Project Summary: The City of Renton is requesting Environmental (SEPA) Review and a Shoreline
Exemption for the replacement of existing undersized storm water conveyance
pipes and the installation of two (2) modular wetland water quality facilities within
the existing public right-of-way on Burnett Ave S and Williams Ave S between 2nd
St S and the Cedar River and S Tobin St between Burnett Ave S and Williams Ave
S. The proposed, larger storm water pipes would help to minimize flooding within
the project area. The proposed project would include removal and in-kind
restoration of asphalt surfacing, concrete sidewalks, grass and other surface
features as necessary for the installation of the storm water improvements. A
portion of the project site would be located within 200 feet of the Cedar River, a
Shoreline of the State. The project site would be located within the Shoreline High
Intensity Designation of Cedar River, Reach B. The project site is mapped within a
seismic hazard area and wellhead protection area, zone 1.

In compliance with RCW 43.21C.240, the following environmental (SEPA) review addresses only those project
impacts that are not adequately addressed under existing development standards and environmental regulations.
A. Environmental Threshold Recommendation
Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials:
Issue a DNS-M with a 14-day appeal period
B. Mitigation Measures
1. If any petroleum or solvent impacted soils and/or groundwater are encountered during project
construction, the impacted materials shall be disposed of appropriately and any employees shall be
protected from exposure.

D. Environmental Impacts
The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether
the applicant has adequately identified and addressed environmental impacts anticipated to occur in
conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have
the following probable impacts:
1. Earth
Impacts: The applicant submitted a Geotechnical Report prepared by Kleinfelder, dated September 27,
2021 (Exhibit 3) with the project application materials. Topography in the area is generally flat and
elevations in the vicinity of the improvements, except for the banks of the Cedar River, which slope
down to the river at about Elevation 25 feet. Three (3) hollow-stem auger (HSA) borings were advanced
to a depth of 20 feet below the existing ground surface (bgs) and one to a depth of 30 feet bgs (the
boring nearest the Cedar River outfall). Fill was encountered just below the pavement sections and
generally ranged from about 7½ to 15 feet thick. Borings KB-1 through KB-3, located in Williams Avenue
South and South Tobin Street, encountered a mix of silts and sands with varying amounts gravel, likely
placed to fill the historical Cedar River channel. Boring KB-4, in the alley south of Williams Avenue
South, encountered gravel with varying amounts of silt and sand, likely placed more recently as backfill
for the below grade portion of the nearby apartments. Alluvium was encountered below the fill in each
of our borings and extended to their termination depths. They were comprised of a mix of fine to
coarse sands and gravels with varying silt contents. Boring KB-1 encountered pieces of buried wood
(interpreted as timber or logs) at depths of approximately 25 and 30 feet bgs. KB -1 is located within
the former Cedar River channel and this material is likely associated with deposits from before the river
was diverted. Groundwater levels observed during drilling were generally about 15 feet bgs. The depth
to groundwater is expected to vary with seasonal changes in rainfall and surface runoff, impacts of
local development, and the level of the Cedar River.

The report included recommendations for excavations, shoring, demolition, paving, and earthwork. It
is anticipated that the City’s adopted erosion control measure and seismic hazard regulations would
adequately mitigate for any adverse impacts that could occur as a result of the proposed project;
therefore no further mitigation is recommended.

2. Water
a. Storm Water
Impacts: The applicant submitted a Design Report, prepared by BHC Consultants, LLC, dated
January 2022 (Exhibit 4) with the project application materials. The project proposes to update the
stormwater collection and conveyance system and install water quality treatment facilities within
the project area. The project proposes the installation of two MWS-Linear Modular Wetland
(ModWet) water quality treatment facilities – one (1) in S Tobin Street, one (1) in Williams Ave S –
to improve the quality of stormwater runoff from the basin. In addition, the stormwater trunk lines
within S Tobin Street would be upsized, to reduce stormwater overflows and flooding. The existing
outfall to the Cedar River would remain intact. The proposed replacement would be subject to the
requirements of the City of Renton Surface Water Design Manual. It is anticipated that impacts
from the proposed improvements would be mitigated through the requirements of the City’s
currently adopted stormwater regulations. Therefore, not further mitigation is recommended.

3. Environmental Health
a. Environmental Health Hazards
Impacts: A Comment Letter from the Washington State Department of Ecology (DOE), dated April
6, 2023 (Exhibit 5) was received during the 14-day public comment period. DOE notes that the
project site is located near a property (73 Burnett Ave S) listed on the Model Toxics Control Act
(MTCA) Confirmed and Suspected Contaminated Sites List. Petroleum and nonhalogenated
solvents have been confirmed in the soil and ground water at this site. The comment letter further
notes that due to the proximity of the proposed proje ct to 73 Burnett Ave S that excavation may
encounter petroleum or solvent impacted soils and/or groundwater. If contaminated soils or
groundwater are encountered, DOE recommends that the applicant be prepared to dispose of
these materials appropriately and to protect workers from exposure. Staff recommends, as a SEPA
mitigation measure, that if any petroleum or solvent impacted soils and/or groundwater are
encountered during project construction, that the impacted materials be disposed of appropriately
and any employees be protected from exposure.

E. Comments of Reviewing Departments

The Environmental Determination decision will become final if the decision is not appealed within the 14 -day
appeal period (RCW 43.21.C.075(3); WAC 197-11-680).
Environmental Determination Appeal Process: Appeals of the environmental determination must be filed in
writing on or before 5:00 p.m. on May 8, 2023. Appeals must be submitted electronically to the City Clerk at
cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee,
normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted
electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals
to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process
may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
