Pursuant to Renton Municipal Code (RMC) 4-9-240D.1.h, model homes equaling the lesser of five (5) or twenty percent (20%) of the total lots within a preliminary plat may submit residential building permits and be constructed with a Tier 1 Temporary Use Permit. The Canopy PUD Subdivision would result in 55 residential lots and therefore be permitted to submit up to five (5) residential building permits. As shown on the submitted site plan (Exhibit 1), the applicant proposes to build five (5) model homes on future lots 30, 31, 32, 33, and 34 near the intersection of NE 40 th and the new public street currently referred to as ‘Road A.’ Access to the lots would be gained from Road A. The applicant has completed an abatement agreement and indemnification for the Temporary Use (Exhibit 2). The Temporary Use Permit is hereby Approved and subject to the following conditions:: *CONDITIONS OF APPROVAL: 1. All model homes shall be connected to water, sewer, and storm before building permits are final. 2. Only a combined five (5) model homes shall be issued building permits for the Canopy PUD Subdivision prior to the recording of the plat. 3. The proposed lot lines for the model homes for the Canopy PUD Subdivision (Lots 30,31,32,33 and 34) shall be staked and strung to ensure proper assessment of setbacks prior to construction of the model homes. The applicant shall provide approved access and fire hydrants prior to construction of the model homes. Identification of such access and hydrants shall be provided with the building permit application for review and approval by the Current Planning Project Manager and the Renton Regional Fire Authority plans reviewer. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on April 27, 2023. Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4- 8-110 and additional information regarding the appeal process may be obtained from the C ity Clerk’s Office, cityclerk@rentonwa.gov. EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the one-year expiration, for up to five years at the time of application or prior to permit expiration.
