NEW PUBLIC HEARING ITEMS FOR PLANNING COMMISSION CONSIDERATION AT MEETING OF OCTOBER 27, 1971 The Planning Director described in detail the following items 'of new business. Plot plans and vicinity maps were displayed for each item and slides were shown of each property. REZONE APPLICATIONS (a) HOLMES , JAY E. , Appl. No. R-682-71; rezone from R-3 to B-1; property located on the east side of Jefferson Ave. NE immedi- ately north of Sunset View Apartments (northeast corner of NE 10th St. and Kirkland Ave. NE) The Planning Director noted that the legal description furnished by the applicant does not agree with the vicinity map also sup- plied by the applicant in that the legal description follows lot lines and the vicinity map does not. This will be discussed with the applicant when he returns to the area and the proper correction made. The applicant was advised at the time of filing of the rezone application that the Planning Commission would make a determination as to the, interpretation of the Com- prehensive Land Use Plan designation for subject area, keeping in mind that the line between the multi-family use and the commercial use in the area is a flexible one subject to ruling of the Commission. Therefore, initially, the Commission should rule on whether the application may be considered as a valid rezone request or if the applicant should be advised to request a change to the Comprehensive Land Use Plan designation prior to consideration of the rezone request. Considerable discussion ensued regarding this item, and the plans and slides were reviewed, several times. (Note further action on this item under item 5 . Committee Assignments . ) (b) HIGHLANDS CONVALESCENT CENTER, Appl. No. R-684-71; rezone from G-7200 to R-3; property located on east side of Edmonds Ave. NE between Sunset Blvd. NE and NE 12th St. Subject rezone relates to the access problem due to state acquisition of right-of-way for the widening of Sunset Blvd. The applicant, owner of the nursing home, lives in the single family residence on subject property. Topography of the area is such that access road to the nursing home has been cut off and new access will be provided through subject property. While access could be provided without necessity for rezone, the property owner would like to have both parcels under his ownership zoned the same. The nursing home site is presently zoned R-3 . The rezone request is in agreement with the Com- prehensive Land Use Plan designation. Commission discussion followed on this item, and the slides and plans were reviewed in detail.
