' I SUMMARY OF REQUEST: Applicant requests approval of a 74-lot preliminary plat for • the proposed Fernwood' single family residence subdivision and approval of an exception to the Subdivision Ordinance to allow pipestem access to Lots #8 and #57. • SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Hearing Examiner on July 13, 1978. 1 PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: •The hearing was opened on July 18, 1978 at 9:50 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported. that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: • Exhibit #2: King County Assessor's Map Exhibit #3: Preliminary Plat Map with Roadway Cross-Sections • Exhibit #4: Proposed Street Profiles Referring to Section 0.13 of Exhibit #1, Mr. Smith noted that Lot #8 had been inadvertently omitted from the report and should be noted in addition to Lot #57 as proposed pipestem lots which meet ordinance requirements. • 1 Referring to Section P.7 of Exhibit #1, Mr. Smith indicated an additional recommendation for review and approval of the Planning Department to provide installation of cinder material or other type of improvements in the walkway area. He also added Section P.8, which encompasses a statement of the ordinance requirement within the pipestem lots that a minimum 10-foot paved driveway be installed as part of plat improvements along a portion of the pipestem. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: • George Cook • 16031 119th Place N.E. Bothell, WA 98011 Mr. Cook indicated his concurrence in objectives of the staff recommendation, but noted exception to the wording of Section P.2 which refers to acquisition of the City of Seattle Mercer Island pipeline right-of-way for dedication as street right-of-way along Union Avenue N.E. He advised that although there was no objection to the improvement or acquisition, a revision in the wording was requested' to allow for the possibility that acquisition. of the pipeline from the City of Seattle may not occur. He suggested an additional phrase be added to Section P.2 as follows: ". . .if mutually acceptable conditions of acquisition can be arrived at by the City of Seattle and the applicant. " He noted that the wording ;had been discussed with Public Works Department staff and would protect the applicant in PP-19 1 Page Two E-205-78 the event the City of Seattle would not relinquish the easement. i Regarding open retention method of storm water storage, Mr. Cook indicated that alternative methods of retention had been discussed with the Public Works Department staff to provide a useable recreational facility in addition to retention purposes. He reviewed a possible concept which included construction of a paved crown center area with basketball hoops at either end in which natural rainfall keeps silt free of the court area and creates a condition in which surrounding neighbors would be willing to maintain the appearance of the facility. The Examiner requested testimony in support or opposition to the request. There was no response. He asked Mr. Smith for clarification that recommendations regarding Tract B at the northeast corner of the site conform with original conditions of the rezone of the property, File No. R-117-78. Mr. Smith indicated that the recommendation had been derived from Recommendation No. 1 of that report and required dedication of the ravine area at the northeast corner of the site for open space to be determined by the Planning and Public Works Departments. Mr. Smith indicated that the requirement had been noted on the final plat map, and covenants and restrictions related to the plat map, and would also apply to the natural buffer area in Tract A. Noting the possibility that the City of Seattle may not relinquish the pipeline easement to the applicant, the Examiner inquired regarding the effect to the improvements along Union Avenue N.E. in the subject proposal. Mr. Smith indicated that the matter should be referred to the Public Works Department. Mr. Cook reported that discussions with departmental staff had indicated concern regarding acquisition of the easterly 30 feet p of the Mercer Island Pipeline right-of-way on Union Avenue N.E. only to the southerly I boundary of Tract C which is the exception to the plat at the northwest corner, and improvements that are requested would lie along that right-of-way. Mr. Cook also stated that no practical method exists to provide improvement requirements if the City of Seattle did not release the right-of-way and the conditions would be required to be altered if this situation resulted. The Examiner inquired if the matter could be reviewed prior to the final plat application process. Mr. Smith indicated the possibility that improvements could be installed since the Subdivision Ordinance requires improvement all the way to the northwest corner of the plat including Tract C. Responding to the Examiner's inquiry regarding application for an exception for Tract C, Mr. Smith indicated that application had not occurred to his knowledge. Referencing Section 0.10 of Exhibit #1, the Examiner requested clarification of recommendation for a 15-foot buffer along Union Avenue N.E. Mr. Smith reported that the recommendation had occurred during tentative plat review and had been required to buffer plats from Union Avenue N.E. , a major arterial street. The Examiner requested final comments from Mr. Smith. Mr. Smith indicated that Exhibit #1 would remain as submitted with additions previously noted consisting of agreement withthe applicant regarding wording of Section P.2, acquisition of the City of Seattle Mercer Island pipeline right-of-way subject to Planning and Public Works Department approval; addition to Section P.7 regarding cinder pathways and other alternatives in the walkway area per, Planning Department approval; and addition of Section P.8 regarding minimum 10-foot wide paved driveway width in the pipestem area. He also added concurrence with the applicant's suggestion for retention methods in providing recreational facilities for the neighboring community. The Examiner requested further comments. Since there were none, the hearing on File N . PP-192-78 and E-205-78 was closed by the Examiner at 10:25 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a preliminary plat (Fernwood) of 74 single family lots and an exception to permit two pipestem lots. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter,I and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. • PP-is 8 Page Three E-205-78 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. .5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. The Heather Downs sewer L.I.D. is being formulated along S.E. 2nd Place. 7. The proposal is compatible with the lot area and dimension requirements of Section 4-704 (SR-1). and Section 9-1108.23.F. of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The open space area (Tract B) at the northeast corner of the site conforms to the condition imposed upon the rezone of the property to SR-1 (Rezone File No. R-117-78) . 9. The Roadway Section (Exhibit. #3) indicates a three-foot planter strip exclusive of curb. Per Section 9-1108.7.H. , this dimension should be 31 feet, whic1 can be easily accommodated.within the proposed 50-foot dedicated public right-of-way: The Public Works Department recommended that the proposed rolled curb be changed to the standard "A" type curb and gutter. Improvements in Union Avenue N.E. are proposed on the Mercer Island pipeline easement for which the applicant does. not have title or rights to use for these improvements. The applicant indicated that appropriate negotiations would be entered, into for the necessary means to install improvements as required by the city. Staff stated that these off-site improvements are required. This street is considered a major arterial. 10. Along the westerly property line abutting Union Avenue N.E. , except for Tract C, is proposed a 15-foot landscape buffer for the purpose of providing screening from this to-be-designated arterial. This same condition was imposed upon the final plat of Parkwood Division No. 1 (File No. FP-040-77) . • 11. Two pipestem lots (Lots ,8 and 5) are proposed which meet the dimension requirements of Section 9-1108.23.F.3. (d) . 12. Restrictive covenants were not submitted. Staff recommended that these be initiated to provide for the maintenance of the open space tracts A and B and the necessary homeowners' . association. It is the policy of the city that open space tracts be privately owned and maintained (Tiffany Park Division No. 3; File No. PP-059-77) . 13. Official policy has not yet been established concerning the use of open, surface storage Of storm water runoff. The proposed Tract A is intended for storage of storm water and some recreational use. However, the Public Works Department has recommended against this proposal. The aforementioned decision of the City Council on Tiffany Park Division No. 3 appears to indicate that open, surface storage is acceptable, but this should be clarified. 14. Site development problems, e.g. soils, topography, etc. , were not shown to exist. 15. Improvement of the north half of South 2nd Place is required and is to be accomplished to constitute a 60-foot right-of-way. 16. The Public Works Department stated that a center line easement on the ,southwest corner of Lot 34. 17. A 15-foot walkway/drainage easement connects Tract A to the proposed Vashon Place S.E. 18. Future access to serve properties to the north has been provided in the proposed Bremerton Avenue S.E. CONCLUSIONS: • 1: The proposal conforms to the Comprehensive Plan and appears to serve the public _interest, health, safety and welfare (Section 9-1106.2.E. (2) ) . 2. Critical to this application is resolution of the use of the- Mercer Island pipeline easement for construction of the eastern half 'of Union Avenue N.E. This street is at some time in the future to be designated as an arterial; therefore, these' improvements will be needed in view of potential development in the area. Through • purchase of the easement, granting of an easement for public right-of;way or some other method, obstacles .should be removed to improving this portion of the street prior to • submittal of the final plat application. PP-192-io Page Four E-205-78 3. Open space Tracts A and B should be held in the ownership of the homeowners' association. Tract A demands particular attention since it is also proposed to include an open, surface drainage retention area. Although official policy of the city has not been clearly established in the Tiffany Park Division No. 3 decision, that decision did appear to indicate that this drainage device was acceptable provided ownership is retained by the homeowners' association and an easement granted to the city for maintenance purposes. In the City Council's review of the recommendation on this application, this policy should be further clarified. 4.. Restrictive covenants are necessary to accompany the final plat application and should include the homeowners' association, ownership and maintenance of Tracts A and B per, the aforementioned conclusion, and preservation of the 15-foot landscape buffer along Union Avenue N.E. 5. Staff recommended retention of existing vegetation and clearing only via approval of staff. A clear policy supporting this recommendation is not contained in the Comprehensive Plan or in the record of the City Council proceedings. Therefore, it appears that, absent environmental problems posing developmental hazards, only voluntary compliance with the staff recommendation can be required. Development practices have currently been to retain as many trees as possible on the individual building sites. This should be encouraged and is a positive and beneficial aesthetic benefit to the city. But without an ordinance requiring approval of land clearing or more specific Comprehensive Plan guidelines, the Examiner is constrained from endorsing the staff's recommendation. 6. Completion of the design of the utilities for the proposal must await approval of the design of the Heather Downs sewer L.I.D. However, the Public Works Department should coordinate the timing of the L.I.D. with the expiration of the preliminary plat to prevent undue delay to the plat. 7. Construction of a pedestrian pathway from what is to be Vashon Place N.E. to Tract A should be coordinated with the proposed recreation facility. This can be accomplished in cooperation with the Planning Department. RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the Examiner's recommendation that the City Council approve the preliminary plat of Fernwood (Exhibit #3) subject to: 1. Improvement of the eastern half (30 feet) of Union Avenue N.E. and north half (30 feet) of S. 2nd Place per approval of the Public Works Department. The City of Seattle Mercer Island pipeline right-of-way is to be purchased, an appropriate easement secured or other method used to permit improvements in Union Avenue N.E. II 2. Restrictive covenants prepared to include a homeowners' association for the ownership (and maintenance per City Council policy) of Tract A, including the 15-foot walkway and drainage easeement, and ownership and maintenance of Tract B and the 15-foot landscape buffer area along Union Avenue N.E. This buffer is to be retained in its existing state, supplemented where desired, and not to be used for vehicular access or driveways. 3. Resolution by the City Council of the acceptability of open, surface drainage retention ponds/areas. Revision of the storm drainage plan per approval of the Public Works Department according to this policy decision. 4. Retention of as many trees as possible. 5. Design of the utilities per the Heather Downs L.I.D. ; however, the Public Works Department is to ensure that the completion of the design of the L.I.D. does not unduly hinder completion of the final plat. 6. Granting of a water line easement on the southwest corner of Lot 34 per the requirements of the Public Works Department. 7. Construction of a pedestrian pathway from Vashion Place N.E. to Tract A in the 15-foolt walkway/drainage easement in coordination with the Planning Department. It is also the Examiner's decision to approve the exception for pipestem Lots 8 and 57 subject to compliance with applicable requirements for the improvement of the pipestem lots per Section 9-1108.23.F. (3) . The proposed single family residence subdivision is consistent with the comprehensive plan land use element which designates thle site and area as potential single family residential land use. 2. The proposed subdivision is consistent with the Sr-1 zone requirements and Subdivision Ordinance requirements for minimum lot area and dimensions. 3. The proposed use is compatible with existing single family residence land uses in the area. 4. Suitable utilities are available in the area. However, the Public Works Department has indicated that final design of the sewer facilities cannot be established until design is completed and approved for the Heather Downs sewer L.I.D. The sanitary sealer line may have to be extended along Union Avenue to the northerly boundary of the plat depending on the final design of the sewer L.I .D. (see Engineering Division comments). Also, a water line easement will be required in the southwest corner of lot '34. All utilities plans shall be subject to final approval of Public Works Department. 5. A storm water drainage and retention plan has been provided. However, the Public Works Department has indicated that open pond retention is not an acceptable alternative (see Engineering Division comments). Storm drainage plans and retention methods shall be subject to Public Works Department approval . Suitable access is available to the subject site. The Traffic Engineering Division has approved the subject plat. However, the easterly portion of what is considered Union Avenue is, in actuality, City of Seattle Mercer Island pipeline right-of-way (see Engineering Division comments). 7. A street has been provided at the northerly boundary of the proposed subdivision for future alternate access into the area. 8. The standard improvements for 60 foot right-of-way per Section 9-1103, Table 1, must be provided along the northern one-half of S.E. 2nd Place adjacent to the subject plat (see EngineerinOivision comments). 9. Rolled curbs are not acceptable per Public Works Department comments. 10. Off-site improvements will be required along the east one-half of Union Avenue N.E. adjacent to the plat. A 15 foot natural buffer has been provided along Union Avenue N.E. A restriction on the plat should also be provided stating that the existing trees ,shall be preserved within this area, and no vehicle access or driveway shall be permitted across the buffer area. 11. Existing trees shall be preserved as much as possible and incor- porated into plat design and development (see Section 9-1108119,B). 12. Tract A and B open space and walkway areas shall be designated a4_ such for the continual use of the public on the plat, together with suitable means of providing maintenance for such open space (generally in the form of restrictive covenants and Homeowner's • Association). 13. The proposed pipestem lot #57 meets ordinance requirements for a pipestem lot and does not impact plat design or adjacent properties. P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of the subject preliminary plat and exception based on the above analysis subject to: 1. Preservation of as many trees as possible. Initial clearing shall be for street rights-of-way and utility easements only. All clearing shall be subject to Planning Department approval . 2. Acquisition of the City of Seattle.Mercer Island pipeline right-of- way for dedication as street right-of-way along Union Avenue. 3. Provision of standard off-site improvements along east one-half of Union Avenue and north one-half of S.E. 2nd Place adjacent to the subject plat. 4. Provision ofstandard street cross section per ordinance require- ments and Public Works Department approval . 5. Final Public Works Department approval of utilities plans and designs and storm water retention/detention methods. 6. Provision of utility easements per Public Works Department approval ._ 7. Soils: Alderwood Gravelly Sandy Loam (AgC). Permeabilityjis moderately rapid in the surface layer and subsoil , runoff is slow to medium and hazard of erosion is moderate. This soil is Used for timber, pasture, row crops, and urban development. 3. Vegetation: Dense ground cover along with thick stands of fir and deciduous trees are the dominant vegetation on the site. 4. Wildlife: The thick vegetation is a suitable environment for native mammals and birds. 5. Water: No surface water was evident on the site. 6. Land Use: Directly south of the subject site lies the residential subdivision of Heather Downs. To the north, east, and west,' the land is generally undeveloped, with occasional single family homes in evidence. .I F. NEIGHBORHOOD CHARACTERISTICS: I The subject site is abutted on the south by Heather Downs, a single family residential subdivision. The remainder of the general area ` surrounding the site is predominantly undeveloped with scattered single family residences. G. PUBLIC SERVICES: 1. Water and Sewer: An existing twelve (12) inch water main is available along 132nd Avenue S.E. which abuts the subject site. At the present time no sewers are available near the site. 2. Fire Department: Provided by the Renton Fire Department as per ordinance requirements. Any future development of the site will be subject to City of Renton standards. 3. A storm water drainage and retention plan has been provided. A street has been provided at the northerly boundary of the proposed subdivision for future alternate access into the area. 8. The standard improvements for 60 foot right-of-way per Section 9-1108, Table 1, must be provided along the northern one-half of S.E. 2nd Place adjacent to the subject plat (see Engineering Division comments). 9. Rolled curbs are not acceptable per Public Works Department comments. 10. Off-site improvements will be required along the east one-half of Union Avenue N.E. adjacent to the plat. A 15 foot natural buffer has been provided along Union Avenue N.E. A restriction on tlhe plat should also be provided stating that the existing trees shall be preserved within this area, and no vehicle access or driveway shall be permitted across the buffer area. 11.
