SHINPOCH • MAYOR May 17, 1983 • Hillis Homes 826 SE Everett Mall Way Everett, WA 98204 RE: Weatherwood #2/Fencing Requirement Gentlemen: The approval of the preliminary plat for Weatherwood #2, File No. PP-149-78, issued on May 16, 1978, required that a fence and as much landscaping as possible be located along the southerly property line per approval of the Planning and Public Works Departments. Several building permits have been issued along the southerly property line without provisions for compliance with this requirement. Please submit a detailed plan showing construction of the fence and the width of the landscaping area adjacent to the fence for approval by the Building and Zoning Department. Since the fence was a condition of the preliminary plat and the requirement has not been complied with, there is a question whether the City can legally issue anymore building permits on the site or issue a certificate of occupancy. I I . i ( May 16, 1978 OFFICE OF THE LAND USE HEARING EXAMINER CITY OF RENTON REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL. APPLICANT: Gene O. Farrell - Weatherwood No. 2 FILE NO. PP-149-78 E-170-78 E-171-78 LOCATION: East side of Edmonds Avenue Northeast between Northeast 23rd Street and the existing Aloha Ranch Subdivision. SUMMARY OF REQUEST: Applicant requests approval of a proposed 35-lot preliminary plat and exceptions to the subdivision ordinance to (1) eliminate the requirement for off-site improvements along Northeast 23rd Street, and (2) permit a cul-de-sac exceeding the maximum length of 500 feet. SUMMARY OF Planning Department: Approval subject to conditions. RECOMMENDATION: Hearing Examiner: Approval subject to conditions. • PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on May 3, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application,, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 9, 1978 at 10:55 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Preliminary Plat Map with staff comments • Exhibit #4: Preliminary Plat Map as submitted Exhibit #5: Street Profile Mr. Smith amended Section P.1 and P.2 of Exhibit #1 to include Planning Department approval of provision of'additional lot width on Lot No. 35 and provision of minimum 80-foot lot depth for Lot No. 16. He also added a recommendation to Section P.4 to include consideration for reduction of impact of drainage to adjacent residents. He noted that inclusion of distribution of remaining area of Lot No. 14 to lots within the bubble of the cul-de-sac should be added to the final paragraph of the Planning Department recommendation contained in Exhibit #1. The Examiner noted that Exhibit #1 did not contain the Declaration of Non-Significance referenced by Mr. Smith in his presentation. Mr. Smith submitted the document which was labeled Exhibit #6 by the Examiner. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Jack Ewing 638 S. Central Kent, WA 98031 Mr. Ewing indicated his concurrence but wished to comment on additional matters pertaining to the development. He questioned whether installation of fire hydrants would be required along N.E. 23rd Street south of the subject site and advised that hydrants and water mains would be included throughout the plat. He reported concurrence with the proposed extension j PP-149-78 Page Two E-170-78 E-171-78 of Harrington Place N.E. from the south property line to the proposed street, but requested consideration of installation of fencing and landscaping strip in lieu of curbs, gutters and paving along N.E. 23rd Street to mitigate visual impact resulting from location of back yards of newly constructed homes abutting front yards of existing residences on the subject street. In response to earlier discussion regarding curbing, Mr. Ewing indicated that roll curbing would be installed. He also requested consideration of elimination of the planter strip in order to locate the sidewalk adjacent to the curb and gutter on Harrington Place N.E. to be extended to the south in order to reapportion the area to Lots No. 15 through! 35 and re-establish Lot 14 which had been previously eliminated. The Examiner asked for testimony in support of the application. There was no response. The Examiner then asked for testimony in opposition to the request. Responding was: Gary Dubois 2729 N.E. 24th Street Renton, WA 98055 Mr. Dubois requested clarification of Building Division comments included in Exhibit #1 regarding impact of septic failure on residents of the new plat. The Examiner felt that, the comment related to residences in the new plat and not to existing residences. Mr. Dubois indicated that because the grade along N.E. 24th Street is below the proposed plat such failures in the new plat would not occur but review should be made regarding impact to existing residences at the eastern end of N.E. 24th Street on the southern side to protect these homes from erosion and drainage during and after development. He noted that his backyard contains a steep downward slope from the proposed plat. He requested that sewer connection be accomplished to the south instead of to the north because of impact on the existing streets which are in good condition and existing traffic along N.E. 24th Street. Mr. Dubois also requested'paving of Harrington Place N.E. to the south to accommodate significant increase in traffic as a result of the development. Responding was: C. J. Straub 2739 N.E. 24th Street Renton, WA 98055 Mr. Straub indicated his concurrence in Mr. Dubois' testimony. He advised that the grade in the backyard of his residence, located at the eastern end of the cul-de-sac on N.E. 24th Street, is approximately 15 feet lower than the grade of the proposed plat. He noted concerns regarding existing 75 to 100-foot tall evergreen trees located near the property line of the proposed plat abutting his back yard which would endanger existing residences if damaged by construction or adverse weather. He also inquired if the platted property would be graded to the elevation of existing backyards, if existing residents would be required to participate in a proposed Local Improvement District, and if the proposal would contain only single family residences. The Examiner requested clarification of Mr. Straub's request regarding the existing evergreen trees. Mr. Straub clarified thatl certain trees which jeopardize property should be removed. He also reported an existing situation in which motorcycles utilized the proposed site for recreational purposes and inquired if the noise level would increase in the future. He also referenced a previous conversation with the Examiner in which the noise level was discussed. The Examiner reported that the referenced telephone conversation did not pertain to the subject application but questioned whether the application had been received. Since it had not, the Examiner indicated that the conversation had terminated. In response to Mr. Straub';s inquiry regarding single family residences, the Examiner reported that since the property was zoned G-7200, single family residential, a rezone would be required to increase the density on the site. Responding was: Ann Berry 2725 N.E. 23rd Renton, WA 98055 Mrs. Berry referenced a letter and petition submitted prior to the hearing. Mr. Smith I read the letter into the record and it was labeled Exhibit #7 by the Examiner. The letter, signed by 13 residents located on N.E. 23rd Street and Harrington Place N.E. , contained objections to backyards of the residences in the proposed development facing front yards of existing residences on N.E. 23rd Street which would reuslt in an impact on property values and' create an alley-way situation which currently did not exist in other areas of Renton or other cities. Mrs. Berry reiterated information contained in the exhibit and requested that N.E. 23rd Street be paved and improved to accommodate additional traffic and encourage safety for children who currently utilize the unimproved roadway for play. PP-149-78 Page Four E-170-78 E-171-78 The Examiner asked Mr. Smith if final drainage plans had been approved by the Public Works Department. Mr. Smith indicated that although final plans had not yet been submitted, the preliminary plans had been approved. Mr. Ewing confirmed Mr. Smith's statement that a conceptual plan containing a street profile and provisions for utilities had been submitted and was acceptable to the Engineering Division. Mr. Smith noted that the Engineering Division had commented in the staff report that storm water retention provisions would be required. The Examiner asked Mr. Smith to reiterate Planning Department recommendations added to the final paragraph of Section P of Exhibit #1 regarding review by the Public Works Department of distribution of Lot No. 14 within the proposed plat. Mr. Smith advised that the recommendation would be subject to Public Works Department approval and noted that the Planning Department had recommended deletion of the lot and reapportionment of the property to other lots located in the bubble of the cul-de-sac limiting the total number of lots contained in the plat to 34. Mr. Ewing indicated that the applicant had intended to retain a 35-lot configuration. The Examiner asked Mr. Smith if review of the 35-lot proposal had been reviewed with the applicant. Mr. Smith indicated that review had not occurred to date. Responding to the Examiner's inquiry regarding receipt of specific data relating to the noise level from the existing gravel pit area within the site, Mr. Smith indicated that removal of the existing trees would increase noise on the site, but the city maintained no control over the pit area in the proposed plat. He advised that the noise level would diminish as single family residential development occurs on the site and that the department did not consider the increase in noise significant. The Examiner inquired, if improvements along N.E. 23rd Street were a requirement of Chapter 11, Subdivision Ordinance. Mr. Smith indicated that improvements were a requirement of the ordinance, but previous comments related to improvements to Harrington Place N.E. south of the subject site which were not required. The Examiner stated that the question of connection of the sewer system to the south or north remained unresolved. Mr. Smith advised that the decision would be contingent upon the final design of the proposed system approved by the Engineering Division. The Examiner asked Mr. Smith for additions, corrections or modifications to Exhibit #1. Mr. Smith indicated that the report would remain as submitted and previously modified with the exception of Section P.5 concerning retention of existing trees which would be reviewed by the Planning Department for the purpose of maintaining safety for residents located to the north of the proposed plat. He also advised that drainage plans should be designed to prevent impact to the existing lots to the north and final review subject to Public Works Department approval. He also noted a recommendation for Traffic Engineering Division review of the necessity for stop signing or other safety devices at Harrington Place N.E. and N.E. 23rd Street. The Examiner inquired if proposed traffic control devices would be considered normal city traffic safety improvements, but not a requirement of the proposed development. Mr. Smith discussed recommendations for stop signing at the proposed cul-de-sac connection to Edmonds Avenue along with installation of a similar stop sign at the connection to N.E. 23rd Street and the stub extension. The Examiner noted that such devices could be reviewed and contained in the final plat application for public hearing. The Examiner asked for further comments. Since there were none, the hearing on File No. PP-149-78, E-170-78 and E-171-78 was closed by the Examiner at 12:05 p.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a preliminary plat of 35 lots; an exception, from the off-site improvements; and an exception for a cul-de-sac over 500 feet in length. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official (Exhibit #6) . { PP-149-78 Page Three E-170-78 E-171-78 The Examiner asked a representative from the Engineering Division to respond to previous inquiries relating to access and sewers. Responding was: Don Monaghan, Office Engineer Public Works Department The Examiner affirmed Mr. Monaghan and reiterated the applicant's inquiry regarding the 1 loop roadway between the development and N.E. 23rd Street and Harrington Place N.E. Mr. Monaghan reported that a 50-foot roadway would be required. Responding to the Examiner' inquiry regarding requirements for participation of existing residents in an L.I.D. , Mr. Monaghan indicated that such participation would be optional and not required. The Examiner asked Mr. Monaghan to respond to the applicant's proposal for elimination of curbs and gutters in lieu of installation of landscaping strip and fencing on N.E. 23rd Street. Mr. Monaghan indicated that although the proposal had not previously been reviewed or discussed with the applicant, the Engineering Division would consider and review the proposal in future discussions. The Examiner asked Mr. Smith for comments. Mr. Smith advised that provision of curbs and gutters should be considered an improvement to the properties along N.E. 23rd Street, and in lieu of sidewalks, landscape planting and fencing could utilize that area. He noted that the Subdivision Ordinance does not provide authority to require improvements that are either part of the plat or in the right-of-way abutting the property such as the roadway of Harrington Place N.E. further south of the property. He noted that the Planning Department had recommended that drainage plans be designed to prevent impact to the existing lots to the north, and connection either to the south or north would be a matter of design proposals and capacity of the sewer system, although he noted that the Public Works Director had recommended connection to the north. Mr. Monaghan advised that connection to the south would be acceptable. Responding to inquiries earlier in the hearing, Mr. Smith advised that excavating the proposed lots to the existing grades of lots located 1 on N.E. 24th Street would not occur, and removal of specific hazardous evergreen trees would be reviewed with residents, although retention of existing vegetation was normally ! encouraged to provide visual buffering in the area. The Examiner asked the appliant if he wished to comment. Mr. Ewing corrected Mr. Smith's', earlier statement regarding installation of fencing and landscaping in lieu of sidewalks in addition to curbs and gutters. He stated that it was not the applicant's intent to install curbs, gutters or sidewalks. Responding to objections and statements contained in Exhibit #7, letter and petition, Mr. Ewing reported that a similar situation exists in the Cascade Shopping Center on the eastern side of 116th Street and had been mitigated,' with installation of fencing, grading and landscaping. He advised that all clearing of 1 trees and grading would be approved by the City of Renton. He reiterated an earlier inquiry regarding installation of hydrants along N.E. 23rd Street. Mr. Monaghan reported that the requirement would not be necessary if adequate coverage was provided by location of hydrants within the plat although interconnection with the water main may be required. The applicant requested permission to testify. Responding was: Gene Farrell 11112 Rainier Avenue South Seattle, WA 98178 Mr. Farrell clarified earlier inquiries and stated that minimum grading would occur on the site, and the projected value of the proposed homes would be in the range of $75,000 to, $85,000 with some in excess of $100,000 which would substantially increase the property value of existing surrounding residences. He reported that although he opposed the 1 extension of Harrington Place N.E. , he concurred with the Planning Department recommendation for the extension but noted that the project would incur additional expense to the applicant for a roadway that would accommodate only a minimal amount of traffic. He objected to recommendations from Mr. Dubois for improvement and paving of Harrington Place N.E. to the south, noting economic hardship and insignificant increase in traffic resulting from the proposed development. He reiterated Mr. Ewing's comments relating to excavation, removal of trees, and emphasized that all matters would be reviewed by appropriate departments of the City of Renton. The Examiner asked for further comments. Responding was: Wilhelm 0. Heisinger 2801N.E. 23rd Street Renton, WA 98055 1 Mr. Heisinger objected to the proposal because of possible increase in traffic and creatiion of safety hazards. He also noted hazards associated with exposed roots of tall evergreen! trees adjacent to the proposed plat. • PP-149-78 Page Six E-170-78 E-171-78 6. N.E. 23rd Street is a right-of-way of 40 feet (Exhibit #2) which is 20 feet less than the normal city street per Section 9-1108.7.H. Improvement of one-half of the street would consume 27 feet (60-foot right-of-way; pavement, curb, gutter, planter strip and sidewalk) . The standards for a 50-foot right-of-way would be 25 feet of half-street improvements. In view of the restricted right-of-way it can be concluded that all of the normal street improvements cannot be constructed therein. Of first priority appears to be a pavement of 32 to 36 feet in width (16 to 18 feet for a half-street) to safely accommodate traffic (Section' 9-1108.7) . The remaining 4 to 8 feet can be used for the minimum 5-foot sidewalk (Section 9-1108.7.H) and some landscaping on only one side of the street. Since the applicant will be closing off direct access from his lots to N.E. 23rd Street, it seems reasonable that the sidewalk should be located on the south side of the street for the benefit of the existing residences. It is also reasonable that the applicant should not be obligated to provide these improvements at that location. These aforementioned special and unusual circumstances (including Conclusion No. 5) would indicate unusual and unreasonable hardship would accrue to the developer to improve the south side of N.E. 23rd (Section 9-1109.1) . Although this may not preclude the use of his land (Section 9-1109.1.A) the economics involved may be unbearable. No rights or privileges of the applicant have been abridged (Section , 9-1109.1.B) , but an unreasonable burden may occur to him. Not requiring the sidewalk improvement on the north side of the street will apparently not injure the public or other properties (Section 9-1109.1.C) . Conversely, other properties may be damaged if sufficient room is not available for future construction of a sidewalk along the south side of N.E. 23rd. Therefore, the exception should be granted to not require the applicant to construct a sidewalk specified in Section 9-1108.7.H. Dedication of additional right-of-way was not recommended by staff. 7. However, as the applicant stated, a fence should be constructed along the south property line per approval of the Planning Department. The half-street improvements should be constructed in the optimum location and of a dimension as specified by the Public Works Department. As much landscaping space as possible should be provided between the curb and the fence per the Planning and Public Works Departments. 8. Careful handling is required of existing trees on the site, particularly on the easterly one-half. Trees remaining after clearing of areas for roads and building sites may not be able to withstand the wind velocities experienced in the past. Therefore, trees should only be removed upon approval of the Planning Department to preclude any damage to existing residences. 9. The Traffic Engineering Division should study the need for traffic control devices on N.E. 23rd Street and install the devices accordingly. 10. The applicant's request to recover the loss of Lot No. 14 (due to the through roadway connection) by reducing the right-of-way by 5 feet (width of sidewalk) was not supported. No justification was provided the Examiner for review of this request. It is obvious that some economic loss may occur, but undue hardship was not alleged. RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the Examiner's recommendation that the City Council approve the preliminary plat of Weatherwood No. 2 subject to: 1. Revision of Lots No. 16 and 35 per Exhibit #3 and approval of the Planning Department. 2. Provision of a 50-foot right-of-way street connection from the proposed street to Harrington Place N.E. per Exhibit #3 and approval of the Public Works Department. 3. Approval of storm drainage plans by the Public Works Department. 4. No clearing, grading or cutting of trees except as approved by the Planning Department to insure the safety of adjacent residences. 5. No grading of the northerly 25 feet of the property. 6. Construction of a fence and as much landscaping as possible along the southerly property line per approval of the Planning and Public Works Departments. PP-149-78 Page Five E-170-78 E-171-78 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. All existing utilities are available and in close proximity. Sanitary sewers exist within 1000 feet. 6. The proposal is compatible with the required setbacks, lot coverage and lot area requirements of Section 4-706 (R-1) and 9-1108.23.F (Subdivision. Ordinance) , of Title IV, Ordinance No. 1628, Code of General Ordinances; except Lot No. 35 must be expanded to be larger than interior lots and Lot No. 16 must be expanded to the 80-foot minimum lot depth. 7. The applicant agreed to the staff recommendation of a connection of the proposed cul-de-sac to existing N.E. 23rd Street at Harrington Place N.E. This renders unnecessary the requested exception to permit a cul-de-sac of more than 500 feet in length. According to testimony from the Public Works Department this roadway right- of-way would be 50 feet, but the applicant preferred 45 feet of right-of-way in order to recover the loss of Lot No. 14 through which the road passes. 8. N.E. 23rd Street abuts what will be the rear yard of the proposed lots. In lieu of the normal off-site improvements in this street of curb, gutter, planter strip and sidewalk, the applicant proposes rolled curb, planter strip and fence. The existing improvements in N.E. 23rd Street consist of only paving. 9. The storm drainage plan has not been finally approved by the Public Works Department) 10. Restrictive Covenants were not submitted. 11. The proximity of the proposed road .(onto Edmonds Avenue N.E.) to N.E. 23rd and N.E. 24th Streets appears to be acceptable from the comments in the staff report, Exhibit #1. 12. The proposed street meets the minimum requirements of Section 9-1108.7 (Subdivision Ordinance) . 13. Significant trees exist in the site, predominantly on the easterly one-half of the property. Residents along the northern property line expressed concern that any clearing of the trees may weaken and cause to fall the large trees adjacent to their property. The applicant expressed a willingness to have the Planning Department control retention and cutting of the trees. It was apparent that because of the danger during storms that some trees would require removal as a result of clearing operations for the road and building sites. 14. The easterly one-third of the site contains an average grade of about 8 to 10%. This portion of the site lies above the elevation of the northerly abutting residences. The applicant stated that the existing grade at the mutual property line would remain undisturbed to prevent impact upon these residences. 15. Traffic control problems have been experienced on N.E. 23rd and Harrington Place N.EJ This is not as a result of the proposal but is a matter for the Traffic Engineering Division of the Public Works Department. CONCLUSIONS: 1. The proposal conforms to the goals and objectives of the Comprehensive Plan. 2. The proposal appears to serve the public interest, health, safety and welfare (Section 9-1106.2.E. (2) ) provided certain conditions are met. 3. Sufficient land area exists to expand Lots No. 35 and 16 per Finding No. 6 and Exhibit #3. 4. The connection of the proposed road and N.E. 23rd Street should occur to provide better access for future residents of the subdivision and public safety vehicles. 5. It is somewhat unusual, but not unprecedented, for the southerly lots of the plat to be located between two streets. The narrow configuration of the applicant's property creates this unusual situation which poses few alternatives for development of a subdivision. In reality, the proposed lots could access from either street, but the applicant has chosen to keep access within the plat by a fence along N.E. 23rd Street. This fence should alleviate neighborhood concerns about the visual impact of the future residences of the subdivision. PP-149-78 Page Seven E-170-78 E-171-78 7. Inclusion of Conditions No. 4 and 5 in restrictive covenants for submittal with the final plat application. The Examiner also decides to approve an exception from the requirement to construct a sidewalk along N.E. 23rd Street. The location of all other off-site improvements in the northerly half of N.E. 23rd Street will be determined by the Planning and Public Works Departments. There are however, sewers closer than 1000 ft. buLa lift station would be needed if this sewer was to be used for this project. It is also requested that no improvements be required by this developer for--the existing NE 23rr3 .Street. There will he no benefit to the subject property since all lots will face on, the new street (NE 23rd Place). The developer would also like an exception for the length of the Cul-de- sac. If a road connection to Harrington Place was provided it would be quite steep and detract from.a very private neighborhood with oversize lots and expensive homes. It is possible to make this connection but it is felt that it would be a detriment to the overall plat.
