ThatsaidGrantor(s),forandinconsiderationofmutualbenefits,dobythesepresents,grant,bargain,sell,convey,andwarrantsuntothesaidGrantee,itssuccessorsandassigns,aueasementforpublicutilities(includingwater,wastewater,andsurfacewater)withnecessaryappurtenancesover,under,through,acrossanduponthefollowingdescribedproperty(theright-of-tvay)inKingCounty,Washington,moreparticularlydescribedonpage1.(oriffulllegalisnotonpage1--ExhibitA.)Forthepurposeofconstructing,reconstructing,installing,repairing,replacing,enlarging,operatingandmaintainingutilitiesandutilitypipelines,including,butnotlimitedto,water,sewerandstonndrainagelines,togetherwiththerightofingressandegresstheretowithoutpriorinstitutionofanysuitorproceedingsoflawandwithoutincurringanylegalobligationorliabilitytherefor.FollowingtheinitialconstructionofitsfaciLities,Granteemayfromtimetotimeconstructsuchadditionalfacilitiesasitmayrequire.Thiseasementisgrantedsubjecttothefollowingtennsandconditions:I.TheGranteeshalt,uponcompletionofanyworkwithinthepropertycoveredbytheeasement,restorethesurfaceoftheeasement,andanyprivateimprovementsdisturbedordestroyedduringexecutionofthework,asnearlyaspracticabletotheconditiontheywereinimmediatelybeforecommencementoftheworkorentrybytheGrantee.2.GrantorshallretaintherighttousethesurfaceoftheeasementaslongassuchusedoesnotinterferewiththeeasementrightsgrantedtotheGrantee.Grantorshallnot,however,havetherightto:a.Erectormaintainanybuildingsorstructureswithintheeasement;orb.Planttrees,shrubsorvegetationhavingdeeprootpatternswhichmaycausedamagetoorinterferewiththeutilitiestobeplacedwithintheeasementbytheGrantee;orc.Develop,landscape,orbeautifytheeasementareainanywaywhichwouldunreasonablyincreasethecoststotheGranteeofrestoringtheeasementareaandanyprivateimprovementstherein.d.Dig,tunnelorperfonnotherformsofconstructionactivitiesonthepropertywhichwoulddisturbthecompactionorunearthGranteesfacilitiesontheright-of-way,orendangerthelateralsupportfacilities.e.Blastwithinfifteen(15)feetoftheright-of-way.Thiseasementshallrunwiththelanddescribedherein,andshallbebindingupontheparties,theirheirs,successorsininterestandassigns.Grantorscovenantthattheyarethelawfulownersoftheabovepropertiesandthattheyhaveagoodandtavhilrighttoexectttethisagreement.BythisconveyancesGrantorwillw’arrantanddefendthesaleherebymadeuntotheGranteeagainstallandevetypersonorpersons,whomsoever,lawfullyclaimingortoclaimthesame.Thisconveyanceshallbindtheheirs,executors,administratorsandassignsforever.IN‘WITNESSWHEREOF,saidGrantorhascausedthisinstmmenttobeexecutedthisdayof___________20.INDIVIDUALFORMOFA(KNOJVLEDGMENTNotarySealniustbewithinboxSTATEOfWASHINGTON)ssCOUNTYOfKING)IcertifythatIknoworhavesatisfactoryevidencethat_________________________________
