Request for a grading and filling permit, site plan approval for the construction of an office building, warehouse/repair shop and storage yard facility in an M-P zone and a Shoreline Management Act permit. D. OFFICIAL TITLE AND SUMMARY OF PROPOSED ACTION. The official title of the proposed action is Scarsella Brothers, Inc. Office and Warehouse/Shop Facility. In summary, the development as proposed will make possible the relocation of the construction business office and repair shop facilities of Scarsella Brothers , Inc. from its present location in south Seattle. The proposal is to fill and grade the entire site, which would fill in the existing pond on the eastern portion of the property. Three buildings will be constructed on the property, off-street parking will be provided on the property, the property will be land- scaped and screened in accordance with environmental re- requirements, the eastern portion of the property will be surfaced with crushed rock for use as a storage yard, and the entire property will be fenced for security purposes. The actions are consistent with the City of Renton zoning and comprehensive plan requirements for this site. No variances from current plans, policies or regulations are requested. - ii - E. SUMMARY OF ENVIRONMENTAL IMPACTS . Short Term: Construction noise, dust and traffic are unavoidable short term impacts for those persons in the immediate area. Long Term: Permanent loss of the portion of the pond located on this site, with the attendant loss of water- oriented birds and animals from the site. F. SUMMARY OF ALTERNATIVES . No action, alternate sites and the development or alternate development of only the westerly portion of the site. G. REVIEW PERIOD. A review period of 30 days will be allowed for this Draft Environmental Impact Statement. Review comments should be sent to Mr. Gordon Y. The Type of Action. The type of action requested is the approval and issuance of a grading and filling permit and the approval of a site plan, all pursuant to the requirements of the ordinances of the City of Renton and issuance of a Shoreline Management Act substantial development permit. It is proposed to fill and grade the site to the approximate level of West Valley Highway. Three buildings, to-wit: an office building of approximately 1,500 square feet, a warehouse/repair shop of. approximately 14 ,400 square feet and a storage building of approximately 1, 600 square feet will be con- structed on the site. The entire site will be fenced, screened and appropriately landscaped. Parking will be provided as required by the City of Renton regulations. The easterly portion of the site will be surfaced with crushed rock and utilized as a storage yard for heavy construction equipment awaiting repairs and/or maintenance or not then needed at a construction site. Once a construction pro- ject is started, the equipment for that job is left at the site and not moved unless it requires repairs and/or maintenance which cannot be accomplished in the field. When one project is completed, the equipment is moved directly to a new project site and so on. 2. Justification for the Proposed Action. Scarsella Brothers , Inc. presently operates its construction business and repair shop on a site at. 16025 Pacific Highway South. The recent death of one of the brother-owners necessitated a divi- sion of the business and its assets between the widow of the deceased owner and the surviving owner-brother, Antonio Scarsella. By this division Mr. - Scarsella retained the business itself, its operating equipment and the subject property and the widow retained the property and improvements on Pacific Highway South and other real property owned by the corporation. Antonio Scarsella is now president of the corporation. The corporation has been permitted to continue its operations out of the Pacific Highway site on a temporary basis and under a one-year lease. which expires in May of 1975. Thus, the corporation is obliged to relocate its office and repair facilities and the logical site is the subject property, which has been owned by the corporation for more than ten years. - 1 - The site is classified for the requested use and the pro- posed use would intrude upon no other less intensive uses. The West Valley Highway provides the site and its proposed use with access. The site is presently undeveloped. 3. Location and description. The site of approximately 5. 81 acres is located on the east side of West Valley Highway (SR 181) approximately 1, 200 feet north of Southwest 43rd Street. The site is of irregular shape and measures approximately 694 feet on the north, 330 feet on the east, 888 feet on the south and an arc distance of 378 feet on the west (abutting West Valley Highway) . The property is bounded on the east by existing railway facilities and rights- of-way. The property is zoned M-P. Sternoffs Metals Corporation' s operation is located to the southeast across the railway right- of-ways . The legal description of the site is as follows : The South 329 . 85 feet of Government Lot 7 , Section 25, Township 23 North, Range 4 , East, W.M. , King County, Washington, lying west of Puget Sound Tractim Light and Power right-of-way and east of State Highway SR-1; EXCEPT the east 15 feet thereof for road and lane purposes. The site is located in red on Exhibits A and B. The general location of the portion of the ponding area located on the site is shown cross-hatched on Exhibit B. 4 . Historical Background. This site was purchased over ten years ago as a future site for the operations of the construction company. No specific planning was developed until the death of the owner' s brother and the consequent division of properties , necessitating this present planning. 5. Public Participation. A. The Soil Conservation Service of the United States Department of Agriculture has designated the pond portion of the site as, a potential site for wetlands retention in connection with the proposed Green River Flood Control Zone District. The Soil Conservation Service ' s wetlands inventory of the Green River Valley is shown on Exhibit C. The letter agreement between the City - 2 - of Renton and the Green River Flood Control Zone District and other participating municipalities provides in part that the local organizations, including the City of Renton, will purchase in title or perpetual easement and maintain in public control during the life of the flood control project at least 110 acres of suitable wetland habitat at locations approved by the Soil , Conservation Service and the Washington State Department of Game. B. Public meetings were held before the Renton Planning Commission on March 27th, June 26th and July 10, 1974 . Minutes of those meetings are on file with the Planning Depart- ment' office in the Municipal Building. The minutes of the meeting of June 26 , 1974 state that the Planning Commission' s Zoning Committee report stated in part: Request for filling and grading were discussed. The suggested development of a wildlife sanctuary on a portion of the subject property was determined to be the paramount concern to be reviewed. The location of a sanctuary should not have a major arterial highway along one side and a main line railroad trackage on the opposite side. The sanctuary would not benefit from the high cost of installed utilities and access that now exist. The committee feels the selection of sanctuary site should be the result of finding the site to be most remote from major traffic thoroughfares and that it should be planned into a compatible development that would best preserve those amenities needed to nurture the existence of our fellow creatures. C. A public meeting of the Renton Planning Commission was held on July 31, 1974 to consider new proposals regarding the Comprehensive Land Use Plan and the discussion included the Soil Conservation Service ' s wetlands retention requirements. The Conservation Chairman of the Seattle Audubon Society and other conservation groups appeared and gave testimony at that meeting. The minutes of that meeting, which are on file in the Planning Department office in the Municipal Building, include the following resume of the testimony on behalf of the Seattle Audubon Society: Leonard Steiner, Conservation Chairman, Seattle Audubon Society, Joshua Green Building, Seattle, offered the follow- - ing main areas of concern for preservation: -the small pond to the east of the Green River, the old Driscoll Boys Farm north of the Boeing Kent facility, and the area near the new South Center Industrial Park.. He stated that the primary area to be preserved for wildlife is the marshland. It is their opinion that habitat for wildlife needs cannot be - 3 - engineered but requires natural grass, trees , shrubs as they now exist. He said they are not certain if the proposed drainage channels will benefit wildlife observed in the area, as they may tend to drain the region and make it unsuitable. Referring to the ponding area proposed as a part of the drainage canal system, he said the pond would be too small for support of wildlife, and development around it would discourage wildlife. He stated that wildlife needs natural habitat in order to exist, but indicated that they feel development can occur with preservation of some valuable marsh areas. He noted the Green River Valley as a major flyway of the Pacific Coast, providing regular feeding and. nesting areas for all type of waterfowl. He offered to obtain a map identifying the area in the Valley that are significant to the support of wildlife for the Commission. The Chairman and Planning Director said they would appre- ciate the information. D. Articles about the project appeared in the Renton Record-Chronicle and copies of such articles are on file with the City of Renton Planning Department and are available for public inspection. 6 . Proposed Method of Financing and Financial Sponsors. Scarsella Brothers , Inc. owns the property free and clear and will finance the proposed site developments and improvements through private funds. 7. Relationship With Existing Laws, Policies , Plans. The proposal does not anticipate any variance or changes in the existing land use or zoning, or other requirements now governing the site. The following list of pertinent considerations show the relation of the action to existing laws and policies : A. Zoning and Comprehensive Plan. The proposal is an allowable use, subject to approval of the Planning Commission, under the existing M-P zoning and is consistent with the Comprehensive Plan, which designates the area as "Light Industry or Manufacturing Park" . Site plan approval is requested to comply with the require- ments of the Zoning Ordinance. B. The approval requested for filling and grading is intended to comply with the Renton Mining, Excavation and Grading Ordinance and the completion of such filling and grading will be governed by that ordinance. - 4 - C. The proposal is in technical variance with the wetlands retention map of the Soil Conservation Service. There are other wetlands of superior or equal value which are shown on the map (Exhibit C) and which would meet the conditions of the plan. The City of Renton and other participating local agencies (King County, Tukwila, Kent and Auburn) must designate and finance the acquisition of the wetlands property to be retained within their respective territorial limits to comply with the letter agreement entered into with the Green River Flood Control Zone District. D. Shoreline Management Act. An application for a substantial development permit was filed in March of 1974 and a notice of such application was published as required by law. The Affidavit of Publication was filed with the City of Renton on July 22 , 1974 . Review pursuant to this law has been commenced and . the Renton Planning Department will make its decision on this application after final action by the Renton Planning Commission on the requests for site plan approval and the filling and grading permits. This law also requires review and approval of the project by the State Department of Ecology. E. State Flood Control Zone Act. Scarsella Brothers, Inc. has an existing permit, No. 640-2 , issued by the State of Washington, Department of . Ecology. F. State Environmental Policy Act. This Draft. Environ- mental Impact Statement has been prepared to comply with the statute. G. The National Environmental Policy Act. This action is not under the jurisdiction of this Act. - 8. Actions/Decisions Remaining for Implementation. Approval and issuance of the grading and filling permit, approval of the site plan and issuance of a substantial development permit. Detailed plans for construction will be submitted to and checked for compliance by the Building Department of the City of Renton. The filling, grading and construction will be completed within one year. - 5 - B. EXISTING CONDITIONS. 1. Natural Setting. The site contains approximately 5. 81 acres and slopes gradually from the west to the east. In the wet season a shallow pond forms on the easterly one-half of the site and on the property to the south. The pond stagnates and dries up or becomes just mud in the summertime. Shown on Exhibit D are photographs taken of the pond on September 16 , 1974. The geological makeup of the site is the sandy loam typical of the valley. The "Soil Survey--King County Area-- Washington" issued in November of 1973 by the Soil Conservation Service (copies of which are on file with the Renton Planning Department and are available for public inspection) classified the site ' s soil as "Puyallup Series" . Attached as Exhibit E are excerpts from such Soil Survey describing Puyallup Series Soil. Shown on Exhibit F is a list of birds which have been ob- served in the Green River Valley area. Many of these birds have been observed on the site by David Castor, a member of the Audubon Society and a Woodland Park Zoo staff member. The report of the Soil Conservation Service indicates that ducks and other migratory_ waterfowl visit the site on an intermittent basis. Shown on Exhibit G are plant species found within the Green River area (source: Soil Conservation Service Draft Environmental Impact Statement. Shell Oil Environmental Impact Statement, Wilsey & Ham. ) The western part of the site is cleared except for low brushy vegetation. Deciduous trees such as willows are found on the perimeter of and in the pond area. Shown on Exhibit H are wildlife species observed in the Green River Valley area (source: Wildlife counts in the Glacier Park census route made by the Soil Conservation Service. ) It would be expected that animals indigenous to the valley area visit the property from time to time. It is believed that the pond is fed exclusively by surface waters and storm drainage runoff and not by any stream or springs. Shown on Exhibit I are pond and Green River elevations, with a discussion of the lack of interaction between the two. - 6 - • The atmospheric conditions are those generally common to the valley area. Reference is made to the Environmental Impact Statement for the City of Tukwila prepared by Wilsey & Ham. for an office complex owned by B. M. A. Mape Industries for existing atmospheric measurements in the valley area. No rare or endangered biological or botanical species are known to be present. 2. Hufnan Use, Development or Values. There is no nearby residential zoned property. There are some scattered old houses some 1,000 or more feet to the south. The large commercial development of Southcenter is located west across West Valley Highway and the Green River. There are industrial developments to the north, including N C Machinery and Stoneway Concrete Products. The existing developments to the east are industrial, notably the large tract used by Sternoff Metals Corporation and a large proposed industrial part. The transportation system in the area utilizes the West Valley Highway for private automobiles, commercial and business vehicles and public motor buses. The property is also served on the east by railroad. There are no agricultural, recreational, educational, religious or scientific uses in the area nor any known historical or archeological sites. C. ENVIRONMENTAL IMPACT OF THE PROPOSED ACTION. 1. Changes in Natural Characteristics. The proposed filling and grading will remove the existing brush and fill the lower portions of the property to a grade generally level with the existing grade of West Valley Highway and the seasonal pond will permanently disappear from the site. No significant impact will be caused on the geology or soils. The fill will consist of a sandy loam material. 7 - Three buildings, an office building, a warehouse/repair shop and a storage building will be constructed as shown on Exhibit J. The required parking areas will be surfaced with an impervious material and properly drained. The entire site will be surrounded by cyclone fencing for security purposes. The westerly frontage will be landscaped and screened pursuant to plans to be approved by, the City of Renton. The size, location and type of landscaping materials will be suitable to adequately screen the property, to enhance the entire site and to provide a wild bird habitat. The yard area will be surfaced with crushed rock. It is estimated that the runoff for the impervious surfaces will be 90% and 33 to 50% for the fill area. It is expected that some surface water will be absorbed in the fill. The evaporation rate is expected to be 25% . The placement of the fill will not affect existing utilities or other facilities . The impervious roof surfaces and parking areas will be an insignificant portion of the total site and the accelerated runoffs therefrom will be absorbed through the permeable on-site surfaces, by evaporation and the remainder will enter the drainage system to be installed per Exhibit J. This drainage system will connect the existing culvert under the West Valley Highway and empty into the Green River. The drainage system will be provided with an oil-water separator as shown on Exhibit J. All such drainage facilities will be designed and installed to meet City of Renton requirements . The surface waters which now collect on the easterly portion of the property will be channelled through the installed drainage system, the oil-water separator and into the existing culvert and then into the Green River. Thus, the natural drainage patterns of the area, which would now drain the sites from east to west and from north to south will be altered. The design of the fill will protect against surface waters flowing south, but some seepage from the fill would be expected. The proposed development will cause no significant changes in the atmosphere. Construction equipement will be brought to the site only when in need of repair or servicing which cannot be performed in the field. The employees ' and customers ' automobiles and the operation of the office and repair shops will result in no significant increase in the noise or air pollution levels now existing in the area and which are generated by the traffic on West Valley Highway, the train traffic and existing industrial uses in the area. - 8 - The existing transportation facilities and the utilities now in existence or now being constructed are adequate to service the proposed project. Water mains serving the property are in place and the site has been'assessed for such water mains in the approximate sum of $12 ,000 . 00. The owner has received a preliminary sewer assessment on the site in the sum of $24 ,928 . 33. The grading and filling will destroy the existing botanical species on the site. The filling of the pond on the site will displace the water-oriented birds and animals which now visit the site., The portion of the pond which is located to the south of the site would remain. Community patterns will not be affected. The proposed use is compatible with and will not affect existing human uses in the area. The area' s population will not be affected. D. UNAVOIDABLE ADVERSE ENVIRONMENTAL EFFECTS. Ori the short term, it is expected that only the on-site grading and construction noise and dust would be expected to have any adverse impact. The size of the site itself, its isolated location from any residential or less intensive uses will mitigate this adverse impact. The existing noise generators in the area, i.e. the West Valley Highway, railroads, and the existing industrial uses also mitigate this adverse impact. The approximate con- struction period for the total completion of the project is one year. 0 There will be no necessity to re-route any vehicular or pedestrian traffic in the area during the construction period. On the long term, the permanent loss of the pond on the property is an adverse impact, although the biological significance of the pond has been questioned. The plan of the Soil Conservation Service and the Green River Flood Control Zone District to preserve 110 acres of valley wetlands in their existing state has not been implemented and the location of the wetlands is subject to change. . The Soil Conservation Service has indicated that there are other wetlands of superior or equal value located in the valley area which would be acceptable for preservation as part ,of the plan. - 9 - The allocation of the 110 acres to be preserved among the partic- pating communities and a plan for their acquisition and financing has not been finally determined nor have the acquisition costs been funded. Additional landscape resources will be added per Exhibit K to comply with, and in fact, exceed, the requirements set forth in the letter agreement entered into with the Green River Valley Flood Control Zone District. The added- landscape resources will serve to mitigate some of the loss of existing wildlife habitat. E. ALTERNATES TO THE PROPOSED ACTION. The existing office and shop site of Scarsella Brothers, Inc. is available only until May of 1975. The alternate of staying there is not available. The acquisition of an alternate site was considered but re- jected since the proposed site is already owned free and clear and the proposed use of the site complies with the Comprehensive Plan and has .good location and access. The business of Scarsella Brothers , Inc. must be relocated and the alternative of no action is not available if business is to continue. No action in the sense of no development of the subject site is not economically possible from the standpoint of Scarsella Brothers , Inc. The alternate of developing only the westerly portion of the site has been considered but has been rejected because of the area needs for the operation of the applicant' s business. The use of one-half of the property as part of a public system of valley wetlands is inconsistent with the applicant' s proposed use of the property. The effect of only partial development of this site was questioned by the Audubon Society spokesman. The alternative of developing only the westerly portion of the site for a different use, which would incorporate the existing pond, has been considered but has been rejected because of the necessity of relocating the applicant' s business. • - 10 - F. RELATIONSHIP BETWEEN LOCAL SHORT-TERM ENVIRONMENTAL USES AND THE MAINTENANCE AND ENHANCEMENT OF LONG-TERM PRODUCTIVITY. The construction of the West Valley Highway on the west of this property and the rail line on the east significantly modified its natural character and committed the land to uses more intensive than residential or agrarian uses. The Comprehensive Plan re- cognizes that fact and states that the suitable future use of this property is light industrial. As long as the highway and rail line bracket the property it will not be developed for any residential use. To preserve this land as open space on a short-term basis has no significant effect on its long-term productivity from an environmental standpoint. To reserve its use as part of a public system of valley wetlands on a long-term basis requires new regulations and decision as to how the public can acquire the rights to use this privately-owned property and how to compensate `the owner therefor and to spread the cost thereof in an equitable manner. The decisions and strategies for controlling land use and human use of the environment should be designed to enhance its long-term productivity. The proposed use of this land does not preclude a wetlands plan for the valley nor its implementation. G. IRREVERSIBLE AND IRRETRIEVABLE RESOURCE COMMITMENTS WITH THE PROPOSED ACTION. Development in accordance with the proposed plan would allow the alteration of approximately one-half of the property which should be considered to be permanent. The loss of the portion of the pond on this property will be replaced by new buildings and new planted area. Additional landscape resources will be added. There are wetlands of superior or equal quality located in the valley which can be reserved, which are part of much larger tracts, and which are not bordered on two sides by high use transportation facilities. - 11 - The construction and maintenance of the improvements on the site will require a commitment of natural and human resources. These developments will require a long-term commitment of energy resources , water resources and waste treatment facilities, as well as a substantial monetary commitment. Based on these elevation differences he believes that there is no interaction between the river and pond. oxcept. during. periods of high water when the water table rises. . An example of this is the 1974 readings after a period of high water. Further hp believes that this pond is supplied mostly by local storm drainage. Since this pond is maintained by surface runoff, it is doubtful, that it will continue to a suitable environment for wildlife as the surrounding area is developed for the following reasons: 1) Run- off rates and amounts will increase, this will cause greater fluctu- ations in the pond level than presently occurs; 2) Oil pollution of pond will increase; 3)' Decreased ground water will allow pond to dry out in the summer. Noting that the application had been continued , Chairman Mola requested t'he current status from the Planning Director . Mr. Ericksen reminded the Commission that the site includes a ponding area which has been designated for retention as a wildlife habitat by the Soil Conservation Service . An environmental assessment was requested by the staff in order to evaluate environmental impact . The assessment was received June 25 , 1974 , and the staff has not had an oppor- tunity to make an evaluation at this time . Renton Planning Commission Meeting June 26 , 1974 Page Two He noted that environmental impact occurs at the time of develop- ment ; therefore , the staff recommends approval of rezoning to M-P but continuance of the request for special permit to fill . The Planning Director pointed out the ponding area on the map and noted that it touches the proposed warehouse facility. It is the staff ' s opinion that zoning of the property would not preclude development of a portion of the property but granting of the fill would create loss of the pond area . Mr . Ericksen discussed the planned Valley Drainage Project and proposed provisions for its funding . Comments were invited from the applicant . Mr . Allan Austin , attorney representing Scarsella Brothers , Inc . , 1515 Norton Building , Seattle , stated that Mr . Cokely of the Soil Conserva- tion Service had advised him that areas that they have mapped for preservation are tentative and not defined by boundaries . The pond was described as covering fifty to sixty percent of the property during the wet season . He described the applicant ' s reasons for seeking relocation of his business facilities , noting that his lease at his present site expires in May 1975 . The 1 property has been owned by the Scarsella ' s for ten years , and is i being sought for industrial use due to its proximity to the West Valley Highway and the railroad . Mr . Mola invited comments from the audience , but none were received . The Chairman then called for a report from the Zoning Committee . Commissioner Ross , chairman , read his report which advised that it was the conclusion of the committee that rezoning to M-P would have no detrimental impact on adjacent properties . . Further comment by the Comdiission was invited by the Chairman , but none was offered ; and IT WAS MOVED BY ROSS , SECONDED BY GIBSON , THAT THE PUBLIC HEARING BE CLOSED . Rezone and Special Permit Applications Gentlemen: We represent Scarsella Brothers, Inc. and this letter is submitted to you in response to your letter of June 5, 1974 re- questing an environmental assessment of the proposed action. We have followed your outline for Environmental Impact Statements, without the summary sheet. A. The Proposed Action The affected property is located along the east side of West Valley Highway north of its intersection with south- west 43rd street. Its legal description is as follows : The South 329 . 85 feet of government lot 7, Section 25, Township 23 North, Range 4 East, W.M. , King County, Washington. The type of action requested is an amendment to the zoning ordinance rezoning the property from G General Class- ification District to M-P Manufacturing Park District and for permits for filling and grading the property and for the construction of an office building and repair shop there- on. The property is classified for light industry or M-P use on the Renton Urban Area Comprehensive Plan. It is bounded on the west by the four-lane West Valley Highway and on the east by the Puget Sound Railroad Right-of-way. The property 4 City of Renton Planning Department ATT: Mr. Michael L. Smith Page Two June 25, 1974 immediately adjoining to the north is zoned M-P, as is property to the south. Sternoff Metals Corporation' s operation is located to the southeast across the railroad right-of-way. Scarsella Brothers, Inc. presently operates its con- struction business and repair shop on a site at 16025 Pacific Highway South. The recent death of one of the brother-owners necessitated a division of the business and its assets be- tween the widow of the deceased owner and the surviving owner- brother, Antonio Scarsella. By this division Mr. Scarsella retained the business itself, its operating equipment and the subject property and the widow retained the property and improvements on Pacific Highway South and other real property owned by the corporation. Antonio Scarsella is now president of the corporation. The corporation has been permitted to continue its operations out of the Pacific Highway site on a temporary basis and under a one-year lease which expires in May of 1975. Thus, the corporation is obliged-to relocate its office and repair facilities and the logical site is the subject property, which has been owned by the corporation for more than ten years. It is classified for the requested use on the Comprehensive Plan and the proposed use would intrude upon no other less intensive uses. The West Valley Highway pro- vides the site and its proposed use with ideal access . The Planning Commission has previously considered this matter at a public hearing in March of this year. That hear- ing was pursuant to notice and citizen imput was received at that time. The suggestion was made at that hearing that the pond which exists on the back half of the property during the wet season should be retained in its natural state. The applicant owns the property free and clear and proposes to finance the proposed site developments and im- provements through private funds . The proposal is consis- tent with the master plan for this area. It would be in City of Renton Planning Department ATT: Mr. Michael L. Smith Page Three June 25, 1974 furtherance of that plan to change its Land Use Classification from its present holding classification of G to M-P. The actions remaining for implementation are the formal actions of the Planning Commission and the City Council on the rezone application, the review and approval of the site and use plans by the Planning Commission, and the issuance of the permits for the proposed grading and construction. B. Existing Conditions 1. Natural setting The site contains approximately 5. 81 acres and slopes gradually from the west to the east. Its geological make up is the sandy loam typical of the valley. The applicant knows of no animal life living on the property although it would be expected that the property would be visited from time to time by birds and small ground animals indigenous to the valley area. The applicant has personally seen mud hens on the property but has not seen any ducks or other similar migrating water fowl. The report of the United States Soils Conservation Service indicates that ducks and other migrating water fowl may visit the property on an intermittent basis. The property is undeveloped and completely cleared except for two fruit trees on the western portion, a half dozen or so small willow trees , and is covered by brushy vegetation such as "skunk cabbage" and the like. There are no evergreens . In the wet season a shallow pond forms on the easterly one-half of the site and on the property to the south. This pond is created strictly by surface waters and is not fed by any stream or springs . The pond stagnates and dries up or becomes just mud in the summertime. City of Renton Planning Department ATT: Mr. Michael L. Smith Page Four June 25, 1974 The atmospheric conditions are those generally common to the valley area. No rare or endangered biological or botanical species are known to be present. 2 . Human Use, Development or Values There is no nearby residentially zoned property. There are some scattered, old houses some distance to the south. The large commercial development of South Center is located east across West Valley Highway and the Green River. There are industrial developments to the north including N C Machinery and Stoneway Concrete Products . The existing developments to the west are industrial, notably the large tract used by Sternoff Metals Corporation and a large industrial park. The transportation system in the area utilizes the West Valley Highway for private automobiles, commercial and business vehicles and public motor buses. The property is also served on the east by railroad. There are no educational, religious or scientific uses in the area nor any known historical sites . C. Environmental Impact of the Proposed Action 1. Changes in Natural Characteristics The proposed rezone itself will cause no changes in the natural characteristics of the property. The proposed filling and grading will remove the existing brush and fill the lower portions of the property to a grade generally leval with the existing grade of West Valley Highway and the, seasonal pond will disappear. No significant impact will be caused on the geology or soils. Two buildings, an office building and a repair shop , will be constructed as shown on the submitted plan. The required parking areas will be surfaced with an impervious City of Renton Planning Department ATT: Mr. Michael L. Smith Page Five June 25, 1974 material . The entire site will be surrounded by cyclone fence for security purposes . The westerly frontage will be landscaped as shown on the submitted plan. The yard area will be surfaced with pervious crushed rock. The fill material to be used will facilitate drain- age and the placement of that fill will not affect existing utilities or other facilities . The impervious roof surfaces and parking areas will be an insignificant portion of the total site and the accelerated runoffs therefrom will be quickly absorbed through the permeable on-site surfaces . The surface waters which now collect on the easterly portion of the property will not be piped or channelled but will be permitted to disburse into their natural drainway. Thus , no change will be made in the natural drainage patterns of the area. The proposed development will cause no significant changes in the atmosphere . Construction equipment will be brought to the site only when in need of repair or servicing which cannot be performed at the location of where the equip- ment is then working. The employees ' and customers ' automobiles and the operation of the office and repair shops' will result in no significant increase in the noise and air pollution levels now existing in the area, which are generated by the traffic on West Valley Highway, the train traffic and existing industrial uses in the area. The existing transportation facilities and the utilities now in existence or now being constructed are 'adequate to service the proposed project. The proposed project will cause no significant changes in either the biological or botanical species in the area. Community patterns will not be affected. r City of Renton Planning Department ATT: Mr. Michael L. Smith Page Six June 25, 1974 The proposed use is compatible with and will not affect existing human uses in the area. The area 's population will not be affected. D. 'Unavoidable Adverse Environmental Effects On the short term, it is expected that only the on-site grading and construction noise and dust could have any adverse impact. These are certainly mitigated by the size of the site itself, its isolated location from any residential or less intensive uses , and may well be insignificant when considered in light of the existing noise generators in the area, i.e . the West Valley Highway, the railroad, and the existing in- dustrial uses. The approximate construction period for the total completion of the project is one year. There will be no necessity to re-route any vehicular or pedestrial traffic in the area during the construction period. On the long term, only the loss of the pond on the property could be considered an adverse impact. The plan of the Soil Conservation Service to preserve 110 acres of valley wetlands in their existing state has not been implemented and the location of the wetlands is subject to change. The Soil Conservation Service has indicated that there are other wetlands of superior or equal value located in the valley area which would be acceptable for preservation as part of the plan. The biological significance of this pond is sub- ject to serious question. The allocation of the 110 acres to be preserved among the participating communities and a plan for their acquisition has not been determined nor have the acquisition costs been funded. E. Alternates to the Proposed Action The applicant 's existing office and shop site is available to him only until May of 1975 . Thus, unless he City of Renton Planning Department ATT: Mr. Michael L. Smith Page Seven June 25 , 1974 ceases business, the alternative of staying there is not available. The applicant did not consider alternate sites since the proposed site is already owned and the applicant believes it to be ideal for his purposes . His proposed use of the site complies with the comprehensive plan and has good location and access . The alternate of developing only the westerly portion of the site was rejected because of the area needs for the operation of the applicant' s business and the desire to have access to the rail line on the east. The use of one-half of the property as part of a public system of valley wetlands is inconsistent with the applicant 's proposed use of the pro- perty. F. Relationship Between Local Short-Term Environmental Uses and the Maintenance and Enhancement of Long-Term Productivity The construction of the West Valley Highway on the west of this property and the rail line on the east signifi- cantly modified its natural character and committed the land to some use more intensive than residential. The Compre- hensive Plan recognizes that fact and states that the suitable future use of this property is industrial . As long as the highway and rail line bracket the pro- perty it will not be developed for residential use. To attempt to preserve this land as open space on a short-term basis by refusing to zone it for its planned use and/or denying permits which would permit its development in accordance with existing codes , is unfair and can have no significant effect on its long-term productivity from an environmental standpoint. To reserve its use as part of a public system of valley wetlands on a long-term basis would require new regu- lations and decisions as to how the public can acquire the City of Renton Planning Department ATT: Mr. Michael L. Smith Page Eight June 25, 1974 rights to use this privately-owned property and how to compensate the owner therefor and spread the cost thereof equitably. The decisions and strategies for controlling land use and human use of the environment should be designed to enhance its long-term productivity. The proposed use of this land does not preclude a wetlands plan for the valley nor its implementation. G. " Of the eight designated areas , three are located in Renton as follows : one along the east side of the Valley freeway ; one situated in Orillia ; and one located east of the West Valley Highway. Estimated cost of work in the total Valley is $28 ,000 ,000 ., Mr. Jahns discussed the location and capability of planned. channels and the types of wetlands found in this area . He listed the following five points to be accepted by local jur- isdictions before the project is begun : 1 . Acquisition of wetlands . 2 . Total land use treatment plan for the Valley. Mr. Smith noted that the pond has been under study by the Soil Conservation Service and has been proposed for preservation as a natural habitat for water- fowl . The proposed use is for an office building , ware- house and outside storage area for construction equipment. Slides and aerial photographs of the site were shown by the Planning Director. Mr. Teegarden invited comment from . the applicant. Antonio Scarsella , president of the corporation , stated that they would like to fill the site to allow. for building or sale . He indicated they plan to fill the entire site , raising the grade so that it will drain toward the Green River rather than the Milwaukee/Burlington Railroad tracks . He described the pond as a breeding place for mosquitoes and noted that it almost dries up in the summer months . At this time they prefer to build a construction facility for their business to replace the one presently located off Highway 99 . Landscaping and fencing will be provided . They hope to complete construction some time this summer and will comply with. any City requirements . Discussion followed regarding consideration of preserva- tion of natural areas . The Planning Director advised that there was no proposal for acquisition of the property by the Soil Conservation Service . The site is part of an. area presently under study in the Valley Drainage Plan . It will be incumbent upon local jurisdictions and indus- trial owners to comply with the requirements of the Soil Conservation Service . Therefore , this is a factor to be considered by the Planning Commission . The Chairman requested that the Planning Director prepare a briefing on the question of preservation of natural areas to be presented at the April administrative meeting . The March 1974 administrative meeting of the Renton Planning Commission was called to order by Chairman Teegarden at 8: 05 p . m. 1• ROLL CALL was taken by Secretary Wik. All Commissioners responded present except Carue (out of town ) , Gibson (illness in family) , Mola (unable to attend due to press of business ) , and Seymour (previously advised of delay in arrival ) . ACTION: MOVED BY WIK, SECONDED BY HUMBLE, THAT THE ABSENT COMMIS- SIONERS BE EXCUSED. MOTION CARRIED UNANIMOUSLY. 2 • NEW PUBLIC HEARING ITEMS : REZONES Noting that there were a number of applications for rezone . on the agenda , the Chairman requested a brief resume regard- ing them from the Planning Director. Mr. Ericksen introduced Assistant Planner Michael Smith to the Commission and indicated that he would be participating in the presentations . Smith reviewed the rezone applications as follows : A, GLACIER PARK CO. ; Appl . No . R-757-74 ; rezone from G to M/P ; property located on east side of West Valley Highway at intersection with Strander Blvd. Mr. Smith pointed out .the location of the Glacier prop- erty , which is divided into two parcels , both situated immediately east of the West Valley Highway at its inter- section with Strander Boulevard and near the Renton- Tukwila boundary . Location of significant geographic features in the area and their relation to the site were noted . Glacier plans construction of a restaurant facil - ity , designed in a railroad motif , and possibly a bank building on the westerly parcel . There are no plans at present for the easterly parcel , which has an access problem. Some. filling may be necessary. Rezone to M/P is in agreement with the Comprehensive Land Use Plan . Commissioner. At this time , there was also discussion regard- ing the requested exception to the Subdivision Ordinance . E. SCARSELLA BROS . , INC. ; Appl . No . SP-760-74 ; special permit to allow fill,ing and grading in G (M/P) zone ; property located approximately 1200 ' : north of S . W. 43rd on West Valley Highway. Mr. Smith described the applicant ' s proposal to fill the subject site for a construction equipment storage and repair facility. Filling of the ponding area was dis- cussed , with particular reference to the level of fill in relation to the P-1 Channel . An environmental impact ; statement may have to be submitted , and the applicant ' s proposed reuse plan is still forthcoming . WAIVERS F. STOREY , FRANK A. ; Appl . No . W-755-74 ; request for waiver of off-site improvements in G-7200 zone ; property located on N . E . 14th and Kennewick Ave . N . E . Slides and aerial photographs of the property , located in the Kennydale area , were shown . The applicant has installed all necessary improvements except sidewalks and is requesting a waiver of the requirement to install sidewalks , as specified in the Subdivision Ordinance . Mr. Storey has been granted a deferment from the Board of Public Works subject to posting of a bond and Plan- ning Commission review. EXCEPTION FROM SUBDIVISION ORDINANCE G. PETERSON , ROGER; WITSOE , STAN ; Appl . No . E-753-74; request for exception from Subdivision Ordinance from the 60 foot property frontage requirements ; property located at N . E . 8th Street between Harring- ton and JefferEnn NflE. At the time of presentation of the applicant ' s request for a special permit, there was also discussion regard- their request for an exception from the Subdivision Ordinance to allow less than sixty feet frontage for two lots that do not meet minimum width requirements . The possibility of eliminating this need by small shifts of. the lot lines was considered and will be studied by the staff. FIELD TRIP A field trip to view the above properties was scheduled for Saturday, March 23rd, at 8: 30 a .m. The group will meet at the Renton Inn . 3- CITY COUNCIL REFERRALS: H. COMMERCIAL ZONE EAST OF FAI 405 , MAY CREEK The subject area , located east of FAI 405 on May Creek is included in the Shoreline Master Program. The present Renton Planning Commission Meeting March 13 , 1974 Page Four zoning and Comprehensive Land Use Plan is inconsistent with the Master Program. The problem has been referred to the Planning Commission for review and recommendation and is being studied by the Comprehensive Plan Committee . j , SUB-REGIONAL TRANSPORTATION STUDY The Planning Director advised the Commission concerning the history of the subject matter , originally referred to as the Renton Area Transportation Study . The need for reconsidera- tion and review of Renton ' s total transportation needs has been expressed by the Washington State Highway Department. The question was referred by Mayor Garrett to the City Coun- cil , which has requested feasibility review by the Board of Public Works and its Transportation Committee and the Plan- ning Commission . The Planning Commission has been asked to review the feasibility as it relates to updating the arter- ial street program as an element of the Comprehensive Plan . ACTION : MOVED BY SCHOLES, SECONDED BY SEYMOUR, THAT THE QUESTION OF THE SUBREGIONAL TRANSPORTATION STUDY BE REFERRED TO THE COM- PREHENSIVE PLAN COMMITTEE FOR STUDY AND REPORT BACK. MOTION CARRIED UNANIMOUSLY. 4. ADMINISTRATIVE : (A) COMMITTEE REPORTS The Chairman called for Committee reports . COMPREHENSIVE PLAN COMMITTEE Mr. Teegarden asked the Planning Director for a report on the status of the Shell Oil Company application . Mr. Erick- sen advised that a letter was mailed to Shell requesting their response on the environmental impact statement . No response has been received at this time . COMMUNITY SERVICES COMMITTEE Chairman Scholes reported meeting several times regarding Whitman Court (Glencoe-Honeydew Circulation and Land Use Study) referral . Commissioner Scholes also reported attending the Soil Con- servation Service meeting on March 5 , 1974 , relating to the Valley Drainage Study. Commissioner Wik of the Committee reported meeting on March 7 , 1974 , with County Councilman Mooney , Soil Conservation Service , and City representatives of Renton , Kent and Tukwila regarding Green River Valley drainage . Mooney is attempting to get involved communities to think seriously about the proposals by the Soil Conserva- tion Service regarding land use and drainage problems in the Valley. ZONING COMMITTEE Chairman Ross called a meeting of the Committee for March 20 , 1974 , at 7 : 30 p .m. , to discuss the Parking and Loading Ordi - nance and Downtown problems .
