The letter further noted the petition will be referred back to Mr. Martindale for further action as the City Attorney advises that the additional signature will be required to validate the vacation petition. Damages Claim Claim for Damages was filed by Patrick A. Nolan in the amount of P. Nolan $185.90 for damages allegedly due to sewer trunk backing up flooding house with raw sewage. CORRESPONDENCE Letter from Mayor Garrett noted review of Referendum 29 funds to Referendum #29 construct a multi-service center as requested by Committee of the Multi-Service Whole 5/15/75. The letter noted need to submit preliminary proposal Center to the Referendum 29 Subcommittee of the Regional Advisory Committee to the Department of Social and Health Services by 6/1/5 including sponsorship, informal committment of agencies providing direct ser- vices to the community, funding proposal , and continuing maintenance and equipment funds as these are not available through Referendum 29. The letter noted the City would be sponsoring agency; that those agencies expressing interest in location include: RAYS, Valley Pulse Clinic, Clothing Bank, Valley Cities Mental Health, and possibly Dept. Social and Health Services (Public Assistance) and Adult Probation and Parole. The letter noted funding proposal of $350,000 for 10,000 square feet ($35 per sq.ft. ) requiring a local match of $87,500 to be derived from $59,450 for 1/2 acre in easterly portion of Cedar River Park and include sewer and water and $28,050 cash or in-kind services; that $262,500 would be requested for Referendum 29 funds. The project sponsor would be required by the State to assume respon- sibility for use of the facility and provision of the prescribed services and the facility maintenance and operation which would not be limited to $13,720; no provision is made for equipment. The letter noted rate for one and two can collection is $2. 16 per month, with the City charging $2.20; that emphasis was given by the Council to charge minimum for residential customers; that a reduction in single family rates would require raising of charges for other classes for subsidizing those rates. The letter noted attem't to obtain funding in the form of an EPA grant for an interceptor sewer which would serve a substantial area including areas currently within the city limits; that the Dept. of Ecology would grant an interest free loan for engineering, environmental and planning costs. Noting that an additional Federal grant for 90% of the costs is almost assured from the Dept. of Ecology in the spring of 1976 which would repay the interest-free engineering loan. The letter requested authorization to proceed with application for engineering loan, to employ a consulting engineer to develop plans and prepare application for EDA funding for Heather Downs interceptor sewer. The Planning Director advised that he would brief the Commission on all items in succession , including review of the site locations , zoning , Comprehensive Plan designations and proposed development, as applicable . REZONE: A. DR. H . M. ALLENBACH ; Appl . No . R-809-75 ; rezone from G-9600 to L- 1 ; property located on East Valley Highway adjacent to SR- 167 and approximately 1/4 to . 1/2 mile north of S . W. 43rd St. Mr. Ericksen pointed out the 4. 5 acre site located on the East Valley Highway adjacent to SR- 167 . He noted that 3. 5 acres of the site is presently zoned L- 1 ; the request concerns the approximate 1 . 0 acre portion of the site presently zoned G-9600 being rezoned to L- 1 . The Comprehensive Land Use Plan designates the Renton Planning Commission Meeting April 2 , 1975 Page Two area as M-P/L-1 . Proposed use is for a "mini -warehouse . " The Planning Director indicated that this type of develop- ment is not specifically defined as an allowable use in an L- 1 zone , and it would be determined by the staff whether or not Planning Commission site plan review is required . He displayed a site development plan and described it briefly. The Chairman invited questions and comments from the Commis- sion members . In response to a query from Commissioner Teegarden , Mr. Ericksen explained that the narrow strip of G zoned land was the result of the division of parcels fol - lowing establishment of the Valley Freeway. The strip has been acquired from the owner of adjacent property. Commissioner Teegarden inquired -regarding the setback pro- vided from the east property line . He was advised by Mr. Ericksen that the setback was established in order to allow for the proposed Soil Conservation Service drainage channel . He noted that at this date there had been no official action to move the channel to the east side of the Valley Freeway which necessitated the setback . Mr. Ericksen said the matter would be reviewed further by the staff. Discussion also ensued with regard to the status of Coun- cil consideration of the Planning Commission recommendations for proposed changes in the L- 1/H-1 categories of the Zoning Ordinance . Appropriate concerns regarding the request were reviewed by the Planning Director. Commissioner Scholes requested that an outline of the P-9 Channel in this area be provided for review, especially as it applies to the G-9600 zoned area . Information with regard to setbacks from the proposed chan- nel site was also requested . The Planning Director indicated that the City of Renton has passed a resolution concurring with the Soil Conservation Service requirement that two percent of each site remain in its natural state or be landscaped for wildlife habitat. Further discussion followed with regard to consideration of the rezone in view of proposed changes in the Comprehen- sive Plan in the area . The Planning Director pointed out the 1 . 27 acre site on Union Avenue on the vicinity map and noted the applica- tion for R-2 zoning and its location in an area designated for medium density residential use on the Comprehensive Plan . He reported that the Environmental Development Committee had met to discuss the proposal and that a recommendation was anticipated . Upon the request of Chairman Mola , Co-chairman Scholes advised the group regard- ing the findings of the Committee . Mr. Scholes noted that the Committee had met on April 17th and had received a letter with six names of residents in the immediate neighborhood who were in agreement with the request. The Committee reviewed develop- ment in the area , with particular emphasis on the single family residences surrounding the area . It was their conclusion that they recommended approval of the rezone from G-7200 to R-2 , as it is compatible with the Comprehensive Plan . They recommended a twenty foot natural preservation buffering strip on the north property line controlled by restrictive covenants and advised that this is acceptable to Mr. Jackson . Mr. Smith then reviewed the proposal on the site plan , noting the wooded area . He advised that Mr. Jackson had voluntarily recommended that restrictive covenants be established pro- viding for a twenty foot natural area on the northerly prop- erty line of the site to protect residences to the north . He stated that the applicant plans to retain as many trees as possible. He described the applicant ' s eventual plans for subdividing the property into three lots of approximately 10 ,000 square feet each but noted that his immediate plans include the construction of a duplex. The Chairman invited questions from the Commission . Commis- sioner Wik suggested that the buffering area be increased to thirty feet and asked if the possibility had been dis- cussed with Mr. Jackson as to feasibility with his plans . He noted that the requested rezone involves a sliver of land consisting of approximately one acre located directly west of the Valley Freeway . He advised Commissioner Wik that the property is approximately 40 feet westerly of the freeway shoulder. Commissioner Teegarden inquired regarding the status of the assessment for the proposed drainage channel in the area . The Planning Director advised that the matter would be reviewed at the time of issuance of the build- ing permit but that at the present time the P-9 Channel eighty foot right-of-way is planned to go through the site . He stated that the staff has been in contact with the King County Department of Hydraulics and that any development plan would be subject to their review with regard to a floodplain permit. He noted a proposal to relocate the channel to the east side of the freeway , but at this time the issue is unresolved . Discussion followed with regard to acquisition of the property for the proposed drainage canals and its effect on pro- posed development. Slides of the site were viewed. The possibility of a moratorium on development in areas affected by the proposed channels was noted. " The Planning Director indicated that this type of develop- ment is not specifically defined as an allowable use in an L- 1 zone , and it would be determined by the staff whether or not Planning Commission site plan review is required . He displayed a site development plan and described it briefly. The Chairman invited questions and comments from the Commis- sion members . In response to a query from Commissioner Teegarden , Mr. Ericksen explained that the narrow strip of G zoned land was the result of the division of parcels fol - lowing establishment of the Valley Freeway. The strip has been acquired from the owner of adjacent property. Commissioner Teegarden inquired 'hegarding the setback pro- vided from the east property line . He was advised by Mr. ' Ericksen that the setback was established in order to allow for the proposed Soil Conservation Service drainage channel . He noted that at this date there had been no official action to move the channel to the east side of the Valley Freeway which necessitated the setback . Mr. Ericksen said the matter would be reviewed further by the staff. Discussion also ensued with regard to the status of Coun- cil consideration of the Planning Commission recommendations for proposed changes in the L- 1/H-1 categories of the Zoning Ordinance . Appropriate concerns regarding the request were reviewed by the Planning Director. Commissioner Scholes requested that an outline of the P-9 Channel in this area be provided for review, especially as it applies to the G-9600 zoned area . Information with regard to setbacks from the proposed chan- nel site was also requested. The Planning Director indicated that the City of Renton has passed a resolution concurring with the Soil Conservation Service requirement that two percent of each site remain in its natural state or be landscaped for wildlife habitat. Further discussion followed with regard to consideration of the rezone in view of proposed changes in the Comprehen- sive Plan in the area . The site is bounded by an easement road at the back . There is R-3 zoned property across the street to the west . Slides and aerial photographs were viewed . The appli - cant proposes to develop the front portion of his pro- perty with a duplex dwelling . Although much of the neighborhood is designated for medium density multi - • family use on the Comprehensive Land Use Plan , it con- sists essentially of single family residences . E. , Renton , the applicant , stated that he has checked with neighbors to the east and south of his property , across Vashon N. E . and N. He noted that the proposed duplex on the front of the property would be screened by existing trees . He stated it was his intention not to cut down any trees on the property. He estimated that the site of the duplex will be between 7 ,500 and 10,000 square feet. The Chairman called for questions from the Commission mem- bers . Commissioner Wik, noting grading of the site as viewed in photographs , inquired if it was Mr. Jackson ' s intention to construct a row of duplexes eventually. Mr. Jackson stated that ultimately he would like to put one duplex in the northwest corner but planned to preserve the contour of the land as much as possible . He stated that he did not have plans for ultimate high intensity multiple family use. Discussion followed with regard to the procedure for obtain- ing public right-of-way in the area , the possibility of off- site improvements at the time of platting , and possible access problems that could occur. In response to Commis- sioner Mola , Mr. Jackson indicated that he planned to accom- plish most of the construction work personally but would subcontract some work. Commissioner Teegarden expressed his concern , that while the area was designated for multiple family by the Compre- hensive Land Use Plan , he noted a number of substantial single family houses on three sides of the site .
