SEC-TWN-R: The proposal is for the remodel of an existing 908
square foot single family residence located in the Residential — 8 du/ac (R-8) zone. The Cedar
River is located on the southern boundary of the property. The present location of the existing
residence encroaches 4 feet into the adjacent property on the east. The remodel will relocate
the structure entirely within the subject property at setbacks of 5 feet from the east side
property line, 10 feet from the west side property line, 102 feet from the front property line, and
61 feet from the ordinary high water mark of the river. The proposed remodel will also raise
the existing structure to a second level and add a new 908 square foot main floor to align with
the existing walls. Included with the proposal is the construction of a 416 square foot attached
garage, the construction of additional decks on both floors, and the demolition of the existing
nonconforming garage. The remodeled residence will comply with the setbacks, height, and
lot coverage requirements specified in both the Shoreline Master Program and the
development standards of the R-8 zone. Construction is proposed to begin September of
1999 and will be completed by April of 2000.
WATER BODY/WETLAND: Cedar River (Urban Designation)
An exemption from a Shoreline Management Substantial Development Permit is hereby
granted on the proposed project described on the attached form for the following reason(s):

X Construction on shorelands by an owner, lessee or contract purchaser of a single-
family residence for his/her own use or for the use of his/her family, which residence
does not exceed a height of thirty-five (35) feet above average grade level and which
meets all requirements of the State agency or local government having jurisdiction
thereof, other than requirements imposed pursuant to this chapter.
1. "Single family" residence means a detached dwelling designed for and
occupied by one family including those structures and developments within a
contiguous ownership which are a normal appurtenance. An "appurtenance" is
necessarily connected to the use and enjoyment of a single-family residence
and is located landward of the ordinary high water mark and the perimeter of a
wetland.
2. Construction authorized under this exemption shall be located landward of
the ordinary high water mark.

Current use of the site: The site is currently used as a residential lot. There is an existing
one story home on the lot that will be remodeled.
Adjacent water area: Cedar River
Nature of the shoreline: A riparian area with a sand and gravel bank, with some small
pieces of concrete installed by previous owners. There is no bulkhead.
Neighboring Structures: The Cedar River is on the southern boundary of the property
and there are no structures north of the home. There is a single family home on the lot to
the east of the home.
Proposed use of property: The property will continue to be used as a residential lot.

Construction Cost: $75,000 (estimate)
Proposed construction dates: September, 1999 -April, 2000
Basis for Exemption: The exemption is sought because it involves construction on an
existing single family residence, for the owner's use, which is less than 35' tall, and that
