previously composed of two smaller lots .
COMMENTS : . 1. Staff has contacted both the applicant and
Mr. Saviage (the adjacent property owner
to the south) and discussed the various
problems related to the improvements on
Queen Ave.
2 . A meeting was held td clarify the concerns
expressed by adjacent property owners.
Those present were Mr. Kirkman, Mr. Saviage ,
Mr. Lowell, Tom Touma, Engineering Division;

marginal for maneuvering . It is the committee ' s recom-
mendation that spacing of forty feet between the exist-
ing building and the first new structure and thirty
feet between the sides of new structures containing the
small ten foot units be provided . He noted that the
applicant has painted garage doors , asphalted the area
around the existing structure and agreed to upgrade
existing landscaping.
Mr . Thomas Weichmann , noting that they have thirty foot
deep units on the existing building , in which large
boats are usually stored , stated that they would favor
forty-five feet between the first building and the new
buildings and twenty-five feet between the two smaller
units . He said that it was their experience that there
were rarely two cars maneuvering at one time and stated
that there is a fifteen foot wide driveway at the east
end of the building for additional passage .
The Chairman invited comment from the audience but re-
ceived no response.
ACTION:
MOVED BY SCHOLES, SECONDED BY SEYMQUR, THAT THE PUBLIC
HEARING BE CLOSED. MOTION CARRIED UNANIMOUSLY.
ACTION:
MOVED BY ROSS, SECONDED BY MOLA, THAT A TEMPORARY PERMIT
BE GRANTED TO WEICHMANN ENTERPRISES SUBJECT TO THE FOL-
LOWING CONDITIONS:
1. STAFF APPROVAL OF THE FINAL LANDSCAPE PLAN.
2. A SPACING OF 45 ' BE PROVIDED BETWEEN THE
EXISTING BUILDING AND ANY NEW BUILDING OR
STRUCTURE.

construct a retaining wall along the cut portion of Mr .
Saviage ' s west property line and to install a screening
fence along the applicant ' s south property line.
The revised site plan was considered ,. and there was discus-
sion regarding expiration of the deferral for installation

In reply to Mr. Smith's letter of'May 23, 1974, I would like to submit the
following information:
•
On August 31, 1971, I was granted a two-year delay in the installation of off-site
improvements on the property in question. A $7500 bond was posted.
On March 20, 1974, I was notified by Lyman Houck, City Engineer, that my time
extension had expired and to please notify him as to when the improvements would
be made.
On April 4, 1974, I wrote Mr. Houck the following:
"Am now preparing a site plan for a fourplex on the East corner of
Queen and Sunset. Have had preliminary talks with the Planning
Commission and will be submitting a request for a special use
•permit on this corner.
My plans are to complete both the proposed building and the off-
site improvements by Fall. As soon as I know what I can build on
the remaining property, then the driveway approaches can be de-
fined and the improvements begun."
• I have received a copy of Mr. Saviage's complaints and can only say that I'm sorry
for his inconvenience and was unaware of his problems with•the sub-contractor.
This occurred during a period of several rainy months, and then to make matters .
worse, after all underground work was complete and the street had been repaired
with crushed rock, Puget Power dug up all their underground service because they
had failed to place it according to City of Renton specifications the first time.
All street grading and the location of the fire hydrant were done according to.
City of Renton Engineering Department requirements. I expect to complete the
off-site improvements to the satisfaction of the City of Renton Engineering De-
partment. The four-foot cut that Mr. Saviage refers to is a result of grading
for the off-site improvements. If you examine my landscaping drawings submitted
for the Special Use Permit, you will see that I have planned a rock wall in that
area. In fact, I simply assumed that the City would require me to retain the cut
if I did not do so voluntarily.
If my letter of April 8, 1974, had been in your file, I don't believe this delay
would have been necessary. At any rate, I certainly have no choice but to finish
the street, as the City could forfeit my bond. Since Mr. Saviage did not know these
things , I can understand his concern..

The neighbors do have a legitimate right to demand that the street improvements
be made. However, I need to know what .I can build on the remaining property
so the driveway approaches can be determined.
I feel that building a fourplex is simply better land use than two duplexes.
In order to build two duplexes (for which the property is already zoned) I
would need to remove almost every tree.
Therefore, I hereby request that my Special Use Permit application be approved.

Saviage , Mr. Don Lowed, and Mr. Tom Touma of the
Engineering Division . The meeting was held to
. discuss the status of the off-site improvements on
Queen Ave . N . E . , of which Mr. Saviage and Mr .
Lowell had expressed concern .
It , was resolved that Mr. Kirkman would accomplish
all of the requirements required by Ordinance as
soon as possible after the decision on his present
Special Permit. He reiterated his intentions to
do so after the location of the driveways of these
last units was determined . He stated that he does
have a bond posted with the City . He also stated to
the satisfaction of both Mr . Saviage and Mr. Lowell
that he would provide a rockery around the fire
hydrant at the southwest corner of the subject

for some time after taxis. It was necessary to leave our cars parked 'down

Complaints were made by another family here, and also the Pout Ilan. During
the summer this condition did dry out, and then'became very dusty. Ito fol.
lowing winter our drive and street went out again, particularly in the p oorly
filled ditch areas. We finally contacted the City of Renton Street Department,
and they came in, hauled• away several,'load; of mud from those ditches, add put ,
gravel in as it 4;41d have been donne in hhe beginning. his was a steep in
the right direction to make the 1141001 passable.
3. Our basement was flooded and'tke rug and mat in our recreation moors both
ruined, due to the water contractor flushing the main line for tests oato the
lot above us and into: the street on several different times.
4. Raw clorivated water was ;allowed to escape from th now water mainduring '
a pressure t est into thei Qity Main and also into My house. This corroded My
toilet facilities making it"ncecceesery' to replace them. Fortunately we slid
not drink any.of the water at this time, or it could have poieened us.
5. A Fire Hydras t was installed in the N W Corner of my property,' the top
of it is below the lsvol oP my yard level, This condition will have to be
corrected or some mdwe made to change the chopped off area of the yard. The
street level for 1/2a of my front lot line is all of 41 below my yard level
leaving my hedge, slubg and. fence hanging . ,

of the Mining , Excavation and Grading Ordinance ; and
there is existing fill to the south and north . Fifty
thousand cubic yards of fill are planned . He noted
recommendation by the staff for continuance to allow
for additional study regarding proposed development
and possible environmental assessment.
The Chairman invited comment from the applicant. Mr .
Gary Merlino , 8630 Fauntlee Cr. S . W . , Seattle , ques-
tioned the need for additional study , stating that
the season for this type of work was limited .

Discussion followed regarding the necessity for a flood-
plain permit from the King County Department of Hydraulics ,
consideration of the Soil Conservation Service position
regarding fills in the area and potential location of a

that filling had been accomplished on a haphazard basis
in accordance with agreement from the City of Renton prior
to enactment of Ordinance 2820 .
Following discussion , it was determined that the appli -
cant planned to accomplish the work starting in early
July.

Mr. Ericksen pointed out the site on the map and noted
that the planned development of two townhouse duplex units
is a revision of a plan previously approved by the Planning
Commission . He described the proposal and displayed the
plot plans . He noted that the Offsite Improvement Ordi -
nance would apply and that on the original request a wai -
ver of improvements until completion of construction had
been granted . He stated that the staff felt the proposal
is an improvement over that previously approved but that
additional consideration should be given to landscaping
and public right-of-way improvements .
Mr. Ericksen reported the receipt of a communication from
Mr. Lawrence S . Saviage , a neighbor , regarding complaints
concerning street improvements and sidewalks affecting
the neighborhood of Mr . Kirkman ' s present development and
hardships endured by neighbors during sewer and water con-
struction .
The Chairman invited comment from the applicant , but he
was noted as not being present. A request for comments
in favor received no response .
Speaking in opposition , Mr. Donald A. Lowe , 1411 Queen
Ave . , N . E . , Renton , described unfinished street and side-
walk conditions which have existed for three years .

Chairman Humble announced a committee meeting to
be held on May 29 , 7 : 30 p .m. , to view a film on

and type of plant materials are recommended.

Joan Lankford and I. talked to Mr. Kirkman today regarding
his special permit application. I had talked to him on
Monday 5-22-74 about most of the areas of concern. He said
that the inside edge of the sidewalk along Sunset Blvd.
was approximately 12 feet from his north property line at
the west end of the site and approximately 8 feet at the .
east end of the site. Joan Lankford went over the addition-
al screening requirements which the Planning Department
felt was necessary. , This included the addition of Photinia • -.
along the 'north property line adjacent to Sunset Blvd. She
said that it was to be planted 4 feet high, 4 feet on
center alternate spacing and well branched. She also said
that the Laurel indicated on his plan for the south property
•line should be a minimum of 4 feet in height and well
branched, Mr. Kirkman agreed with these comments. He
also stated that his plan is to save as much existing plant
material as possible and that he would make certain drive-
way location changes if necessary. to realize this goal .

along the highway as we could not cross this ditch due to the muddy condition.
Complaints were made by another family here, and also the Post Man: During
the summer this condition did dry out, and then became very dusty. The fol-
lowing winter our drive and street went out again, particularly in thepoorly
filled ditch areas. We finally contacted the City of Renton Street Department,
and they came in, hauled away several loads of mud from these ditches, add put
gravel in as it should have been done in the beginning. This was a step in
the right direction to make the street passable.
3. Our basement was flooded and the rug and mat in our recreation room both
ruined, due to the water contractor flushing the main lino for tests onto the
lot above us and into the street on several different times.
4. Raw clorinated water was allowed to escape from th new water mainduring
a pressure t est into the City Main and also into my house. This corroded by
toilet facilities making it necessary to replace them. Fortunately we did
not drink any of the water at this time, or it could have poisoned us.
5. A Fire Hydra at was installed in the N W Corner of my property,, the top
of it is below the level of my yard level. This condition will havie to be
corrected or some move made to change the chopped off area of the ylard. The
street level for 1/2 of my front lot line is all of 41 below my yard level
leaving my hedge, shrubs and fence hanging
Because of these conditions, I do not feel Mr. Kirkman should be all-
owed to start more construction until be corrects the existing problems. I
fool strongly the landscaping of myfront yard on my property line should be
fixed to my satisfaction.
I do not feel he should be issued any variances, special permits, or
even a -building permit until he has seen to-it that all concerned are sat-
isfied with proper adjustments, repairs, or corrections done.
We were willing to write off the many problems ee had to the rigors of
progress & construction.. Now our patience is gone because Mr Kirkman is ask*
ing for something again without finishing th 1st job he started. That protect -
ion will we have from the city if another permit is let out? Will it be
another 3 years or more for us to wait for street completion & so forth.

1 . COMPREHENSIVE PLAN COMMITTEE
Commissioner Humble, chairman , reported that the
committee has met several times and is preparing
a land use proposal for THE VALLEY AREA. Almeet-
ing was scheduled for May 15 , 1974 , to again con-
sider the subject and the Shell Oil Company pro-
posed development.
Regarding the REQUEST OF THE SEATTLE AUDUBON SOCIETY
for re-evaluation of the Renton Comprehensive Land
Use Plan , the committee is already studyingithe
question of land use in the Green River Valley .
2 . COMMUNITY SERVICES COMMITTEE
Commissioner Scholes , chairman , brought theigroup
up-to-date on the HONEYDEW APARTMENTS ' PROPOSAL .
Mr . Ericksen advised the Commission regarding Coun-
cil plans to conduct a public hearing on a revised
plan on May 13 . He indicated that the Public Works
Department and Planning Department had met with the
applicant in an attempt to answer some of the con-
cerns in order to provide the best type of develop-
ment for the immediate community and the City.
Scholes requested that an opinion from the City
Attorney be obtained relative to jurisdiction of
SHORELINE MANAGEMENT regarding fill in the Valley.
Scholes reported that the committee had met jointly
with the Council Community Services Committee regard-
ing the OLYMPIC PIPELINE REFERRAL . He noted that an
environmental assessment is being considered regard-
ing a proposed trail system over the pipeline right-
of-way which runs through the City from May Creek on
the north to the Mobil site on the south .
