CORRESPONDENCE AND CURRENT BUSINESS Gustafson Letter from Land 'Jse Hearing Examiner Fred Kaufman presented Preliminary Plat Preliminary Plat and Exception of Arthur D. Gustafson, 14-lot PP-441-79 and single family subdivision on property located on the west side E-448-79 of Union Ave. NE and an exception to the subdivision ordinance Union Ave. NE for cul-de-sac length. The Examiner recommended approval with at NE 10th St. conditions. Appeal was. filed. by Public Works Director Gonnason Appeal of the Examiner's decision dated December 24, 1979, noting his request for consideration January 2, 1980 and Examiner's response of the 3rd. The appeal letter claimed substantial errors in law and fact: (1) The Examiner determined that NE 10th St. should not be extended as a collector arterial between Union Ave. NE and Monroe NE, which is contradictory to the 1985 Urban Area Comprehensive General Development Plan adopted by the City Council ; (2) The decision of the Examiner changes the Plan without -going through appropriate process. Planning and Develop- ment Committee Chairman Rockhill presented committee report recommending that the City Council modify the recommendation of the Land Use Hearing Examiner based on error of lawwhich is Renton City Council 2/4/80 Page 3 OLD BUSINESS Committee of Council President Trimm submitted committee report re review of the Whole the Eastside Watershed Project proposed revision and the revised Green River Flood Watershed Plan Agreement. The committee recommended the Control Program Council authorize the Mayor and City Clerk to sign the agreement the matter be referred to the Ways and Means Committee for the resolution with the following stipulations: (1 ) That there be full consideration of the wetland area east of the freeway (SR-167) for additional storage and channel area and approved wetlands; (2) Current wetlands be retained as approved wetlands and/or traded for property of equal dollar value for suitable wetland retention and project compensate City totally; (3) Cost of the project be born by benefiting property owners located on the Valley floor west of SR-167 and south of the Burlington Northern - Milwaukie railroad right-of-way or as otherwise specified by the City Council in a subsequent agreement prior to the commitment of any local funds. (3) There has been a request for an unlimited hydroplane race at Gene Coulon, Memorial Beach Park in May; potential crowd 20,000; no one permitted on undeveloped park and developed area accommodates 7,500. Some merchant support. (4) CPR classes will be held at Delaurenti Fire Station, March 4-5/80, Council Members invited to attend. (5) A supple- mental budget for 1980 has been presented to Council ; $1 ,120,000 unanticipated revenue received from area of sales tag; projections were low for the City as well as other cities, county and state. The Mayor noted i.t may be prudent to reserve some excess to protect the City's cash flow due to new reports advising County tax statements will be late. Clemens , Senior Planner RE : Background Information : Gustafson Plat Appeal The following information is submitted to clarify some of the issues raised in the appeal of the approval of the Gustafson preliminary plat . 1) The Examiner in his response to the request for reconsideration indicated that he felt that the notice provided on the plat application was insufficient to cover the extension of the NE 10th corridor through the plat . It is our opinion that the notice , and subsequent posting in the vicinity of the property (especially to the west along NE 10th) should have been sufficeint notice to cause any interested party to make themselves more fully aware of the action proposed . 2) Refering to the attached map , you will notice that the actual street paving is significantly wider for NE 10th than the adjoining streets running in the same direction (40 foot paved vs . 28 foot paved ) . This indicates that the original design and intent of the platted area to the west was to insure future extension of the street to the east . 3 ) The Examiner expressed concern that connection of the street will lead to significant increases in traffic along the NE 10th corridor . While it is acknowledged that there will be increases in traffic above the current levels, the increases will not be that significant due to the fact that existing development east of Union Avenue (red circles on the map ) effectively blocks , if not fully precludes an extension of this corridor further to the east . page 2 Planning and Development Committee January 31 , 1980 4) The NE 10th corridor is already experiencing collector level traffic demands as it approaches the corimercial areas that front along Sunset Blvd . The map 'illustrates the three intersections which currently provide for four way stops . Thus , any traffic which is diverted from more circuitous routes will be subject to the existing conditions which slow traffic speeds and insure proper traffic flow . 5 ) One of the most crucial aspects of this street connection relates to public safety ® As an example (illustrated in blue on the map ) the route of the Fire Department from the Highlands Station to Honeydew Elementary school is about 8000 feet in length , while the route via the proposed NE 10th corridor is only 5000 feet in length . Using an average figure of 25mph for responding safety equipment , access response to the school will be reduced from 3 minutes 38 seconds , to 2 minutes 16 seconds or 40% improvement . 6 ) The only east west route in the vicinity of the proposed route other than NE 12th to the north , is an extension of NE 7th, shown in green on the map . The traffic impacts and safety concerns of significant increases in traffic levels on these streets would appear to be unacceptable . As noted in the original recommendation of the Planning Department , it is our opinion that the appeal should be approved , and that the plat be constructed in a manner providing for through traffic movements on NE 10th from Union Avenue NE to Sunset Blvd . Gustafson, Request for Preliminary Plat On behalf of the City of Renton Public Works Department, I hereby appeal the recommendation of the Hearing Examiner regarding the subject plat. This is an appeal of the Hearing Examiner's Decision PP-441-79 dated 24 December 1979 and my request for reconsideration dated January 2, 1980 and Examiner's response dated January 3, 1980. This appeal is made for the reason that there is substantial errors in law and fact in the Examiner' s decision, the errors include the following: 1 . The Examiner has determined that N.E. 10th Street should not be extended as a collector arterial. to provide. con- tinuity and circulation between Union Ave. N.E. and Monroe Ave. N. E. This is in direct contradiction •to the duly adopted 1985 Renton Urban Area Comprehensive General Development Plan duly adopted by the Renton, City Council . A copy of the plan sheet indicating this is attached. We have also attached a copy of Page l34 of Urban Arterial routes which clearly designate this portion of N.E. 10th Street from Redmond Ave. N. E. to Union Ave. N. E. as a collector arterial . 2. The act of the Hearing Examiner in this case has a net effect of changing the City's Comprehensive Plan without going through the appropriate Comprehensive Plan change approval process with ultimate approval by the City Council . It is therefore requested that the City Council consider this appeal and sustain the appeal and provide for the extension of N. Dear Mr. Gonnason: I have reviewed your request for reconsideration, and except for a modification in the size of the required dedication, find no merit in modifying the recommendation. Since the recommendation of the Examiner may have foreclosed the options of the City Council at some future time as to the benefits of creating a community arterial along N.E. loth Street by requiring 'a 'dedication of less than required right-of-way width, that portion of the recommendation should be modified. Paragraph One should be modified to read: "The dedication to the city of a . 50-foot wide (north-south dimension) parcel beginning at the terminus of the cul-de-sac and running to the western end of the subject property, 105 feet • south of the north property line for the construction of a pedestrian easement." • The response to your various arguments follows: 1. 'The Comprehensive Plan was considered by the Examiner in making the determination. Conclusion No. 3, , along with. Finding No. 13, reviews .the impact of the Comprehensive Plan's various definitions of neighborhood and community arterial. In light of these various • provisions, the conclusion to grant the exception, therefore not creating a community arterial on N.E. 10th Street, is justified. Generally, community arterials and plats are arranged such that heavy traffic is diverted to the rear of lots with a combination of landscape and buffering, further lessening the impact along,the rear lot lines. The intrusion of up to ,5,000 ADT (information available at the time of the hearing, but not submitted) would, certainly violate the Comprehensive Plan's concept of a neighborhood free of arterial traffic. Of further significance is the fact that property fronting on arterials is generally reserved by the various zoning and comprehensive planning provisions for more intense uses. Such is the case with both N.E. 12th Street and N.E. 4th Street. They are either zoned or designated in the Comprehensive Plan for a combination of commercial and multifamily apartment uses. N.E. 10th Street is designated for residential uses in the Comprehensive Plan, and is zoned and generally developed accordingly. • Warren C. Gonnason January 3, 1980 Page Two There are, of course, examples of where this is not the case as early and unplanned development patterns permitted arterials to divide neighborhoods rather than serve along the boundaries of neighborhoods. The Comprehensive Plan, subdivision regulations and zoning may now provide guidance which prevents such unplanned intrusions into otherwise quiet residential neighborhoods. 2. The Comprehensive Plan (Conclusion No. 3) indicates that residential neighborhoods are to be kept free of overcrowding influences; and arterial traffic should be diverted around neighborhoods. The question of traffic control, possibly widened streets and. limitations on parking (raised in the request for reconsideration but not prior to or during the public hearing) all indicate a greater impact on a residential neighborhood than the Comprehensive Plan suggests. Collector arterials do not cut through residential neighborhoods nor does the creation of a new plat immediately give rise to the need to create such an arterial through its center. The area to the west of the subject property, both north and south of N.E. 10th Street, is a quiet residential area, and the possible 5,000 ADT anticipated for the proposed street is inappropriate. 3. The definition of neighborhood used in Conclusion No. 3 is found on Page 4 of the Comprehensive Plan. The pedestrian path will permit access from the subdivision to the west and Kiwanis Park, and from the area west of the subdivision to Honeydew Elementary School. 4. The Hearing Examiner is empowered by ordinance with the responsibility of conducting public hearings. Such authority carries with it the responsibility to review pertinent documents, the recommendations of the various departments and agencies of the city, and public input (Section 4-3010.B) . After considering the input which comprises. the record of the public hearing, the Examiner then either recommends to the Council a certain course of action or makes a decision. The ordinance nowhere implies that the Examiner is limited to following the recommendations of any one department (and both the Police and Parks Departments found the proposed cul-de-sac acceptable) , when to do so would result in the disruption of an existing neighborhood and divide a proposed subdivision with a major cross street. "The Examiner's recommendation may be to grant or deny the application or the Examiner may recommend or require of the applicant such conditions, modifications and restrictions as the Examiner finds necessary to make the application compatible with its environment and carry out the objectives and goals of the Comprehensive Plan, the Zoning Ordinance, the Subdivision Ordinance, other codes and ordinances of the City of Renton and the Preliminary Plat as approved. " (Section 4-3010.D) (Emphasis added) As the Public Works Department is aware, there was an opportunity for input into the hearing process on December 18, 1979. The written comments from the Public Works Department were quite limited. There was no representative of the Public Works Department present to Warren C. Gonnason January 3, 1980 • Page Three • answer questions, although they were specifically requested to attend the hearing. The data submitted in the request for reconsideration should have been submitted at that time by the Public Works Department so that it could have been considered by the Examiner during deliberation on the subject'proposal. • This data has. now been reviewed and as is indicated above, the. recommendation to the City Council remains unchanged, except as modified above.' • Further,' the City .Council had the opportunity in June of 1979 to consider the Six Year Transportation Improvement Program and Arterial Plan (Finding No. 17) : A public hearing on that plan was held by the City Council, and N.E. 10th Street was riot considered at that time. Such a hearing affords all concerned parties an opportunity to present their respective views of the need for improvements of certain.streets. The Council then decides the merits of' each request. The hearing on December 18, . 1979 on the subject preliminary plat was concerned primarily with the creation of a 14-lot plat; notice was limited, and the proposed arterial (N.E. 10th Street) was not posted as was suggested the last time this matter was considered in June, 1979. The creation of a community arterial is a policy matter which should be decided by the City Council and not as a ' secondary issue to the creation of a 14-lot plat. Gonnason, Public Works Director SUBJECT: Request for Reconsideration - Arthur Gustafson; File No. PP-441-79 Pursuant to Title IV, Section 3015, of the Code of the City of Renton, request for reconsideration of the subject preliminary plat is hereby made. It is my feeling that the Examiner's conclusion in the Gustafson preliminary plat is based on erroneous procedure, errors in fact and error in judgement. The following items are stated for your consideration: 1. The city's Comprehensive Plan provides for a circulation element consisting of major arterials, secondary arterials, neighborhood collector arterials and local access streets. In developing the neighborhood concept, a neighborhood is normally bounded by a combination of major arterials or secondary arterials and are normally serviced by collector arterials and local access streets. The neighborhood in this situation is generally bounded by Monroe Ave. on the west, NE 12th Street on the north, Union Ave. on the east and NE 4th Street on the south. Both Monroe and NE 12th are classified as collector arterials. However, they do have a higher level of traffic service than would the collector arterial proposed by the extension of NE 10th Street. NE 10th would serve as a collector arterial with an average daily traffic volume estimated to be in the range of more than 500 and less than 5,000 ADT. Its function in this instance would be to "collect and distribute traffic from higher type arterial streets to access streets or directly to traffic destinations." It should function as an arterial street only within one neighborhood and should service traffic only with an origin or destination within that neighborhood. Traffic control measures would be as warranted but not to encourage traffic with trips through the neighborhood. Parking restrictions as necessary. With parking on both sides, the minimum roadway width for this type of facility should be 40 feet curb to curb. Fred J. Kaufman Page 2 January 2, 1980 2. You find that opening NE 10th Street would have a negative effect on the quiet enjoyment of the proposed area and already existing homes to the west. All homes cannot be situated on "dead end cul-de-sacs." The normal development of neighborhood patterns includes access streets as well as collector arterials which are designed to provide a proper balance of traffic service to the neighborhood. This will provide a relatively convenient traffic circulation pattern to serve the neighborhood and the properties to the west of this proposed street opening. It would afford them a more convenient access to Union Ave. and destinations to the east. This neighborhood is almost completely without reason- able access and circulation to Union Ave. It is only by a very circuitous route that traffic from this area can find a path to Union Ave. Instead of providing a hardship on the existing homes to the west, it will provide a convenience. You have greatly overemphasized the indicated hardship on potential residents within the subdivision. Fire and Police access are likewise an important consideration in developing a pattern of collector arterials within neighborhoods. 3. The decision that you have made in this case is inconsistent with your own definitions of the neighborhood, in view of the fact that a cul-de-sac as approved makes a small neighborhood consisting of the 14 lots in the proposed plat. Their only access is to Union Ave. NE, a seconday arterial, and would not be a part of the "neighborhood" to the west except by means of a 10-foot walkway. If this development is to become an integral part of the defined neighborhood, the cul-de-sac should be located at the Union Ave. end with access only from the west. 4. It appears in this instance that the Hearing Examiner has exceeded his intended authority in this matter by taking it upon himself to overrule the technical expertise and recommendations from the Planning and Public Works Department's staff in the matters of neighborhood development and traffic circulation. It is therefore requested that the Hearing Examiner reconsider his decision on this preliminary plat and provide for the continuation of NE 10th Street through the properties to provide a collector arterial to service this neighborhood. Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: • Exhibit #2: Preliminary Plat as submitted Exhibit #3: Preliminary Plat with staff comments The Examiner inquired' if the lot which runs parallel to the south of the subject site ' is separately owned, and therefore, not required to be subdivided from the proposal. The applicant responded affirmatively. The Examiner referenced Section K.3 of the Planning Department Analysis, Exhibit #1, which indicates that side yard setbacks would not meet six foot requirements for one and one- half story structures, and inquired how the matter would be resolved. Mr. Blaylock advised that application for variance would be possible since a five foot minimum setback is required, and the buildings would be set back at the time of application for individual building permits. • Mr. Blaylock deleted a portion of Section K.7, which reads as follows: ". . . (adjacent to the southerly boundary) . . .", part of line three and four. He also noted that the applicant should arrange a pre-construction meeting with the Fire Department to discuss installation of hydrants, access and water mains. The Examiner inquired whether side yard setbacks would be in conformance with city requirements if one-story structures were proposed on the site. Mr. Blaylock responded affirmatively. The Examiner apologized on behalf of the city for inconveniences and delays incurred to the applicant during review of the previous plat application. • PP-441-79 Page Two The Examiner inquired regarding right-of-way width of N.E. 10th Street west of the site. • Mr. Blaylock indicated his belief that the street contains varying widths of from 50 to 60 feet. The Examiner requested the actual street width. Mr. Blaylock advised that the matter would be researched and the Examiner would be provided with a supplemental memorandum. The Examiner noted that at the previous public hearing, discussion occurred regarding appropriate notification to existing residents on N.E. 10th Street located west of the proposed development who may be impacted by additional traffic created by the extension of the street from Union Avenue N.E. Mr. Blaylock indicated that he was not aware of the previous discussion. The Examiner requested testimony in support or opposition to the proposal. There was no response. The .hearing regarding File No. PP-441-79 and E-448-79 was closed at 10:35 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for, approval of a 14-lot single family subdivision (preliminary plat) together with an 'exception for a cul-de-sac which exceeds 500 feet in length. 2. The Planning Department report sets forth the issues, applicable policies and provision and departmental recommendations in this matter, and is entered as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. ; as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal .have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close 'proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-704 (SR-1; Single Family Residential; minimum lot size - 7500 square feet). of Title IV, Ordinance No. 1628, Code of General Ordinances. A variance would-be required under the proposed plat for any lot upon which residences (higher than one story) were constructed. 8. The subject property is' located north of Kiwanis Park and north and west of the Honeydew Elementary School. The applicant has applied for a rezone from the present classification of. GS-1 (Single Family Residential; minimum lot size - 35,000 square feet) to SR-1 and the request is pending before the City Council, File No, R-292-79. 9. The applicant had also requested approval of an 18-lot long plat at the time the rezone was requested. That preliminary plat has since been withdrawn and the present application was substituted. 10. The area is characterized by mixed large and small lot single family residential development. There is a hub of commercial development on or near N,E. 4th Street and Union Avenue N.E. There is also commercial development along Sunset Boulevard N.E. north of the subject property. 11. The B.P.A. power line crosses the subject site along its western boundary. 12. The Comprehensive Plan 'indicates that the area in which the subject property is located is ,suited for single family development and open space in the vicinity of the power line. 13. Union Avenue N.E. is a north-south arterial. 'The major east.-west routes in the area are N.E. 4th Street to the south and N.E. 12th Street to the north. The Planning Department has recommended that N.E. 10th Street which runs through the plat be opened at the western. end to serve as a community arterial. Adopted in 1965, the Major Streets and Arterials Plan and the General Development Plan indicate that N.E. 10th Street would serve as a community arterial. 14. The proposed lots will vary between approximately 7800 square feet and 8400 square feet. 15. The proposed cul-de-sac will be about 540 feet in length, whereas Section 9-1108.7(K) requires cul-de-sacs to be no greater than 500 feet in length, and therefore, the applicant has requested an exception to the Subdivision Ordinance pursuant to r:' • PP-441-79 Page Three Section 9-1109. • 16. The area both north and south of N.E. 10th Street west of the proposed subdivision is developed almost exclusively with single family homes and is a quiet residential neighborhood. Unlike the commercial and multifamily zoned frontage along N.E. 12th Street and N.E. 4th Street, the lots fronting on N.E. 10th Street are zoned for single family residential development. 17. The City.Council which held hearings in June on the Six Year Transportation Improvement Program and Arterial Plan did not consider creating a community arterial on N.E. 10th Street. CONCLUSIONS: 1. The preliminary plat appears to serve the public use and interest. The area is designated for single family development by the Comprehensive.Plan and the proposal will create 14 lots suitable for such development. • ' If the requested zoning change to SR-1 is approved by the City Council, each of the proposed lots will exceed the minimum lot size. 2. The area is well serviced with schools and convenient shopping, is located north and south of the subject area along Sunset Boulevard N.E. or N.E. 4th Street. 3. The Planning Department has recommended that N.E. 10th Street which would run through . the subject property and 'through the middle of the proposed subdivision be opened and developed as a community arterial, as is indicated in the Arterial and Street Plan. The creation of such an arterial, though, would violate other policies which are also indicated in the same document. Single family use should be protected from . heavy traffic. On page 4 of the Renton Urban Area Comprehensive Plan (1965) a residential neighborhood is described as an area "of relatively solid patterns of homes, linked by quiet streets, . .". "In planning neighborhoods, the creation of 'residential districts free of overcrowding influences, arterial traffic, . . .are important objectives." " (Arterials) should not conflict or interfere with the functions of residential neighborhoods." ' The Arterial and Street Plan defines a community arterial on Page 6 as a street which "should be located on neighborhood boundaries and should serve major traffic volumes generated within the community. They should serve as a secondary connecting • link between residential areas and major facilities, such as shopping centers, located therein." N.E. 10th Street, if. opened between Union Avenue N.E.. and Sunset Boulevard N.E. ,, will become a community arterial and would more importantly intrude heavily into this new proposed subdivision and the quiet area to the west. It would serve to divide quiet residential areas rather than connecting them to shopping via periphery roads bordering neighborhoods. 4. ' Opening N.E. 10th Street would have a negative effect on the quiet enjoyment of the proposed homes in the area and already existing homes to the west. The creation of this proposed 14-lot subdivision in itself does not justify the creation of a community arterial down the center of the proposed subdivision, and in fact, the creation of such a 'community arterial would create an undue hardship on potential residents of the subdivision. It would similarly work an undue hardship on the existing homes to the west. • 5. The requested exception'will permit the applicant to create a quiet residential environment for the potential homeowners. Cul-de-sacs which exceed 500 feet in length have been granted to avoid hardship in other residential subdivisions and to avoid the impact of through traffic where such through traffic is not warranted. The 40 additional feet is de minimus and will not harm the public welfare. This . small subdivision should not be required to provide a link through a residentially developed neighborhood which is residentially zoned, when traffic can use N.E. 4th Street and N.E. 12th Street which are zoned for higher intensity uses and developed with higher intensity uses without causing the same impact. • 6. Since the. roadway does not now exist and was not included in the Six Year Transportation Improvement Program and Arterial Plan, the residents of the area will not be materially harmed by the granting of this exception. Further, the granting of the exception will not materially harm neighboring properties which will also be spared the intrusion of an arterial passing through their quiet residential neighborhood. The dedication of a full right-of-way width for inclusion of a walkway will provide , a link between the new subdivision and the existing residential development to the • PP-441-79 Page Four west. 7. Topc,;raphy: The site slopes generally from west to east at a moderate 5% to 10%. 2 . Soils : Alderwood gravelly sandy loam (AgC) . Land Use: The site is generally surrounded by single family homes with a church located to the north and the Kiwanis Park to the southwest . E . NEIGHBORHOOD CHARACTERISTICS : The area is basically single family residential in nature. F. PUBLIC SERVICES : 1. Water and Sewer : A 12" water main runs north-south on Union Avenue N.E . adjacent to the subject site. An 8" sanitary sewer is located on Union Avenue approximately 150 feet south of the subject site. 2. Fire Protection : Provided by the Renton Fire Department per ordinance requirements. 3. Transit : Metro Transit Route 107 operates along Union Avenue N.E . adjacent to the subject site. 4. Schools : The Honeydew Elementary School is located to the east of the subject site across Union Avenue N.E. , while McKnight Middle School is situated within 1 3/4 m' les to the northwest , and Hazen High School is approximately one mile to the northeast . 5. Recreation: Kiwanis Park is south of the subject site on Union Avenue and the grounds of the Honeydew Elementary School provide recreational opportunities for area residents . G. Natural Systems: Development will disturb the soils, remove vegetation, increase storm water runoff and ,have ;any effect on traffic and noise levels in the area. Through proper development controls and procedures, however, these impacts can be mitigated. 2 . Population/Employment : The proposed 14-lot subdivision will increase the area population by approximately 49 people (3. 5 persons/home times 14 homes).. This increase isn 't likely to adversely affect existing public services. 3. Schools: The proposed plat will increase the school population by approximately 7 students ( . 5 student/home times 14 homes) . These students will be distributed throughout the grades and should not significantly affect existing facilities. 4. Social: Development of the subject site into single family residences will provide increased opportunities for social interaction among the area residents. 5. Traffic: The proposed development will increase traffic in the vicinity by approximately 140 trips/day (10 trips/unit times 18 units) . Current traffic on Union Avenue N.E. of 9200 trips per day will thus be increased by about 1. 5%. J . The Engineering Division advises that storm water reten- tion/detention will be required as well as off-site improve- ments consisting of curbs, gutters, sidewalks , paving and storm drainage and street lighting on Union Avenue N.E. 6. Fire hydrants and water mains shall be installed per water engineering requirements. Hydrants and access shall be installed prior to any building construction. 7. The Parks Department notes that the subject site is located in an area in which neighborhood park acquisition is com- plete. The existing Kiwanis Park (-adjacent to th-&-sout-her ly bow) will be impacted by the new plat. 8. The applicant is seeking an exception to the Subdivision Ordinance to allow the creation of a cul-de-sac which is in excess of 500 feet in length. This is in direct oppo- sition to the Comprehensive Plan General Development Plan and the Major Streets and Arterials Plan for the City of Renton (see attached) . Both plans, adopted in 1965, require that N.E. 10th Street be a Community Arterial and be extended to Union Avenue N.E. Without the con- struction of N.E. 10th Street as a through street , a service area of one-half mile by one mile would be created. The population would be in excess of 5,000 people, plus the additional commercial development along N.E. 4th Street . In addition, the creation of a cul-de-sac instead of a through street would impede emergency services such as fire and police, which would be detrimental to the public wel- fare. N.E . 10th Street is a critical link in the arterial street plan. N.E. 12th Street is presently taking an. . enormous traffic burden. Fortunately, most of the area has been developed. Since N.E . 10th Street does not extend • farther to the east of Union Avenue N.E. , it will not be- come a collector arterial servicing more than the, immediate neighborhood. It would also have a tendency to reduce traffic volumes on the north/south streets within the neighborhood. L. DEPARTMENTAL RECOMMENDATIONS : Based upon the above analysis, it is recommended that the exception request , file number E-448-79, be denied and the preliminary plat , file number PP-441-79 , be approved subject to the following condi- tions; 1. Completion of rezone from GS-1 to SR-1. 2. Construction of N.E. 10th Street from Union Avenue N.E. to the existing portion of N.E. 10th Street lying to the west of the preliminary plat . 3. Final Public Works Department e approval of detailed utili- ties plans and payment of hook-up fees. 4 . Installation of off-site improvements and approval of storm drainage plans as per Engineering Division comments. 5. Installation of fire hydrants, access , and water mains as per Fire Department approval. 6 . Conformance to the required sideyard setbacks as noted in L-4. 7. Vegetation : The central strip of the site consists princi- pally of grass, while the northern and southern boundaries of the site has an abundant supply of Douglas Firs and some medium growth deciduous trees . 4. Wildlife : Existing vegetation on the site provides suitable habitat for birds and small mammals. 5. Water: No standing water was observed on the subject site. 6 . Land Use: The site is generally surrounded by single family homes with a church located to the north and the Kiwanis Park to the southwest . E . NEIGHBORHOOD CHARACTERISTICS : The area is basically single family residential in nature. F. PUBLIC SERVICES : 1. Water and Sewer : A 12" water main runs north-south on Union Avenue N.E . adjacent to the subject site. An 8" sanitary sewer is located on Union Avenue approximately 150 feet south of the subject site . 2. Fire Protection : Provided by the Renton Fire Department per ordinance requirements. 3. Transit : Metro Transit Route 107 operates along Union Avenue N.E . adjacent to the subject site. 4. Schools : The Honeydew Elementary School is located to the east of the subject site across Union Avenue N.E. , while McKnight Middle School is situated within 1 3/4 miles to the northwest , and Hazen High School is approximately one mile to the northeast . 5. Recreation: Kiwanis Park is south of the subject site on Union Avenue and the grounds of the Honeydew Elementary School provide recreational opportunities for area residents . G. IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT: 1. Natural Systems: Development will disturb the soils, remove vegetation, increase storm water runoff and have an effect on traffic and noise levels in the area. Through proper development controls and procedures, however, these impacts can be mitigated. 2. Population/Employment : The proposed 14-lot subdivision will increase the area population by approximately 49 people ( 3. 5 persons/home times 14 homes).. This increase isn 't likely to adversely affect existing public services. 3. Schools : The proposed plat will increase the school population by approximately 7 students ( . 5 student/home times 14 homes) . These students will be distributed throughout the grades and should not significantly affect existing facilities. 4. Social : Development of the subject site into single family residences will provide increased opportunities for social interaction among the area residents. 5. Traffic: The proposed development will increase traffic in the vicinity by approximately 140 trips/day ( 10 trips/unit times 18 units) . Current traffic on Union Avenue N.E. of 9200 trips per day will thus be increased by about 1.5%. J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, a declaration of non-significance has been prepared for the sub- ject proposal. The proposed plat is consistent with the Comprehensive Plan Land Use Element , which designates the site and surrounding area as single family residential. 2. The applicant 's proposal is consistent with existing single family subdivisions to the north and east of the subject site. 3. The proposed plat meets or exceeds all zoning and subdivision ordinance requirements relating to minimum lot size (7500 square feet) and dimensions with the following exception : The Building Division indicates that the setback lines illustrated would not meet the side yard setback require- ment of 6 feet for 1-11- story structures as per Section 4-706-4( c) of the Zoning Code. 4. The water main on Union Avenue will have to be extended to Redmond Avenue N.E. and suitable sewer service supplied as per Utilities Engineering Division comment . Plans are re- quired and the standard hook-up fees will be charged. The Engineering Division advises that storm water reten- tion/detention will be required as well as off-site improve- ments consisting of curbs , gutters, sidewalks , paving and storm drainage and street lighting on Union Avenue N.E. 6 . Fire hydrants and water mains shall be installed per water engineering requirements. Hydrants and access shall be installed prior to any building construction. 7. The Parks Department notes that the subject site is located in an area in which neighborhood park acquisition is com- plete. The existing Kiwanis Park (adjacent to the southerly boundary) will be impacted by the new plat . 8. The applicant is seeking an exception to the Subdivision Ordinance to allow the creation of a cul-de-sac which is in excess of 500 feet in length. This is in direct oppo- sition to the Comprehensive Plan General Development Plan and the Major Streets and Arterials Plan for the City of Renton (see attached) . Both plans, adopted in 1965 , require that N.E. 10th Street be a Community Arterial and be extended to Union Avenue N.E. Without the con- struction of N.E. 10th Street as a through street , a service area of one-half mile by one mile would be created. The population would be in excess of 5,000 people , plus the additional commercial development along N.E. 4th Street . In addition, the creation of a cul-de-sac instead of a through street would impede emergency services such as fire and police , which would be detrimental to the public wel- fare. N.E. 10th Street is a critical link in the arterial street plan. N.E. 12th Street is presently taking an enormous traffic burden. Fortunately, most of the area has been developed. Since N.E . 10th Street does not extend • farther to the east of Union Avenue N.E . , it will not be- come a collector arterial servicing more than the immediate neighborhood. The Examiner' s preliminary decision would require an application for an exception in order to complete the application . As an alternative, you could request the City Clerk' s office, through our department , to forward the Hearing Examiner' s decision to the City Council for their consideration and resolution of the street extension issue. Assuming that you did not propose any modifications in the original ar- rangement of your plat , either approach would be acceptable . Since we have discussed on several occasions the possibility of rearranging the lotting of your plat , it may be more expeditious to submit an amendment application, which then can be forwarded to the Hearing Examiner for review and approval and the issue of the street resolved at that time .
