Source of Income Discrimination

General Description: Source of Income Discrimination (SOID) refers to landlords refusing to accept
legitimate forms of income, such as Section 8 Housing Choice Vouchers, from existing or potential
tenants. Some jurisdictions have adopted SOID provisions that require landlords accept other forms of
rental income (refer to chart on next page). This report is intended to provide City Council examples of
other sources of income that might warrant protection from discrimination.
Background: In 1974, to combat the concentration of poverty and racial segregation in housing, the
federal government developed the Section 8 Housing Voucher Program (now known as the Housing
Choice Voucher Program), which supplies vouchers to low-income tenants to assist with rental
payments. However, despite receiving vouchers to help with rental payments, participants in the
program are said to still experience substantial difficulties obtaining housing due to landlords unwilling
to accept these legitimate subsidies provided by the federal government.
In November of 2016, the Renton City Council declared a public emergency in response to an alarming
increase in the number of landlords refusing to accept Section 8 vouchers, and passed Ordinance 5826
to prohibit such action. Ordinance 5826 was only effective until August 1, 2017; however, Ordinance
5847 was approved in June of 2017 and removes the expiration date of this particular tenant protection.
While the passage of Ordinance 5826 (and Ordinance 5847) helps low-income Section 8 participants
secure housing by eliminating the ability of landlords to not accept this particular source of income,
there are other sources of income that might deserve the same protections, such as: Social Security,
Veteran’s benefits, retirement programs, Temporary Assistance to Needy Families (TANF) or Aged, Blind
and Disabled (ABD) benefits, or any federal, state, or local subsidy programs.
Next Steps: Consider if other forms of rental assistance should be protected from discrimination. See
attached matrix showing what is protected in other jurisdictions.

Dog Kennel Update
Since the last update in June, the following has been completed:
Exterior fencing installed to mitigate wind exposure.
Automated roof vent fans installed to mitigate excessive heat.
Epoxy floor coating applied for ease of disinfecting the kennel and for disease
control.
Purchase of propane heater to mitigate cold weather.
The final step is to install a barrier panel to ease the process to disinfect the kennel for
the purpose of disease control. This should be completed within the next week or so.
Hookah Lounge Update
The Renton Fire Authority has the lead on this issue. They issued a press release on the
most recent activity. I have pasted the release below.
Local Business in Renton Evacuated and Shut Down Due to Fire Safety Concerns
On July 22, 2017, Renton Regional Fire Authority issued a “Stop Work Order” to
Nomads Lounge located at 101 SW 41st St, Suite F. The “Stop Work Order” resulted in
the immediate evacuation of the business, and requires that the owners make
required modifications to the occupancy and submit an abatement plan to the Fire
Marshal for approval prior to reopening.

Specifically, Nomads Lounge continues to exceed their occupancy load; constituting
an unsafe condition due to inadequate means of egress (exiting). The business was
cited and issued a stop work order in January for being over occupancy that resulted
in a temporary shutdown at that time. Additionally, the business was issued a stop
work order on July 3, 2017, for the use of a cooktop due to improper installation
without proper permits and for lacking any hood and ventilation system.
Due to ongoing gun violence that has occurred at the location or in its vicinity since
December, Renton Regional Fire Authority requested assistance from Renton Police
Department in conducting the occupancy load count and ensuring a safe evacuation
for employees and patrons of the business.

Alcohol Impact Area
This is a multi‐step project. The first step was to identify the need of such an ordinance
and to identify the area. This was completed. Once we identified the area we pulled
statistics of calls related to fortified alcohol. The next step was a council ordinance
which the council adopted last December requesting a voluntary ban of the sale of
identified fortified alcohol in the identified area.
Once this ordinance went into effect, we have six months to track calls for service in the
area to determine if this voluntary ban had an effect and to determine who was
complying with the voluntary ban.
We identified seven establishments that sold fortified alcohol in the targeted area.
Those seven establishments are:

South Seas

101 Grocery

Prior to the council action on a voluntary ban, both Safeway and Fred Meyer pulled all
of the products off the shelf. Commander Jon Schuldt visited all of the establishments
and discussed the voluntary ban.

Commander Schuldt revisited the establishments in March and in June. Both Safeway
and Fred Meyer were in compliance with the voluntary ban, the other establishments
were not. The small businesses chose not to participate with the voluntary ban due to
regular customers and potential loss of sales.
A statistical comparison of calls for service from January thru June of 2017 was
conducted using the same criteria as was done in 2016 for this same time period. The
total calls for service increased by only four incidents in 2017 as compared to 2016. The
purpose was to determine if the voluntary ban had an impact.
The result of this voluntary ban had little to no impact on calls for service in the
identified area. The two largest retail establishments pulled their product off the
shelves and will continue to abide by the voluntary ban.
Commander Schuldt concluded that the current level of intoxicants available for
purchase in the identified area if restricted by the Liquor and Cannabis Board (LCB)
would not have a significant impact on the homeless and/or public inebriation in the
downtown core. The LCB would require substantially more documentation and impact
before they would consider an Alcohol Impact Area in the downtown core and restrict
the sales of fortified alcohol to remaining four small businesses. (South Seas appears to
be out of business.)
At this point we are recommending that we do not pursue an Alcohol Impact Area.
However we will continue to develop a stronger presence in the downtown area and
will work with local businesses to develop a stronger relationship to improve the
appearance and perception of our downtown.
