Due to the awkward shape of the portion of this plat fronting on Duval' .Ave. , a pipe stem lot is necessary to allow a lot of adequate width and depth to be placed in this area. A 20 ft. access easement is planned to cross a pipe stem portion of lot 9 to provide access to lot 10, thus pre- venting lot 10 from having to access directly on Duval Ave. We feel that this combined access, rather than two individual driveways fronting on Duval Ave. , provides a safer and more attractive design. CARRIED. Referendum 29 Letter from State Department of Social and Health, Services Referendum Funds 29 Coordinator, J. P.' Orrico, replied to Mayor Delaurenti 's inquiries Senior Center re funds to assist in construction of a senior citizens center. The letter in reply to the Mayor's question about timing, noted the Regional Citizens Advisory Committee allocated the fund to the City based on belief that the project would be through the application process and under construction in 1977; clarifying that the funds are allocated to the City for the senior center by the Regional Committee, but the actual grant request has not been approved, and part of the approval process involves estimate of when the project will enter; the construction phase. That if the facility is not going to be under construction for three years, it is highly unlikely the Committee would sign off on the application or carry it forward into 1978. The letter noted the Area Agency on Aging prioritized another senior center higher than Renton's . That one of reasons to split the funds, in addition to need, there were 'indications the Renton project was ready to begin in 1977. Noting, information such as contained in the 3/30 local newspaper article dimishes City's chance of keeping present allocation and reduces opportunity for additional funds available in DSHS Region 4. The letter further stated assurance is required that funds are actually approved from other sources; that to ensure the facility will progress even if other funds which were approved at the time of Referendum 29 grant award, fail to become available, require- Renton City Council 4/18/77 Page 4 Correspondence and Current Business - Continued Referendum 29 ments are that project must be under contract with DSHS within one year Funds - Continued from date of approval , that if construction contract is not signed during 12 months allowed, funds revert to other projects; noting inflation decreasing value of Referendum 29 funds. Wetlands The Committee of the Whole recommended that the Mayor be requested to prepare a report for the next Committee of the Whole meeting indicating the status of financing and acquisition of wetlands, includ- ing the status of the 39 acres set aside by Burlington Northern, MOVED BY PERRY, SECONDED BY SHINPOCH COUNCIL CONCUR IN RECOMMENDATION. CARRIED. Wetlands The Committee of the Whole recommended that the Administration pursue all avenues of funding, including contacting our local legislators for recommendations of sources for funds to acquire the additional 39 acres set aside by Burlington. City Attorney Shellan reviewed provisions of the Hearing Examiner ordinance wherein there is no requirement for public hearing unless a substantial error committed by Land Use Hearing Examiner; Shellan reviewed appeal hearing when new evidence was called for, that Council found no gross error;. also reviewing hearings before the Examiner, noting three hearings have been held; noting additional restrictions added. SUMMARY OF REQUEST: Applicant requests preliminary plat approval of a proposed 14-lot subdivision. SUMMARY OF Planning Department: Approval subject to RECOMMENDATION: conditions. Hearing Examiner: Approval subject to conditions. PLANNING DEPARTMENT The Planning Department staff report was received REPORT: by the Examiner on March 15 , 1977 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on March 22 , 1977 , at 10 : 00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibit into the record: Exhibit #2 : Plat Map Designating Street Layout and Lot Layout. The Examiner asked Mr. Smith to clarify the notation on the plat map regarding the buffer areas, and inquired if the requirement would be enforced by restrictive covenants. Mr. Smith read the notation into the record which referred to a 15 foot natural buffer easement to be preserved in its natural state, all trees to be retained, no driveways or other vehicular access to be permitted to cross said buffer easement except for Lots 1 and 14 , and additional landscaping or planting to be permitted within said buffer area. Mr. Smith indicated that the notation would be recorded with the plat. The Examiner questioned the requirement for restrictive covenants. Mr. Smith reported that he expected no difficulty in the procedure as recorded on the plat map. The Examiner inquired about the recommendation to require an easement between Lots 1 and 14 to provide access onto 10th Avenue N.E. M . Smith indicated that Lots 1 and 14 were specified because they were corner lots, contained no significant vegetation, and allowed access and flexibility in the plan. . t PP-025-77 Page Two The Examiner inquired about the average lot size in the plat. Mr. Smith reported that the lots vary in size from 7200 to 10 ,000 square feet, and the average lot size was from 7500 to 8000 square feet. The Examiner asked Mr. Bigbie, representative for the applicant, if he. concurred in the staff report„ Mr. Bigbie indicated his concurrence. The Examiner asked Mr. Bigbie if he would have objections to the notation on the plat map being placed in the form of restrictive covenants. Mr. Bigbie 'indicated he had no objection, and reported that the same notation would be placed on the final plat, map in the form of covenants. The Examiner asked for additional comments. Since there were none , the hearing on Item #PP-025-77 was closed by the Examiner at 10 : 10 a.m. FINDINGS, CONCLUSIONS, & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: '1. Mr. Scott Bigbie stated that he was representing the applicant, had received and reviewed the Planning Department report, and has concurred with the Planning Department' s recommendations. 2. There was no written correspondence from opposing parties nor was there opposition to this request present in the audience. The purpose of the request is to review a preliminary plat consisting of 14 single family residential lots. 3. All City of Renton departments have been contacted and have made their specific comments. 4. Size of the property is approximately 3 . 2 acres and has access from Monroe Avenue N.E. and N.E. 10th Street. 5 . The Comprehensive Land Use Plan designates this property as single family residential. The subject property has undergone a number of proposed uses dating back to April, 1967 . The last proposed use was the construction of, a church facility on the site. However, this proposal was strongly opposed by the neighbors in the area and was eventually denied by the City Council on December 15 , '1975. 6 . The westerly half of the property consists of significant stands of Douglas Fir together with intermittent dogwood and thick evergreen underbrush. The eastern half of the site has been previously cleared and consists of grasses , brush, and scrub ' deciduous trees. The area surrounding the site on the east, west and south is basically single family residential with the Bethlehem Lutheran Church situated directly to the north. 7 . All water and sewer lines are available adjacent to the property. 8 . The City of Renton Planning Department, pursuant to the City of Renton Environmental Ordinance and the State Environmental Policy Act of 1971 as amended by R.C.W. 43. 21.c., has issued a 'Declaration of Non-Significance for the subject proposal. This is based on the fact that the city through various approvals has worked with the applicant to preserve as much significant trees on the site as possible. The lot sizes and division of property would be compatible with the surrounding area. ' 9. The City of Renton Planning Department report accurately sets forth the issues , findings of fact, applicable policies and provisions, and departmental recommendations in this matter, and , this report itself , being uncontested, is hereby attached as Exhibit #1 and incorporated in this report by reference as is set forth in full herein. PP-025-77 Page Three CONCLUSIONS: 1. The proposed subdivision is in compliance with the subdivision codes, the R-1 zone requirements, and the Comprehensive Land Use Plan and policy statements. 2. The applicant has proposed to screen the subdivision by providing a 15 foot natural buffer easement along the west, north and south property lines. This buffer would be a very effective screen from adjacent properties and would provide the new residents in this subdivision with a sense of privacy. RECOMMENDATION: Recommend approval subject to the Planning Department' s recommendations. The easterly half gently slopes upward to the easterly property line (approximately 6% slope) . The overall slope of the site is approximately 5%. 2 . Soils : Arents , Alderwood material , 6% to 15% slopes (AMC ) . Runoff is medium; erosion hazard is moderate to severe ; and permeability is very slow below a depth of 24" to 40" . This soil is suitable for urban development. 3. Vegetation : The westerly half and along the north property line consists of significant stands of Douglas Fir, together with intermittent dogwood and thick evergreen underbrush . The easterly half of the site has been previously cleared and .consists primarily of grasses , brush , and scrub decidu- ous trees . The existing stands of evergreen trees are primarily 6" - 18" caliper and provide a destinctive character to the site. 4. Wildlife : The existing vegetation on the site provides suitable habitat for birds and small mammals native to the area . 5. Water : Surface water or streams are not apparent on the subject site . 6. Land Use : A single family residence previously existed on the site. It has been demolished and the site remains undeveloped . The area surrounding the site on the east , west, and south is single family residential . The Bethlehem Lutheran Church exists directly to the north , with the Seventh Day Adventist Church located across Monroe Ave . N . E. and approximately 100 feet north of the subject site.. F. NEIGHBORHOOD CHARACTERISTICS: Land use and zoning in the area is primarily single family resi - dential . However, several churches exist within one-fourth mile of the site . Refer to Section E . 6. and Exhibits 1 and 2 for more detailed land use information . G. PUBLIC SERVICES: 1 . Water and Sewer: A 10" water main exists along Monroe Ave . N. E . and a 4" water main exists along N. E. 10th St. . There are existing 8" sewer and storm sewer mains located along Monroe Ave . N . E . . 2 . E. 10th St . was vacated in 1974 , thereby eliminating access to the previously platted portion of the PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING OF MARCH 22 , 1977 PAGE TWO RE : RUDDELL ' S 2ND ADDITION (MacPHERSON ' S , INC . ) property (easterly one-third of site) . A special permit to con- struct a church facility on the subject site was denied by the City Council on December 15 , 1975 . A rezone from GS-1 to R- 1 was approved by the City Council on March 7 , 1977 . E. PHYSICAL BACKGROUND: 1 . Topography : The westerly half of the subject site is relatively level . The easterly half gently slopes upward to the easterly property line (approximately 6% slope ) . The overall slope of the site is approximately 5%. 2. Soils : Arents , Alderwood material , 6% to 15% slopes (AMC ) . Runoff is medium; erosion hazard is moderate to severe ; and permeability is very slow below a depth of 24" to 40" . This soil is suitable for urban development. 3 . Vegetation : The westerly half and along the north property line consists of significant stands of Douglas Fir, together with intermittent dogwood and thick evergreen underbrush . The easterly half of the site has been previously cleared and consists primarily of grasses , brush , and scrub decidu- ous trees : The existing stands of evergreen trees are primarily 6" - 18" caliper and provide a destinctive character to the site. 4. Wildlife : The existing vegetation on the site provides suitable habitat for birds and small mammals native to the area . 5. Water : Surface water or streams are not apparent on the subject site . 6 . Land Use : A single family residence previously existed on the site. It has been demolished and the site remains undeveloped. The area surrounding the site on the east , west, and south is single family residential . The Bethlehem Lutheran Church exists directly to the north , with the Seventh Day Adventist Church located across Monroe Ave . N . E. and approximately 100 feet north of the subject site . F. NEIGHBORHOOD CHARACTERISTICS: Land use and zoning in the area is primarily single family resi - dential . However, several churches exist within one-fourth mile of the site. Refer to Section E . 6 . and Exhibits 1 and 2 for more detailed land use information . G. PUBLIC SERVICES: 1 . Water and Sewer : A 10" water main exists along Monroe Ave . N . E. and a 4" water main exists along N . E. 10th St. There are existing 8" sewer and storm sewer mains located along Monroe Ave . N . E. 2 . Fire Protection : Provided by the Renton Fire Department as per ordinance requirement. Any future subdivision and development of the site will be subject to the City of Renton standards . 3. Transit : Metro Transit Route No. 42 provides service along N . E . 10th St . directly adjacent to the subject property . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on February 8 , 1977 , at 9 : 00 a.rn, in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had 'received and reviewed the Planning Department report, and the report, including attached maps , was entered into the record by the Examiner as Exhibit #1 . Michael Smith, Planning Department, reviewed Exhibit #1 , and entered the following additional exhibits into the record: Exhibit #2 : Assessor' s Map. ' Exhibit #3: Applicant' s map, received January 11 , 1977 , designating property to be rezoned with proposed . use plan including general site dimensions and topography . Mr. . Smith indicated that the proposed plat request will be submitted if the zoning is approved, and has been prepared by Triad Associates , Inc. , 4 consulting firm. He also reported that during a previous rezone request for the subject property in 1975 , neighbors in the area had indicated a desire for single-family residential zoning for the property. Mr. Smith reported that additional comments will be forthcoming from city departments and agencies upon receipt of • preliminary and final plat requests for this property . The Examiner asked for additional comments from the Planning Department staff. There were no further comments . The Examiner requested comments from the representative for MacPherson ' s , Inc. Responding was : Mr. Scott W. Bigbie c/o Triad Associates , Inc. . 846-108th Avenue N.E . Bellevue, Washington 98004 R007- 77 Page Two Thu Examiner asked Mr. Bigbie if he concurred with Exhibit #1 . Mr. Bigbie responded that he concurred. In response to the Examiner ' s question regarding the retention of the trees on the rezone property , Mr . Bigbie stated that there is a green belt easement' on the western , southern and northern prcperty lines included in the restrictive covenants of the plat. He indicated that the lots along the western portion of the property would be larger than the minimum 7200 square feet requirement because they are located in a cul-de-sac. The Examiner commented that because the property is heavily wooded, retention of the trees is an important aspect of the development. Mr. Smith reported that a 15 to 20-foot easement will be retained which would preclude access onto Monroe Avenue N.E. and a portion up to the cul-de-sac, and would serve a dual purpose to �e access onto the streets and retain the trees as well . ive.�10c4+3- Mr. Bigbie stated that the restrictions will assure that most of the vegetation will remain if the final plat is approved at a later date , and that the applicant was amenable to the request. The hearing on Item #R-007-77 was closed at 9 : 20 a.m. by the Examiner. FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1 . The Planning Department report accurately sets forth the issues , findings of fact, applicable policies and provisions and department recommendations in this matter, and being uncontested is hereby attached as Exhibit #1 and is incorporated into this report by reference as is set forth in full herein. 2 . A final Declaration of Non-Significance was approved by Gordon • Y. Ericksen, responsible official , on January 28 , 1977. 3. The land use and zoning in the area is primarily single-family residential with the exception of several churches within one- quarter mile of the site. The request is compatible with the character of the area and the Comprehensive Land Use Plan. • 4 . All public services are immediately available, 5 . The previous history of potential rezoning of this property to. zones other than single-family residential has met with considerable objection from property owners in this area. 6 . Mr. Bigbie , representative for the applicant., stated that he concurred with the staff report and recommendation, CONCLUSIONS : 1 . Ordinance No . 3071 , Section 4•--3014 (b) , states that the property is potentially zoned for the reclassification being requested pursuant to the policies set forth in the Comprehensive Land Use Plan and conditions have been met which would indicate the change is appropriate . 2 . The Land Use Report 1965 , Page 11 , Residential , states : "The successful utilization of land for low density residential development will depend on the availability of easily accessible areas which are relatively free of recurring or potential hazards such as floods , slides , and land subsidence . Residential districts should be free of manufacturing or commercial uses which would be detrimental to the community and its residents , The R-007-77 Page Three 2 . (continued) natural features and amenities that may exist or can be developed should be utilized to best advantage for the use and benefit of the community. Convenience to place of employment, shopping districts , schools , parks and other cultural activities should be inherent features of the location. " 3 . The applicant has agreed to a green belt easement on the northern, southern and western property lines . These easements are to be included as restrictive covenants on a proposed plat. Maintenance of this buffer will provide a physical buffer between the proposed new development and Monroe Avenue N.E. , an adjacent arterial , and from encroaching residential development. This is one of the last remaining heavily wooded tracts available for development, and with proper planning and selective cutting could result in one of the more attractive developments in the area. • 4 . The application is consistent with the goals , policies and location criteria for residential areas as stated in the Comprehensive Land Use Plan and the Land Use Report. RECOMMENDATION: Approval of the requested rezone subject to the conditions as stated in the Planning Department report to the Hearing Examiner as set forth in Exhibit #1, Section P : "Recommend approval of the rezone request subject to the retention of the existing natural vegetation on the site until subdivision and development. At such time as much significant trees and vegetation as possible will be incorporated into the development plans . Possibly restrictive covenants should be provided to ensure retention of the significant trees, especially around the north, west and south perimeters of the site.
