RE:Motion to Stay - The Home Depot – Appeal of Outlot 1 and Outlot 2Deferral
Decisions (C22004541 / DEF23001823 & DEF23001824 / LUA 21-000542)
Dear Hearing Examiner:
Please accept this Motion to Stay the Appeal of the decision entered by Brianne Bannwarth,
Development Engineering Director, on April 7, 2023 (the “Decisions”), related to “Outlot 1” –
also known as “Grady Way Improvements” and related to “Outlot 2” – also known as “Talbot
Road Improvements.”
The Appellant, The Home Depot, intends to file a request to modify the site plan upon which the
Decisions rely within the next sixty (60) days. If the City grants the modification request in whole
or in part, the modification may moot portions – and potentially all – of the above-captioned
appeal. The City indicated that it might accept and consider such a request.
In the interests of administrative efficiency and proper preservation of taxpayer funds, The Home
Depot respectfully requests the Hearing Examiner stay the above-captioned appeal pending the
outcome of The Home Depot’s modification request.
The Home Depot is informed and understands the City does not oppose a stay of the appeal
generally, but the parties were not able to agree on the proper duration of such a stay.
