The Board has authority only to grant deferral of improvements until a maximum period not to exceed two years. The short plat was recorded in October, 1978. PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT: the Examiner on March 14, 1979. PUBLIC HEARING: After reviewing the Planning Department report, .examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on March 20, 1979 at 10:30 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Preliminary Plat as submitted Exhibit #3: Preliminary Plat with staff comments Exhibit #4: Preliminary Plat designating travel distances Exhibit. #5: Letter to Hearing Examiner from Paul Lumbert, Public Works Department, dated March 20, 1979, regarding compliance of street lengths with • ordinance requirements. Mr. Clemens corrected Section L.5 of Exhibit #1 which states that sewers will be extended to Jones Avenue N.E. , and advised that extension will occur in a northerly direction to N.E. 27th Street. The Examiner entered th'e following letter into the record: Exhibit #6: Letter to Hearing Examiner from Bill Hickox, dated February 19, 1979, • regarding request for exception of street widths. • The Examiner asked the applicant if he concurred in Exhibit #1. Lake Morton Drive • Kent, WA 98031 Mr. Downing indicated his concurrence in the report, and advised that residences within the plat will be constructed by his company.. ' The Examiner, requested further comments in support of the request. Responding was: PP-313-79 Page Two Noel Townsend 409 S. 3rd Avenue Kent, WA 98031 Mr. Townsend, engineer representing the applicant, indicated that preliminary utility and storm drainage details had been coordinated with city engineering staff. Referencing Section L.9 of Exhibit #1 which states that due to existence of 30 to 40o slopes near the southerly boundary, specific grading plans should be reviewed by the Hearing Examiner prior to final plat approval, Mr. Townsend clarified the location of the toe of the slope on Exhibit #3 which runs parallel across the entire southern boundary of the property at the 300 foot elevation level, and noted the existence of only a six-foot difference in grade from the street. The Examiner requested testimony in opposition to the request. Responding was: Stephen J. Randall 2125 N.E. 24th Street Renton, WA 98055 Mr. Randall advised the location of his residence which borders Lots 1, 2 and 3 on the western boundary of the proposed plat, and situated at a lower elevation. He indicated that grading and removal of vegetation accomplished by the applicant had created an over- flow of storm runoff to his lot from the subject site, and as much as eight inches of water has collected under his residence during periods of inclement weather. Responding was: Jackie Lukowski 2216 Aberdeen Avenue N.E. Renton, WA 98055 Mrs. Lukowski requested clarification of disposition of an existing house, garage and driveway located on Lot .6 of the proposed plat. Mr. Clemens advised that the house which is located approximately 90 feet from Mrs. Lukowski's property line, as well as the garage, are expected to remain. Regarding access to the plat, Mr. Clemens indicated that Lots 6 and 7 would access to N.E. 23rd Street and Lots 8 and 9 would have direct access to Aberdeen Avenue N.E. Responding was: Stanley Olson 2217 Aberdeen Avenue N.E. Renton, WA 98055 Mr. Olson inquired regarding the extent and financial responsibility of required off- site improvements on Aberdeen Avenue N.E. The Examiner advised the responsibility of the applicant to provide improvements abutting only his property. Mr. Olson inquired if existing residents would be required to share the cost of sewer line installation. Mr. 'Clemens reviewed recent City Council action to revise the sewer ordinance in order to allow property owners intervening in the extention the option of determining whether or not they wish to connect to the utility lines. He advised that sewers will extend from N.E. 24th Street in a northerly direction to N.E. 27th Street, and lines would be placed in the park area near but not within Aberdeen Avenue N.E. due to existence of steep grades of that roadway. Mr. Olson advised the prior existence of a lake on the subject property which has since been filled, and expressed concern regarding disposition of the water. Responding was: Wayne Regnier 2325 Aberdeen Avenue N.E. Renton, WA 98055 Mr. Regnier inquired regarding location of proposed sewer lines. Mr. Clemens clarified that although the staff report originally designated extension to Jones Avenue N.E. , it had since been corrected and extension will occur to N.E. 27th Street. The Examiner requested further comments. Mr. Townsend explained that the proposed sewer line on Aberdeen Avenue N.E. would be a pressure main, not a gravity line, and would preclude connection by adjacent residents. However, he noted that connection to the gravity system would be possible extending to the pump station at the northwest portion of the plat. Mr. Townsend advised that the design of the storm drainage system had been coordinated with the King County Engineer and city staff and although preliminary details are yet to be completed, the system utilizing percolation trenches and storage pipe would prevent an increase of runoff from the site. The Examiner inquired if the storm drainage plan would facilitate removal of existing water from Mr. Randall's property. Mr. Townsend indicated that it is his, understanding that drainage problems had existed on Mr. Randall's property for some time, and the applicant had not caused significant change to the subject • PP-313-79 Page Three property since acquisition. Mr. Randall advised that although his property,had previously . been relatively damp, recent grading and clearing activity on the subject site had caused an increase in runoff resulting in as much as eight inches of standing water on his property.- Utilizing Exhibit #3, he suggested provision of .a temporary term extending from N.E. 24th to N.E. 23rd Street west of Blaine Avenue N.E. until construction can occur to prevent further storm runoff from the site. Mr. Downing indicated concurrence with the suggestion presented by Mr. Randall. The Examiner requested Mr. Clemens to contact a representative of the Public Works Department to review the matter. Responding was: Don Monaghan Public Works Department Mr. Monaghan was affirmed by the Examiner. The Examiner reiterated previous inquiries regarding disposition of the lake on the subject site, and recent grading activities which have created storm. drainage problems in the area, and requested an opinion regarding whether or not the possibility exists to mitigate these impacts. Mr. Monaghan indicated that once the storm system is installed, problems will be minimized. The Examiner reported the suggestion for installation of a berm along the northwest portion of the proposed plat and questioned whether such installation would mitigate drainage problems. Mr. Monaghan indicated that the properties in question contain lower elevations and undiverted storm water collects on the sites; however, the applicant's drainage proposal would alleviate the runoff problems and specific attention regarding the Randall property could be addressed in the final drainage plan. • The Examiner requested clarification of required off-site improvements in conjunction with the plat necessary for the public health, safety and welfare. Mr. Monaghan indicated departmental requirements for immediate installation of curbs, , gutters, sidewalks, storm drainage, street lighting and paving on N.E. 24th Street, but noted that similar improvements on Aberdeen Avenue N.E. may be delayed through one of the city's processes until such time as the entire street is improved.- The Examiner requested final comments from the Planning Department representative. Mr. Clemens indicated the recommendations contained in Exhibit #1 would' remain as submitted. The Examiner asked the applicant if it is his intent to install off-site improvements as required by .the 'Public Works, Department on N.E. 24th Street and Aberdeen Avenue N.E. Mr. Downing indicated his' intent to install improvementson N.E. 24th Street concurrent .with development of the plat, but felt that improvements to a 100-foot area on Aberdeen Avenue N.E. would not enhance the area since the remainder of the street is unimproved, and would escalate :the cost of housing to the' buyer. The Examiner advised that the Subdivision Ordinance does not specifically state that' off-site improvements are required and the Examiner must determine if and what improvements should be installed. He indicated that a deferral of off-site improvements for .a maximum period of 24 months may be granted by the Board of Public Works and application for a waiver for an indefinite period may be made to the .Hearing Examiner through the Planning Department. He noted that if a waiver is granted, restrictive covenants attesting to agreement to participate in any future LID must be executed. The Examiner requested further comments. Since there were none, the hearing on File No. PP-313-79 and E-314-79 was closed by the Examiner at 11:30 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: ' FINDINGS: • 1. .The request is for approval of the preliminary plat of Azalea Lane consisting of 35 single family lots on 8.4 acres of property in the G-7200 zone. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings 'of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has.been issued for the subject proposal by Gordon Y. Ericksen, responsible official, • subject to review and 'approval of lot grading plans for Lots 10 through 18 to minimize adverse impacts on the adjoining site. • 4. Plans' for the proposal have been reviewed by all city departments affected by' the impact of this development. ' 5. All existing utilities are available- and in close proximity; except that sanitary PP-313-79 Page Four sewer extension from N.E. 27th Street is required. 6. The proposal is compatible with the required lot area and dimension requirements of Sections 4-706 (R-1) and 4-729 (G) of Title IV, and Section 9-1108.23 (Subdivision Ordinance) , Title IX, Ordinance No. 1628, Code of General Ordinances. 7. An exception has been requested from Section 9-1108.7.H which requires that streets longer than 800 feet be 60 feet in width. In Exhibit #4, staff identified that various lengths are present within the proposal, which are less than or greater than 800 feet. A clear definition of Section 9-1108.7.H. , Table I, is not contained in the Subdivision Ordinance. 8. It was clarified that the steep slope area at the southern portion of the proposal (Exhibit #3) ends at approximately the 300-foot elevation. Staff indicated that the approximate 287-290-foot elevation was the terminus of the slope. 9. The site was at one time a lake which was filled some time ago. Approximately five to six months ago the landfill was graded to the present condition. 10. Storm water drainage appears to collect on the properties at the northwest abutting corner of the site. The applicant testified that a land berm could be installed to help solve the problem. . Staff indicated that much of the drainage problem is the result of accrued storm water run-off from properties along Aberdeen Avenue N.E. and N.E. 24th Street. Staff also testified that the final approved storm drainage plan should substantially correct the problem. At this point only conceptual approval has been given by staff of the storm drainage plan. 11. Off-site improvements of curbs, gutters, paving, sidewalks, storm drainage facilities, utilities and street lighting were recommended by the Planning and Public Works Departments (attached memoranda of March 26, 1979 and March 30, 1979) . 12. Per discussion with the City Attorney, the Examiner does not, in fact, possess authority to review applications for waiver of off-site improvements since waivers apply only to short plat, not preliminary and final plat, applications. CONCLUSIONS: 1. The proposal appears to conform to the goals and objectives of the Comprehensive Plan and serve the public interest, health, safety and welfare (Section 9-1106.2.E. (2) ) . Special consideration needs to be given of the steep slope area along the southerly portion of the site and storm drainage impacts upon adjacent properties. 2. It appears that the most reasonable interpretation of Section 9-1108.7.H. , Table I, is that "street" be considered a public right-of-way measured by the least distance to access to another public street not within the proposal. N.E. 23rd Street is served by Camas Avenue N.E. and Blaine Avenue N.E, According to Exhibit #4, the distance from N.E. 24th Street via Camas Avenue N.E'. , N.E. 23rd Street and Blaine Avenue N.E. is approximately 960 feet. This distance does not conform to the section maximum of 800 feet. But the distance from N.E. 23rd Street via Blaine Avenue N.E. to N.E. 24th Street is a maximum of 690 feet in conformance with the section of the ordinance. 3. An exception from the requirements of Section 9-1108.7.H, Table I, was- requested upon the contingency that the Examiner determined noncompliance with the section. Per Conclusion No. 2, the exception application applies to the internal loop road of Camas Avenue N.E. , N.E. 23rd Street and Blaine Avenue N.E. Constraints of the steep slope area along the southern portion of the property (requires larger than required lot area and depth) and limited frontage along N.E. 24th Street impose some special circumstances upon development of the property (Section 9-1109.1.A) . Other properties in the vicinity have apparently been permitted to be subdivided into approximately 7200 square foot lots, but testimony did not address whether similar street widths were approved (Section 9-1109.1.B) . Injury to the public or other properties is not apparent due to approval of the exception (Section 9-1109.1.C) . Therefore, it seems appropriate in this instance to approve the exception to permit 50-foot wide public streets within the proposal. 4. Prior to submittal of the final plat, the applicant and the staff should review the steep slope area at the southern portion of the site. Stabilization of these slopes appears necessary since they are exposed and unprotected from erosion. An interim stabilization and erosion control program should be initiated per staff requirements. PP-313-79 Page Five 5. Storm water run-off control can only be expected of the applicant within the confines of the subject property. However, it appears that within the property, more specifically along the northwesterly perimeter of the site, earth berming and/or other storm water control measures can be installed by the applicant to help relieve adjacent properties of existing run-off problems. This should be incorporated into the, Public Works Department review and approval of the final drainage plan prior to submittal of the final plat application. 6. Off-site improvements along N.E. 24th Street and Aberdeen Avenue N.E. of curbs, • gutters, sidewalk, paving, storm drainage facilities, utilities and street lighting appear upon review of the record to be in the best interest of ". . .the public health, safety, welfare and. . .adequate public services, and safe and functional streets and thoroughfares. " (Section 9-1101.2) • RECOMMENDATION: • Approval of Exhibit #2 subject to: • 1. Submittal to the Planning and Public Works Departments of a slope stabilization and erosion control plan for review and approval and implementation as required. 2. Submittal of the final drainage plan for review and approval of the Public Works . Department per Conclusion No. 5 prior to submittal of the final plat application. 3. Installation. of off-site improvements along N.E. 24th Street and Aberdeen Avenue N.E. of curbs, gutters, sidewalks, street paving, storm drainage facilities and street lighting per review and approval of the Public Works Department. It is the feeling of this department that the street improvements on N.E. 24th and Aberdeen Avenue N.E. constitute integral parts of the' applicant's • plat, and thus should be required. N.E. 24TH: With regard to this, particular street, the lotting . arrangement provides for side yard exposures for four lots across the entire frontage of the plat. As such, these street improve- ments become actually a portion of the development. Secondly, the proposal will triple the number of intersections on N.E. 24th between Aberdeen and Edmonds as well as more than double the traffic conditions on the same street area. Based upon these two factors , . it would appear that the public's safety and welfare would not be served by elimination of these improvements. Lastly, storm drainage control would be established by the completion of these improvements, and thus relieve, in part or in total , the problems addressed at the public hearing. ABERDEEN AVENUE N.E. : The two lots from this proposed development which face Aberdeen Avenue in fact require. the installation of the street improvements in order to complete the proposed lots. With- out the. street improvements, the adequacy•of access to the street right-of-way and control of storm drainage would be clearly in question., The proposed development Will also increase the public use on Aberdeen Avenue N.E.• and thus the total number of traffic trips on this street by approximately 35% - 40%. Based upon this traffic increase plus the need for completion of the improvements noted to serve the two proposed lots, it would appear that the public safety and welfare would be best served by requiring these improvements. Specifically, the public health, safety and welfare requires that these improvements be installed in conjunction with the plat. Street improvements, consisting of curbs, gutters and street pav- ing are necessary for the public safety to provide vehicular traffic facilities. Sidewalks are required to provide safe pedestrian facilities. Storm drainage facilities are required for the public health and welfare. Sanitary sewers and water systems are required for the public health and the integration of the system to provide for logical development of the area and provide for the general welfare of the community. Street lighting provides safety and is for the general welfare. The sanitary sewer systems and water systems shall be extended to the appropriate property lines to provide for the extension to service other properties in the vicinity consistent with our Com- prehensive Development Plan and Programs.. It is the feeling of this department that the street improvements on N.E. 24th and Aberdeen Avenue N.E. constitute integral parts of the applicant's plat, and thus should be required. N.E. 24TH: . With regard to this particular street, the lotting arrangement provides for side yard exposures for four lots across the entire frontage of the plat. As such, these street improve- ments become actually a portion of the development. Secondly, the proposal will triple the number of intersections on N.E. 24th between Aberdeen and Edmonds as well as more than double the traffic conditions on the same street area. Based upon these two factors, it would appear that the public's safety and welfare would not be served by elimination of these improvements. Lastly, storm drainage control would be established- by the completion of these improvements, and thus relieve, in part or in total , the problems addressed at the public hearing. ABERDEEN AVENUE N.E. : The two lots from this proposed development which face Aberdeen Avenue in fact require the installation of the street improvements in order to complete the proposed lots. With- out the street improvements, the adequacy of access to the street right-of-way and control of storm drainage would be clearly in question. The proposed development will also increase the public use on Aberdeen Avenue N.E. and thus the total number of traffic trips on this street by approximately 35% - 40%. Based upon this traffic increase plus the need for completion of the improvements noted to serve the two proposed lots, it would appear that the public safety and welfare would be best served by requiring these improvements. ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C , a declaration of non-significant environmental impact has been issued subject to final review and approval of lot grading plans for lots 10 through 18 to minimize adverse impacts on the adjoining site . The single family residential plat is consistent with the Comprehensive Plan and zoning designations for single family residential use of the site and surrounding area . 2 . The proposed subdivision is consistent with the adjacent single family residence land uses and subdivisions . 3. The proposed lots range in size from 7200 square feet to over 10 ,000 square feet and are consistent with the minimum lot size ( 7200 square feet) of the G-7200 zone in which the site is located.. These sizes are also compatible with the Bel -Shane and Edendale Subdivisions adjacent to the east. 4 . Section 9-1108- ( 7H ) of the Subdivision Ordinance states that for residential access streets less than 800 feet long right-of- way width of 50 feet is allowed . For neighborhood collectors the right-of-way width requirement is 60 feet . Driving distances on the interior streets are as indicated on the attached exhibit . Due to the looped street pattern , no "collector" street design exists . However , the question of length is unclear . One; definition of length would be by different street names . Using street names as a definition could lead to excessive travel routes , although over various names . Another could relate to routes of traffic movements . It would seem reasonable that the 800 ' maximum for 50 ' width streets should relate to the longest required travel route where no alternate (or secondary ) route is available . However, these are essentially optional routes . Based upon the above , it appears that this plat conforms to the 800 ' maximum length allowedfor 50 ' width streets . No comments were received on this issue from other Departments . 5 . Suitabl.e utilities are available in the vicinity of the subject site . The developer will be required to extend sewer to Jones Avenue N . E . and install a lift station . Other Utilities Division comments are attached . Detailed plans shall be subject. to Public Works Department approval . 6. The Fire Department indicates that hydrants shall be installed and ready for use prior to any building construction . Water main size and installation shall be approved by the Utilities Division . See additional comments . 7 . The Engineering Division advises that off-site improvements consisting of curb , gutter , sidewalk , and paving will be required on Aberdeen Avenue N . E . and N . E . 24th Street. Storm drainage plans will also have to be installed . Other comments attached . 8. A street lighting plan will have to be approved by the Traffic Engineering Division . This will eventually become a city owned system. See other comments . 9 . As noted earlier , slopes of 30-40% exist near the southerly boundary of the subject site (Lots 10-1.8) . It would be adviseable that a site specific grading plan for this portion be submitted for review by the Hearing Examiner prior to final plat approval . No clearing or grading of these lots shall occur until this requirement has been satisfied . Additional comments of other departments are attached for consideration . M. DEPARTMENTAL RECOMMENDATIONS : Based upon the foregoing analysis , recommend approval of the proposed plat subject to the following conditions : 1 . Final Public Works Department approval of detailed utilities plans . 2 . Fire Department approval of hydrant sizes and locations . 3 . The' single family residential plat is consistent with the Comprehensive Plan and zoning designations for single family residential use of the site and surrounding area . 2. The proposed subdivision is consistent with the adjacent single family residence land uses and subdivisions . 3. The proposed lots range in size from 7200 . square feet to over 10 ,000 square feet and are consistent with the minimum lot size (7200 square feet) of the G-7200 zone in which the site is located . These sizes are also compatible with the Bel -Shane and Edendale Subdivisions adjacent to the east. 4. Section 9.-1108- (7H) of the Subdivision Ordinance states that for residential access streets less than 800 feet long right-o way width of 50 feet is allowed. For neighborhood collectors the right-of-way width requirement is 60 feet-. Driving distances on the interior streets are as indicated on the attached exhibit. Due to the looped street pattern , no "collector" street design exists . However, the question of length is unclear. - One definition of length would be by different street names . Using street names as a definition co lead to excessive travel routes , although over various names . Another could relate to routes of traffic movements . It would seem reasonable that the 800 ' maximum for 50 ' width streets should relate to the longest required travel route where no alternate (or secondary ) route is available . In the case of this plat , the longest required route with no alternate access is 690' feet in length , this complying with I PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : JOYCE DEVELOPMENT CO . , File Nos : PP-313-79 , E-314-79 MARCH 20, 1979 PAGE FOUR the 800 ' maximum. .The other longest route would extend from lot 30 to N . E . 24th , a distance of 585 ' . It should be noted that two routes exceeding the 800 ' limit exists . However, these are essentially optional routes . Based upon the above , it appears that this plat conforms to the 800 ' maximum length allowed for 50 ' width streets . No comments were received on this issue from other Departments . 5. Suitable utilities are available in the vicinity of the subject site. The developer will be required to extend sewer to ; Jones Avenue N . E . and install a lift station . Other Utilities Division comments are attached . Detailed plans shall be subject to Public Works Department approval . 6 . The Fire Department indicates that hydrants shall be installed and ready for use prior to any building construction . Water - main . size and installation shall be approved by the Utilities Division . See additional comments . 7 . The Engineering Division advises that off-site improvements consisting of curb , gutter , sidewalk, and paving will be required on Aberdeen Avenue N . E . and N . E . 24th Street. Storm drainage plans will also have to be installed . Other comments attached . 8. A street lighting plan will have to be approved by the Traffic Engineering Division . This will eventually become a city owned system. See other comments . 9. As noted earlier , slopes of 30-40% exist near the southerly boundary of the subject site (Lots 10-18) . It would be adviseable that a site specific grading plan for this portion be submitted for review by the Hearing Examiner prior to final plat approval . .No clearing or grading of these lots shall occur until this requirement has been satisfied . Additional comments of other departments are attached for consideration . M . DEPARTMENTAL RECOMMENDATIONS : Based upon the foregoing analysis , recommend approval of the proposed plat subject to the following conditions : 1 . Final Public Works Department approval of detailed utilities plans . 2 . Fire Department approval of hydrant sizes and . locations . 3 . Installation of off-site street improvements and approval of storm drainage plans as per Engineering Division requirements . (Per Analysis #7 above ) . 4. Final Traffic Engineering Division approval of a street lighting plan. 5 . A detailed lot grading plan should be reviewed by the Hearing Examiner at the time of Final Plat approval for lots 10-18. Regarding the proposed exception for street width , the Planning Department recommends that no exception be required based upon the above analysis contained in item L-4 . However , if the Examiner determines that an exception is necessary , the Planning Department would recommend approval of the exception , also based upon that analysis .
