Councilman Stredicke asked for evaluation of possible joint ownership
Parking -- of alleys behind buildings which could be opened up to parking of
Street Sweeping customers. Stredicke inquired re street sweeping of downtown area
and suggested the five nights a week sweeping as done, be shifted so
that Monday morning the streets have been cleaned.

REZONE THAT EVENING. After considerable discussion, the MOTION CARRIED.
The Mayor called on Mr. Magstadt, Ass 't. Planning Director, who had set
up a map of the area to be rezoned, to explain the points of disagree-
ment. The Planning Commission asked a setback of 60 feet from F.A.I.
405, but the property owners objected as the Rivily property in that
area had been allowed a 20 foot setback. Applicants were willing to
sign the Declaration of Restrictive Covenants on all other boundaries,
but requested 30 foot setback from F.A.I. 405. Mr. Charles Grouws ,
3201 S. 115th, Seattle, one of the partners in the enterprise, remarked
that the property was 30 feet below and not visible from the freeway.
After some more discussion, it was moved by Perry, seconded by Clymer,
that the Council grant the rezone with the restrictive covenants agreed
to except the 60 foot setback from F.A.I 405'would be reduced to 30
feet. SUBSTITUTE MOTION BY STREDICKE, SECONDED BY DELAURENTI , THAT
THE RESTRICTIVE COVENANTS AGREED TO BY THE APPLICANTS BE ACCEPTED.

Limit Number of Councilman Stredicke said that a year ago, the newspapers carried a
Service Stations front page story asking the City to limit the number of service sta-
tions in the City. MOVED BY STREDICKE, SECONDED BY PERRY, THAT THE
MATTER BE REFERRED TO THE COMMUNITY SERVICES COMMITTEE. CARRIED.
Street Signs Councilman Stredicke remarked that there were still no street signs
in the vicinity of S. 2nd Street and Logan Avenue and it was causing
confusion. Mr. Gonnason said the signs were delayed because of the
Puget Power strike and it wasn't practical to put back the old signs
as it would be a duplication of effort.
Punch Boards and Councilman Stredicke inquired what the City was doing about regulating
Pull Tabs punch boards and pull tabs. Mayor Garrett said the City does not have
jurisdiction until July 24th and Councilman Delaurenti said there would
be a proposed ordinance within two weeks.
NEW BUSINESS Council President Clymer requested the Council to approve Council-
International man Delaurenti 's attendance at the International Fire Chiefs Convention.

Stop Sign at Councilman Bruce inquired of the status of the stop sign requested at
Index Ave. N.E. the intersection of Index Ave. N.E. and N.E. 9th Street. Some discussion
& N.E. 9th followed, Mr. Gonnason remarked that the City did not put stop signs at
all intersecting streets, less than 25% were so marked. Streets inter-
secting with arterials have stop signs. It was moved by Perry, seconded
by Stredicke, that the subject stop sign be installed. Councilman
Schellert asked the City Attorney for an opinion on the question. Mr.
Shellan replied that the Council had the right to overrule any depart-
ment head, but that the Council was a legislative body. Councilman
Clymer remarked that he did not think the Council was just a legisla-
tive body, it was also for the citizens to voice their opinions and
wishes. Councilman Grant remarked that this was a citizen complaint, Mr.
Gary Hoffman asked for the sign. MOVED BY CLYMER, SECONDED BY DELAURENTI ,

the abovementioned project . Mrs . Bailey who is in charge
of the landscape installation, questioned the time of com-
pletion of landscape in relation to the proposed mid-August
auction .
Upon checking with the Building Department , we were
informed: ,
1 . The building would not be completed at time
of August auction .
2 . Special provisions would have to be explored
regarding the temporary use at time of auction,
prior to building completion - Fire Department ,
Building Safety inspections etc.
3,. Mrs . Bailey was informed that landscaping was
to be completed after building construction
was completed and prior to occupancy permit .

less than 7500 square feet. " He stated that the commit-
tee is considering the definition of a lot as it applies
to this situation and therefore has requested a meeting
for Tuesday evening , May 14 , with the City Attorney, inter-
ested neighbors and staff. At this time it is their opin-
ion that the two lots platted to the west do not meet the
width requirement of the restrictive covenants and the
other lots do not meet the backyard setback requirements .
Mr. Roger Peterson , applicant , requested recognition and
stated that there are several violations of the existing
covenants in the area . Stating that he had met with the
City Attorney , he indicated that it was their conclusion
that lots 1 and 2 shall be known as residential lots and
lots 3 , 4 and 5 are multi -family dwelling .
Mrs . Doris Reed , 801 Jefferson , Renton , an adjacent prop-
erty owner, said that the neighbors did protest the con-
struction cited by Mr. Peterson as in violation of the
covenants .

tures continues as an unresolved question .
Commissioner Scholes , chairman of the Community Services
Committee , reported that they had met with the applicant
and conducted a field trip to the site . He stated that most
of the problem areas had been resolved and that further work
was planned in committee relative to landscaping and dif-
ferences in spacing of the structures .
The Chairman noted that the applicant was not in attendance .

ning Director. Mr. Ericksen pointed out the site on the map ,

noting that it is located southeast of the Longacres
Race Track and adjacent to the P-1 Channel in the
Green River Valley. The site is presently a part of
the overflow parking area of Longacres and comprises
approximately two acres . Proposed use for a horse
auction facility and permanent general offices and
library is acceptable within the M/P zone . There is
no apparent need for fill . The request is in agree-
ment with the Comprehensive Land Use Plan .
SPECIAL PERMIT:

to construct a petroleum marketing plant in H-1

The Chairman requested the status on this application
from the Planning Director. Mr . Ericksen advised that
the draft of the final environmental impact statement
is under review, and revisions are being completed .
The Chairman asked the Planning Director to check the
legalities of the question of timing regarding the sub-
mittal of the final environmental impact statement and
Planning Commission action . Mr. Ericksen referred the
Commission to copies of Washington State Environmental
Policy Act of 1971 and its 1973 Amendments , which were
distributed; and he stated that any action by the Com-
mission in accordance with state guidelines should come
after the final impact statement has been accepted . He
also advised the Commission of a meeting scheduled with
the City Attorney for May 15 to define the Commission ' s
role in this action . The availability of the final EIS
by the May 22nd public hearing was discussed.
In response to questions regarding the environmental
impact statement which was distributed by Shell as final ,
Mr. Ericksen indicated that the EIS as drafted by Shell
did not respond to many questions that were raised and
did not provide sufficient information in a number of
areas . The staff is therefore attempting to provide
response to those questions and complete the EIS .
Commissioner Mola suggested that some other body be
established to consider the ramifications of complica-
ted items in order to ease the burden on the Planning
Commission and the staff , stating that he felt that the
public was not being served adequately in view of the
workload. The Planning Director noted the number of
critical items before the Commission and cited instances
where the Planning Commission had been relieved by hav-
ing the staff consider various items with a public hear-
ing only if of a critical nature .
Seymour requested that a tape recorder be available for
the May 22nd public hearing . . .
A recess was declared at 9 : 50 p .m. The meeting resumed at
10 : 05 p .m. with all members noted as being present .

REZONE
Noting that the applicants had requested both a rezone
of their property from G to M-P and approval of their
site development plan for an auction facility and
office/library , the Chairman suggested considering
them simultaneously and requested background informa-
tion from the Planning Director.
Mr. Erickson pointed out the site on the 'man and noted
its relationship to Longacres Race Track area and the
P-1 Channel . The site is presently a part of the over-
flow parking area of Longacres and comprises approxi -
mately two acres . The Planning Director stated that
• a north/south arterial highway facility is proposed to
be situated either to the west or the east of the P-1
Channel but that the Traffic Engineer had advised that
the location is subject to further study . Approval is
recommended by the staff subject to the applicant incor-
porating requirements of the Soil Conservation Service
with reference to preservation of two percent natural
area into their site development plan and subject to
the applicant agreeing to work with the City with
respect to development .of the proposed north/south
valley arterial . Mr. Ericksen suggested that the appli -
cant ' s request for site on ru .al also be considered with
ro_ . . k ..., possible arterial conflict .
Chairman Teegarden invited comment from the applicant .
�—; Mr. Lawrence Campbell , architect , stated that they
were prepared to shift their building thirty feet to
the west in order to avoid conflict with the proposed
arterial . He indicated that required setbacks would
continue to be met.

Discussion followed regarding the effect of the pro-
posed arterial on the planned development. Public
Works Department representative Touma stated that to
provide access it would be necessary for owners on
each side of a major arterial to give a minimum of
thirty feet from their property line for right-of-way .
Mr. To:... t . . . rented an arterial street map to the
! . = Planning Director , noting that the
proposed facility is planned as a major arterial ,
pointed out its location and significant development
in the vicinity on the map . He discussed possible
effects on the site should it be constructed to the
east of the P- 1 Channel and to the west . Mr. Erick-
sen indicated that in order to obtain a building per-
mit , pubic access is required .
Mr. Kyle Johnson , 3822 Seattle First National Bank
• Building , Seattle , attorney for the Washington Horse
Breeders Association spoke in favor of the application .

Mr. James Plemmons , 1819 South Central , Kent , contractor,
noted the present parking area for the Commission and
stated that the parcel is owned by Broadacres , as is the
entire track facility . He indicated that the purpose of
the facility is for an auction to be held three times a
year. In fifty years the facility will revert to the
track and be a part of Longacres . The site was selected
so that it would not interfere with parking on race days .
Mr . Blair Bernson , 2000 IBM Building , Seattle , attorney
for Broadacres , Washington Jockey Club and Longacres ,
discussed development plans , stating that they were neces-
sarily tied in with barn facilities and separated from
track activities . Public access to the area will be via
the present public route from the west ; and the East Barn
Road (S. W. 16th ) , a private road , will be available for
emergency use . Mr. Bernson noted their intentions for
making the facility available for the use of community
groups , theater groups , etc .
The Chairman invited comments in opposition from the
audience . None were offered.
Mr. Kyle Johnson read letters to the Renton City Council
from the Washington Division of the Horsemens Benevolent
and Protective Association , urging granting of the re-
quest and from the Washington Horse Racing Commission ,
stating that they have no objection to the plan .
Responding to Commissioner Ross , Public Works representa-
tive Touma stated that deferment of off-site improvements
would be considered at the time of off-site approval .

Trustees to sell the property to provide revenue for needed

to build a home on the site and that his inlaws may also want

G6000 to R-3 ; property located on Lake Washington ,
south of and adjacent to N . E . 52nd St .
The Chairman requested a briefing from the Planning
Director. Mr. Ericksen pointed out the location on the
map and pointed out significant development in the vicin-
ity. The Comprehensive Land Use Plan. indicates medium
density multi -family use . A draft environmental impact
statement was received on April 23rd . The staff recom-
mended continuance to allow for review of the EIS .
The Chairman invited comment from the applicant.
Mr. Val Rupeiks of Clark , Coleman and Rupeiks , intro-
duced people involved in the project : Mr . Thompson ,
President of Citizens Federal Savings and Loan ; Mr. Parr ,
architect ; and Mr. De En Lang , project planner. He des-
cribed the 56 unit condominium development plan proposed
for the 5 . 8 acre site . Access will be via one-way streets
under the Burlington/Northern railroad trestle . He stated
that they plan to observe the thirty-five foot height
limitations and are trying not to infringe on the views .
Mr. Carl Hanson , 6615 Ripley Lane N . , Renton , representing
the Lake Lanes Community Group , stated they are interested
in the proposal in view of serious concerns regarding prev-
ious development plans and noted access as a primary con-
cern . He stated that any development in this area would
have an environmental impact , stating that it is the last
wildlife refuge on the east side of the lake .
Mr. Rupeiks , responding to the Chairman , indicated that
environmental questions were addressed in the environmental
impact statement.
Discussion followed regarding the time required for review
and public hearing . Consideration of the application as a
rezone only was discussed ; however , it was decided that an
environmental impact assessment should be made prior to
making any decision .

GS-1 to L- 1 ; property located on S . W. 16th St . between
Oaksdale and Pacific Ave . S . W.
A presentation was requested of the Planning Director by
the Chairman . Mr. Ericksen pointed out the location of
the 65 ,000 sq . ft . site south of FAI-405 on the map . The
undeveloped site is presently zoned GS-1 , single family
residential . Proposed use is for a wholesale distribution
center and warehouse . Mr. Ericksen pointed out street
right-of-ways on the property .
Since the site is sufficiently large and adjacent proper-
ties are similarly developed , the staff recommends that
the property be rezoned M-P rather than the requested L-1 .
Mr. Smith stated that the differences in standards between
L-1 and M-P were discussed with the applicants . The Com-
prehensive Land Use Plan indicates either L-1 or M-P zon-
ing for the area .
Seymour inquired if it would be necessary for the appli -
cants to change their application , if the Commission were
to recommend M-P zoning rather than L-1 . The Planning
Director advised that the applicants should agree to
amending the application in order for the Planning Com-
mission to recommend M-P .
The Chairman invited comment from the applicants . Mr .
Dean Bitney , 1082 Anacortes N . E . , Renton , stated that
while it is not their ultimate plan , they are planning
to build only one building at this time . Parking will
be located either along the front or side of the building .
One thousand square feet of office space is planned . He
asked to be reminded of the setback requirements on M-P
zoning versus L-1 .
Mr. Teegarden stated that M-P zoning stipulates 60 foot
setbacks in front and rear and 20 foot side yards .
Mr. Bitney indicated concern regarding the 60 foot rear
setback . Discussion followed regarding possible excep-
tion to this requirement , inasmuch as the rear of the
property lies adjacent to FAI-405 . It was pointed out
that open area can be used for storage purposes , off-
street parking , etc . Seymour asked if a variance from
the setback could be requested . The Planning Director
stated this was not a proper variance situation .

Mr. Charles H . Brouws , 7201 So . 115th , Seattle , stated that
the 60 foot setback would mean more open space than would be
required .
Mr. Chester Nesheim , 201 2nd St. S. , Kirkland , owner of the
property , stated that FAI-405 is approximately 15 feet above
the level of the land. He said that by rezoning the property
to M-P rather than L-1 , it would be difficult to sell .

Appl . SP-763-74; special permit to allow filling and
grading in G zone ; property located at Black River
Junction .
In response to a request for background information from the
Chairman , Mr. Ericksen described the proposed operation as
follows : an application for a special permit under the
Mining , Excavation and Grading Ordinance to fill in two phases
an area approximately 2500 feet long and approximately 150 feet
wide , totaling approximately 188 ,000 cubic yards of fill mater-
ial . He pointed out the location of the site and prominent
development in the vicinity. He noted the approximate bound-
aries of the two phases on a section drawing of the proposed
fill and railroad yard . The Comprehensive Land Use Plan des-
ignates the area as M/P . The anticipated use as a railroad
switching area would be classified as H-1 .
Mr. Ericksen stated that the applicant should consider the
aspect of environmental impact and indicated that it is the
the staff ' s recommendation that the item be continued to
allow for this assessment . He also suggested that additional
information be submitted by the applicant regarding future
use of the proposed site as well as adjacent property .
Slides and aerial photographs of the area were viewed .
Phases one and two were indicated , and it was noted that
five or six more phases are anticipated .
Comments were invited from the applicant. Mr. Paul Scott ,
2308 S . E . 19th , Renton , Western Director of Real Estate and
Industrial Development , Milwaukee Road , pointed out exist-
ing facilities and proposed development sites on the vicin-
ity map . He noted that the hillside area to the east above
the site is designated medium to high density use by King
County. The proposed drainage channel , proposed industrial
sites and Earlington Golf Course were indicated .
In response to questions from the Commission , Mr . Scott
stated that Milwaukee is asking only for a permit to fill
at this time . The first phase is for permission to fill to
the same height ( 130 ' ±) as the present railroad right-of-way .
Phase two is approximately the same height ( 112 ' ±) as the
Earlington fill . The availability of fill material coming
from certain construction jobs was the reason for requesting
permission to fill .

The Washington Horse Racing Commission has been advised that
the Washington Horse Breeders Association is proposing to
build a combination headquarters office and horse sale pavilion
at Longacres racetrack.
The members of this Commission have no objection to this plan,
and recognize that many benefits will accrue to the large
Thoroughbred breeding industry of the state with the comple-
tion of an adequate marketing facility.
We understand that the Breeders Association has entered into
a land use agreement with the Washington Jockey Club. The
indicated location will in no way interfere with the conduct
and/or supervision of racing in so far as we can, determine.

Horse Breeders be approved for 1 .8 acres located southeast of Longacres Race Track
Association at' the east end of the Track's southerly parking area. The letter
stated existing use as grass parking area with proposed use as ,
horse auction facility and permanent general offices and library.
MOVED BY PERRY, SECONDED BY CLYMER, COUNCIL CONCUR IN RECOMMENDATION

Surplus Vehicles Letter from Purchasing Agent Church requested permission to dispose
of 13 vehicles within the Equipment Rental Fund which have been re-
placed during the past few months; vehicles consist of four Ford & four
Dodge sedans, station wagon and four Chevrolet pick up trucks.

Reception An invitation was extended by the Community of St. Anthony Church
Honoring to Mass and Reception in honor of Father Thomas Lane for 25 years
Father Lane service as Pastor; Mass will begin 12:00 noon 6/9/74 at St. Anthony
Church, So. 4th and Morris Ave. So. with the reception in the Parish
Hall from 3:00 to 5:00 PM.
AUDIENCE COMMENT Mr. George R. Lee, 711 Aberdeen Ave. N.E. , complained of a horse
being tied in the neighborhood for over two weeks, that calls to the
various departments and visits by the Animal Control Officer and the
Building Dept. officials were of no avail . Planning Director Ericksen
advised that this appears to be zoning ordinance violation. Public
Works Director Gonnason reported they will proceed with any needed
enforcement. Mayor Garrett noted the matter would be investigated.
OLD BUSINESS
Community Services Committee Chairman Grant reported meeting with
Community Services representatives of the Olympic Pipeline Co. and the City Planning
Committee Department staff along with Councilman Delaurenti on 5/29/74 to fur-

Olympic Pipeline 20" line requested 5/7/73. Councilman Grant reported agreement
Request for as follows: (1 ) The donation for park purposes of land through
Franchise which pipeline will be routed from Lake Ave. S. to the marshy
Amendment land below. (2) Easement for trail purposes along route of pipe-
line contained in Puget Power's rights-of-way that are fee-owned
by Puget Power. (3) Agreement by Olympic Pipeline Co. to properly
revegetate areas disturbed by construction. (4) Agreement by Olympic
to add trees as per City recommendation along portion of pipeline
adjacent to SR-167. (5) At such time as Lind Ave. is extended to
the Pipeline Station in the Valley, the existing access road will
be made available to the City by easement or purchase, whichever
Olympic desires. (6) A letter and/or restrictive covenants stat-
ing that Olympic and Mobil 's easterly 30 feet will be left in its
natural state or revegetated suitable for screening to the City's
satisfaction if the need arises, the easterly 10 feet of this 30
feet will be donated to the City for trail purposes. (7) $3.00
per lineal foot franchise fee, plus an annual fee, and possibly an
inspection fee. Councilman Grant submitted letter addressed to the
Mayor and Council which stated these conditions agreed to by Mr.
Max Farr, Olympic Pipeline Right-of-Way Agent. The letter also
stated Mr. Farr would prepare Letter of Agreement on these items
not added to the franchise agreement. The letter further stated
Councilman Grant felt a negative declaration on the project could ,
be provided. Councilman Grant explained the environmental impact
statement requested by Council 8/20/73 . had been reviewed by the
Planning Dept. and Community Services Committee; that the shut-off
valves requested by Planning Dept. have been included.
Mr. Max Farr of the Olympic Pipeline Co. reported the franchise fee
mentioned in Item (7) would amount to $13,719 with annual fee of
$830. Mr. Farr reported easements had been obtained for 100% of
right-of-way through private property. MOVED BY GRANT, SECONDED
BY BRUCE, LETTER COUNCILMAN GRANT SUBMITTED.OUTLINING THE SEVEN CON-
DITIONS BE MADE PART OF RECORD OF THIS MEETING AND ALONG WITH THE
FRANCHISE AMENDMENT BE REFERRED TO THE CITY ATTORNEY AND LEGISLATION
COMMITTEE FOR PROPER ACTION. CARRIED. MOVED BY GRANT, SECONDED
BY BRUCE, THAT THE CITY OF RENTON DECLARE THAT OLYMPIC PIPELINE
HAS DECLARATION OF ENVIRONMENTAL IMPACT STATEMENT AND GO ON RECORD
THAT NEGATIVE DECLARATION OF IMPACT IS RECORDED. Discussions ensued
wherein the City Attorney advised that no public hearing is required
under either Federal or State laws re environmental impact state-
ments. Councilman Grant noted that Olympic Pipeline has committed
in the range of $30,000 to the City in property donations and fran-
chise fees; that the company is desirous that construction be accomp-
lished during this summer. ROLL CALL: AYE-CLYMER, DELAURENTI , BRUCE.
NO-PERRY STREDICKE AND GRANT. MAYOR GARRETT CAST AYE VOTE. MOTION
CARRIED.
In further discussions the City Attorney noted that the franchise
matter involving terms , conditions and fees was legislative matter
to be determined by the Council ; that the physical work involving
public property and requiring permit and the aspect of the environ-
mental impact statement relationship is an administrative matter and
the responsibility of the public official issuing the permit.
MOTION BY GRANT, SECONDED BY BRUCE, THE CITY COUNCIL CONCUR IN THE
PUBLIC WORKS DIRECTOR RECOMMENDATION FOR ADOPTION OF THE NEGATIVE
DECLARATION OF IMPACT. MOTION CARRIED.
Ball Field Public Safety Committee Chairman Delaurenti reported that monies
Lighting received for Little League ball field lighting are deposited into
Park Fund Acct. No. 101/362. 10, Rents and Royalites (Energy) which
is used for all park lighting. Moved by Perry, Seconded by Bruce
that the remainder of funds needed to meet added increase to ball
park lights, be authorized and the matter be referred to the Finance
Committee. Councilman Grant noted $3,750 was added to ball field
lighting, $305 having been raised with more promised. MOVED BY
CLYMER, SECONDED BY STREDICKE, SUBSTITUTE MOTION THAT SUBJECT BE
REFERRED TO FINANCE COMMITTEE TO LOOK INTO THE MATTER OF FUNDING

the Washington Horse Breeders Association is proposing to
build a combination headquarters office and horse sale pavilion
at Longacres racetrack.
The members of this Commission have no objection to this plan,

Thoroughbred breeding industry of the state with the comple-
tion of an adequate marketing facility.
. We understand that the Breeders Association has entered into
a land use agreement with the Washington Jockey Club. The

I talked with Larry Campbell today about the subject proposal.
I asked him if he had any additional plans that would aid in
further explaining the proposal. He said that he may, and that
he would be present at the public hearing to answer any ques-
tions on the site plan or architecture of the proposed building.
I informed him that our Landscape Designers felt that the
Poplar trees should be 12-14 high as planted and the trees should
be planted along the south property line. The other plant mater-
ials 'used do meet SC.S. requirements for wild bird food and
habitat.
. I also told him. that there may be a requirement to setback from
the east property line 60 feet or more to avoid conflict with
North South arterial and the P-1 channel.

Gentlemen:
This letter will serve to confirm the commitment of
Broadacres, Inc. to provide permanent ingress and egress to
the proposed Washington Horse Breeders Association Sales
Pavilion site (legal designation number A on ,the plat plan. )
We will also enter into a reciprocal parking agreement on
Parcel B on the plat plan. Parcel B will be used by
Longacres Race Track on regular racing days and will be
used by the Washington Horse Breeders Association on Sale
days. (Sales will be conducted on non-race days . )
The. ingress-egress and reciprocal parking agreement, will run
concurrently with the land lease agreement for the Sales
Pavilion.
When our attorneys have completed the necessary papers we
will forward copies to, you.
