HISTORY: Prior to May 24 , 1960, all of Block 36 was zoned R-l. On May 24, 1960, Lots 1 through 10, Lot 18, and the most westerly extensions of Lots 15 through 17 were rezoned to B-1 upon applica- tion filed by Mr. Fred Akers. On October 24, 1966, the southerly half of Lot 5 and all of Lots 6 through 16 were rezoned to R-3 upon application filed by Pacific General Construction Company as contract purchaser. On July 21, 1968 , the eastern portion of Lot 17 (which was still zoned R-1) was rezoned to B-1 upon application filed by Mr. Alec • Bakamus . Ericksen, Planning Director; Harriet Hilder, Recording Secretary The May 1972 public hearing meeting of the Renton Planning Commis- sion was called to order by Chairman Teegarden at 8 : 05 p.m. 1 . ROLL CALL was taken by Secretary Mola. All Commission members responded present except Moritz and Yankeh, both of whom had previously advised they would be unable to attend. ACTION: MOVED BY ROSS, SECONDED BY DENZER, THAT THE ABSENT COMMISSIONERS BE EXCUSED. MOTION CARRIED. 2 . APPROVAL OF MINUTES With reference to the minutes of the meeting of May 10 , 1972, Scholes requested that his comments in the first paragraph of page 6 be amended to show that he opposed the granting of the General Securities rezone for the following reasons : 1. There was not a reversionary clause in the rezone which he felt necessary to protect adjacent property owners in the event proposed construction was not completed. It was also felt the clause should be included because the rezone might be considered spot zoning. 2. There was not adequate consideration, in his opinion, of a buffer zone to protect adjacent northerly owner. • 3. Proposed use, in his opinion, was not the highest and best use in a commercial zone. As there were no other additions or corrections to the minutes of the meeting of May 10, 1972 , the Chairman declared them approved as corrected...by Scholes.. 3. CONTINUED PUBLIC HEARING ITEM REZONE APPLICATION (a) HOLMES, JAY E. , Appl. No. R-682-71; rezone from R-3 to B-1; property located east side of Jefferson Ave. NE, north of Sunset View Apartments The Chairman described the application, noting that the matter had been continued from the meeting of April 26 and referred to the Commission Zoning Committee for review and recommenda- tion. Renton Planning Commission Meeting May;,,24, 1972 Minutes - Page 2 The Planning Director displayed vicinity map, blow-up map of the area and proposed development plan submitted by the appli- cant, noting the development would involve the vacation of a portion of Jefferson Avenue NE on the west side of subject property as well as vacation of a portion of Index. Avenue ,NE. Proposed development is for a two-story structure. The upper level would be a medical clinic and professional offices with parking for this facility on the property presently zoned .R-3 north of Sunset. View Apartments . The lower level is proposed for a drug store of, approximately 27 ,000 square feet and new shops of approximately 15 ,00 square feet adjacent the drug store tothe south. Access to the clinic would be from Kirk- ! land Avenue NE; access to the lower level would be from NE 10th Street and the service road east of Sunset Blvd. NE. Slides of the property were . shown. Mr. Jay E. Holmes, the applicant, spoke on behalf of the rezone ; . and discussed his proposed development plan in detail, indicating the property zoned R-3, for which clinic parking is proposed, is under his ownership and that he would be requesting a special permit for the clinic at a future date. 1 Ross pointed out that subject application is for rezone from R-3 to B-1 and that , the Commission should be considering the application on its merits as concerns good zoning and agree- ment with the Comprehensive Land Use Plan. The development of 1 the R-3 area is not of consequence to this hearing. ; Seymour asked if adequate parking could be provided on the west or front side of the proposed structure. The Planning Director stated that there would be sufficient space to provide required parking for the structure as proposed. Seymour stated she felt all access to the subject property should be restricted from Kirkland Avenue NE in light of opinions expressed previously by residents on the east side of Kirkland. Seymour noted further that a buffer should be provided between the Holmes development and the residential properties to the east, and if parking can be provided in the front, that would be a better plan. Seymour stated the plan should be revised to eliminate the ramp shown leading from the upper level of the property to the lower level as well as parking and access to the property from Kirkland; and that restrictive covenants should be drawn to restrict access from Kirkland Avenue NE. Humble stated he agreed that access from Kirkland should be restricted insofar as the property contained in subject rezone is concerned as well as the proposed ramp; however, the Commis- sion is not in a position to make any judgments on any property I other than that requested for rezone. Subject property does not abut Kirkland Avenue NE. The intervening property, although owned by' the applicant, is zoned R-3 , and development on that land as proposed for a clinic and its parking would require review and approval of the Planning Commission. Ross noted that property presently being considered for rezone has access from a dedicated right-of-way (NE 10th Street) ; that discussion at this time concerning proposed development on other than subject property is out of order. Scholes asked if the proposed lower level drug store and shops building would be constructed entirely on B-1 zoned property if the rezone were granted. The applicant replied affirmatively. The Chairman called for the Zoning Committee report. Holmes, #R-682-71, from R-3 to B-1 zoning. "We find that the application for subject property to be in accordance with the Comprehensive Land Use Plan. "We have determined that the subject property has public access from a dedicated right-of-way and existing ordi- , ; nances will control parking, setbacks, and all require- ments pertaining to the B-1 zone. " It was MOVED BY DENZER, SECONDED BY HUMBLE, THAT THE PLANNING COMMISSION ACCEPT THE COMMITTEE REPORT. Considerable discussion ensued concerning whether such action was necessary. The Chairman indicated the motion was to formally receive the report; Humble agreed. Seymour stated she felt the action was unnecessary and would imply the Plan- ning Commission accepted and agreed with the action of the Zoning Committee. Later in the meeting the staff was directed to request a ruling from the City Attorney on this matter. Pending MOTION CARRIED. Other audience comments were invited. ACTION: MOVED BY ROSS, SECONDED BY MOLA , THAT THE PLANNING COMMISSION CONCUR IN THE RECOMMENDATION OF THE ZONING COMMITTEE APPROVING THE HOLMES REZONE APPLICATION AND FORWARD TO THE CITY COUNCIL FOR ITS CONSIDERATION. Seymour stated there should be restrictive covenants control- ling access. Since the motion is to concur in the committee recommendation, Seymour stated she disagreed on two points : First, when considering a rezone to B-1 , access is very important. A greater amount of traffic will be generated than from a resi- dential zone. The question is access , not parking; how will all the new traffic get there. If traffic could come from the west and get around to the rear there would be no objection, but there should be no access from Kirkland. Secondly, when the property is rezoned to B-1, something will eventually be developed there and consideration should have been given to setbacks. Therefore, there should be a requirement in terms of site plan approval by the Planning Commission considering the complex nature of the area. Committee Chairman Ross stated his committee had checked the access question thoroughly; that the Parking and Loading ordi- nance prevents access to B-1 , property from other than a ' dedicated public right-of-way and that subject property does not abut Kirkland Avenue NE. NEW PUBLIC HEARING ITEM REZONE APPLICATION (a) COLLMAN, EILEEN, Apple No. R-695-72; rezone from R-2 to ' B-l; property located north of City Center Motel, fronting on S. 2nd Street The Chairman described the application. The Planning Director pointed out property location and displayed a vicinity map, noting that property to the east zoned multi-family is being used for parking for the existing Safeway store. Should sub- ject rezone be approved, Safeway will lease the property from Mrs. Collman and construct a new store., The old store will be subleased for a retail use. Subject site is presently used as a mobile home park. The mobile homes will be removed and the park will cease to exist. The rezone request is in agree- ment with the Comprehensive Land. Use Plan. Off-site improvements will be required on S. 2nd Street. Slides of the property were shown. Lengthy review ensued concerning the application. Seymour asked if it would be appropriate to include in the rezone site plan approval by the Commission. The Planning Director replied that this would be possible; however, normal procedure is staff review at time of application for building permit. At that ' time compliance with specific Commission requests is generally obtained at the staff level. With reference to Seattle Pipeline Right-of-Way adjacent to the south side of S. 2nd Street, the Planning Director noted that Safeway is negotiating a lease to permit parking on this right- of-way. Mr. Norton Carlson, representing Safeway Stores , noted the lease will be a 30-day revocable one, as the Seattle Water Department policy is not to issue long-term leases for use of their r ghts-of-way. .,..However,. Safeway' s previous lease has been in effect for some years without a revocation problem. Mr. Carlson stated he would furnish copy of a letter received from the Seattle Water Department in answer to his request for a long term lease which outlines their policy in these matters. Discussion ensued concerning the proposed development of a. new Safeway store. Mr. Carlson noted, in answer to query by Teegarden, that Safeway leases the R-2 property used for parking for the existing building from an insurance company. The Chairman requested that Mr. Carlson contact the insurance company to determine whether that firm would be willing to file for rezone for that R-2 parcel to B-1 in order to legalize the use and standardize zoning in the area. The matter now before the Commission is request for rezone from multi-family residential to commercial; such request being in agreement with the Comprehensive Land Use Plan. The Assistant Planning Director pointed out property location on the zoning map and displayed vicinity maps and plot plan of subject property. Slides were shown. Commission comments were invited. Seymour expressed concern regarding possibility of access to subject property from Kirk- land Avenue NE even though the logical access would appear to Ibe from Jefferson Avenue NE. It was noted that the undeveloped ! property directly east of subject property is zoned for multi- 1 family residential and could be used for business parking for the commercial enterprises to be located westerly by special 1 permit of the Planning Commission. (Note by Planning Director: 1 the Commission in the past has allowed business parking in the R-4 zone by special permit) . Seymour felt that any access to subject property from Kirkland through the R-3 zoned property would be detrimental to the residents on the east side of Kirkland Avenue NE and urged consideration of restriction of any such possible access . John Becker, 1034 Kirk- land Avenue NE, stated his concern regarding the possible access from Kirkland Avenue NE, citing similar problems with the apartment complex located on the northwest corner of NE 10th Street and Kirkland Avenue NE. Mr. Becker also urged consideration of a fence or hedge requirement along the easterly boundary of subject property for the protection of children due to the steep topography factor. Mr. Glenn Burrelle, 1010 Kirkland Avenue NE, also indicated his concern regarding the possibility of access to subject property and requested that access be restricted from Kirkland Avenue NE. • Discussion ensued among Commission members concerning the access problem and mention was made of the possibility of restrictive covenants to control ingress and egress from Kirkland for the protection of the single family residents in the area. The Comprehensive Land Use Plan indicates public use for the southerly portion of subject property, single family for the northerly portion, with an area shown as green belt on the westerly boundary. Slides of the property were shown. The Chairman stated the Commission must make a determination regarding the Comprehensive Land Use Plan designation for the area before the rezone request can be considered. Planning Commission members attending the field trip noted that the ravine north of subject property appears to be a logical topo- graphic break between the zones or land use designations . The proposed use of the existing residential structure for medical offices would be compatible with the hospital use directly to the south and would have no detrimental effects on the single family residential uses across the ravine to the north. Commission discussion ensued regarding the land use plan, and its flexibility as determined by the Commission with reference to compatibility with existing uses . Denzer and Seymour agreed that the color zones on the official plan should not pin the boundaries down definitely; that the Commission has flexibility in its interpretation of the plan depending upon circumstances, existing surrounding uses and natural features . The application proposes extension of an existing building with 17 ,600 square feet in warehouse .' . and 300 square feet in office space.. The truck loading areas shown in the proposed plan render some parking spaces unusable . . and trucks would have to back out onto the public right-of-way. The staff prepared an alternate plan to alleviate this problem which involves a reduction in the size of the building proposed. Landscaping will be provided. Audience comments were invited. Mr. Orville Dawson of Seattle, representing the applicant, stated that his office unfortunately submitted the wrong plan to the Planning Department. He dis- played the plan he had intended to submit showing one of the truck loading areas in a different location which did not encroach on the parking stalls . However, this plan did not, solve the problem of trucks having to back out on the public ' right-of-way. The applicant is required to provide vehicular maneuvering space on site so that there will be no backing onto the public right-of-way. Mr. Dawson stated he believed he could work this problem out without reducing the size of the building. This will be discussed with the applicant when he returns to the area and the proper correction made. The applicant was advised at the time of filing of the rezone application that the Planning Commission would make a determination as to the interpretation of the Com- prehensive Land Use Plan designation for subject area, keeping in mind that the line between the multi-family use and the commercial use in the area is a flexible one subject to ruling of the Commission.
