REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Kohl Excavating, Inc. FILE NO. PP-076-80,
E-091-80
LOCATION: Property located between 80th Avenue S. and S.W. 3rd Place
(81st Avenue S.) ; north of S.W. Sunset Boulevard.
SUMMARY OF REQUEST: The applicant requests approval of a seven-lot preliminary plat
together with an exception to the Subdivision Ordinance for two
pipestem lots in preparation for development as single family
detached housing.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on September 16, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on September 23, 1980 at 9:27 a.m.• in the Council Chambers of the
Renton Municipal Building.
Parties, wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Roger Blaylock, Associate Planner, presented the report, and
entered the following exhibits into the record:

The E:.<aminer requested testimony by the applicant. Responding was:

Mr. Harbert advised that although the applicant is in almost complete agreement with the
recommendations of the Planning Department, certain exceptions to the report should be
discussed. Referencing Section D.5, which states that surface drainage resulting from an
existing intermittent stream on the site appears to have been controlled as part of the
fill operation, Mr. Harbert stated that in his professional opinion, the stream water is
now being collected by the storm water pipe system installed during the fill operation
and the system has sufficient capacity to collect the stream flow as well as additional
contributing runoff from adjacent sites.
Referencing Section L.4, which states' that approval of the pipestem would deprive the
applicant of the maximum use of the property, Mr. Harbert pointed out that the word
"deprive" should be omitted and the word "permit" used instead for the correct meaning.
Referencing Section L.7 which denotes the existence of a roadway established across Lot 1
without apparent legal right-of-way, Mr. Harbert discussed the condition and location of
the roadway, which appears to have evolved as a short cut for a series of eight to ten
lots in King County to the north, and is an unimproved roadway. He stated his opinion
that the surveyor'of record could verify that the roadway is located to the north of the
subject site's northern boundary line, and would, therefore, not be relevant to the
development of the property.

At this point in the public hearing, a party in attendance requested the opportunity to
testify. Responding was:

Mr. Texeira advised that the roadway has been in existence for the past 16 years, the
length of time of Mr. Texeira's residency in the area, and he requested confirmation from
another resident in attendance. Responding was:

Mr. Eastman was affirmed by the Examiner. Although Mr. Eastman could not specify the
exact date of commencement of use of the roadway by residents, he confirmed that it was
never an established roadway, but had resulted from residents taking a short cut from
Sunset Boulevard S.W. , and has not been improved to this date.
Referencing Section L.8, which states that Section 9-1108.23. (F) (3) (c) requires a lot
width of 75 feet, Mr. Harbert expressed his opinion that the referenced section is not
relevant, but perhaps a subsequent section, 9-1108.23. (F) (4) would apply, which states
that corner lots shall be platted wider than interior lots as determined by the Planning
Department. Mr. Harbert indicated that in order to be responsive to the Planning
Department's concerns, two development alternatives may exist; the first is related to
the fact that the right-of-way along Sunset Boulevard S.W. appears to have been taken
from the subject site for the purpose of sloping the easement on the right-of-way, and
preliminary contact with the State Highway Department indicates that it would now be
willing to relinquish that right-of-way to the applicant. The second alternative would
allow two lots to be served by one pipestem roadway since a precedent has been established
by the city with the recent approval of the Douglas Weston short plat on Renton Hill . The
Examiner noted that an exception to allow one pipestem has not been applied for. Mr.
Harbert advised that the applicant had not been aware of the concern until receipt of the
Planning Department report on Thursday prior to the hearing.
Responding to the Examiner's inquiry regarding the possibility of acquiring additional
frontage from the State Highway Department, Mr. Harbert advised the possibility of
acquiring approximately eight additional feet along Sunset Boulevard S.W. in an extended
arc to 81st Avenue S. He also indicated that the home constructed on Lot 7 would probably
have its longest side facing Sunset because there is some view potential towards the
southwest and the landscaped berm which will be provided; therefore, he does not concur
in the recommendation for a 75-foot lot width to allow fronting the home onto 81st Ave. S.
Responding to the Examiner's inquiry regarding the previously approved preliminary plat
for the subject site, Mr. Harbert indicated awareness that a plat has already been approved.
The Examiner requested testimony in support of the application. There was no response.
He then requested testimony in opposition to the matter. Mr. Pat Texeira stated that
although he is not in total opposition to the proposal , he objected to granting approval
of an exception for the pipestem road to allow provision seven rather than six lots
on the 'site since he felt that development of seven homes on the site would produce
overcrowding. The Examiner.noted that the applicant would have the option of requesting
a Planned Unit Development which would allow clustering the dwelling units on the site and
provide an expansive area of landscaping. Mr. Blaylock interjected that the ordinance
precludes development through the PUD process if the property contains less than four acres.
Mr. Hiprbe-t indicated disagreement with ,previous testimony that the site would appear
crowded with development of seven lots, and advised the objective. of the applicant to
provide moderately priced housing based on an affordable lot which would be possible with
construction of one additional home on the site.
The Examiner requested further comments. Mr. Blaylock advised that the Planning Department
has no objection to either of the applicant's two alternatives, either provision of one
pipestem to serve two lots or acquisition of additional right-of-way from the State Highway
Department; however, he maintained that Lot 7 should be 75 feet in width to provide the
option to front the proposed residence on 81st' Avenue S.
Since there were no further comments, the hearing regarding File No. PP-076-80 and E-091-80
was closed by the Examiner at 10:03 a.m.

FINDINGS , CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a seven-lot preliminary plat on +1 .3 acres, together
with exceptions for two pipestem lots. An approved six-lot preliminary plat for the
subject property, together with an exception for a pipestem lot has already been
approved by the City Council. This proposal is an alternative plan providing an
additional lot.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-706 (R-l ; Single Family Residence; Minimum lot size - 7200
square feet) of Title IV, Ordinance No. 1628, Code of General Ordinances.
7. The subject site was annexed into the city in 1975. The current zoning of R-1 was
applied in 1978. A requested reclassification to R-3 (Medium Density Multifamily)
was denied by the City Council .
8. The subject site lies on the north side of S.W. Sunset Boulevard between 80th Avenue
S. and S.W. 3rd Place just within the western limits of the city.
9. The site gently slopes up from Sunset Boulevard at about one to two percent. The
site is undeveloped and is covered with brush and grasses. An intermittent creek
probably flowed across the site prior to the grading and filling which has occurred
on the site.
10. The Comprehensive Plan designates the area in which the subject site is located as
suitable for both single family and low density multifamily uses.
11 . The applicant has proposed developing a seven-lot detached single family subdivision
on the site. The applicant has further proposed pipestem access to Lots 3 and 6, and
has applied for exceptions pursuant to Sections 9-1108.23. (F) (3)d and 9-1109.
12. North of the subject site are older single family homes. Single family uses are the
predominant land use surrounding the subject site. Sunset Boulevard located south
of the subject site is a busy arterial .
13. The proposed subdivision in the area .is expected to generate approximately 25 new
residents; about four new school age children; and about 70 automobile trips per day.
14. The impact of Sunset Boulevard with its traffic generating noise, fumes, light and
glare is expected to be significant, and therefore, the Planning Department has
recommended the construction of a landscaped berm along Sunset Boulevard. The berm
as proposed by the ,Planning Department would screen out the traffic associated impacts.
The berm would be integrated into a. 20-foot wide landscape easement to cut down on the
noise, light and glare.
15. The proposal will front along both 80th Avenue S. and 81st Avenue S. and. half street
improvements 'are required for both of these streets. S.W. Sunset Boulevard, State
Route 900, requires the installation of a sidewalk, the only improvement necessary
along this frontage.
16. The applicant indicated that there were no objections to the required improvements
along 80th S. , 81st S. , and S.W. Sunset Boulevard, nor were there objections to
providing the buffer and landscape easement.
17. The applicant has been offered excess property along the north side of S.W. Sunset
Boulevard by the state which acquired it when, widening Sunset. This acquisition
will make Lot 7 approximately 75 feet by 120 feet.

CONCLUSIONS:
1 . The proposed preliminary plat for a seven-lot subdivision appears to serve the public
use and interest. The plan is consistent with the Comprehensive Plan' s designation
of the area in which the subject site is located as suitable for single family uses.
All the lots meet or exceed the 7,200 square foot size required by the Zoning Code.
2. The plat will be tied in with the existing single family development on the north and
the berm will provide relief from the traffic impacts of S.W. Sunset Boulevard.
The combination of a berm and a 20-foot wide landscape easement will isolate the
proposed subdivision from the impacts of traffic along S.W. Sunset Boulevard and
will also work to integrate the proposed plat into the existing neighborhood.
3. There are sufficient schools, parks and utilities to serve the proposal without
burdening city services, and the proposal will add to the housing stock of the
city and will increase the tax base.
4. The proposed pipestem access to Lots 3 and 6 will not harm the general welfare nor will
it injure neighboring properties. The pipestems permit the applicant to make
reasonable use of the subject property by permitting the development of a sixth and
seventh lot. Similar pipestem exceptions have been permitted to allow access to
similarly landlocked parcels. The pipestem exception should be approved.
5. With the additional frontage along S.W. Sunset Boulevard reacquired from the state,
Lot 7 will meet the zoning and subdivision requirements.
RECOMMENDATION:
Exhibit #3 should be approved by the City Council subject to the following:
1 . Improvement of 80th Avenue S. and 81st Avenue S. with full improvements for a half
street.
2. Installation of a sidewalk along S.W. Sunset Boulevard.
3. Creation of a 20-foot wide landscape easement along S.W. Sunset Boulevard and the
incorporation of a four-foot high berm within that easement.

C . HISTORY/BACKGROUND :
The subject site and the surrounding area was annexed into the
City of Renton by Ordinance 2913 dated February 10 , 1975 . It
was rezoned to the present R- 1 classification by Ordinance 3206
on April 15 , 1978 . An application to rezone the property from
R- 1 to R-3 was filed in September 1979 , and denied by the Hearing
Examiner. A request for preliminary plat to allow six lots was
approved on June 2 , 1980 by the City Council , File No . : PP-008-80 .

D. PHYSICAL BACKGROUND :
1 . Topography : The site has a gentle slope of approxi -
mately one to two percent from the north to the south .
2 . Soils : The site consists of Beausite gravelly sandy
loam ( BeC ) . Permeability is moderately rapid . Avail -
able water capacity is low. Runoff is medium , and the
hazard of erosion is moderate . This soil is used for
timber and pasture and for urban development .
3 . Vegetation : The majority of the site consists of light
brush and grass . Minor amounts of scrub brush and
bushes are also evidenced on the site .
4 . Wildlife : The existing vegetation of the site is
sufficient to provide a suitable habitat for birds
and small mammals .
5 . Water : Prior to filling the site it appears that an
intermittent stream crossed from north to south near
the easterly one-third of the site . It appears that
surface drainage has been controlled as part of the
fill operation . Even though there is no sign of a
stream or surface water on the site at the present time ,
a high ground water table is probable because there were
no drainage improvements constructed with the fill . No
surface water was observed on the subject site at the
time of on-site inspection on September 12 , 1980 .
6 . Land Use : The site is currently in an undeveloped state .
To the southwest , it abuts S . W. Sunset Boulevard , an
extremely busy arterial . The surrounding area consists
primarily of older single family residences .
E . NEIGHBORHOOD CHARACTERISTICS :
The subject site is located in a marginal ,older single family ,
residence neighborhood . The development of the site may have
potential spill -over effects in helping to upgrade the sur-
rounding area .
F . PUBLIC SERVICES :
1 . Water and Sewer : An existing six-inch water main is located
along N . W. 3rd Place near the northeast corner of the sub-
ject site . An eight-inch sewer main exists along S . W . Sun-
set Boulevard .
2 . Fire Protection : Fire protection is provided by the Renton
Fire Department as per ordinance requirements . Any future
development of the site will be ,subject to the City of
Renton Standards .
3 . Transit : Metro Transit Route #107 operates along S . W . Sun-
set Boulevard within one block of the subject site .
4 . Schools : The site is within one-half mile of Earlington
Elementary School , three-quarters of a mile of Dimmitt
Middle School , and within one mile of Renton High School .
5 . Recreation : The former Earlington School site os_ West Hill

I . IMPACT OF THE NATURAL OR HUMAN ENVIRONMENT :
1 . Natural Systems : Development of the subject site will
disturb soils , remove the vegetation , increase storm
water runoff , and have an effect on traffic and noise
levels in the area . Through proper development controls
and procedures , however , these impacts can be mitigated .
2 . Population/Employment : The proposed plat of 7 lots
will increase the population by approximately 25 persons
(3 . 5 persons/home x 7 homes ) .

population by approximately 4 students ( . 5 student/home

throughout the grades and not significantly impact
existing services .
4. Social : Increased opportunity for social interaction

in the area by approximately 70 trips per day ( 10 trips/
unit x 7 units ) .

Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW

the south side is S . W. Sunset Boulevard , also known as
State Route #900 . The subject site is the same level
as S . W. Sunset Boulevard , while the residential land uses
adjoining the site are at higher elevations .

3 . This would suggest that the site is impacted directly by
the present traffic volumes and noise levels generated
along S . W. Sunset Boulevard . The seven new residences
should be buffered from the noise impacts by the creation
of a berm and landscaping barrier. The scope of the buffer
is hard to calculate to determine what would be adequate .
However , it would appear that a 20-foot wide bermed land-
scaping area along S . W. Sunset Boulevard could provide
the necessary separation to suggest that the residential
plat is a portion of the established residential community
instead of an area separate and distinct from those because
of the topographic elevations .
4 . The pipestem lots comply with the length requirement of
150 feet under Section 9-1108 . 23 . F . 3 . d . The actual shape
and location of the proposed plat does not allow for the
normal lot configuration . Approval of the pipestems
would not deprive the applicant of the allowed use of
the property. It would deprive the applicant of the
maximum use of the property . The site can accommodate
seven lots by utilizing the pipestems . Without the
pipestems , the lots would be increased in area ; and
only five lots would be created . The granting of the
exception will not increase the density of the develop-
ment to a point where it would be detrimental to the
public welfare or injurious to the adjacent properties .
It appears that the exception is the sole result of the
physical boundaries of the site .
5 . The proposal will be required to include half-street
improvements on 81st Avenue South and 80th Avenue . South .
In addition , a sidewalk will be required along S . W.
Sunset Boulevard . Improvements would include the
installation of necessary fire hydrants .
6 . The redesign of the proposed preliminary plat from 6
lots as approved in PP-008-80 to 7 lots is a result of
the detailed engineering related to tie sewer system.
The 6-lot configuration was difficult and costly to
serve with sanitary sewers , while the 7 lots can be more
efficiently served .
7 . There is a roadway established across Lot #1 without
apparent legal right-of-way. This roadway would be
eliminated with approval and construction of the
preliminary plat.
8. The redesign into 7 lots suggests some ultimate design
problems for each lot to be functionally developed .
Lot #7 is only 67 feet wide ; Section 9-1108( 23) ( F) ( 3) ( c)
suggests that because of setbacks on corner lots the lot
width should be increased to a minimum of 75 feet to
allow a building width of 50 feet.
Widening of Lot #7 would force the reduction of the
number of lots from 7 to 6 by eliminating Lot #1 .
The only alternative design to maintain the 7 lots •
would be to use the same approach as was approved in
the Doug Weston Short Plat 061-80, where two separate
10-foot wide pipestems were established side-by-side
to be utilized as a singular access with easements ,
granted for joint use by the owners of Lots #3 and #6.

M. DEPARTMENTAL RECOMMENDATIONS
Based upon the above analysis , the request for preliminary
plat approval , file PP-076-80, for the Kohl -Christianson
Addition , should be approved with the following conditions :
1. Reduction of the preliminary plat from 7 to 6 lots by
eliminating lot #1 and widening lots #2 and #7 . Lot
#7 shall be a minimum of 75 feet in width .
2. The creation of a 20-foot wide landscaping easement along
S. W. Sunset Boulevard .
3. The installation of a minimum 4-foot high berm along with
dense evergreen plantings on the 20-foot wide easement.
4. Construction of all off-site improvements including
half-street improvements on 80th Avenue South and 81st
Avenue South ( S. W. 3rd Place) , along the construction
of a sidewalk along S . W. Sunset Boulevard . Installation
of fire hydrants per Fire Department requirements .

Dear Mr. Munson:
In accordance with Renton Subdivision Ordinance No. 9-11 .09 this letter
is a request for an exception to allow two-pipestem lots, which have been
proposed for the Kohl-Christianson Addition. The exception is requested
due to the physical characteristics of the property. The steep grade,
property shape and setback requirements result in a subdivision with two-
pipestem lots, where storm water and sanitary sewer flow can be collected
efficiently (minimum disruption to the environment; i.e. , trenching,
grading, etc.). Without the pipestems and the reasonable utility align-
ments they provide, additional manholes, catch basins and pipeline would
be needed for the utilities. Further, some of these would probably
require frequent maintenance because of the ground elevations at lot
corners.
The alternative of a cul-de-sac was considered; and it was determined
that, due to lot shapes and setback constraints, that alternative was
unreasonable and that two pipestems are the most reasonable alternative.

Subject: Proposal for a 7-Lot Subdivision
of the Kohl-Christianson Addition
Dear Mr. Munson:
This letter documents the advantages of the proposed 7-lot configuration
rather than the previously accepted 6-lot configuration for the subdivision
of the Kohl-Christianson Addition which is north of Sunset Avenue between
80th and 81st, the western boundary of the City in the West Hill area. The
advantages of a 7-lot configuration include:
1 . Simplified Utility Design
Design, construction, operation and maintenance of utilities
(water, sewer and storm water) would be difficult and ineffi-
cient in the 6-lot configuration. As an example, sewer and
stormwater pipelines would have numerous bends which results
in more manholes and catch basins, some of which would require
frequent maintenance because of the low ground elevation at
lot corners in the 6-lot configuration. This and other
maintenance problems would be resolved in the 7-lot config-
uration.
2. More Uniform Lot Size
In the 6-lot configuration previously approved, the lot sizes
varied from 7,200 to 10,750 square feet whereas in the 7-lot
configuration, lots would range from 7,200 to 7,510 square
feet. The result would be more efficient use of the land and
a more uniform lot size which would conform better with the
existing neighborhood.

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

you believe an explanation would be helpful to government decision makers , include your
