PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on November 22, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing ;was opened on November 28, 1978 at 9:22 a.m. in the Council Chambers of the
Renton Municipal Building. •

The Examiner indicated that a request for continuance had been received prior to the
hearing and invited testimony regarding the request. Responding was:

Mr. Lawrie; representing residents of the surrounding community, indicated that because
residents had not been aware of public hearing notices posted on and near the subject
site, proper preparation for the meeting had not occurred, and a continuance of 90 days
was requested to review the application and assess environmental impact from the proposed
development. Mr. Clemens reviewed legal requirements for publishing and posting notices
for public hearings and indicated that all requirements had been met. The Examiner •
requested the applicant's response to Mr. Lawrie's request. Responding was:

Mr. Millard indicated that he concurred with the request for continuance to allow appropriate
review of the application but felt that 90 days was an unreasonable period of time. He
stated that he agreed with the Planning Department staff report analysis that the proposal
did not negatively impact the environment.
•
The Examiner advised that although proper legal notice had been provided, he would continue
the hearing for one week to allow sufficient review time for residents in the area. The
meeting was subsequently closed at 9:30 a.m. and continued to December 5, 1978, second item
on the agenda. .

The hearing was reopened on December. 5, 1978 at 9:35 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.

It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the,report was entered into the record as Exhibit #1.

David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following

The Examiner asked the representative for the applicant if he concurred in Exhibit #1.

Mr. Millard indicated basic concurrence in the report. He advised that subsequent to the
previous public hearing, meetings had been held with residents in the area to review
concerns related to traffic circulation and safety at the intersection of N.E. 12th Street
and Aberdeen Avenue N.E. . As a result of the meeting, three alternatives had been proposed
which eliminate through access from Monterey. Avenue N.E. to N.E. 12th Street and provide
three different concepts- for cul-de-sac configurations.

Mr,. Millard reported that the proposed plat is in conformance to the Comprehensive Plan
and existing zoning, 'social impacts from development will be minimal, and population will '
increase by approximately 45 people including 12 school-age children. He indicated
concurrence in staff's recommendation for a 50-foot improved right-of-way containing
curbs, gutters, sidewalks and paving, noting that the previously planned 60-foot right-of-
way would contain a thickened edge concept similar to the surrounding area.
Mr. Millard concluded his testimony by supporting the alternative access plan concept
which contains provision for two cul-de-sacs to satisfy concerns of existing residents
along N.E. 12th Street. The Examiner labeled'the alternative access plan concepts as '
follows:

to N.E. 14th Street)
Exhibit #6: Alternative Plan Concept No. 2 (cul-de-sac access
to N.E. 12th Street)
Exhibit #7: Alternative Plan Concept No. 3 (two cul-de-sacs
each containing seven lots to access to N.E. 14th
and N.E. 12th Streets)
The Examiner requested testimony in support of the application. ' There was no response.
He then requested testimony in opposition to the request. Responding was:

Mr. Burns indicated he was representing the 12th Street community. He requested
clarification of Section J. of the staff report which reviews impact on the natural
systems by the proposal; clarification of Section 0.4 which designates the roadway width;
whether anticipated traffic volume from the proposed plat also included projections of
traffic from future plats; and whether an environmental impact statement was prepared for
the subject site. Mr. Clemens referenced Item J of Exhibit #1 and clarified'that certain
natural portions of the site should be retained as part of development, and storm water.
drainage provisions would be required on-site. He indicated that the Planning Department
had made a brief analysis of projected traffic volumes in the area and had determined
that the proposed increase would not exceed minimum noise or traffic volume requirements
of the city. Responding to, Mr, Burns' inquiry regarding projections_;of:traffic...from '
future plats, the" Examiner indicated' that a representative'of `the Traffic-.Engineering
Division would be requested to testify in response to the inquiry later in the hearing. ;
Regarding an environmental impact statement; Mr. Clemens reported that minimal environmental
impact would occur as a result of the 14-lot subdivision and a declaration of non-significance
was attached to Exhibit #1 as determined by the Planning Director. He also explained that
every project which is defined as an action by state law is required to submit an
environmental checklist which is reviewed by. all city departments and is the basis .upon
, which a determination of environmental significance is made.
Mr. Clemens also explained that the original 60-foot right-of-way which was reviewed by
staff as noted by staff comments attached to Exhibit #1 had been revised to 50 feet ;as a
_ result of finding that lot sizes were of insufficient size, thereby reducing the paved •
section from 36 to 32 feet.

Mr. Burns objected to provision of a through connection from N.E. 12th Street to N.E. 14th.
Street since it would provide access from the north to the Highlands Shopping Center and .
the downtown area of Renton. Due to lack of visibility on N.E. 12th and narrow configuration
of the street, Mr. Burns felt that the cul-de-sac concept provided an improved and safer
alternative. for existing residents in the area. He indicated the preference of residents
of.Alternative No. 3, 1 and 2, in that order. •
•
The Examiner requested further testimony in opposition to the request. There was no
response. Mr. Clemens reported Fire Department concerns regarding proper access for
emergency vehicles and noted that extension of Monterey Avenue N.E. from N.E.. 14th. to
N.E. 12th Street would divide N.E. 12th, along cul-de-sac, in half, which may, be . ' •
preferable to the department from an access standpoint. However, Mr. Clemens felt that
because the cul-de-sac concept is considered a significant amenity to the neighborhood,
the Fire Department may consider Alternative No. 1 which provides a cul-de-sac to N.E. 14th
' Street and allows access of only three lots onto N.E. 12th Street. The Examiner indicated'
that testimony should be provided regarding access by the Traffic Engineering Division
.and requested a member of that division to testify. Responding was:

Traffic Engineering Division
Mr. Morgan was affirmed by the Examiner. He reported that although sight distance related •
to traffic and pedestrian safety was limited at the intersection of N.E. 12th Street and
Aberdeen Avenue N.E. , unavailability Of funds precluded improvement of the situation.
• He advised that the uniform traffic control manual listed certain criteria required to '
warrant installation of various types of traffic control devices and existing and projected
volumes in the area did not warrant installation of a traffic light. Provision of other
types of devices would require further study, he indicated. •
The Examiner inquired if connecting N.E.' 12th to N.E. 14th Street .via Monterey Avenue N.E.
would alleviate existing traffic problems. Mr. Morgan reported that the connection would
be beneficial to the entire area at peak traffic hours and would be preferable to
alternatives for cul-de-sacs since it provides two points of access and improves to a minor
amount fire and police protection.
•
The Examiner requested further testimony in opposition to the request. . Responding was:

Mr. Weers reported residing on the corner of N.E. 12th Street and Aberdeen Avenue N.E.
He discussed an existing dangerous situation created by lack Of•visibility in that
location which would increase if Monterey Avenue N.E. were extended to N.E. 12th Street.
He requested that the problem be reviewed and resolved by the city prior to development.
The Examiner requested a final recommendation from the Planning Department. Mr. Clemens
indicated that based on the testimony from the Traffic Engineering,Division he would
recommend approval of the original proposal for extension of Monterey Avenue N.E. from
N.E. 14th to N.E. 12th Street since provision of cul-de-sacs may create additional problems.
The Examiner requested Mr. Millard's preference on the matter: Mr. Millard indicated that
although he was amenable to the access provisions in the original plat, he supported the
preference of the neighborhood for the cul-de-sac concept. The Examiner indicated that
he would request a written response regarding preferable access from the Fire and Police
Departments and all correspondence would be attached to his report and recommendation on
the matter.
The Examiner requested further comments. Since there were none, the hearing on File No.
PP-254-78 was closed by the Examiner at 10:40 a.m.
•
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, . the
Examiner now makes and enters the following:
FINDINGS:
•
1. The request is for approval of a 14-lot preliminary plat on 3.2 acres of G-7200 zoned
'property.
•
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and .departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference'
as set 'forth in full therein. •
•
•
•
3. ' pursuant to the City of Renton':s Environmental Ordinance and the State Environmental
•
PP-254-78 Page Four
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
• has been issued for the subject proposal by Gordon Y. Ericksen, responsible official
subject to retention of significant trees within the lots. •
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development. .
5. All existing utilities are available and in close proximity.
6. The proposal (Exhibit #3) is compatible with the lot coverage and dimension but not
lot area requirements of Section 4-706. (R-1) and 4-729 (G) of Title IV and, Section
'9-1108.23.F. of Title IX, Ordinance No. 1628, Code of General Ordinances.
7. Four alternative. plat designs were submitted. Exhibit #4 contained staff comments
regarding the proposal, and involved Only reducing the width of the proposed street;
rights-of-way and enlarging some of the lots. Exhibits #5, 6 and 7 were submitted I
by the applicant pursuant to discussions with the neighborhood. These alternatives ) •
'were for one cul-de-sac extending southward from Monterey Avenue (Exhibit #5) ,' one
cul-de-sac extending northward from N.E. 12th Street (Exhibit #6) or two cul-de-sacs,
one from each of these two streets (Exhibit #7) . The street or cul-de-sacs would be
.
350 feet westward of Aberdeen Avenue N..E.
I
The Planning Department and Traffic Engineering Division of the Public Works Department
favored the original proposal as amended in Exhibit #4. Either this alternative or
that in Exhibit. #7 was acceptable to the applicant. :Residents in the area appeared
to favor Eichibit #7, which would minimize the amount of traffic on N.E. 12th Street.
8. A difficult and dangerous intersection seems to exist at N.E. .12th Street and
Aberdeen Avenue N.E. Staff testified that costs incurred to improve the sight
distance at this intersection approach.being prohibitive: Without further study
a recommendation' could not be given relative to traffic control devices that would
' be appropriate, except that staff found that the situation did not warrant a traffic
signal. Residents in the area using N.E. 12th Street have found this intersection
very dangerous and wished to minimize traffic utilizing the street.
CONCLUSIONS:
•
1. The proposal appears to conform to the goals and objectives of the Comprehensive Plan.
• Of most concern is the impact that the resulting traffic will have upon the already
difficult intersection of N.E. 12th Street and Aberdeen Avenue N.E. This issue raises
difficulty in finding that the proposal serves the public interest, health, safety and
welfare (Section 9-1106.2.E. (2) ) .
Testimony from the Traffic Engineering Division indicated that the proposed Monterey
'Avenue N.E. extension to form a through',street and mid-block connection would not 1
. adversely impact this intersection but would. provide the best circulation for the
neighborhood. . In the attached memorandum of December 10, 1978, the Fire Department'
- concurs with the division. Also concurring. is. the Police Department (attached
. memorandum' of December 8, 1978) which recommends a stop sign, at Monterey .Avenue .N.E.
and N.E. 12th Street.
•
The Comprehensive Plan for arterials and streets, page 3, lists three general
objectives:
•
•
a. Provision for the safe, efficient and convenient movement of peoples and goods.
b. Arterial and street patterns compatible with and complimentary to the general
land use plan.
•
• c. . Adequate and safe access..to allow convenient and efficient utilization: of abutting-
properties. • . ,
•
Within, the boundaries of the proposal either of the four alternatives street
configurations will safely and conveniently carry traffic away from residences
(Objective a.) . The alternative streets are typical single family lot-by-lot
development streets (Objective b.) . Each lot will safely and conveniently access to
the streets (Objective c.) . The proposed alternatives appear to conform to-,the. j •
Comprehensive- Plan (Objective b.) .
Expansion of consideration to include the neighborhood quickly focuses upon the
intersection of N.E. 12th Street and Aberdeen Avenue N.E. Additional traffic will
' logically .increase the probability-of accidents at this intersection.. However,
since N.E. 12th Street is essentially a long cul-de-sac west'of this intersection,
a mid-block connection to N.E. 14th, Street via Monterey Avenue N.E, would appear to

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before December 26, 1978. Any aggrieved person feeling that •
the decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after,
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the City Clerk's office, first floor of City Hall, or same may be purchased at cost in
said office.

provide a safer crossing of and/or access to Aberdeen Avenue N.E. (Objectives a. and c.) .
This connection would also be available to existing residents,on N.E: 12th Street as
an alternative to the difficult intersection. . This circulation system appears to more .
closely be compatible with residential development and the Comprehensive Plan
(Objective d.) .
2. Traffic control devices at the intersection of N.E. 12th Street and Aberdeen Avenue .
N.E. would relieve many of the concerns of the residents along N.E. 12th Street. .
• Precisely the extent of the relief may only be seen after the'devices have, been in use
for a reasonable period, of time. This intersection has been a problem in the past, . 1,
and appropriate traffic• control'devices are needed. • ' it is' important to not unduly
increase the problem which should be the result of extending Monterey Avenue N.E. to
N.E. 12th as proposed.
. ' 3. Exhibit #3 should 'not be revised per Exhibit #4. Monterey Avenue N.E. north of 'N.E. .
14th Street (Exhibit #2) is a 60-foot right-of-way in conformance with Section
9-1108.7.H (Table 1) . This street is a neighborhood collector street 'requiring a
60-foot right-of-way. The Engineering Division of the Public Works Department
recommended this type of street in Exhibit #1: However, the.Planning Department
recommended a 50-foot. right-of-way (Residential Access Street of Table 1) . But this
narrower street is not appropriate since Monterey Avenue N.E. will be longer' than
800 feet (approximately 1140 feet) . Therefore, the Examiner is constrained. by
Section 9-1108.7.H to consider only the. 60-foot right-of-way in view of recommending' ,
Monterey Avenue N.E. be a through street.
4. It is apparent that essential to making Monterey Avenue N.E. a through street is
'appropriate traffic control devices at the affected intersections, particularly
N.E. 12th Street and Aberdeen Avenue N.E. Although the amount of traffic does not
justify a traffic. signal at this intersection, the unquestionable sight distance
problems require appropriate traffic control devices to minimize the impact of
additional traffic and solve most, if not all, of these problems. Testimony appears, '
to indicate that traffic control devices can accomplish these two objectives.
RECOMMENDATION:
Approval of the preliminary plat (Exhibit #3) ' subject to: '
1. Public Works Department conducting a traffic analysis to determine what traffic
control devices are necessary at the intersections of:
' a. N.E. 12th Street and Aberdeen Avenue N.E. '

b. N.E. 12th Street and Monterey Avenue N.E.
•
c. N.E. 16th Street and Aberdeen Avenue N.E.
d. N.E. 16th Street and Monterey Avenue N.E.
The conclusions of this analysis are'to be implemented prior to installation of
roadway improvements on the property.
2. Submittal of storm drainage plans with the final plat application, except that these
• plans shall be'approved by the Public Works Department prior to installation of
improvements.
3. Compliance with other applicable ordinances and regulations of the City of Renton. .

dated March 17 , 1968 . The existing G-7200 zoning was carried
from an existing 7200 square foot minimum zoning in the County .
E . PHYSICAL BACKGROUND :
1 . Topography : The site slopes forward from east to west at a
slope varying from 4-8% from north to south .
2 . Soils : Indianola loamy fine sand ( InC ) . Permeability is
rapid . Available water capacity is moderate . Runoff is
slow to medium , and the erosion hazard is slight to moderate .
This soil is used for timber and is suitable for urban
development .

6. Land Use.: Except for one residence the subject site is
presently undeveloped . Adjacent properties are developed

The area is primarily single family residential in nature .

1 . Water and Sewer : Six inch water mains extend east-west
along N . E . 12th Street adjacent to the southern boundary
of the subject site and east-west along the northern ,
boundary at the southern end of existing Monterey Avenue
N . E . A ten inch main extends north-south along Monterey
at the north end of the site . Eight inch sanitary sewers
extend east-west on N . E . 12th and east-west at the southern
end of existing Monterey . A third eight inch sewer runs
north-south on Monterey Avenue .
2 . Fire Protection : Provided by the Renton Fire Department
in accordance with ordinance requirements . 1
3. Transit : Metro Transit Route 142 operates along Edmonds
Avenue N . E . approximately 0. 3 of a mile to the east of

three-fourths of a mile to the northeast of the subject
site and McKnight Middle Schoolis within one-third of a
mile to the east while Hazen High School is approximately
two miles to the east .
5 . Parks : North Highlands Park is within one-half mile ; to
the northeast of the subject site and Gene Coulon Memorial
Beach Park is approximately 0. 6 of a mile to the west while
Kennydale Lions Park is within 3/4 of a mile to the north .

the minimum standard of 7200 square feet. By reducing the
street right-of-way width of Monterey Avenue to 50 feet ,
the necessary lot area can be achieved . This alternative
has been reviewed with Engineering and Traffic Engineering ,
who concur with the reduction . The Subdivision Ordinance
• . allows this street right-of-way ( 9- 1108-Table 1 ) .
3 . Suitable utilities are available in the vicinity of the sub-
ject site. Detailed plans shall be submitted to the Public
Works Department for review and approval .
4 . A 32 foot wide paved street section with curb , gutter , side-
walk , and storm drainage will be required for future Monterey
Avenue N . E . , N . E . 14th Street , and N . E . 12th Street. In
addition , storm water retention/detention facilities will
need to be provided . Also see the Engineering Division
comments .
5. The Traffic Engineering Division advises that street lighting
and two street name signs will have to be installed .
6 . Hydrants to meet fire flow requirements will need to be
installed per Fire Department approval .
7 . Although ,significant natural vegetation does not exist on
the subject site , any such vegetation should be retained
wherever possible and incorporated into plat design and
development as prescribed by the declaration of non-signi -
ficance . •
8 . A 20 foot wide right-of-way dedication has previously been
made along the south side of N . E . 14th . No additional
right-of-way is required on this street .

State Environmental Policy Act of 1971 , as amended , RCW' 43-21C ,
a declaration of non-significant impact has been prepared based
upon retention of any significant trees outside of the right-of-
way area and implementation of appropriate development controls .

1 . The subject request is consistent with the Comprehensive Plan
Land Use Element designation of single family residential for
the site and surrounding area .
2 . The proposed plat contains several interior lots on the east
side of future Monterey Avenue Northeast which do not meet
the minimum standard of 7200 square feet . By reducing the
street right-of-way width of Monterey Avenue to 50 fleet ,
the necessary lot area can be achieved . This alternative
has been reviewed with Engineering and Traffic Engineering ,
who concur with the reduction . The Subdivision Ordinance
allows this street right-of-way ( 9-1108-Table 1 ) .
3 . Suitable utilities are available in the vicinity of the sub-
ject site . Detailed plans shall be submitted to theiPublic
Works Department for review and approval .
4. A 32 foot wide paved street section with curb , gutter , side-
walk , and storm drainage will be required for future , Monterey
Avenue N . E . , N . E . 14th Street , and N . E . 12th Street . In
addition , storm water retention/detention facilitiesiwill
need to be provided . Also see the Engineering Division
comments .
5 . The Traffic Engineering Division advises that street lighting
and two street name signs will have to be installed .
