Although the comprehensive plan indicates manufacturing park land use for the area , several circumstances related to the subject property appear to justify the alternative of L-1 zoning with restrictive covenants governing developmental standards compatible with M-P zoning . These circumstances include : (a ) The size, of the parcel is such that if the M-P setbacks were applied , little or no buildable area would remain . (b) Seneca Avenue S .W . terminates in a dead- end at the Freeway. (c ) S . W. 13th Street is not a full street width at the west end of the block in which the subject site is situated . It may be possible to vacate portions of this street in the future . (d ) The property between S .W . 13th Street and the Freeway is so small and oddly shaped that it is virtually unusable . The subject site is setback from the Freeway ± 87 feet at its closest point , therefore , creating sufficient open space and visual relief from the freeway . (e ) The site is of sufficient size to provide landscaping , parking and screening com- patible with the manufacturing park type of zoning . 2 . Single family residential uses exist to the west and north of the subject site . 3 . The area , however , is in transition to industrial and commercial uses , with Cummins Diesel Company and Wally ' s Fabricators located within a block of the subject site . Wally ' s Fabricators was developed without specific ordinance or covenant standards . CONCLUSIONS : The Committee recommends approval of the rezone request with restrictive covenants relating to set- backs , landscaping , and screening of outdoor storage . The covenants shall specifically include a minimum 30 ' setback along Seneca Ave . S . W. , 20 ' setback along S . W . 13th St . , 10 ' setback along the northerly property line , and minimum 30 ' setback along the wes- terly property line . The first 10 feet adjacent to all property lines shall be appropriately land- scaped subject to Planning Department approval . The resulting site plan shall be generally similar to that indicated as Exhibit "A . He then showed slides of charts illustrating his position and in support of his requested set- back . He noted that Paul Hunt , 2807 Mountain View Avenue No . , owner of adjacent property has indicated no objection to the proposed setbacks and that he has received similar reports from other neighbors . In addition , slides on home development in the area were displayed and described . Noting the complexity of the application and probable referral for study , the Chairman called for audience input in favor of the application . None were offered . He then called for com- ments in opposition . Clarence Nack , 2811 Mountain View Ave . No . , situated to the north of the subject site , indicated his opposition due to the possibility of being cut off from access to his lot should Mountain View Avenue be improved . Bev Morrison , 3011 Mountain View Avenue No . , inquired regard- ing the applicant ' s intentions regarding his other lots , noting that a group of houses located with a limited setback from the water would not be very attractive . He suggested that the entire ownership be re-divided into larger lots to accomodate homes with setbacks established by the Shoreline Master Program. A letter from Peggy and John DuBois , 2907 Mountain View Ave . No . , in opposition due to their feeling that the twenty foot setback stipulated by the Shoreline Master Program is reason- able and concern that a precedent will be established was read into the record by. the Recording Secretary . Discussion among the Commissioners followed with regard to the jurisdiction involved with the applicant ' s request for vari - ance from setback requirements from the rear as well as the front. Glen Norwood , 710 Maplewood Avenue , Kent , advised the Commission that he is an inventor and of his need for a small facility in which to do business in a limited way . He described the proposed use as a business office with provison for some light experimen- tation . Sanitary sewers are availalbe in the alley behind the subject property. Water supply is available on the east and south of the site. The water supply for fire protection is poor. A fire hydrant located at Seneca and S.W. 12th St.. flows 1200 gallons per minute at 20 psi. The existing water system in the Earlington Gardens neighborhood is poor, and the developer of this site may have to make some water main extensions to improve the fire flows to protect his site. There are connection fee's for water and sewer service at the rate of $0.01 per square foot of site area.
