The 25,380 sq. ft. (0.58 acres) parcel is located in the Residential-8 (R-8) zone and is developed with a single-family home. To make the repairs, the applicant proposes to remove a portion of the spa area at the northwest corner of the pool and perform work including replacement of waterline tile and precast coping, filling of cracks, and adding a plaster finish overlay. The shape and size of the pool would remain largely the same it currently exists. The electric pool cover would be installed on south side of the pool on top of a paved portion of the site. All work would occur landward of the ordinary high water mark (OWHM) with a total estimated cost of $53,000.00. Work would occur within Lake Washington, a Shoreline of Statewide Significance, approximately 32 feet from the OHWM. The project site is located within the Shoreline Residential designation of Lake Washington, Reach D. No vegetation or trees are proposed for removal and no new impervious surface would be added as a result of the project. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment. RMC 4-9-190C.1.f Construction of Single Family Residence and Accessory Buildings: Construction on shorelands by an owner, lessee or contract purchaser of a single family residence for his own use or for the use of his family, which residence does not exceed a height of thirty five feet (35') above average grade level as defined in WAC 173-27-030 and which meets all requirements of the State agency or local government having jurisdiction thereof, other than requirements imposed pursuant to this Section. i. “Single family” residence means a detached dwelling designed for and occupied by one family including those structures and developments within a contiguous ownership which are a normal appurtenance. An “appurtenance” is necessarily connected to the use and enjoyment of a single family residence and is located landward of the OHWM and/or the perimeter of a wetland. ii. Construction authorized under this exemption shall be located landward of the OHWM. Staff Comment: The proposal to repair of the existing swimming pool would qualify as an Exemption from a Shoreline Substantial Development Permit under the allowance for Maintenance and Repair as the repair of major cracks, replacement of waterline tile and precast coping, and removal of the spa area to reduce overall settling will return the pool to a state comparable to the original condition . The installation of the pool cover would qualify as an Exemption from a Shoreline Substantial Development Permit under the allowance for the Construction of Single Family Residence and Accessory Buildings, as the pool is a landward structure/development within the contiguous ownership and a normal appearance of a single -family home. The repair would also be categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197 -11-800(3) Repair, remodeling, and maintenance activities. The proposal would result in no net loss of ecological functions and values on the project site. FINDINGS: The proposed development is: i. Consistent with the policies of the Shoreline Management Act: and ii. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on May 16, 2023. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
