration will establish a poor precedent and further extend the City's abuse of this procedure. The City has long abused lot line adjustments by allowing them to be used as an alternative to short platting. This too is poor but established policy and should itself be reviewed; particularly in light of the recent streamlining of the short plat process for smaller short plats. There is no discernable difference in the City's approval process between such short plats and lot line adjustments. The type size for the land record number should be smaller than that used for the land use action number. The dimension of 30' for a portion of Lot 13 of said Block 2 is incorrect. The common lot line between proposed Lots 2 and 3 does not allow for required lot setbacks around the existing garage. Revise as necessary to conform to city standards. Note what was, or is to be, set at all new corners along the common lot line between proposed Lots 2 and 3. Note all existing easements, agreements, restrictions, etc. on the drawing, if any. Note discrepancies between bearings and distances of record and those measured or calculated, if any. All owners of record need to sign the lot line adjustment drawing. The address of each lot needs to be noted on the drawing. The address for proposed Lot 1 will be provided by the city as soon as available. Remove the building setback lines. Setbacks are determined when building permits are issued. We (Mike and Barbara Duby) are the owners of Lots 6 and 7. Mikel Papke is the owner of Lots 8 and 9. It is the Duby's intention to purchase 10 ft. of Lot 8 and add it to Lot #7. There will be a minor alteration near the Southeast corner of the lot 8 due to the existing garage on Lot 8. This will result in a minor jog in the property line. The original Lots 6,7,8 and 9 were all 40 ft. wide. The 10 ft. purchase will result in Lot 6 staying the same (40 ft. wide) and renamed Lot 1.
