E-002-77 W-003-77 #34-77 Short Plat LOCATION: Located on the east side of Lake Washington Boulevard North, midway between North 36th Street and North 38th Street. SUMMARY OF REQUEST: Applicant requests a two lot short plat, a waiver of the off-site improvements and an exception to the platting ordinance for the development of a pipestem type lot . SUMMARY OF Planning Department: Approval for requests on RECOMMENDATION: short plat and exception. Approval subject to conditions on waiver. Hearing Examiner: Approval on short plat. Approval subject to conditions on exception. Approval subject to conditions on waiver. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on January 31 , 1977 , at 10 :20 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had . received and reviewed the Planning Department report, and the report was entered into the record by reference. Gordon Y . Ericksen, Planning Director, entered the following exhibits : Exhibit 1 : Assessor Map - location of parcel of land on Lake Washington Boulevard. Exhibit 2 : G. M. Walker Short Subdivision Map, ,received by Planning Department on December 17, 1976 . Exhibit 3: Letter from Public Works Director, dated January 28 , 1977, re Waiver Application #W-003-77. Letter was read into the record by the Hearing Administrative Assistant. • The Planning Director, Gordon Y. Ericksen, reviewed the Planning Department report. In regard to the letter from the Public Works Director recommending denial of the waiver, he indicated that approval of indefinite deferral was more acceptable than a waiver if the applicant would sign restrictive covenants . The Public Works Director, Warren C. Gonnason, noted that he recommended the waiver application be denied and that an indefinite deferral be granted subject to the applicant signing a restrictive covenant agreeing to participate in any future Local Improvement Districts . The applicant indicated that such restrictive covenants have been signed and sent to the city. IIP 0 E-002-77 Page Two W-003-77 • #34-77 Short Plat The Examiner entered Exhibit 4 : Telephone conversation with Dick Houghton, Engineering Supervisor, which concurred with the Public Works letter and noted that the Engineering Department could not establish a grade for Lake Washington Boulevard at this time since the Boulevard may be widened or improved in the future. The Examiner asked for comments from the applicant, Mr. Walker. Mr. Walker responded that he had- no comment. The Examiner asked for any comments in opposition or concurrence from the audience. There was no response . The Examiner directed questions to the applicant regarding the access road to the existing house located on the pipestem lot and noted that the present condition of the roadway is deeply rutted. The applicant responded that he had plans to gravel the roadway but not to regrade for the reason that only the front two lots , Lots A and B, would be utilizing the roadway. In response to the Examiner' s question, the applicant indicated that the back lot was divided four years ago and has access by a 15 ' easement on the north property line. The Planning Director stated that with reference to the improvements that were mentioned by the applicant there were three potential problems : access to the pipestem lot, storm water runoff and improvements proposed. If the access road were used by other than one party, it would require improvement other than gravel and would require regrading and surfacing with a material such as asphalt. Mr. Walker responded that only Lots A and B would be utilizing the access , and regarding the storm water runoff, water had been running along the road for fifteen to twenty years . He also indicated that a ditch is located along the north side of the easement road. The hearing on Items E-002-77, W-003-77 , and #34-77 Short Plat was closed by the Examiner at 10 :40 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1 . Mr. Walker has an existing lot that is approximately 275 ' x 107 ' (approximately one-half acre) that he is proposing to short plat into two lots : Lot A, 10 ,650 square feet, and Lot B, 14,014 square feet. 2 . In order to accomplish this proposed request, three procedures must be. applied: 1) Short plat; 2) Exception to allow pipestem lot; and 3) Waiver from existing off-site. improvements . 3. The original platting of this property and adjacent areas consisted of lots ranging in depth from 400 to 600 feet. This extreme depth caused hardships for future property owners to plat property into smaller lots conforming to the existing zoning of G-7200 and G-6000 . 4 . The topography on the property has a moderate slope of approximately 9% . 5 . The residential character of the area consists of a variety of sizes of lots with the most recent platted lots consisting of approximately -7 ,000 to 9,000 square feet. 6 . The short plat does not create any significant problems for the subject site or for adjacent properties. The proposed property division is one of the few alternatives available for subdivision. 7. Off-site improvements presently do not existinn the general area along Lake Washington Boulevard. . v, E-002-77 Page Three W-003-77 #34-77 Short Plat FINDINGS : 8. The existing road providing access to Lot B .is narrow, heavily rutted and in relatively poor condition. An existing open ditch lies directly north of the road and borders the northern property line. 9 . The northern 15 feet of the property also provides easement access rights to the existing platting lot directly east of Lot B. Mr. Walker owns this lot and the residence directly east of this property. Mr. Walker' s residential access is from Wells Avenue North. CONCLUSIONS : Short Plat: 1 . The proposed lot division is compatible with the adjacent properties . 2 . The short plat also agrees with the Comprehensive Land Use Plan. • Exception: 1 . The access to Lot B is accommodated by a pipestem consisting of an area 20 ' x 101 ' . This configuration agrees with the Subdivision Ordinance, Section 9-1108 23 F. (3) (d. ) , as amended, and Section 9-1109 (Exceptions) . 2 . The ordinance also requires that all pipestems at least 20 ' wide shall not exceed 150 ' in length and shall consist of permanent paving 10 ' wide for the length of the pipestem. This ordinance also requires that the remaining portion of the pipestem not paved shall be landscaped. Waiver: 1 . The Public Works Department has indicated that Lake Washington Boulevard is contemplated to be widened and redesigned in the near future . Final grades for this improvement have not been set or. determined. 2 . The elevation of curbs , gutters , and sidewalks must be calculated from an existing grade usually determined at the center line of the right-of-way. 3. The Public Works Department at this time is not able to present the applicant with the required information to establish grade and this work is not comtemplated in the 1977 department work schedule. 4 . The Public Works Director, Warren C. Gonnason, has recommended that the request for waiver of off-site improvements be denied. In lieu thereof, he recommends approval of an indefinite deferral of off-site improvements subject to the signing and filing of restrictive covenants in which the owner agrees to participate in an L.I .D. for such improvements at a future time. The Planning Department has concurred in this report. • 5 . It can be assumed that an L. I .D. . will eventually be created to provide these improvements at such time as Lake Washington Boulevard is widened or redesigned. 6 . Mr. Walker has submitted a Declaration of Restrictive Covenant document agreeing to participate in a future L. I .D. E-002-77 Page Four W-003-77 #34-77 Short Plat RECOMMENDATION: Short Plat: Approval Exception: 1 . Approval subject to grading and paving the existing pipestem to a 10 foot width, as per- ordinance. 2 . The. remaining 20 foot area not paved shall accommodate storm drainage and..is to be landscaped with landscaping to consist of vegetation natural to the area, as per ordinance. Waiver: Approval subject to recording the Declaration of Restrictive Covenant document with King County. HISTORY/BACKGROUND: • The subject property was part of a larger tract of land included in the orginal C.D. Hillm n Lake Washington Garden of Eden subdivision. This orginal subdivision created long narrow tracts of land throughout the entire area. As these tracts were further subdivided on a piecemeal basis many problems have been created. 401 D . PHYSICALJBACI(GROUND 1 . Topography: The subject site has a moderate slope of 9%. Rising continually within the first 50' , then gently leveling off with a steep incline bordering the eastern property line. 2. Soils: Indianola Loam Fine Sand - Loamy fine sand, 4 to 15 % slopes. Permeability is rapid. Available water capacity is moderate. Run off is slow to medium, and the erosian hazard is slight to moderate. This soil is used for timber and urban development. Slight to moderate limitations for foundations and septic tank filter fields. 3. Vegetation.: The site consists primarily of thick under brush and grass with douglas fir and alder sparsely scattered throughout the site. Dense brush dominates the western portion with a proliferation of small trees within the eastern section. • 4. Wildlife: Brush and trees provide a habitat for birds (native to the area) and small mammals. 5. Water: N/A 6. Land Use: A single family residence presently exists on the easterly portion of the subject property (proposed lot B) together with a gar- age/storage structure. The westerly portion (lot A) is presently vacant and undeveloped. Single family residences surround the site and are the predominate form of land use within the general vicinity. Kennydale Beach Park is located near the site to the southwest. F. NEIGHBORHOOD CHARACTERISTICS: • Land use and zoning in the area is single family residential with varying lot sizes and configurations. G. PUBLIC SERVICES: 1. Water and Sewer: An eight inch water main exists along Lake Washington Boulevard. Eight inch sewer mains exist along the south property line of the subject site and along Lake Washington Boulevard. 2. Fire Protection: Provided by the Renton Fire Department as per ordinance requirements. 3. Transit: Metro Transit route #240 provides direct service running along Lake Washington Boulevard. The two lots created exceed the minimum 7200 square foot lot size. 2. The short plat as proposed will not create any significant problen for the subject site or adjacent properties, no other reasonable subdivision alternatives exist at the present time. 3. Access is provided for the adjacent lot to the east of the sub- ject site by Wells Avenue North and an easement over the northerly portion of the subject site. 4. Off-site improvements presently do not exist anywhere in the general area along Lake Washington Boulevard. P. PLANNING DEPARTMENT RECOMME`DATION: 1. Short Plat: Recommend approval as proposed. 2. Letter was read into the record by the Hearing Administrative Assistant. • The Planning Director, Gordon Y. Ericksen, reviewed the Planning Department report. In regard to the letter from the Public Works Director recommending denial of the waiver, he indicated that approval of indefinite deferral was more acceptable than a waiver if the applicant would sign restrictive covenants . The Public Works Director, Warren C. Gonnason, noted that he recommended the waiver application be denied and that an indefinite deferral be granted subject to the applicant signing a restrictive covenant agreeing to participate in any future Local Improvement Districts . The applicant indicated that such restrictive covenants have been signed and sent to the city. E-002-77 Page Two W-003-77 #34-77 Short Plat The Examiner entered Exhibit 4 : Telephone conversation with Dick Houghton , Engineering Supervisor, which concurred with the Public Works letter and noted that the Engineering Department could not establish a grade for Lake Washington Boulevard at this time since the Boulevard may be widened or improved in the future. The Examiner asked for comments from the applicant, Mr. Walker. Mr. Walker responded that he had no comment. The Examiner asked for any comments in opposition or concurrence from the audience. There was no response . The Examiner directed questions to the applicant regarding the access road to the existing house located on the pipestem lot and noted that the present condition of the roadway is deeply rutted. The applicant responded that he had plans to gravel the roadway but not to regrade for the reason that only the front two lots , Lots A and B, would be utilizing the roadway. In response to the Examiner' s question, the applicant indicated that the back lot was divided four years ago and has access by a 15 ' easement on the north property line. The Planning Director stated that with reference to the improvements that were mentioned by the applicant there were three potential problems : access to the pipestem lot, storm water runoff and improvements proposed. If the access road were used by other than one party, it would require improvement other than gravel and would require regrading and surfacing with a material such as asphalt. Mr. Walker responded that only Lots A and B would be utilizing the access , and regarding the storm water runoff, water had been running along the road for fifteen to twenty years. He also indicated that a ditch is located along the north side of the easement road. The hearing on Items E-002-77 , W-003-77 , and #34-77 Short Plat was closed by the Examiner at 10 :40 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1 . Mr. Walker has an existing lot that is approximately 275 ' x 107 ' (approximately one-half acre) that he is proposing to short plat into two lots : Lot A, 10 ,650 square feet, and Lot B, 14,014 square feet. 2 . In order to accomplish this proposed request, three procedures must be applied: 1) Short plat; 2) Exception to allow pipestem lot; and 3) Waiver from existing off-site improvements. 3 . The original platting of this property and adjacent areas consisted of lots ranging in depth from 400 to 600 feet. This extreme depth caused hardships for future property owners to plat property into smaller lots conforming to the existing zoning of G-7200 and G-6000. 4 . The topography on the property has a moderate slope of approximately 9% . 5 . The residential character of the area consists of a variety of sizes of lots with the most recent platted lots consisting of approximately 7 ,000 to 9,000 square feet. 6 . The short plat does not create any significant problems for the subject site or for adjacent properties. The proposed property division is one of the few alternatives available for subdivision. 7. Off-site improvements presently do not existIn the general area along Lake Washington Boulevard. E-002-77 Page Three W-003-77 #34-77 Short Plat FINDINGS : 8. The existing road providing access to Lot B is narrow, heavily rutted and in relatively poor condition. An existing open ditch lies directly north of the road and borders the northern property line. 9 . The northern 15 feet of the property also provides easement access rights to the existing platting lot directly east of Lot B. Mr. Walker owns this lot and the residence directly east of this property. Mr. Walker' s residential access is from Wells Avenue North. CONCLUSIONS : Short Plat: 1 . The proposed lot division is compatible with the adjacent properties . 2 . The short plat also agrees with the Comprehensive Land Use Plan. Exception: 1 . The access to Lot B is accommodated by a pipestem consisting of an area 20 ' x 101 ' . This configuration agrees with the Subdivision Ordinance, Section 9-1108 23 F. (3) (d. ) , as amended, and Section 9-1109 (Exceptions) . 2 . The ordinance also requires that all pipestems at least 20 ' wide shall not exceed 150 ' in length and shall consist of permanent paving 10 ' wide for the length of the pipestem. This ordinance also requires that the remaining portion of the pipestem not paved shall be landscaped. Waiver: 1 . The Public Works Department has indicated that Lake Washington Boulevard is contemplated to be widened and redesigned in the near future . Final grades for this improvement have not been set or determined. 2. The elevation of curbs , gutters, and sidewalks must be calculated from an existing grade usually determined at the center line of the right-of-way. 3. The Public Works Department at this time is not able to present the applicant with the required information to establish grade and this work is not comtemplated in the 1977 department work schedule. 4. The Public Works Director, Warren C. Gonnason, has recommended that the request for waiver of off-site improvements be denied. In lieu thereof, he recommends approval of an indefinite deferral of off-site improvements subject to the signing and filing of restrictive covenants in which the owner agrees to participate in an L.I .D. for such improvements at a future time. The Planning Department has concurred in this report. 5 . It can be assumed that an L. I .D. will eventually be created to provide these improvements at such time as Lake Washington Boulevard is widened or redesigned. 6 . Mr. Walker has submitted a Declaration of Restrictive Covenant document agreeing to participate in a future L. I . D. E-002-77 Page Four W-003-77 #34-77 Short Plat RECOMMENDATION: Short Plat: Approval Exception: 1 . Approval subject to grading and paving the existing pipestem to a 10 foot width, as per ordinance. 2 . The remaining 20 foot area not paved shall accommodate storm drainage and is to be landscaped with landscaping to consist of vegetation natural to the area, as per ordinance. Waiver: Approval subject to recording the Declaration of Restrictive Covenant document with King County. SUMMARY OF REQUEST: Applicant requests a two lot short plat, a waiver of the off-site improvements and an exception to the platting ordinance for the development of a pipestem type lot. SUMMARY OF Planning Department: Approval for requests on RECOMMENDATION: short plat and exception. Approval subject to conditions on waiver. Hearing Examiner: Approval on short plat. Approval subject to conditions on exception. Approval subject to conditions on waiver. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on January 31 , 1977 , at 10 :20 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record by reference. Gordon Y. Ericksen, Planning Director, entered the following exhibits : Exhibit 1: Assessor Map - location of parcel of land on Lake Washington Boulevard. Exhibit 2 : G. M. Walker Short Subdivision Map, received by Planning Department on December 17, 1976 . Exhibit 3: Letter from Public Works Director, dated January 28 , 1977, re Waiver Application #W-003-77 . Letter was read into the record by the Hearing Administrative Assistant. The Planning Director, Gordon Y. Ericksen, reviewed the Planning Department report. In regard to the letter from the Public Works Director recommending denial of the waiver, he indicated that approval of indefinite deferral was more acceptable than a waiver if the applicant would sign restrictive covenants . The Public Works Director, Warren C. Gonnason, noted that he recommended the waiver application be denied and that an indefinite deferral be granted subject to the applicant signing a restrictive covenant agreeing to participate in any future Local Improvement Districts . The applicant indicated that such restrictive covenants have been signed and sent to the city. t A S E-002-77 Page Two W-003-77 #34-77 Short Plat The Examiner entered Exhibit 4 : Telephone conversation with Dick Houghton, Engineering Supervisor, which concurred with the Public Works letter and noted that the Engineering Department could not establish a grade for Lake Washington Boulevard at this time since the Boulevard may be widened or improved in the future. • The Examiner asked for comments from the applicant, . Mr. Walker. Mr. Walker responded that he had no comment. The Examiner asked for any comments in opposition or concurrence from the audience. There was no response . The Examiner directed questions to the applicant regarding the access road to the existing house located on the pipestem lot and noted that the present condition of the roadway is deeply rutted. The applicant responded that he had plans to gravel the roadway but not to regrade for the reason that only the front two lots, Lots A and B, would be utilizing the roadway. In response to the Examiner's question, the applicant indicated that the back lot was divided four years ago and has access by a 15 ' easement on the north property line. The Planning Director stated that with reference to the improvements that were mentioned by the applicant there were three potential problems : access to the pipestem lot, storm water runoff and improvements proposed. If the access road were used by other than one party, it would require improvement other than gravel and would require regrading and surfacing with a material such as asphalt. Mr. Walker responded that only Lots A and B would be utilizing the access, and regarding the storm water runoff, water had been running along the road for fifteen to twenty years . He also indicated that a ditch is located along the north side of the easement road. The hearing on Items E-002-77, W-003-77 , and #34-77 Short Plat was closed by the Examiner at 10 :40 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1. Mr. Walker has an existing lot that is approximately 275 ' x 107 ' (approximately one-half acre) that he is proposing to short plat into two lots : Lot A, 10 ,650 square feet, and Lot B, 14,014 square feet. 2 . In order to accomplish this proposed request, three procedures must be applied,: 1) Short plat; 2) Exception to allow pipestem lot; and 3) Waiver from existing off-site improvements. 3. The original platting of this property and adjacent areas consisted of lots ranging in depth from 400 to 600 feet. This extreme depth caused hardships for future property owners to plat property into smaller lots conforming to the existing zoning of G-7200 and G-6000. 4 . The topography on the property has a moderate slope of approximately 9% . 5 . The residential character of the area consists of a variety of sizes of lots with the most recent platted lots consisting of approximately 7 ,000 to 9 ,000 square feet. 6 . The short plat does not create any significant problems for the subject site or for adjacent properties. The proposed property division is one of the few alternatives available for subdivision. 7. Off-site improvements presently do not exist 'in the general area along Lake Washington Boulevard. A E-002-77 Page Three W-003-77 #34-77 Short Plat FINDINGS : 8. The existing road providing access to Lot B is narrow, heavily rutted and in relatively poor condition. An existing open ditch lies directly north of the road and borders the northern property line. 9 . The northern 15 feet of the property also provides easement access rights to the existing platting lot directly east of Lot B. Mr. Walker owns this lot and the residence directly east of this property. Mr. Walker' s residential access is from Wells Avenue North. CONCLUSIONS Short Plat: 1 . The proposed lot division is compatible with the adjacent properties . 2 . The short plat also agrees with the Comprehensive Land Use Plan. Exception: 1 . The access to Lot B is accommodated by a pipestem consisting of an area 20 ' x 101 ' . This configuration agrees with the Subdivision Ordinance, Section 9-1108 23 F. (3) (d. ) , as amended, and Section 9-1109 (Exceptions) . 2 . The ordinance also requires that all pipestems at least 20 ' wide shall not exceed 150 ' in length and shall consist of permanent paving 10 ' wide for the length of the pipestem. This ordinance also requires that the remaining portion of the pipestem not paved shall be landscaped. Waiver: 1 . The Public Works Department has indicated that Lake Washington Boulevard is contemplated to be widened and redesigned in the near future . Final grades for this improvement have not been set or determined. — 2. The elevation of curbs , gutters, and sidewalks must be calculated from an existing grade usually determined at the center line of the right-of-way. 3. The Public Works Department at this time is not able to present the applicant with the required information to establish grade and this work is not comtemplated in the 1977 department work schedule. 4. The Public Works Director, Warren C. Gonnason, has recommended that the request for waiver of off-site improvements be denied. In lieu thereof, he recommends approval of an indefinite deferral of off-site improvements subject to the signing and filing of restrictive covenants in which the owner agrees to participate in an L.I .D. for such improvements at a future time . The Planning Department has concurred in this report. 5 . It can*be assumed that an L. I .D. will eventually be created to provide these improvements at such time as Lake Washington Boulevard is widened or redesigned. 6 . Mr. Walker has submitted a Declaration of Restrictive Covenant document agreeing to participate in a future L. I . D. 4 E-002-77. Page Four W-003-77 #34-77 Short Plat RECOMMENDATION: Short Plat: Approval Exception: 1 . Approval subject to grading and paving the existing pipestem to a 10 foot width, as per ordinance. 2 . The remaining 20 foot area not paved shall accommodate storm drainage and is to be landscaped with landscaping to consist of vegetation natural to the area, as per ordinance.
