Gentlemen :
We have reveiwed the initial stages of clearing of the above
referenced site , which is being conducted under the control
of Granville N. Horn , B.S . Forestry, pursuant to his letter
from your office dated April 15 , 1980 . Although we generally
concur in the clearing that is occurring at the site, we
will need to further evaluate the condition as site clearing
nears completion . It would appear that in order to conform
to the requirements of the preliminary plat approval , that
some additional tree plantings may be required within the
development of the site. This may include rear lot line
plantings or street trees , or a combination of both.
Since our final evaluation cannot be completed prior . to the
expiration of the preliminary plat on April 23, 1980, by
carbon copy of this letter, we are suggesting that the Hearing
Examiner consider an extension for the preliminary plat .
At such time as the final plat application is submitted ,
we will consider a revised environmental declaration based
upon the conditions that exist on the site at the time.

Gentlemen:
The Board of Public Works, at its meeting of February 13, 1980,
agreed to defer that portion of N. E. 23rd St. abutting your
development for a period of one year. The Board is not author-
ized to waive requirements for off-site improvements. It would
be necessary for you to appeal to the Hearing Examiner for an
exception to the ordinance.
The deferral is granted on condition that a bond in the amount of
150% of the estimated cost of the improvement is posted. The bond
amount has been set at $6,800.00. Please post the bond with this.

RE: WEATHERED WOOD #2 PLAT
Dear Mr . Holmberg:
We briefly inspected the clearing operation at the
Weathered Wood #2 plat during the afternoon of
April 2 , 1980. The clearing operation in progress
exceeds the right-of-way area clearing agreed to by
this department in our letter of March 6, 1980. By
carbon copy of this letter, we are requesting the
Building Division to issue a stop-work order for
this clearing.
Until such time as a tree preservation plan indicating
the precise location of individual homes is submitted
and approved by this department, no further clearing
is to occur. The tree preservation plan should be
in such a form and with sufficient detail to be able
to accurately determine which trees by size and type
should be retained on the site to meet the intent of
the Hearing Examiner' s decision.

Gentlemen:
This letter is a follow-up to our phone conversation this morning
requesting Planning Dept. on-site inspection for clearing per your
letter of March 6, 1980 (i.e. 24-hour notice).
It is anticipated that the right-of-way clearing will be completed
tomorrow so Hillis Homes needs someone from the Planning Dept.
to authorize additional clearing. If you are unable to make the site
inspection tomorrow morning, Hillis Homes will be forced to shut
down the clearing operation and may have to move the equipment
to another job.
Please let me know if you will be able to make the inspection tomorrow
morning and if you would like someone from our firm present.

Dear Mr . Holmberg :
After reviewing your letter of March 5, 1980 the Planning
Department cannot agree with the suggested method of clearing
the plat for Weatherwood No . 2 .
It is apparent that the condition of the Hearing Examiner
to require that all trees that could be saved should be saved
can only be fulfilled through a limited and specific clearing
process . It is the Planning Department 's position that the
only method to obtain this result is to allow the clearing
of the road right-of-ways to begin with . We will then proceed
with an on-site inspection to allow the specific clearing
of the individual lots . It is our feeling that this can
be accomplished on the site while your bulldozer operators
are finishing the clearing of additional areas on the right-
of-way. The Planning Department staff will be available
to conduct these on-site inspections based on 24-hour notice .
We anticipate that our on-site inspections will probably
not take more than 1-2 hours for each section that we are
looking at . Hopefully this will resolve the construction
problems that you have expressed to the department .
If this is not an equitable solution for you, it is possible
to conduct another meeting involving the Planning Director
to discuss other viable alternatives . However , I would like
to stress the fact that the Planning Department is fairly
limited in its position to assure that as much vegetation
is retained on the site to assure the natural character of
the development . .

which was affirmed by the City Council on April 23 , 1979,
has been violated . This condition required the retention
of existing vegetation on the site , subject to the Planning
Department ' s approval .
On February 5th and again on March 6 , 1980, this department
granted the authority to clear the 50-foot right-of-way for
this project subject to further review of specific on-site
details. During inspections of the site on April 2nd and
April 4th, it is apparent that this condition has been
substantially violated by clearing areas far in excess of
the right-of-way .

Dear Mr. Holmberg:
Your request for an extension of your preliminary plat was forwarded to this
department by the Planning Department. In a separate memorandum to this
department commenting on the advisability of the requested extension, the
Planning Department indicated that Condition #4 of the Examiner's decision
of March 30, 1979 as approved by the City Council on April 23, 1979, has
been violated. That condition stated: "Retention of existing vegetation
in the easterly portion of the site as much as possible while protecting the
public, health, safety and welfare per review by the Planning Department with
the applicant. "
That approval was further predicated on a Declaration of Non-significance
issued by the responsible official, Gordon Y. Ericksen. Condition #2 of
that Declaration stated: "Negative declaration is further based upon
applicant's retention of significant trees on site and incorporating into
plat design and development."
The Planning Department's determination that that condition has been violated
would therefore invalidate the Declaration of Non-significance. I cannot
take further action on this request until the environmental determination is
complete to the satisfaction of the responsible official.
I would also point out that if you have in fact violated Condition #4 of the
approved preliminary plat, your final plat could not conform exactly to the
approved preliminary plat pursuant to Section 9-1106.2(F) .
Therefore, I would suggest that you contact the Planning Department in regard
to the original environmental assessment which may in fact require modification
based on the facts of the matter.

Dear Mr. Holmberg:
I have received a copy of the letter addressed to you from the Planning
Department this date referencing the clearing of your property pursuant
to the conditions imposed by the previously approved preliminary plat.
The Planning Department has indicated that full review of the actions
to date would not be possible prior to the expiration of the preliminary
plat on this date.
Because of the constraints imposed by the imminent expiration of your
preliminary plat, a one year extension would appear justified until
the facts pertaining to the alleged violation of site preparation can
be ascertained. You are hereby notified that if, in fact, the
conditions as approved by the City Council have been violated, you may
be subject to the penalties provision of Section 9-1110.
Pursuant to Section 9-1106.2(H) , only one extension is permitted, and
that extension is limited to a maximum of one year. If at the
expiration of this additional year a final plat based upon the approved
preliminary plat has not been submitted, the plat will lapse. In order
to pursue your objectives after that expiration, a new preliminary plat
would have to be submitted.

Preliminary Plat No. PP-315-79
LOCATION: East side of Edmonds Avenue N.E. between N.E. 23rd Street and
the existing Aloha Ranch Subdivision.
SUMMARY OF REQUEST: Applicant was granted preliminary plat approval on April 29,
1979, and now desires approval of an exception to street width
for the proposed east/west N.E. 23rd Place N.E. The subject
street exceeds the maximum 800-foot length which would allow
a 50-foot street.

PLANNING DEPARTMENT The Planning Department supplemental report was received by
REPORT: the Examiner on May 10, 1979. •
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject' as follows:

The hearing.was opened on May 15, 1979 at 11:15 a.m. in the Council Chambers of the Rento
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
•
It was reported that the Hearing Examiner and the applicant had received and reviewed .
the. Planning Department supplemental report, and the report was entered into the record
as Exhibit #4.
David Clemens, Associate Planner, indicated that the exception to the Subdivision Ordinan,
was requested subsequent to previous approval on Apri1 .23, 1979 of preliminary Plat, File
No. PP-315-79, upon discovery of the intent of the applicant to provide a 50-foot right-
of-way within the plat in lieu of the 60-foot right of way which is required by ordinance
Mr. Clemens reviewed Exhibit #4 and entered the following additional exhibit into the rec
Exhibit #5: Preliminary Plat designating exception request

The Examiner requested testimony by the applicant. Responding was:

Mr. Ewing; engineer for -the project, reviewed background of the preliminary plat process,
and advised that, the requested exception had been overlooked during resubmittal of the
preliminary plat subsequent to expiration of a previously approved application. The
Examiner reviewed Section 9-1109.1 of the Subdivision Ordinance which designates conditii
which must be in evidence: to allow approval of an exception. Utilizing Exhibit #5, Mr.
Clemens-reviewed the special, physical circumstances affecting the property pertaining ti
lot depth on the northwestern portion of 'the plat, and the applicant advised• that other
developments in the vicinity have enjoyed similar rights and privileges in .providing red
right-of-way width. Mr. Ewing also indicated the.possibility of locating proposed
Harrington Place N.E. further to the west to comply with the cul-de-sac length requireme
of the ordinance.
• The Examiner requested further testimony in support or opposition to the application. .
There was no response. He then requested further comments from the Planning 'Department
staff. Mr. Clemens advised that the recommendation contained in Exhibit #4 would remain
. as submitted:
The Examiner requested further comments. Since there were none, the hearing'on File'No.
E-343-79 was closed. by the Examiner at 11:23 a.m. •

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
low makes and enters the following:
'INDINGS:
▪ The request is for approval of an exception from the Subdivision Ordinance for a street
of less than the minimum width; proposed - 50 feet, required - 60 feet.
. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 (as amended) - R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
. There was no opposition to the proposal expressed.
▪ All existing utilities are available and in close proximity.
. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Sections 4-706 (R-1) and 4-720 (G) of Title IV, and Section 9-1108.23
(Minimum Standards for Residential Design - Subdivision Ordinance) of Title IX,
Ordinance No. 1628, Code of General Ordinances.
. The preliminary plat as conditioned by the Examiner received approval of the City
Council on April 23, 1979. Those actions, both the Examiner's recommendation and. the
Council's approval are incorporated by reference.
. The subject plat is 1264.48 feet deep off of Edmonds Avenue N.E. The proposed access
from Edmonds will be via N.E. 23rd Place. This roadway will then intersect Harrington
Place N.E. 960 feet to the east.
Section 9-1108.23. (A) (4) requires that a street over 800 feet in length that connects
to a major street be 60 feet in width.
Presently Harrington Place is an unopened street right-of-way. The applicant has been
required to provide a second access to the proposed development and Harrington Place
N.E. was designated.
The applicant could open Harrington Place N.E. some 160 feet to the west and avoid the
width requirement of the ordinance. This would cause a jog in Harrington Place N.E.
which the Planning Department states would cause an adverse effect on general circulation
along Harrington Place N.E.
There are no public rights-of-way in the vicinity of the proposed development.
Other properties in the area are not constrained by prior development of the existing
street pattern.
The additional ten feet required for street right-of-way would create unusually narrow
lot depths in the proposed subdivision.
CLUSIONS:
Due to the large depth of the subject block and the preexisting street pattern the
applicant would suffer undue hardship in meeting the strict provisions of the
Subdivision Ordinance.
Harrington Place N.E. which is the most logical and the nearest north-south street in
the vicinity of the subject property is located some 960 feet to the east of Edmonds
Avenue N.E. and therefore without a realignment of Harrington Place N.E. which the
Planning Department finds unacceptable , the applicant must provide a street of 960 -
feet in length.
The length of 960 feet then in turn requires a width of 60 feet. The applicant would
be unduly constrained in his development if required to narrow his proposed lots by
this additional ten feet.

2. The public welfare will not suffer adverse effects if 23rd Place N.E. is 50 feet wide
instead of 60 feet. Nor will property in the area be affected by the narrower street
width.
3. Other properties in the area have been developed and have not been constrained by the
existing street and block pattern. The applicant could comply with the provisions
of the ordinance either by creating a jog which the Planning Department finds would
create adverse effects for traffic circulation or narrowing his developable lot areas.
The approval of a special exception appears to be the better choice and allow the
applicant to develop his property as others in the vicinity have developed theirs.
DECISION:
The exception is granted subject to the conditions specified in the Examiner's Recommendation
as approved by the City Council on the Preliminary Plat, dated March 30, 1979.

C. ANALYSIS :
1 . For background on the subject plat , a review of the staff
report dated March 27 , 1979 , and the Hearing Examiner
report of March 30 , 1979 , would be appropriate . _
2. The applicant ' s request is to reduce the street weidth for
N . E. 23rd Street as it extends through the plat from 60
feet to 50 feet. The subject street is 960 feet in length ,
which would normally require a 60 foot right-of-way . For
streets of less than 800 feet in length , a 50 foot right-of-
way is allowed by the Subdivision Ordinance.
3 . The applicant ' s letter of April 30 , 1979 , sets forth the
reasoning and background of the request. It would appear
that due to the configuration of the proposed plat , and
the location of Harrington Place at the easterly end of
the plat , this arrangement does create a hardship upon
this development to provide a longer connecting street
than the ordinance criteria for a 50 foot neighborhood
street . Although the applicant could conform to the length
requirements by moving the street connection westerly, this
would have an adverse effect on the general circulation
pattern by not providing a�smooth connection between the
north/south streets in the vicinity and the proposed east/
west street.
4. The proposed exception has been reviewed by Traffic Engineer-
ing , the Fire Department , Utilities and Engineering , which all
concur in the requested exception . Additional comments from
those departments are attached.

Dear Mr. Clemens:
Please consider this letter a request for an exception from
the sub division ordinance as it relates to the length of NE
23rd Place as shown on the preliminary plat. This request
is based on the following reasons:
1. This plat had prior preliminary approval and the length of
NE 23rd Place was not an issue.
2. By moving Harrington Place approximately 160 feet to the
West the exception would not be required. The City of
Renton has requested the connection to Harrington Place
as shown which is causing the excessive length of NE 23rd.
Place.
3. The 50 foot right-of-way width is compatible with simular
property in the area. The exception should be granted to
insure same rights and privileges that other properties
enjoy in the area.
4. The 50 foot right-of-way has never been an issue with the
engineering department as it relates to the public safety
and welfare.

Section 13.208 (A) of the Uniform Fire Code which has been adopted
by the City Of Renton sates "Every building hereafter construction
shall be accessible to Fire Department Apparatus by way of access
roadways with all weather driving surface of not less than 20 feet
of unobstructed width, with adequate roadway turning radius capable
of supporting the imposed loads of fire apparatus and having a
minumum of 13 feet 6 inches of vertical clearance. "
A 50 foot right-of-way will require a "No Parking" zone on one side
of N.E. 23rd Place which must be identified and posted according
to City Ordinance Number 3312 in order to meet the above section -6f
the Uniform Fire Code.

Section 13 .208 (A) of the Uniform Fire Code which has been adopted
by the City Of Renton sates "Every building hereafter construction
shall be accessible to Fire Department Apparatus by way of access
roadways with all weather driving surface of not less than 20 feet
of unobstructed width, with adequate roadway turning radius capable
of supporting the imposed loads of fire apparatus and having a
minumum of 13 feet 6 inches of vertical clearance. "
A 50 foot right-of-way will require a "No Parking" zone on one side
of N.E. 23rd Place which must be identified and posted according
to City Ordinance Number 3312 in order to meet the above section -Of
the Uniform Fire Code.

Dear Mr. Clemens:
Please consider this letter a request for an exception from
the sub division ordinance as it relates to the length of NE
23rd Place as shown on the preliminary plat. This request
is based on the following reasons:
1. This plat had prior preliminary approval and the length of
NE 23rd Place was not an issue.
2. By moving Harrington Place approximately 160 feet to the
West the exception would not be required. The City of
Renton has requested the connection to Harrington Place
as shown which is causing the excessive length of NE 23rd,
Place.
3, The 50 foot right-of-way width is compatible with simular
property in the area. The exception should be granted to
insure same rights and privileges that other properties
enjoy in the area.
4. The 50 foot right-of-way has never been an issue with the
engineering department as it relates to the public safety
and welfare.

REPORT: Examiner on March 22, 1979. . •
.PUBLIC HEARING: After reviewing the Planning Department ,report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
. The hearing was opened on March 27, 1979 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed.,by the Examiner.
It was .reported that the Hearing Examiner and the applicant had received and reviewed .
the Planning Department report, and the report was entered into the record as Exhibit #1.
Steve Munson, Planning Department, reviewed Exhibit'#1, and entered the following
additional exhibits into the record:

Mr. David Clemens; Associate Planner, corrected Section A. of Exhibit #1 (Summary and
Purpose of Request) , advising that requests for exceptions and waiver had been included
with the previous preliminary plat request, File No. PP-149-78, which had expired, and
should be deleted from the current request. •
The Examiner asked 'the representative for the applicant if he concurred in Exhibit #1.

Mr. Ewing indicated general concurrence in the report, but requested an exception to the
recommendation contained in Section L.8 which requires provision of a 60-foot wide right-
of-way' due to the width of 950 feet of the main residential access through the plat. He
also objected to installation of full off-site improvements, particularly on N.E. 23rd
Street which, with the exception, of Harrington Place N.E. , does not provide access to •
the plat. Mr, Ewing requested clarification of a previous requirement imposed during
review of File No. PP-149-78 for fencing along the southern boundary of the site which
had not been included in Exhibit #1, as well as comments submitted by the Park Department
requesting delay of approval of the plat until such time as suitable park land is developed
in. the area. '

'Responding to concerns expressed by the applicant; Mr. Clemens confirmed the Park Department
recommendation,that :additional. recreational space be. provided in the northeast quadrant
of the city prior 'to'final approval of the plat, but noted the Planning Department's Opinion
that specific.requirement. of this particular 'applicant is inappropriate.
The Examiner, r.equested'comments in support or opposition 'to the request. .There was no
response. Mr; Clemens, advised that'. the'.applicant's.request for exception 'to the Subdivision'
' ..Ordinance _for reduction of roadwaywidth.would require >formal:application and .a subsequent.
public.hearing; Mrtwing ;indicated'that:'because. :the' previous preliminary plat approval .

roadway width, he was unaware of the requirement. Mr. Clemens noted that because
discussion of the exception at that time had related to cul-de-sac length, it was possible
the issue of roadway width requirements had been clouded.
Regarding Park Department request for reconsideration of recreational space in the area, the
Examiner inquired if requirements of the ordinance specify allocation of a certain
percentage. of property for recreational needs in a single family subdivision. Mr. Clemens
indica ted that existing ordinances do not contain the requirement. The Examiner stated
his opinion that the city has no formal process for proceeding with the Park Department
request., Mr. Clemens referenced Section 9-1106. (E) .2. , Subdivision Ordinance, which states
that the City Council must determine that appropriate provisions are made for the public
health, safety and welfare and whether .the general public interest would be served by the
subdivision; therefore, the section provides the vehicle for the Council to consider the
appropriateness of development as it relates to the general area. Mr. Clemens noted that
it was not the intent of the department to prevent development of the subject plat, but .
to ensure provision at a future date of the necessary park property to accommodate potential
users prior to final approval of the plat. The Examiner requested clarification of the
deletion. of. previously approved fencing on the southern boundary of the site. Mr. Clemens
indicated the recommendation of the department 'that installation of the fencing be an
option of the developer and builder.
The Examiner requested a representative from the Park Department to testify. Responding
was:

Parks and Recreation Director •
Mr. Webley was affirmed by the Examiner. .The Examiner referenced a memorandum from the
Parks and Recreation Director attached to.Exhibit #1 which states that although the
subject plat does not constitute a major impact on the park system, cumulative effect
from other developments had created a need for an additional 7 to 10 acre neighborhood
park in the east Kennydale area. Mr. Webley noted that in the Comprehensive Park and
Recreation Plan recently adopted in January of .1978, the east Kennydale area is ranked
fourth in priority for acquisition and development of a neighborhood park. The Examiner
inquired if the department is proposing that specific land be dedicated from the subject
development. Mr. Webley indicated that. it was not the intent of the department to
acquire a portion of the subject site, but to reflect the need for dedication of a 7
to 10 acre park in a general contiguous location to the site. The Examiner inquired if
location of a 'site had been specified. Mr. Webley advised that due to necessity of
acquisition and cost of the property as. well as existence of three other priorities in
the Comprehensive Plan, determination of site location had not occurred. •
The Examiner requested a 'representative of the Public Works Department to testify regarding
the requirements of off-site improvements. Responding was:

Public Works Department
Mr. Monaghan was affirmed by the Examiner. The Examiner advised that Exhibit #1 reflects
recommendations for complete off-site improvements along Edmonds Avenue N.E. as well as
the same requirements with the exception of sidewalks along N.E. 23rd Street. He noted
that because the ,intent of the Subdivision .Ordinance is unclear regarding off-site
improvement requirements, it had been determined by the City Attorney that justification
must be contingent upon the public health, safety and welfare, and he inquired regarding
the reason for the requirements. Mr. Monaghan indicated that requirements of improvements
to protect the public health, safety and welfare were necessary on Edmonds Avenue N.E. for
purposes of traffic safety, storm drainage and pedestrian use. The Examiner requested
justification for required improvements on N.E. 23rd Street. Mr. Monaghan indicated that
curbs and gutters would be necessary on the northern half of- the street to protect
motorists and 'parked vehicles, and storm drainage would concurrently be required to assist '
removal of water from the improved street. The Examiner inquired if, in the interest of
the public, sidewalks should be required. Mr: Monaghan felt that sidewalks should not
be required at this time. The Examiner requsted the applicant to respond to the question
of off-site improvements. Mr. Ewing indicated his intent to install full off-site
improvements on Edmonds Avenue N.E. but objected to installation of duplicate storm
drainage facilities along N.E: 23rd Street as well as street lighting since half-street
improvements on that roadway will not benefit the residents of the plat. He requested
clarification of,necessary, street widening on N.E. 23rd Street. Mr. Monaghan indicated •
that requirements for street lighting could be deferred until the entire street is
improved, and the final street width would contain 32 feet curb to curb or 16 feet for
the required half street section.

The. Examiner clarified.procedures defined in the Subdivision Ordinance which allow
deferral for & maximum period of .two years to be granted by the Board of Public Works, .
and asked Mr.. Monaghanif..a date had'been projected' for. the complete improvement project.

Mr. Monaghan' indicated that a date had not been established. Mr. Ewing advised that
restricted•right-of-way exists on N.E. 23rd Street and it is questionable whether a full
half-street could be installed, but he indicated willingness to coordinate all plans with
the Public Works Department.

The Examiner. requested a final recommendation from the Planning Department representatives.
Mr. Munson concurred with the Public Works Department for full improvement of Edmonds
Avenue N.E., and contended that paving and storm drainage measures should be• required on
.N.E. 23rd Street since .that roadway'.will provide certain access along Harrington Place N.E.
for traffic entering and' leaving the plat. .He recommended possible deferral of •
installation of street lighting with requirement of restrictive covenants for future •
participation in an LID. The Examiner indicated that. he does not have the authority to
waive the improvements since application for•waiver had'not 'occurred, and deferral for
'a period of,two years would require application to the Board of Public Works.. Mr.
Clemens stated that 'because requirements•of off-site improvements are somewhat undefined
in the Subdivision Ordinance, in this instance whereby improvements may or may not be
required, 'a waiver seems to be consistent.with the attorney's previous decision on the
current status for requirements of off-site .,improvements. . The Examiner advised that a .
legal opinion will •be obtained regarding the'matter prior ,to publication of a
recommendation. •

The Examiner 'requested further comments. Since there were none, the hearing on File No.
PP-315-79 was closed by the Examiner at 10:00 a.m. ' •
•
FINDINGS, CONCLUSIONS & RECOMMENDATIONS:, Having reviewed the .record. in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of the 35-lot single family preliminary plat of
Weathered Wood No. 2. This application was previously heard as File No. PP-149-78
and approved on June 12, 1978. A final-plat application or extension request was
not filed by .the-December 12, 1978 expiration date;' therefore, the preliminary plat
application lapsed per Section 9-1106.2.H.:"
2. The Planning Department report accurately sets forth the issues, applicable policies
and 'provisions, findings of fact, and departmental recommendations in this matter,
and is 'hereby.attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as. amended by R.C.W. 43.21.C. , ,a Declaration of Non-Significance
has been issued 'for the subject proposal by Gordon Y. Ericksen, responsible official
subject to provision of proper sanitary sewers and preservation of as much of the
existing trees as possible. , •
4. Plans for 'the proposal have been reviewed by all city departments 'affected by the
impact of this .development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and' in close proximity. Sanitary sewer extensions
are required to the site.
•
7. The proposal is compatible with the required lot area and dimension requirements of
Sections 4-706 (R-1) and 4-729 (G) of Title IV, and Section 9-1108.23 (Minimum
Standards. for 'Residential Design - Subdivision Ordinance) of Title IX, Ordinance No.
1628, Code of General Ordinances; except for:
a. Width of corner Lots 13 and 14 which are not greater than the interior lots
per Section 9-1108.23.F. (4) . '
b. Right-of-way width of. proposed access road is 50 feet instead of 60' feet per
Sections9-1108.23.A. (5) and 9-1108.7. (H) . ,
8. . The .Parks. and Recreation Department raised the 'initial application of the Comprehensive .
• Park and ,Recreation. Plan for Renton, Washington, March, 1978: At the interface of
. Neighborhoods' #12 and 13 (extreme westerly border of #12) is located the proposal.
• The Action Program, ,page H1, indicates acquisition of 7 to 10 acres in Neighborhood'
#13 to be fourth. priority and acquisitions of one to three acres to be 10th priority
within Neighborhood#12. According to testimony of the Director' of the Parks and
Recreation Department,. specific properties in::these neighborhoods have not been
selected and dedication or.acquisition of'property within the proposal'was unnecessary. ,

9. Exceptions from the Subdivision Ordinance requirements have not been requested.
10. Access from individual lots to N.E. 23rd Street is not proposed and will be precluded. '
CONCLUSIONS:
1. The proposal conforms to the goals.and objectives of the Comprehensive Plan and
appears to serve the'public health, interest', safety and welfare (Section 9-1106.2.E. (2) .
2. Since, exceptions from the Subdivision Ordinance were not a part of this consideration,
and unless such exceptions are approved, the proposal must be revised to conform to
the ordinance. Lots 13 and 14 must be widened to be .greater in width than the
interior lots per Section 9-1108.23.F. (4) . The access road, proposed N.E. 23rd
Place, must be widened to 60 feet per' Sections 9-1108.23.A. (5) and 9-1108.7. (H) .
The length of N.E. 23rd Place is greater than 800 feet.
3. Concerns. expressed by .the Parks and Recreation Department should be raised by that •
department with the City Council relative to policy of implementing the Comprehensive
Park and, Recreation Plan, as affecting land use decisions. This public hearing
represents the initial occurrence of the department presenting these concerns since
adoption of the plan •one'year ago. Since specific recommendations relative to the
proposal were not made, it appears more appropriate for the department's concerns .
to be discussed with the City Council .for determination of policy and direction for
mitigating these concerns.
4. The Subdivision Ordinance was found previously by the City Attorney to not
specifically require or define off-site improvements. These improvements can only
be required if justified on the basis of public health, 'safety and welfare. In this
proposal it appears that sufficient justification exists to warrant requiring
improvements of curbs, gutters, sidewalks and street lighting along Edmonds Avenue
N.E. Improvements 'of curbs and gutters appear justified along N.E. 23rd Street.
The amount of traffic and potential pedestrian movement along Edmonds Avenue N.E.
indicate the 'need for off-site improvements that adequately protect the public
health, safety and welfare. Curbs, gutters, paving,. sidewalks and street lighting
will accomplish this protection. ' Gutters will accommodate storm water runoff to
provide this protection.
N.E. 23rd Street contains a right-of-way varying from 40 to 50 feet width and
accommodates comparatively little traffic. Existing improvements are minimal.
Off-site improvements of curbs, paving and gutters will adequately protect vehicular
and pedestrian traffic utilizing' the street. Sidewalks and street lighting do not
appear warranted at this time, but may be necessary at some future date.
5. Existing vegetation at the easterly portion of the site should be retained as much
as possible while considering the public health, safety and welfare. The Planning
Department should review with the applicant vegetation removal in this 'area to
insure protection of the public health, safety and welfare while enhancing the
aesthetics of the proposal.
6. Per discussions with the City Attorney applications for waiver of off-site improvements
are. not within the preliminary and/or final plat regulations of the Subdivision •
Ordinance.
RECOMMENDATION:
Approval of Exhibit #2 subject to:
1. Revision.per Exhibit #3 per review and approval of the Planning and Public Works
Departments; except as otherwise specified herein. .
2. Construction of off-site improvements of curbs, gutters, sidewalks, paving and
street lighting along the easterly one half of Edmonds' Avenue N.E. per review and
approval of 'the Public Works Department.
3. Construction of. ,curbs, gutters and paving along the northerly one-half of I .E. 23rd
Street per review and approval of the Public _Works Department.
•
4. Retention of existing, vegetation in the easterly portion of the site as much as:
possible, while protecting the public. health, safety and welfare per review by the
Planning Department with the applicant.

5.- Public Works Department review and approval of utility and storm drainage plans.. .

6. Compliance with all applicable regulations and ordinances of the City of Renton.

It is also recommended, but not an issue for resolution with this application, that the
city Council review 'with the Parks and Recreation Department the implementation of the
Comprehensive Park and Recreation Plan relative to land use decisions (See Conclusion
No. 3) .

A. SUMMARY AND PURPOSE OF REQUEST :
The applicant requests the approval of a proposed 35 lot
preliminary plat and exceptions to the subdivision ordinance to
( 1 ) eliminate the requirement for off-site improvements along
Northeast 23rd Street , and (2 ) permit a cul -de-sac exceeding
the maximum length of 500 feet.

C . HISTORY/BACKGROUND :
The subject site was annexed into the City of Renton by
Ordinance #1796 dated October 7 , 1959 . A preliminary plat application
was filed on March 31 , 1978 and approved by the City Council on
June 12 , 1978. However , the approval expired on December 12 , 1978
because neither final plat application nor a request for extension
had been filed prior to that date Therefore , a new Preliminary Plat
application is required and has been filed .
D . PHYSICAL BACKGROUND :
1 . Topography : The site rises fairly gently from west to east
at approximately a four per cent grade . However, the easterly
1 /3 of the site rises toward the east at approximately eight
to ten percent slope .

2 . Soils: Indianola loamy fine sand ( InC ) ; runoff is slow to
- medium, and the erosion hazard is slight to moderate . This soil
is used for timber and for urban development.
3. Vegetation : The site is dominated by a heavy cover of tall
evergreen trees (east 1 /2 of the site ) with wild shrubs and grass
ground cover.
4. Wildlife : The existing vegetation on the site provides suitable
habitat for birds and small mammals .
5 . Water: There is no surface water evidenced on the site .
6. Land Use : The land use of the site consists- of a single family
home on the western edge of the property with the remainder
undeveloped.
E . NEIGHBORHOOD CHARACTERISTICS :
The area is primarily single family residential in nature .
F . PUBLIC SERVICES :
1 . Water and Sewer : An existing 6" water main is located on
Northeast 23rd. Street , a 4" main on the east side of Edmonds
Avenue Northeast, and . a 12" main on the west side of Edmonds .
An 8" sanitary sewer is located approximately 500 feet south
of the subject site and another 8" main is located approximately
1300 feet north of the site along Northeast 27th Street.
2 . Fire Protection : Provided by the Renton Fire Department per
ordinance requirements .
3. Transit: Metro Transit Route #142 operates along Edmonds
Avenue Northeast at the western boundary of the subject site .
4. Schools : The subject site is located approximately one-quarter
mile north of Hillcrest Elementary School',' about one-half mile
north of McKnight Junior High School and approximately two miles
northwest of Hazen Senior High School .
5 . Recreation :. Kennydale Lions Park is located approximately
one-quarter mile northwest of the subject site with North
Highlands Park situated about one-quarter mile south .

I . IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT :
1 . Natural Systems : Development of the subject site will disturb
soil and vegetation , increase storm water runoff and have an effect
on traffic and noise-levels in the area . However, through
proper development controls and procedures , these impacts can
be mitigated .
2 . Population/Employment : The proposed plat of 35 new lots will
increase the population by approximately 122 persons (3. 5
persons/home times 35 homes ) .

3 . Schools : The proposed plat will increase the school population
by approximately 18 students ( . 5 students/home times 9 homes ) .
These new, pupils are likely to be scattered throughout the
grades and not significantly impact the existing services .
4 . Social : .. Increased opportunities for social interaction will
result from development of the subject site.
5 . Traffic : The new subdivision will increase traffic in the area
by, approximately 350 trips per day ( 10 trips/unit times 35 new
units ) .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
, ;• Pursuant to the City of Renton ' s Environmental Ordinance and the
State: Environmental Policy Act of 1971 , as amended, RCW 43-21C ,
a declaration of non-significance has been issued for the subject
proposal . This , declaration is based on the provision of proper
sanitary sewers and. preservation of as much of the existing trees
on the site as , possible . .

L . PLANNING DEPARTMENT ANALYSIS :
1 . The subject proposal is consistent with the Comprehensive Plan
and zoning designations of single family residential use of
the site and surrounding area .
2 . The proposed. plat. is , consistent with :the adjacent single family
uses and subdivisions in the vicinity. '
3. The proposed lots are consistent with the minimum lot size and
dimension requirements of the G-7200 zone and the Subdivision
Ordinance.
4. Utilities including sewer are available to the subject site
and are proposed to '.be installed per City standards . The
word "dry" should be eliminated from the sanitary sewer
plan . The Building Division advises that septic tanks will
not likely be acceptable for sewage disposal and that sewer
connections to City lines for all lots should be required
subject to. Public Works Department review and in accordance
with City standards .
5. Storm drainage plans should be subject to ordinance standards
and Public Works Department approval (see comments ) .
6. The Engineering Division of the Public Works Department has
recommended that all off-site improvements including curb ,
gutter, sidewalk , paving , storm drainage and street lighting
be required on Edmonds Avenue N . E . and N . E. 23rd Street. On
N . E . 23rd Street the sidewalks could be deleted with no access
to the rear of the lots , as provided by the Hearing Examiner' s
previous action .
7 . The proposed connecting street to N . E . 23rd Street at approxi -
mately Harrington Place N. E . , as previously required by the
Hearing Examiner , will require that Lots 13 and 14 be revised

to 80 foot frontages and the succeeding lots to the west
altered accordingly to meet ordinance requirements .
8. Traffic Engineering notes that, Section 9-1108- ( 7H) of the
Subdivision Ordinance states that for residential access
streets less than 800 feet long right-of-width of 50 feet
is allowed . For neighborhood collectors of streets exceed-
ing 800 feet , the right-of-way width requirement is 60 feet.
In this plat the longest driving route with no alternate
access is 950 feet in length . Thus , the proposal exceeds
the allowable maximum by at least 150 feet. Therefore , as
noted by Traffic Engineering, a 60 foot wide right-of-way
must be shown or an exception requested.
9 . The Fire Department notes that hydrants and access shall be
installed prior to any building construction and the hydrants
and water matins are to meet water engineering requirements .
10 . ,Water and sewer plans for locations' will need to be submitted
to and reviewed by the Utilities Engineering Division for
approval . Standard hook-up fees must also be paid. See
other comments .
11 . Average grade is approximately 8 to 10 percent in the
easterly one-third of the site. Grading should be minimized
as much as possible to reduce any potential impacts.
12 . A number of significant evergreen trees exist throughout
the site , especially within the easterly one-half of the
subject site. These should be preserved as much as possible
and incorporated into plat design and development. ( Section
9-1108. 19. B) No clearing shall be permitted prior to Planning
Department approval and shall be consistent with the intent of
the declaration of environmental non-significance.
13. It has been noted by the Parks Department that the subject
proposal together with other developments in the vicinity is
generating a high demand for additional parks and open space
land. The need is becoming increasingly more acute as
undeveloped land is converted into residential sites without
accompanying park land. The Park Department therefore recom-
mends that suitable park land be developed prior to plat appro-
val . ( See attached comments . ) . The additional recreational
space may be provided by the City , the developer or a combina-
tion- thereof.

tion :
M. DEPARTMENTAL RECOMMENDATIONS :
Recommend approval of the proposed plat subject to : 2
1 . Final Public Works Department approval of drainage plans
including suitable retention and oil /water separation facilities .
2 . Installation of fire hydrants ,, water mains and access as per
#10 of the analysis .
3 . Final Utilities Engineering Division approval of detailed water
and sewer plans as per #11 of the' analysis. Sanitary sewers
shall be provided to this plat per, #4 of the analysis and in
accordance with ordinance requirements .
4. Retention of as many significant. trees on the site as possible .
Only, areas for right-of-way should be cleared initially. Land
clearing shall be coordinated and approved by the Planning
Department.

The proposed development, in itself, does not constitute a major impact
on our Parks and Recreation system. However, there have been several
such developments in this area and their cumulative effect is being felt
by our system. Kennydale Park located to the west of this development
and North Highlands Park to the southeast both are limited in size and
therefore any development in the area has measurable impact. The
acquisition of a 7-10 acre neighborhood park in East Kennydale is the
City's #6 overall acquisition priority and #4 neighborhood park priority,
according to the City's. Comprehensive Park & Recreation Plan. It would
appear from the current trend that new development inside the City limits
is increasing with available undeveloped land being acquired by developers.
Desirable locations for park land are few and far between and generally
speaking, the criteria used for site selection are similar to those used
by developers with the net effect being either no land being available
for parks or at best mediocre/poor sites. Same statement needs to be
made concerning the cumulative affect of continued rapid development
of small and large tracts of land without accompanying park acquisition. ,
