Marenakos (Sunset Addition) FILE NO. PP-155-78 E-156-78 LOCATION: Southwest corner of N.E. 14th Street and Edmonds Avenue N.E. SUMMARY OF REQUEST: Applicant requests approval of a proposed 19-lot single family preliminary plat and an exception to the Subdivision Ordinance to allow a 20-foot pipestem road to provide access to the proposed plat. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: • Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on April 26, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 2, 1978 at 10:15 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. The Examiner disclosed previous association with the representative for the applicant, Mr. Del Bennett, during his previous tenure as Deputy Public Works Director, and advised that the association had not prejudiced his ability to review the subject application. The Examiner requested comments or objections from parties in attendance to proceeding with the hearing upon receipt of the disclosure. There was no objection. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Preliminary Plat Map with staff comments Exhibit #4: Preliminary Plat Map as submitted Exhibit #5: Memorandum to Rick Beeler from Jim Hanson, Building Division, dated April 27, 1978 Exhibit #6: Memorandum to Rick Beeler from Ron Olsen, Utility Engineering Division, dated April 28, 1978 Exhibit #7: Staff comment from Fire Chief Richard Geissler, dated May 1, 1978 Exhibit #8: Preliminary Plat Map with Utility and Engineering Division comments Mr. Smith reported revisions noted in Exhibits #5, #6, and #7 to previous departmental comments attached to Exhibit #1 as follows: Building Division recommendation revised to approval subject to payment of drainage plan check fee at the time of submittal of the final drainage plan; Utility Engineering Division recommendation revised to approval with recommendation for plans to be submitted for approval prior to construction; and Fire Department recommendation revised to approval with requirement for additional fire hydrants installed prior to construction. PP-155-78 Page Two E-156-78 Mr. Smith noted revisions on Exhibit #8 reflected a computation of 620.61 feet between the monument located at the corner of N.E. 16th Street and Edmonds Avenue N.E. and the monument located at the corner of N.E. 14th Street and Edmonds Avenue N.E. in lieu of the approximate 590 feet reflected on the plat map as submitted by the applicant. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: Del Bennett 18004 S.E. 147th Renton, WA 98055 Mr. Bennett, the purchaser and developer of the property, indicated his concurrence in the report. He advised that a final decision had not yet been made on disposition of the unimproved portion of N.E. 14th Street which is presently partially barricaded on the easterly side, serves as access to one single family residence, and provides access for parking for an existing apartment building. He noted that it would not be reasonable or feasible to improve that portion of the right-of-way to city standards which would include installation of curbs, gutters, sidewalks and paving, and the applicant would either initiate a vacation of the north 30 feet of N.E. 14th Street or apply for an exception to the Subdivision Ordinance depending upon the outcome of discussions with the Public Works Department regarding the matter. The Examiner asked for testimony in support or opposition to the request. There was no response. Since a representative from the Engineering Division was not available to testify in response to the Examiner's inquiries regarding storm drainage and status of N.E. 14th Street, the Examiner advised that written responses would be required from the divisions prior to rendering a decision on the matter. Regarding storm drainage, Mr. Bennett advised that a study would be made to determine whether an existing 18-inch, storm sewer on the western boundary of the property could accommodate storm water runoff on the site in compliance with the city's current storm sewer ordinance. He noted that the city's ordinances allow for either open pond detetention or underground pipes to meet storm water drainage requirements even though certain members of staff had previously disfavored an open pond method of retention, and suggested that the existing ordinance be revised to preclude this method if staff disallowed its use. He reported that a storm drainage plan is currently being prepared by his engineer which would designate connection to the existing 18-inch storm sewer system but it was undetermined whether above ground or underground retention would be acceptable. He emphasized that all plans would be in conformance to existing city ordinances. The Examiner asked Mr. Smith if city street names had been designated on Exhibit #3, preliminary plat with staff comments. Mr. Smith responded affirmatively. The Examiner reiterated previous statements relating to receipt of written responses to, his inquiries regarding storm drainage and N.E. 14th Street from various city departments to be incorporated into the record in the matter, and asked parties of record if they were amenable to the proposal. There was no objection. The Examiner asked for final comments. Since there were none, the hearing on File No. PP-155-78 and E-156-78 was closed at 10:45 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a preliminary plat of 19 single family lots in an R-1 zone and approval of an exception to allow one pipestem lot. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and department recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. i 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. PP-155-78 Page Three E-156-78 6. All existing utilities are available and in close proximity. 7. The proposal (Exhibit #4) is compatible with the required setbacks, lot coverage and height requirements of Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances; except that Lot No. 11 is less than 7200 square feet (minimum area) and the corner lot (Lot No. 17) should be enlarged to conform to Section 9-1108.23.F. (4) . 8. A house exists on Lot No. 18 and will remain. 9. One pipestem lot (Lot No. 8) is proposed and an exception requested per Section 9-1109. The "foot" configuration of the southwestern•portion of the total site (where Lot No. 8 is located) creates an unusual situation for planning lots (Section 9-1109.1.A) . Disapproval of the exception would impose difficulty upon the development of the "foot" of the property. Interference was not alleged of the applicant's ". . .rights and privileges enjoyed by other properties in the vicinity. . . " (Section 9-1109.1.B) . Development of the "foot" would proceed but perhaps at a density of two instead of the three proposed lots. The exception will not produce detriment to the public or adjacent properties (Section 9-1109.1.C) . 10. A discrepancy in Exhibit #4 was discovered that provided an additional 30 feet of property at the north (Exhibit #8) . 11. City street names are indicated on Exhibits #3 and #8. N.E. 16th Street and Edmonds Avenue N.E. abut the property. Access is proposed via an approximate 480- foot cul-de-sac to N.E. 16th Street. N.E. 14th Street is a barricaded street permitting only limited access to development south of the street. 12. Tract A has been designated for storm water retention. An 18-inch storm sewer exists on the western boundary of the property (Exhibit #8) . Per the attached memorandum of May 9, 1978, the Director of the Public Works Department indicated that insufficient storm drainage plans had been submitted for review. 13. The proposal complies with the provisions of Section 9-1106.2. 14. The site has been graded. 15. Restrictive covenants were not submitted. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan. 2. The proposal appears to serve the public interest, health, safety and welfare (Section 9-1106.2.E. (2) ) . 3. Lot No. 11 should be expanded, perhaps per Exhibit #3. 4. Lot No. 17 should be expanded to be larger than the interior lots per Section 9-1108.23.F. (4) . 5. The pipestem configuration of Lot No. 8 is acceptable per the aforementioned Finding No. 9 and Section 9-1109. 6. Exhibit #4 should be revised to incorporate the additional northerly 30 feet of / property. 7. The status of N.E. 14th Street should be resolved. Since this does not impact the proposal significantly, except perhaps to add property to Lot No. 10, this issue can be resolved prior to, during or after review of the final plat. Per the attached memorandum of May 9, 1978, the Director of the Public Works Department recommended filing a street vacation request for review by the City Council. 8. Storm drainage plans should be submitted for approval by the Public Works Department prior to construction of improvements on the property. A surface storage or closed drainage system appears to be available. Each may impact improvements in different ways. 9. Restrictive covenants, if any are proposed, should be submitted with the final plat application. PP-155-78 Page Four E-156-78 RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the Examiner's recommendation that the City Council approve the preliminary plat subject to: 1. Expansion of Lot No. 11 to include at least 7200 square feet. 2. Expansion of Lot No. 17 per Section 9-1108.23.F. (4) . 3. Revision of Exhibit #4 to include the additional northerly 30 feet and city designated street names per Exhibit #8. 4. Submittal of restrictive covenants with the final plat application. 5. Submittal of final drainage plans for approval of the Public Works Department prior to construction of on-site improvements. 6. Compliance with all applicable provisions of Chapter 11 and staff comments on Exhibit #8. It is the decision of the Examiner to approve the pipestem configuration of Lot No. 8. The proposed single family residential plat is compatible with the Comprehensive Plan , existing zoning , and land uses in the general vicinity. 2 . The G-7200 zone requires a minimum lot size of 7200 square feet. The lots generally meet this minimum requirement. However, lot 11 is only approximately 6800 square feet and will require additional area to meet the minimum lot size requirements . 3. Lots 16 and 17 have been reduced in size from that indicated on the tentative plat because of the location of the existing house to the east. Although these lots meet minimum size requirements , they should be enlarged. This is particularly important on the corner lot, which should be platted larger (both area and dimensions ) than interior lots (Section 9-11108. 23 . F (4) ) . 4 . The 60 foot right-of-way of N . E .- 14th Street presently abuts the southeast corner of the subject site. This creates a, "double-front" 1for lots 9 and 10, with the necessary 20 foot front yard setback required along the portion of the easterly line of lot 9 abutting the right-of-way. A 25 foot rear yard is required for the portion of lot 10 abutting N . E . 14th Street. ' 5 . N. E. 14th StreTt then turns directly south and extends ±2'50 feet as a 30 foot right-of-way. This minimally improved road serves r; as access to only one house. It may be appropriate to vacate all or part of ; this right-of-way abutting the subject plat. 6 . Proper utilities are available to the subject site . 7 . Drainage retention ' will be provided on Tract A of the subject site . The existing house on the subject site at the corner of NE 16th Street and Edmonds Avenue NE must be accurately shown on the plat map. The house must meet required side and rear yard setbacks . If possible lot 18, a corner lot, should be widened along Edmonds Avenue NE. 3. It will be necessary to apply in writing for an Exception to the Subdivision Ordinance per Sections 9-1108. 23. F. 3..(d ) and 9-1109 for the proposed pipestem lot. The minimum pipestem width is twenty (20) feet. 4. Lots 9 and 10 double-front onto NE 14th Street, a public right- of-way. SUMMARY OF REQUEST: Applicant requests approval of a proposed 19-lot single family preliminary plat and an exception to the Subdivision Ordinance to allow a 20-foot pipestem road to provide access to the proposed plat. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on April 26, 1978. PUBLIC HEARING: After reviewing, the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 2, 1978 at 10:15 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. The Examiner disclosed previous association with the representative for the applicant, Mr. Del Bennett, during his previous tenure as Deputy Public Works Director, and advised that the association had not prejudiced his ability to review the subject application. The Examiner requested comments or objections from parties in attendance to proceeding with the hearing upon receipt of the disclosure. There was no objection. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Preliminary Plat Map with staff comments Exhibit #4: Preliminary.Plat Map as submitted Exhibit #5: Memorandum to Rick Beeler from Jim Hanson, Building Division, dated April 27, 1978 Exhibit #6: Memorandum to Rick Beeler from Ron Olsen, Utility Engineering Division, dated April 28, 1978 Exhibit #7: Staff comment from Fire Chief Richard Geissler, dated May 1, 1978 Exhibit #8: Preliminary Plat Map with Utility and Engineering Division comments Mr. Smith reported revisions noted in Exhibits #5, #6, and #7 to previous departmental comments attached to Exhibit #1 as follows: Building Division recommendation revised to approval subject to payment of drainage plan check fee at the time of submittal of the final drainage plan; Utility Engineering Division recommendation revised to approval with recommendation for plans to be submitted for approval prior to construction; and Fire Department recommendation revised to approval with requirement for additional fire hydrants installed prior to construction. PP-155-78 Page Two E-156-78 Mr. Smith noted revisions on Exhibit #8 reflected a computation of 620.61 feet between the monument located at the corner of N.E. 16th Street and Edmonds Avenue N.E. and the monument located at the corner of N.E. 14th Street and Edmonds Avenue N.E. in lieu of the approximate 590 feet reflected on the plat map as submitted by the applicant. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: Del Bennett 18004 S.E. 147th Renton, WA 98055 Mr. Bennett, the purchaser and developer of the property, indicated his concurrence in the report. He advised that a final decision had not yet been made on disposition of the unimproved portion of N.E. 14th Street which is presently partially barricaded on the easterly side, serves as access to one single family residence, and provides access for parking for an existing apartment building. He noted that it would not be reasonable or feasible to improve that portion of the right-of-way to city standards which would include installation of curbs, gutters, sidewalks and paving, and the applicant would either initiatq a vacation of the north 30 feet of N.E. 14th Street or apply for an exception to the Subdivision Ordinance depending upon the outcome of discussions with the Public Works Department regarding the matter. The Examiner asked for testimony in support or opposition to the request. There was no response. Since a representative from the Engineering Division was not available to testify in response, to the Examiner's inquiries regarding storm drainage and status of N.E. 14th Street, the Examiner advised that written responses would be required from the divisions prior to rendering a decision on the matter. Regarding storm drainage, Mr. Bennett advised that a study would be made to determine whether an existing 18-inch storm sewer on the western boundary of the property could accommodate storm water runoff on the site in compliance with the city's current storm sewer ordinance. He noted that the city's ordinances allow for either open pond detetention or underground pipes to meet storm water drainage requirements even though certain members of staff had previously disfavored an open pond method of retention, and suggested that the existing ordinance be revised to preclude this method if staff disallowed its use. He reported that a storm drainage plan is currently being prepared by his engineer which would designate connection to the existing 18-inch storm sewer systemm but it was undetermined whether above ground or underground retention would be acceptable. He emphasized that all plans would be in conformance to existing city ordinances. The Examiner asked Mr. Smith if city street names had been designated on Exhibit #3, preliminary plat with staff comments. Mr. Smith responded affirmatively. The Examiner reiterated previous statements relating to receipt of written responses to his inquiries regarding storm drainage and N.E. 14th Street from various city departments to be incorporated into the record in the matter, and asked parties of record if they were amenable to the proposal. There was no objection. The Examiner asked for final comments. Since there,were none, the hearing on File No. PP-155-78 and E-156-78 was closed at 10:45 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a preliminary plat of 19 single family lots in an R-1 zone and approval of an exception to allow one pipestem lot. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and department recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. PP-155-78 Page Three E-156-78 6. All existing utilities are available and in close proximity. 7. The proposal (Exhibit #4) is compatible with the required setbacks, lot coverage and height requirements of Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances; except that Lot No. 11 is less than 7200 square feet (minimum area) and the corner lot (Lot No. 17) should be enlarged to conform to Section 9-1108.23.F. .(4) . 8. A house exists on Lot No. 18 and will remain. 9. One pipestem lot (Lot No. 8) is proposed and an exception requested per Section 9-1109. The "foot" configuration of the southwestern portion of the total site (where Lot No. 8 is located) creates an unusual situation for planning lots (Section 9-1109.1.A) . Disapproval of the exception would impose difficulty upon the development of the "foot" of the property. Interference was not alleged of the applicant's ". . .rights and privileges enjoyed by other properties in the vicinity. . . " (Section 9-1109.1.B) . Development of the "foot" would proceed but perhaps at a density of two instead of the three proposed lots. The exception will not produce detriment to the public or adjacent properties (Section 9-1109.1.C) . 10. A discrepancy in Exhibit #4 was discovered that provided an additional 30 feet of property at the north (Exhibit #8) . 11. City street names are indicated on Exhibits #3 and #8. N.E. 16th Street and Edmonds Avenue N.E. abut the property. Access is proposed via an approximate 480- foot cul-de-sac to N.E. 16th Street. N.E. 14th Street is a barricaded street permitting only limited access to development south of the street. 12. Tract A has been designated for storm water retention. An 18-inch storm sewer exists on the western boundary of the property (Exhibit #8) . Per the attached memorandum of May 9, 1978, the Director of the Public, Works Department indicated that insufficient storm drainage plans had been submitted for review. 13. The proposal complies with the provisions of Section 9-1106.2. 14. The site has been graded. 15. Restrictive covenants were not submitted. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan. 2. The proposal appears to serve the public interest, health, safety and welfare (Section 9-1106.2.E. (2) ) . 3. Lot No. 11 should be expanded, perhaps per Exhibit #3. 4. Lot No. 17 should be expanded to be larger than the interior lots per Section 9-1108.23.F. (4) . 5. The pipestem configuration of Lot No. 8 is acceptable per the aforementioned Finding No. 9 and Section 9-1109. 6. Exhibit #4 should be revised to incorporate the additional northerly 30 feet of property. 7. The status of N.E. 14th Street should be resolved. Since this does not impact the proposal significantly, except perhaps to add property to Lot No. 10, this issue can be resolved prior to, during or after review of the final plat. Per the attached memorandum of May 9, 1978, the Director of the Public Works Department recommended filing a street vacation request for review by the City Council. 8. Storm drainage plans should be submitted for approval by the Public Works Department prior to construction of improvements on the property. A surface storage or closed drainage system appears to be available. Each may impact improvements in different ways. 9. Restrictive covenants, if any are proposed, should be submitted with the final plat application. PP-155-78 Page Four E-156-78 RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the Examiner's recommendation that the City Council approve the preliminary plat subject to: 1. Expansion of Lot No. 11 to include at least 7200 square feet. 2. Expansion of Lot No. 17 per Section 9-1108.23.F. (4) . 3. Revision of Exhibit #4 to include the additional northerly 30 feet and city designated street names per Exhibit #8. 4. Submittal of restrictive covenants with the final plat application. 5. Submittal of final drainage plans for approval of the Public Works Department prior to construction of on-site improvements. . 6. Compliance with all applicable provisions of Chapter 11 and staff comments on Exhibit #8. It is the decision of the Examiner to approve the pipestem configuration of Lot No. 8. The proposed single family residential plat is compatible with the Comprehensive ; Plan , existing zoning , and land uses in the general vicinity . 2 . The G-7200 zone requires a minimum lot size of 7200 square feet. The lots generally meet this minimum requirement. However, lot 11 is only approximately 6800 square feet and will require additional area to meet the minimum lot size requirements. 3. Lots 16 and 17 have been reduced in size from that indicated on the tentative plat because of the location of the existing house to the east. Although these lots meet minimum size requirements , they should be enlarged. This is particularly important on the corner lot, which should be platted larger (both area and dimensions ) than interior lots (Section 9-;1108. 23 . F(4) ) . 1 4. The 60 foot right-of-way of N . E . 14th Street presently abuts the southeast corner of the subject site . This creates a " double-front" lfor lots 9 and 10, with the necessary 20 foot front yard set1ack required along the portion of the easterly line of lot 9 abutting the right-of-way, A 25 foot rear yard is required for the portion of lot 10 abutting N . E. 14th Street. 5 . N . E . 14th Street then turns directly south and extends ±250 feet as a 30 foot right-of-way. This minimally improved road serves as access to only ,one house . It may be appropriate to vacate all or part of ; this right-of-way abutting the subject plat. 1 6 . Proper utilities are available to the subject site . 7 . Drainage retention will be provided on Tract A of the subject site. Final drainage plans should be approved by the Public Works Department , together with the question of ownership, of Tract A. MARENAKOS (SUNSET ADDITION ) 8. The proposed pipestem lot ( lot 8) will not be detrimental to adjacent properties . It is also required because of the ; irregular shape of the southwest portion of the site (Section 9- 1109 ) . However, the pipestem portion of the lot should be consistent with the standard 20 foot width , thereby allowing a slight increase in lot 9. 9 . The proposed street widths and improvements are consistent with ordinance requirements . 10. See attached comments from Public Works Department and Fire Department for further review considerations . P. STAFF RECOMMENDATION : 1 Recommend approval of, the proposed preliminary plat subject to : 1 . Increase of lot size of lot 11 to meet minimum zoning require- ments . Increase in lots 16 and 17 .
