ImprovementsDEPARTMENTOFCOMMUNITYANDECONOMICDEVELOPMENT—“Renton0AGREEMENTTOCONSTRUCTApplicant’sNameandAddressName:SocheatKhnorIMPROVEMENTSANDSTABILIZEAND/ORRESTORETHERIGHTOFWAYAND/ORAddress1:26721106thAveSESITEAddress2:Kent,WA98030ProjectNo.(PR)/ConstructionPermitNo.(C/U)ProjectNamePHi6-000243/U16-006297BounShortPlatGuaranteeAmountSiteLocation$297,890.121012DuvalIAveNE,Renton,WA98059ThisAGREEMENTismadeandenteredintothis29dayofJune,2018,betweentheCityofRenton,hereinaftercalledtheCITY,andtheabovenamedapplicant,hereinaftercalledAPPLICANT.BasisforAGREEEMENT:WHEREAS,theundersignedAPPLICANTwishestoconstructrightofwayimprovementsand/orperformsiteworkattheabovelocation,andWHEREAS,theCITYwillauthorizesiteworkorlimitedrightofwayuseandpermitsaidconstructionuponagreementbytheAPPLICANTtocomplywithalltermsofthisAGREEMENT;andNOW,THEREFORE,theAPPLICANTherebyagreesandbindsitselfanditslegalrepresentatives,successors,andassignsasfollows:TermsoftheAGREEMENT:1.TheAPPLICANTguaranteesthatconstruction,maintenanceandrestorationofroadway,site,drainage,retention/detention,water,andsanitarysewerfacilitieswilloccurinfullcompliancewiththeapprovedconstructionplansandprofiles,includinganyapprovedamendmentsthereto,andinfullconformancewithapplicableCITYordinances,standardsandspecifications,tothesatisfactionoftheCITY.2.Ifthesubdivision,shortsubdivision,orsiteplanisnotrecorded,orthebuildingdoesnotreceiveanycertificateofoccupancyorfinalbuildingpermit,theAPPLICANTagreestorestoretherightofwaytoitsoriginalconditionorbetterANDstabilizethesiteorcomplywiththeconditionsofanypermitorapproval,including,butnotlimitedto,correctiveworknecessarytoprovidedrainageconsistentwithapprovedplansandconditions,andtoprotectthepublichealth,safety,andwelfare,includingeffectsonwaterquality.3.UnlessotherwiseauthorizedbytheCITYinwriting,asspecifiedintheconditionsofthepermit,alldeferredworkshallbecompletedwithintwelvemonthsfollowingtheissuanceofthecertificateofoccupancy,ortwelvemonthsafterrecordingthesubdivision,shortsubdivisionorsiteplan,orpriortotheexpirationorcompletionofthedeferralpermit,whicheveroccursfirst.4.TheCITYmustapprove(inwriting)anyproposedchangesfromtheapprovedplanspriortotheAPPLICANTbeginningsuchwork.5.Priortobeginningconstruction,apreconstructionmeetingshallbeheldwiththeCITY,theAPPLICANTandtheAPPLICANT’Scontractor(s).12/1/2018 ProjectNo.(PR)/ConstructionPermitNo.(C/U)ProjectNamePR16-000243/U16-006297BounShortPlat6.TheAPPLICANTshallberesponsibleforthecostofanycorrectiveworkonoroffthesiteorwithintherightofwaytotheextentthatsuchcorrectivemeasuresareassociatedwithworkperformedand/ornotcompleted.7.TheAPPLICANTshallpayanyfeesrequiredinconjunctionwiththeprojectpursuanttotheCityofRentonFeeSchedule.8.IftheAPPLICANTfailstoproceedwithduediligenceandingoodfaithintheworkprovidedherein,theAPPLICANTshallremoveallorpartofconstructedfacilitiesandrestorealldisturbedareasofthesitetoitsoriginalorbetterconditionattheAPPLICANT’Ssoleexpense.TheAPPLICANTshallnotstop,delayorabandontheprojectwithoutfirstrectifyinganydamage,stabilizingandrestoringtherightofwayand/orsitebygrading,hydroseeding,and/orlandscapingasmayberequiredbytheCITY.9.PriortotheCITY’Sapprovalandauthorizationofconstruction,theAPPLICANTshallprovidetheCITYwithafinancialguaranteeintheamountandinaformapprovedbytheCITYtosecurecompliancewithalltermsofthisAGREEMENT.ThefinancialguaranteeshallremaininforceandeffectuntilwrittenreleasebytheCITY.TheAPPLICANT’Sobligationtoperformworkandpayfeesorotheramountsisnotlimitedtotheamountoftheassociatedfinancialguarantee.10.UponcompletionoftherequiredpublicimprovementstothesatisfactionoftheCITY,theAPPLICANTshallfilesuchfurtherfinancialguaranteesandagreementsintheamountsandformsacceptabletotheCITYtosecurethesuccessfuloperationandmaintenanceoftheimprovementsforaminimumperiodoftwoyearsafterconstructionapproval.IntheeventthattheAPPLICANTfailstopostsuchadditionalfinancialguaranteeinstruments,theCITYmaydemandpaymentontheperformancefinancialguaranteeinstrumentsandmayutilizesuchamounttosecureoperationandmaintenanceofimprovementsinaccordancewiththeRentonMunicipalCodeandthisAGREEMENT.11.TheAPPLICANTshallfurnishtotheCITYasetof“finalcorrectedplans”(photoMylarquality)ofallrequiredpublicandprivatefacilitieswhenapplicable.12.TheAPPLICANTshallberesponsiblefortheproperperformance,safeconductandadequatepolicingandsupervisionoftheproject.ThisresponsibilityshallnotbelessenedorotherwiseaffectedbytheCITY’Sapprovalofplans,specifications,orwork,orbythepresenceattheworksiteoftheCITY’Srepresentative(s),orbythecompliancebytheAPPLICANTwithanyrequestsmadebysaidrepresentative(s).13.TheAPPLICANTshallindemnifyandholdtheCITYanditsagents,employeesand/orofficersharmlessfromandshallprocessanddefendatitsownexpenseallclaims,damages,suitsatlaworequity,actions,penalties,losses,orcostsofwhatsoeverkindornature,broughtagainsttheCITYarisingoutof,inconnectionwith,orincidenttotheexecutionofthisAGREEMENTand/ortheAPPLICANT’SperformanceorfailuretoperformanyaspectoftheAGREEMENT.Provided,however,thatnothinghereinshallrequiretheAPPLICANTholdharmlessordefendtheCITYfromanyclaimarisingfromthesolenegligenceoftheCITY’Sagents,employeesand/orofficers.22/1/2018 ProjectNo.(PR)/ConstructionPermitNo.(C/U)ProjectNamePR1G-000243U16-006297BounShortPlat14.IntheeventthatanypartydeemsitnecessarytoinstitutelegalactionorproceedingstoenforceanyrightorobligationunderthisAGREEMENT,thepartiesheretoagreethatanysuchactionorproceedingshallbebroughtinacourtofcompetentjurisdictionsituatedinKingCounty,Washington.15.ItistheAPPLICANT’SresponsibilitytonotifytheCITYofanychangeinaddress,phonenumber,orchangeofownershipofproperty.ItistheAPPLICANT’Sresponsibilitytoarrangeforreplacementofany/allfinancialguaranteespriortothetimethatachangeofownershipoccurs.TheAPPLICANT,asindicatedinthisAGREEMENT,shallremainresponsibleforalltermsoftheAGREEMENTuntilsuchtimeasanewownershallreplacethefinancialguaranteesandcompleteanyotherdocumentsasrequiredbytheCITY.ReleaseRequirements:ThisAGREEMENTshallremaininforceandeffectandshallnotbereleaseduntilalltermsofthisAGREEMENThavebeencompletedtothesatisfactionoftheCITY.INWITNESSTHEREOF,thepartiesheretohaveexecutedthisAGREEMENTasofthedayandyearfirstabovewritten.APPLICANTSociiecf)3t’z10-/2,/)\\Js-;nAY50yReceivedforCityofRentonByrNameTitleDate7/JgDate32/1/2018
