HomeMy WebLinkAboutC_On Hold ltr_Hardie Townhomes_20230411 April 11, 2023 Hans Korve DMP 726 Auburn Way N Auburn, WA 98002 SUBJECT: "On Hold" Notice Hardie Townhomes / LUA23-000019, SA-A, SHPL-A Dear Mr. Korve: The Planning Division of the City of Renton accepted the above master application for review on February 16, 2023. During our review, staff has determined that additional information is necessary in order to proceed further. In accordance with RMC 4-2-110E.13: “If the lot abuts a single family residential zone (RC through R-14) a fifteen foot (15') setback shall be required along the abutting side(s) of the property.” The proposed project currently provides a ten foot (10’) setback along the south property, which abuts an R -8 zone. As the proposed ten foot (10’) setback is less than the required fifteen foot (15’) setback, the applicant has two options: 1. The applicant may revise the building footprint to comply with the required fifteen foot (15’) setback from the south property line, abutting the R-8 zone; or 2. The applicant may submit an application for a variance to vary from this requirement. In order for the City to support a variance, the applicant would be required to submit a justification demonstrating that the proposed variance would meet the following criteria: a. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification; b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated; c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated; d. That the approval is a minimum variance that will accomplish the desired purpose. If the applicant elects to apply for a variance, the application would be subject to an additional $1,396.50 application fee. The above requested information will need to be corrected and submitted before July 11, 2023 so that we may continue the review of the above subject application.
