CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES
WITHIN THE CITY OF RENTON FROM GENERAL CLASSIFICATION
DISTRICT (G-9600) TO PUBLIC USE DISTRICT (P-1)
• WHEREAS .under Chapter VII, Title IV (Building Regulations)
of Ordinance No. 1628 known as the "Code of General Ordinances of
the .City of Renton" , as amended, and the maps and reports adopted
in conjunction therewith, the property hereinbelow described has
heretofore been zoned as General Classification District (G-9600) ;
and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the City Clerk on or about
April 21, 1975 , which p petition was duly referred to the Planning
Commission for investigation, study and public hearing, and a public ,
hearing having been held thereon on or about May 28 , 1975 , and said
matter having been duly considered by the Planning Commission and
said zoning request being in conformity with the City's Comprehensive
Plan, as amended, and the City Council having duly considered all

stories or twenty-five ( 25 ) feet , whichever is less .
ACCESS
Access shall be limited to Talbot Road South . ( If

DEVELOPMENT PLANS
All site development plans , including those of public
or quasi -public institutions , shall be approved by the

DURATION

Any violation or breach of these restrictive
covenants may be enforced by proper legal procedures in the
Superior Court of King County by either the City of Renton

Rezone 'Letter from Planning Director Ericksen presented Planning Commission
W.Stewart Pope recommendation for approval of rezone in view of restrictive covenants ,
R-816-75 from G-9600 to P-1 as requested by W. Stewart Pope for 8.28 acres located
at 3713 Talbot Rd. S. , being in agreement with Comprehensive Land
Use Plan as per Amending Ordinance 2891 . The letter noted meetings
were held with the Commission, adjacent property owners and developers
being in agreement with resultant covenants. MOVED BY GRANT, SECONDED
BY BRUCE, COUNCIL CONCUR IN RECOMMENDATION OF THE PLANNING COMMISSION
AND REFER TO THE LEGISLATION COMMITTEE. Assistant Planning Director
Magstadt used map to explain location and proximity to the Valley General
Hospital , noting covenants executed and filed with the City Clerk. Coun-
cilman Grant commended Commission and owner for foresight of covenants
preserving natural vegetation and landscaping of area. MOTION CARRIED.

Management Letter from City Management Employees Committee requested the subject
Employees of 1975-76 salaries and fringe benefits for management employees be
Salaries & referred to the Committee of the Whole for discussion with management
Benefits representatives at the July 10, mdeting. The letter noted that on
11/7/74 representatives of the management employees had met with the
Committee of the Whole to discuss salaries and fringe benefits, the
subject being referred to the Finance and Personnel Committee as
had requests of the bargaining units of the City, and that the Council
has completed negotiations with 21R, Firefighters Local and Police Guild.
MOVED BY GRANT, SECONDED BY STREDICKE, COUNCIL REFER THIS REQUEST TO THE
COMMITTEE OF THE WHOLE. CARRIED.
Manning of Letter from Mayor Garrett reported concerning manning of the fire sta-
Fire Stations - tions, the contract with Firefighters Local 864 providing for a minimum
CETA Positions manning of 12 firefighters for each assigned shift. The letter noted
the 1975 budget adopted by the Council contains five additional fire-
fighter positions to be funded under Title II of the Comprehensive
Employment and Training Act of 1973 (CETA) , that the Fire Civil Service
Commission has conducted an examination and provided an eligibility
list with two qualified CETA positions of those first five eligible.
The Civil Service Commission determined that no special exceptions will
be made to the rule that certifications are made from the list in the
order of applicant score. The letter reported that in order to meet
minimum manning requirement the City is hiring firefighters on an over-
time basis at an expenditure of $4,200 per month, which would amount to
$27,300 for 1975. The letter recommended preferable alternate that
certification be made of the first five firefighters on the eligibility
list (two of which would be CETA employees paid by the federal govern-
ment) at an expenditure of $22,131 for the remainder of 1975. MOVED BY
GRANT, SECONDED BY PERRY, COUNCIL REFER THE MATTER OF MANNING FIRE
STATIONS TO THE COMMITTEE OF THE WHOLE AND THAT FIREFIGHTERS LOCAL #864

John LaManna - Letter from Mr. and Mrs. John LaManna, 2733 N.E. 27th, requested permis-
Trailer Request sion to place a permanent, stationary double-wide mobile home without
wheels on their property within the City limits, which is State and
Federally approved, and be connected to septic tank, water and electri-
city. The letter notes being advised the City prohibits mobile homes
other than in a licensed trailer park. The letter also noted problems
involved when their home burned in January and request was made to live
on the property in a travel trailer in order to protect property from
Renton City Council

for use of could reside at the site in travel trailer. The letter complained of

District matter be referred to the Public Safety Committee to consider policing
(Continued) problem and with the Community Services Committee to review City and
County ordinances to determine whether changes necessary. Public Works
Director Gonnason noted review of the matter. •Upon inquiry, City Attor-
ney Shellan advised the City's ordinance prohibits use of trailer as
living quarters in single family residential district but noted allow-
ance could be made for emergency. MOVED BY STREDICKE, SECONDED BY GRANT,
SUBSTITUTE MOTION THAT SPECIAL PERMIT BE ISSUED,NOT TO EXCEED SIX MONTHS,
ALLOWING THE LA MANNA FAMILY TO RESIDE IN TRAILER IN RESIDENTIAL DISTRICT
IN ORDER TO PROTECT THEIR PROPERTY WHICH WAS DAMAGED BY FIRE. Councilman
Delaurenti noted the family is seeking permanent installation of mobile
home in residential district. MOTION CARRIED.
RECESS MOVED BY BRUCE, SECONDED BY GRANT, COUNCIL RECESS. CARRIED. Council
Recessed at 9:22 and reconvened at 9:30 p.m. Roll Call : Councilmen
present as previously shown.
Diamond Jubilee Letter from the Sign Design Committee, Acting Chairman Hanson, reported
Flag Display review of proposal to display Diamond Jubilee Flags through the downtown
for CBD business area and agreed with appropriateness of display during. the cele-
bration year. Noting that flags may project over the public right-of-
way and noting that care should be taken in their placement, the Com-
mittee made the following recommendations: That the City Council allow
the flags to be displayed from private property; that the flags be
equal in height and spacing along the street; that the flags be located
so as not to interfere with traffic control devices or affect public
safety. MOVED BY STREDICKE, SECONDED BY DELAURENTI , COUNCIL CONCUR IN
THE RECOMMENDATION FOR DISPLAY OF DIAMOND JUBILEE FLAGS IN CBD. It was
noted installation was under the direction of the Public Works Director.

L. I.D. 286 Letter from Public Works Director Gonnason submitted for approval Final
Kennydale Area Assessment Roll for L.I.D. No. 286 in the total amount of $217,058.12.
Sanitary Sewer The letter noted three additional properties were added to the roll
under the Kennydale Elementary Latecomers Agreement, as the property
fell within the boundary of the LID as set by Ordinance 2868, which
total $2,832.77. The addition of the Latecomers Agreement brings the
total roll to $219,890.89. Date of Public Hearing for the Final Roll
having been set on 6/9 for 7/21/75, it was MOVED BY BRUCE, SECONDED
BY DELAURENTI, COUNCIL ACCEPT REVISION TO THE LID ROLL. CARRIED.
AUDIENCE Mrs. Pat Seymour requested opportunity for the Victoria Park Home Owners
COMMENT Association to furnish input regarding SR-515, though 6-Year Street Plan
Hearing closed. MOVED BY GRANT, SECONDED BY PERRY, COUNCIL REFER THE
MATTER CONCERNING SR-515 TO COMMITTEE OF THE WHOLE. CARRIED.
PROCLAMATION Proclamation of Mayor Garrett declared Friday July 4, 1975 as Honor
Honor America America Day and called upon all citizens to recognize this special

former member of the planning mommission convinced two neighbors who
live outside city limits that P-i zoning would be detrimental to thuur
property. They have attempted to persuade. some of my neighbors who .
live in the city but not adjacent to my propet ty that such zoning
would be detrimental, chiefly by .misinformation. They have represent-
'ed., for 'instance, that P-1 zoning will permit the construction of
'apartment houses. I urged these, people to call the planning staff
to learn the truth until I learned that the planning staff did not
deny that apartment houses could be conbtructed on P-1 zoning. Ac-
cordingly, I may say that the neighbors to whom I have made known my
plans favor the change in zoning I have requested. ' I can supply doc-
umentaay proof of the misinformation that has been circulated among
those who oppose the change. Nearly all of this group whom I have

NATURAL AREAS
The existing ravine and creek shall be preserved
in its natural state , and no structures shall be
constructed within the ravine area unless other-
wise approved by the Renton Planning Department.
LANDSCAPE AREAS
a ) Detailed landscape plans , including existing
vegetation to remain , shall be submitted to
and approved by the Renton Planning Department
prior to further development on the site .
b ) Minimum fifteen ( 15 ) foot landscape buffers shall
be added along South 37th Street and a fifteen ( 15 )
foot buffer along Talbot Road South shall be main-
tained to adequately screen and reduce impacts to
adjacent residential uses prior to further develop-
ment on the site .
c ) Existing vegetation shall be maintained as much
as possible . Existing vegetation shall be removed
only by approval of the Renton Planning Department
• prior to any further development or clearing on
the site .
SETBACKS
A minimum forty (40 ) foot setback shall be maintained
for all structures along the north and east property
lines .
HEIGHT LIMIT
All buildings or structures located within one hun-
dred ( 100 ) feet of the north and east property lines
shall maintain a maximum height limit of two (2 )
stories or twenty-five (25 ) feet , whichever is less .
ACCESS
Access shall be limited to Talbot Road South . ( If access
is allowed to South 37th Street , then twenty (20 ) feet
of additional right-of-way shall be dedicated .
DEVELOPMENT PLANS
All site development plans , including those of public
or quasi -public institutions , shall be approved by the
Renton Planning Commission .
DURATION
These covenants shall run with the land and expire on
December 31 , 2020 .
Any violation or breach of these restrictive
covenants may be enforced by proper legal procedures in the
Superior Court of King County by either the City of Renton
or any property owners adjoining subject property who are
adversely affected by said breach .

Gentlemen:
Your letter of June 13 by Michael L. Smith is in our hands .
It appears that the (b) Dart of the section on LANDSCAPE AREAS
still does not embody the agreement we reached.
As I pointed out in the first commission hearing on this matter,
this wording commits me, the present owner, to erect these land-
scape buffers at once .
If the wording, "Prior to further development on the site, " were
added to that sentence, it would conform to our understanding,
except for one matter which I think is merely one of clarifica-
tion.
We feel that the present larel hedge alone. Talbot Road conforms
to the requirement of this (b) Dart. Your addition of the words
"and Talbot Road" to that part could be construed to mean that
the present laurel hedge is not adequate and another type of land-
scape buffer should be added along that street. Also it could
mean that 15-foot landscape buffers must be added along the ravine
part of the frontage along that street.

deleted from said (b) part to completely incorporate all elements
of our understanding.

I met today with Mr. Pope regarding the restric-
tive covenants involved in his rezone request,
We discussed the various concerns that need to
be addressed in the covenants and alternative
methods of achieving development standards that
would preserve the natural character of the
site and protect adjacent residential properties .
We agreed upon the need for preservation of the
ravine area , the character of the site , a 15
foot landscape strip adjacent to the north and
east property lines , 40 foot setback require-
ment along the north and east property lines , 25
foot height limit within the first 100 feet from
the north and east property lines , and site and land-
scape plan approval . Mr. Pope said he would agree
with restrictive covenants outlining these con-
siderations .

of additional input from the applicant and time required
for further review by the staff , neighbors , and Commis-
sion .

The Vice-chairman requested that the request for Tempor-
ary Permit to allow a group home by Mrs . Evelyn M. Pipo
be considered at ,this point.

The application was introduced by Secretary Gibson and
the staff report was presented by the Planning Director
at the request of the Vice-chairman .
Mr. Ericksen advised that the Planning Commission had
previously approved a temporary permit for a period of
two years and that permit is now expiring . He noted
the site of the group home located on a 90 ' x 120 '
fenced lot off Benson Highway and S . 27th St . on the
vicinity map . Slides of the single family home and
neighborhood were viewed . Mr. Ericksen noted that to
the use adjacent neighbors have no objections .
The Vice-chairman invited comment and discussion from
the Commission , but none was offered . Similarly , no
one in the audience responded to a call for questions
from the audience by Commissioner Scholes .
The Vice-chairman reminded the Commission that issuance
of a temporary permit was allowable for a two year
period and then was subject to the review process . It

The Planning Director referred the Commission to previous
action by the Commission and Council with regard to an
amendment to the Comprehensive Plan to a P-1 category ,
as it related to the 8. 28 acre site . Present zoning is
G-9600 , and existing use is single family residential :
Mr. •Ericksen noted adjacent zoning , significiant develop-
ment in the vicinity and described the natural characteris-
tics of the site , which includes a ravine and creek on, the
southerly third of the property. Single family residential
districts lie to the north and east across Talbot Road
South . P- 1 use lies to the south .
Aerial photographs , slides of the property , and a topographi -
cal map were viewed . It was noted that approximately fifty
percent of the site is wooded and that principal access is
from Talbot Road . Mr. Ericksen pointed out that South 37th
is a half street--with thirty feet of right-of-way--and,
that additional development might require upgrading of the
right-of-way and improvements .
The Vice-chairman invited questions from the Commission .
In reply to Commissioner Gibson with regard to possible
encroachment of P-1 usage to the north , Mr . Ericksen noted
that this matter had been discussed rather extensively at
the time of the Comprehensive Plan amendment and stated
that any further changes in Comprehensive Plan designation
would require Planning Commission review.
Responding to Vice-chairman Scholes relative to allowable
uses in a P- 1 District , the Planning Director quoted from
Section 4-710 , P- 1 Public District , and noted that pro-
posed development would require Planning Commission re-
view. 'P- 1 limitations include height limitations of four
stories or forty feet.
Vi'ce-chairman Scholes invited comment from the applicant .
W. Stewart Pope ., applicant , stated that from an ecological
point of view, it was his opinion that P- 1 zoning is
preferable to residential zoning .
The Vice-chairman called for comment from the audience, but
none was received .
In response to an inquiry from the Vice-chairman with ref- .
erence to the possibility of an Environmental Impact Assess-
ment , Mr. Ericksen noted that Mr . Pope has submitted an En-
vironmental Impact Worksheet ; and it was the staff ' s posi -
tion that an Environmental Assessment or Environmental Impact
Statement were not necessary for the proposed rezone . He
advised. that the Commission will have development review
and that with design control , the impact on adjacent use
could be controlled.
Discussi-on ensued with regard to possible restrictive cove-
nants relating to development of the property . Among the
items considered were limitation of access to Talbot Road
South unless the right-of-way of South 37th is widened ; pres-
ervation of the natural vegetation ; structure height limita-
tions ; setback requirements ; and location of the structures
on the property to reduce impact to adjacent single family
residential areas . Mr. Pope stated that height limitations
of two stories or 25 feet would be acceptable to him within
100 feet from the northerly line with conformance to P-1
restrictions for the balance of the site .

The Underwood application for rezone of his approximate one
acre site from GS- 1 to SR- 1 was introduced by Secretary Gib-
son . The staff report was called for by the Vice-chairman .
The Planning Director pointed out the subject site , located
on Talbot Road South in the vicinity of South 17th . He
noted that there is an existing single family residence on
the property . The requested SR- 1 zoning would allow for
division of the property into three lots and is in agree-
ment with the Comprehensive Plan . Mr. Ericksen noted that
a short plat and waiver of off-site improvements has also
been requested.
Slides of the property and neighborhood were viewed . It
was noted that the property will back onto the proposed
Highway SR-515 . Principal access will be from Talbot Road
South . The proposed lots will be a minimum of 13 ,000 square
feet each .
Questions of the staff were invited by the Vice-chairman ,
but none were offered . Then the Vice-chairman called for
comment from the audience .
Patricia Seymour , 2534 Burnett Court South , Renton , stated
that her concern was in respect to the fact that the site
backs onto the proposed SR-515 Highway . She said it was
her opinion that the zoning was appropriate . She sug-
gested some type of screening to insure protection for
future buyers of the lots .
Mr. Ericksen replied that the proposed lots exceed the
zone requirements and are roughly 225 feet in depth , which
would be considered more than adequate as far as protection
from SR-515 is concerned . He noted that the Talbot Road -
SR-515 access would be at approximately S . 21st Street .
Vice-chairman Scholes invited further audience comment .

IT WAS MOVED BY GIBSON, SECONDED BY MOLA, THAT THE PUBLIC
HEARING BE CLOSED. MOTION CARRIED UNANIMOUSLY .
ACTION:
MOVED BY GIBSON, SECONDED BY RIVILY, THAT APPROVAL OF THE
UNDERWOOD REQUEST FOR REZONE FROM GS-1 TO SR-1 BE RECOM-
MENDED TO THE CITY COUNCIL, INASMUCH AS IT IS IN AGREEMENT
WITH THE COMPREHENSIVE PLAN AND ADJACENT LAND USE. MOTION
CARRIED.

E, GLACIER PARK CO . ; Appl . No . SP-822-75 ; special permit
to fill and grade in M-P/B zone ; property located south
of existing Mobil and Olympic Petroleum Distribution
Facility north of S . W. 43rd and westerly of E . Valley Rd .
The special permit application to fill and grade was intro-
duced by the Secretary , and a staff presentation was invited
by the Vice-chairman .
Mr. Ericksen noted the approximate 594 acre site in the Green
River Valley on the vicinity map and indicated that a portion
of it was included within the City of Tukwila . Present zon-
ing includes M-P and G designations . Surrounding zoning in-
cludes G , M-P , H- 1 , and L- 1 with Tukwila area zoned M- 1 .

Further discussion followed with regard to appropriate
setbacks from Talbot Road South and South 37th and
access problems . The Vice-chairman suggested that the
item be referred to Committee for further study .

POPE REZONE APPLICATION BE REFERRED TO THE ENVIRONMENTAL
DEVELOPMENT COMMITTEE FOR STUDY AND CONTINUANCE TO THE

The Vice-chairman announced that the question of the
Pope rezone was again open to discussion .
Noting that it would be desirable to meet with the appli -
cant regarding possible restrictive covenants at an open
meeting , Commissioner Mola suggested reconsideration of
the original motion . IT WAS THEN

TION BE REFERRED TO THE ENVIRONMENTAL DEVELOPMENT COM-

In response to a request by Commissioner Gibson for
clarification , the Planning Director noted that all
committee meetings are open meetings and that if the
matter were continued for two weeks , the meeting
would be advertised .

as practical by the Community Development Committee , COMMIS-
SIONER TEEGARDEN MOVED THAT THE PLANNING COMMISSION APPROVE
THE PROPOSED CHANGES , INCLUDING THE AMENDMENTS INCORPORATED
IN THE COMMUNITY DEVELOPMENT COMMITTEE REPORT OF MAY 12 , 1975 ,
AND FURTHER THAT THE EAST/WEST COLLECTOR ROAD ACROSS THE
VALLEY BE NOTED ON THE MAP AS INDICATED IN THE CIRCULATION
MAP DATED FEBRUARY 1975 .
In the discussion that followed , Commissioner Wik inquired
if Commissioner Teegarden favored the north/south arterial
and was advised that the committee report was not in favor.
Mr. Teegarden stated that if the Valley is developed , he
feels it will be necessary eventually although expensive
to build.
The Chairman called for a second to the motion . Noting
none , he declared the motion dead for lack of a second .
Further discussion ensued with Commissioner Scholes indi -
cating that he was in favor of the general concept of the
proposed change but did not believe it represented what
the community wants to see . He stated that he felt that
twenty acres of dedicated greenbelt was insufficient and
that there could be problems associated with the designa-
tion "deferred development. "
ACTION:
MOVED BY SCHOLES, SECONDED BY GIBSON, THAT THIS REVISION
BE REFERRED TO THE COMMITTEE OF THE WHOLE FOR FURTHER STUDY
AND REPORT BACK BY THE JUNE 25TH PUBLIC HEARING . MOTION
CARRIED.
Commissioner Teegarden reminded the Commission that the
public hearing had been closed , allowing for no public
input at the June 25th meeting . Discussion followed , and
it was the conclusion of the Commission that it may be
necessary to reopen the public hearing prior to final
action . Commissioners will be notified of the date for
the study meeting.
Commissioner Gibson left the meeting at this time , 10 : 25 p . m. ,
having been excused for a previous commitment .
4 - NEW BUSINESS :
The new business items were introduced to the Commission by
the Planning Director at the request of the Chairman . Loca-
tion of all sites were noted on the vicinity map , and a gen-
eral description of the proposals were given as follows :

Mr. Ericksen noted that the Comprehensive Plan had been
amended by the City Council per Ordinance No . 2891 with
regard to the 8. 28 acre site , and an - application had been
submitted for rezone of the property from G-9600 to P- 1 .
The Planning Director described the natural characteristics
of the 520 ' x 800 ' site , which includes a ravine , and the
general make-up of the neighborhood .
At the request of the Chairman , Vice-Chairman Scholes chaired the

I called and informed Mr . Pope that the Environmental
. Impact Worksheets that I mailed him needed to be sub-
mitted to us today , in order for his application to be
on the May agenda . He said that he didn ' t relize that
the worksheets needed to be returned so quickly . He
said that he would bring in the worksheets first thing •
Wednesday morning . I said bring them in as quickly
as possible and we would do our best to get his re- •
