I .S. contributors. Mr. Moore summarized the Impact Statement, describing the L. I .D. project which will provide collection sewer lines for residential areas in the northern portion of Renton (Kennydale area)with 28 linear feet of 8-inch or larger line plus side sewers stubbed to the 500 homes in the area, each homeowner required to make connection from home. The Draft Statement listed direct environmental impacts: Removal of ground cover on easements ( two acres), would be replaced; construction noise & dust, and con- struction disruption of traffic; and elimination of health hazard. Secondary environmental impacts: full utilization of existing zoning and possible increase in storm water runoff. Alternatives listed: no action and reduce occupancy in areas with septic problems through abatement procedures. The Statement listed mitigation of adverse impact by hydroseeding of unimproved easements; sprinking with water to relieve dust and traffic detours during construction. Mr. Moore requested that all responses to the E. I.S. be written and submitted to the responsible official , Public Works Director Gonnason, by 11/15/75. Councilman Perry inquired re storm water and was advised existing run- off has been taken into consideration and that new plats should be con- sidered as developed. The July 1975 public hearing meeting of the Renton Planning Commission was called to order at 8 : 05 p . m. by Chairman Ross , who led the Pledge of Allegiance . Approximately fifty people were noted as being present in the audience . 1 . INTRODUCTION OF OFFICERS : The Chairman requested that Commissioner Scholes assume his newly elected post as Chairman for the year 1975-76 at this time . He described the duties of the Chairman- ship , offered his congratulations , and thanked Commis- sion members for their cooperation during the past year . The new Chairman introduced the new officers : Vice- chairman Wik and Secretary Rivily . He also introduced a newly appointed Planning Commissioner , Joan Walker. Mrs . Walker expressed her appreciation to the Commis- sion and staff for their helpfulness and interest . Chairman Scholes announced the formation of three new committees and their officers : Land Use Commit- tee - Teegarden , Chairman ; Rivily and Scholes , members ; Zoning Committee - Mola , Chairman ; Walker and Ross , members ; and Special Studies Committee - Gibson , Chairman ; Garrison and , Wik members . He stated that a list of outstanding activities that are before the Commission would be announced prior to July 30th and • committee assignments designated . 2 . Commissioner Teegar- den requested that the word " rezone" in the first para- graph of item 3 , referring to an addition to the minutes of June 11 , 1975 , by Commissioner Mola , be corrected to read " reason . " He also noted with regard to the discus- sion concerning the John C . Edwards ' application on page ten an apparent misinterpretation in the first paragraph in the statement by Mrs . Bala and requested that the word "moss " be changed to "marsh . " In the same para- graph in one instance Mrs . Bala was referred to as "Mr . Environmental Development Committee July 23 , 1975 Page Two Other committee members questioned the need for more business zoning in the area at this time . Mr . Moritz made his presentation in favor of his request noting existing business zoning in the area . He indicated that the property cannot be properly developed under its existing classification . When asked if he had a specific development proposed that the committee could review , he said he did not. ACTION The committee voted to continue the application for further information and justification from the applicant. iITEM 2 DENNIS OSTER Rezone #R-827-75 Mr . Smith gave a brief overview of the proposal and the area in which it is located . Mr . Mola stated that R-2 zoning may be more appro- priate at this time because it would be more com- patibile to the single family uses directly adjacent to the subject site and act as a buffer between the single family area and anticipated multi family area to the north . Mr . Oster made his presentation stating that R-3 was appropriate and that the property could not be reasonably developed in a lesser intensity zoning . The matter of public use of the undeveloped eastern portion of the property led Mr. Lynn Spech , the ministers -to indicate the chruch ' s willingness to allow public type uses of the property if it does not hinder their exemption status . The related traffic problems in the area were dis- cussed with complaints issued by Mrs . Gist and Mr. Noble , who reside in the area . They complainabout general traffic as well as church traffic problems . Mrs . Gist also felt that single family residence usage of the property would be less detrimental than the proposed use in terms of visual quality and traffic • impacts . However , the committee and staff indicated they would ask that the traffic engineer comment on these questions and the six year street program for the area . He was then informed of the possible allowable uses in each zone . It was pointed out that some of the possibilities he anticipated may be allowed in an R-2 zone . ACTION The committee voted to recommend R-2 zoning for this site , feeling that the R-3 zoning was not appropriate for the area at this time . ITEM 3 HIGHLANDS CHURCH OF CHRIST Site Approval #SA-830-75 Mr. Ericksen gave a brief overview of the proposal , and commented an the field trip conducted to the church in Montlake Terrace developed by the applicant. Mr. Teegarden made a brief statement concerning his impressions as a result of the field trip. He indicated that with some controls established he would not be opposed to the development . Mr. Pribble then presented the revised plans requested by staff and the committee . These included: 1 . revised site plan 2 . landscape plan 3 . grading plan 4 . floor plan Mr. Ericksen also stated that there were alternatives to the development plan that would reduce certain impacts which include additional setbacks and screening, control of access , and choice of colors for the pro- posed structures . Mrs . Gist felt that there were enough churches in the area . Mr. Noble stated that he didn ' t necessarily object to the proposed project, but did complain about traffic problems in the area . . The Chairman asked for' comment from the applicant . Gary Moritz , 2525 N . E . 24th , Renton , stated that it was his opinion that since the property across the street to the west was zoned for business usage , his request seemed appro- priate . He noted that the Dennis Oster site to the south pre- sently zoned G is the last piece of property within the City limits and inquired if the property to the south , located in the County , was not zoned as R-3 . He also inquired re- garding the King County Comprehensive Plan designation for the area . Mr. Magstad replied that the King County Planning Department had been contacted on June 24th and had advised that the property to the south is presently zoned SR, which is single family residential . The Assistant Planning Direc- tor stated that he could not comment regarding the County ' s Comprehensive Plan designation . The Chairman invited comment from the audience but received no response . He also stated that the property to the north of the subject site was zoned R-3 as a part of a larger site to provide a transition be- tween business and single family use to the south . In response to Commissioner Garrison ' s inquiry regarding the availability of plans for the site , the Planning Director advised that none had been submitted , and he understood that there were no immediate plans for its use . It was noted that the Comprehensive Plan in the Highlands area will be reviewed next by the Community Development Commit- tee and that the County ' s Comprehensive Plan for adjacent areas should be considered in the decision . He reported that an existing single-family residence is to be removed and the property subdivided into sixteen single family 'residential lots ranging in size from 7600 square feet to 25 ,000 square feet . Primary access to the site is from North 38th Street ; access from Park Avenue North is limited to two lots . The rear lots would have access from separate roads that front North 38th Street . City sewers are available . In reply to Commissioner Teegarden ' s inquiry regarding the width of the stem of the pipe to the pipestem lots , the Assistant Planning Director indicated that they are twenty feet wide private driveways which run with the property . He also indicated , in response to Com- missioner Gibson , that the owner could combine the two rights-of-way for a total of forty feet . Discussion followed with respect to possible preserva- tion of natural vegetation . It was noted that some of the sites have a view of Lake Washington . Comment was invited from the applicant by the Chairman . Lyle L . Pickle , 1150 Union Avenue , Renton , stated that it was his intention to subdivide the property for a custom home development . He noted that while some of the trees would be desirable for preservation , he felt potential buyers may wish to choose between them or the Lake Washington view. Mr. Ericksen indi - cated that the assessment had not yet been prepared and was unavailable which would preclude any final action. by the Planning Commission . The Assistant Planning Director described the existing • gravel pit operation , which includes an area north of a single family area and incorporates all of one hill - side , and noted the boundaries of the 90 acres , which are located within the City limits . He pointed out single family residential areas in the vicinity , primarily the Maplewood area . Mr. Magstadt indicated that the Comprehensive Plan indicates the eventual use of single family , low and medium density development and a poten- tial for high-rise , recreational and greenbelt areas . He reviewed the present topography of the area and plans for grading and excavation and eventual regrading . Aerial photographs , slides , and maps of the area were viewed. The Chairman invited comment from the applicant or his representative . David Kennedy of Moore , Wallace , and Kennedy , 1915 - 1st Avenue , Seattle , consulting planning and engineering firm, noted that he represented John C. Edwards , also known as Rainier Sand and Gravel Company , and that Mr. Edwards was in. the audience . Mr . Kennedy cited the provision of the Mining , Excavation and Grading Ordinance which directs itself primarily to the compatibility of the proposed use and adjacent uses and stated that he would primarily direct his remarks to that matter. Mr. Kennedy then described the history of the Edwards ' operation , noting that it was first leased by Mr. Edwards 1, Renton Planning Commission Sir Meeting June 25, 1975 Page Eight from the State of Washington in 1939 while a coal mining facility the land partially acquired by auction in 1940 and balance of the site purchased in 1946, at which time it was converted to Rainier Sand and Gravel Company. He stated that the volume of material removed annually since that time had reached a maximum of 400, 000 cubic yards . The area was annexed into the City in 1947 . A crushing plant was erected in 1963, and settling ponds were added. Mr . Kennedy reviewed the permit procedures of th.e City of , Renton and the State that had been met by Mr. Edwards . A , permit for his grading plans was issued by the City in 1967 , and in 1971 another permit was granted for an excavating plan . He stated that the State Department of Natural Re- sources had also issued the applicant a permit under their Surface Mining Operation Act in 1971 and that this permit had been renewed annually since. Upon notification by the City of Renton of the passage of their Mining , Excavation and Grading Ordinance in 1974, an application was submitted along with an Environmental Impact Worksheet . Mr. Kennedy stated that it was their view that the Renton Ordinance referred to compatibility of a proposed use and that this had been an existing use for approximately thirty years . He also noted an additional eighty acres under the same ownership outside of the City limits . Slides depicting the operation were presented by the appli - cant and described by Mr. Kennedy, who described the general area as covered with gravel pits and primarily used for cemeteries , municipal uses and gravel pits . The primary traffic flow is to Third Avenue North and some traffic to the east on N . E . 4th Street . During the summer: months there are twenty to forty trips on an eight hour per day basis on Third Avenue North . He stated that the property is fronted on the south by the Maple Valley Highway ( SR169) . noting that the property is bordered by major east/west arterials on both the north and south . Mr. Kennedy stated that with regard to screening , landscaping and setbacks , most of the property is fenced ; and there is a ten foot screening easement as required through the Department of Natural Resources . There is an additional forty foot setback from areas adjacent to residential uses but not much landscaping . He described proposals for the slope treatment, when the operation is •completed , stating that these plans would go forward within one year. With regard to unsightliness , he stated: that most of' the excava- tion is not visible except from the air , with the exception of the bluff to the south . He said that bluff would continue to slide at a slow rate and could not be screened . Ulti - mately the problem will be resolved when it is regraded . With reference to noise and dust , he described the general operation as consisting of a crushing procedure , which is worked primarily in the winter with the materials held for use during the summer . In regard to surface drainage , Mr . Kennedy indicated that they have had settling ponds for years and revised, plans have recently been submitted to the Public Works Department relative to them. Noting the requirement for Planning Commission determination that the activity would *not be unreasonably detrimental to the surrounding area , he stated that there were some' things .that could be detrimental but they feel they are no more detrimental than in the thirty years the operation has been in business . Smith noted that the proposed plan comprises 3 . 7 acres and is planned for subdivision into approximately 16 single family residential lots varying from 7600 square feet to 25 ,000 square feet . The Assistant Planner described the requested rezone for the . 67 acre undeveloped site and noted that the proposed use is for a commercial building site . The conflict with the requested rezone and the Comprehensive Plan designation was discussed , and the Commission advised that the applicant is aware of the disagreement . The . 66 acre site directly south of the Moritz property was described by Mr . Smith . It was noted that there are no plans for the property at this time . The Comprehensive Plan desig- nates the area as medium density , multi -family residential district. In response to an inquiry from Commissioner Gibson , Mr . Smith indicated that sewers would be necessary for develop- ment of the site . SPECIAL PERMIT: De JOHN C. EDWARDS ; Appl . No . SP-752-74 ; special permit for existing gravel and sand excavating operation in S- 1 zone ; property located at 2930 S. E . 5th St . It was noted that 90 acres of the existing gravel pit are loca- ted within the City of Renton . Its locale off the Maple Valley Highway and north and west of the Maplewood area was pointed out by Mr. Smith . The request for review is pursuant to the Mining , Excavation and Grading Ordinance . Existing zoning is S- 1 . While the present use is a gravel pit , it is proposed to ultimately develop the area for various residential uses , combined with greenbelt and recreational areas . The Compre- hensive Plan for the property indicates a combination of single family residential ; low, medium and high density multi - family , recreational and greenbelt uses . It was noted that the property is about 1350 feet in depth within the City ; topographical and natural characteristics of the site were described. The proposed excavation plan and provisions for drainage were noted . There is no operation at this time . The Planning Director noted items to be considered will involve processing of the plan , the long-range process and rehabilitation of the site , Mr. Smith noted that the reuse plan submitted indicates plans for a commercial shopping cen- ter facility which is not in agreement with the Comprehensive Plan . 1 Renton Planning Commission Meeting June 11 , 1975 Page Nine' Robert Boyd , Property Manager of the Burlington Northern , Glacier Park Company , stated that the new plan involving "deferred development" did not change their position . They continue to ask for some heavy industrial zoning , and their offer to donate 20 acres for greenbelt remains . Responding to Commissioner Teegarden ' s inquiry , Mr . Boyd stated that after study of the Zoning Ordinance with re- • gard to M-P zoning , it was still their position that the designation did not satisfy the things they wanted to do . Vice-chairman Scholes reminded representatives of Burling- ton Northern and Milwaukee Railroad that a great deal of their land is zoned G, and there is no intent of the Commission to affect the rezone of the property either up or down , noting that it may be developed to the fullest extent allowable in the G zone . Further discussion continued with respect to the issue of the method of acquisition of land for greenbelt areas , and it was noted by Commissioner Gibson that land devel - opment should be made on a cooperative basis . A sug- gestion that the issue be placed on the ballot was made by Commissioner Rivily . Leonard Steiner spoke in support of citizen ' s rights regarding the use of property and noted avenues for preserving land as "open space , " if the property owner wants to take advantage of it . Kay Johnson , Secretary of the Renton Chamber of Commerce , noting the intent to continue the public hearing for two weeks , stated that he preferred to provide his input in writing . Following further discussion regarding the need for fur- ther study of recent input , possible revision of the Environmental Impact Statement and desire for a decision as soon as possible , IT WAS ACTION: MOVED BY TEEGARDEN, SECONDED BY GIBSON, THAT THE PUBLIC HEARING BE CONTINUED UNTIL JUNE 25, 1975, AND THAT A COMMITTEE-OF-THE-WHOLE MEETING BE HELD ON JUNE 18, 1975, TO DISCUSS THE MATTER.
