When Sea Belle properties was given a fill permit, they were required to maint?in the volume-ofstormwater storage that naturally existed on the site. This storage, including retention for the property, amounted to approximately 100,000 cubic feet. This requirement was necessary because the downstream system is inadequate to handle the runoff from the upstream basin. Any proposed charges should not decrease the amount of storage available or alter the hydraulic characteristics of the sys- tem. Also, a decision needs to be made regarding using the public right-of-way for most or all of this required storage, If the use of the public right-of-way is allowed, provisions will be needed for main- tenance of the pond by one of the adjacent property owners. 10. If the required storage is not maintained the risk of flooding increases and would result in the closure of Lake Washington Blvd. during high water conditions. Besides the loss of access to the north and possi- ble property damage, the roadway is susceptible to structural damage when it is overtopped and the subgrade is saturated. 16. The plans submitted do not provide adequate detail as to how sewer ser- vice is to be provided and if the necessary rights across private prop- erty have been secured. The storm drainage is of major concern and will require careful evaluation. Off -site improvements would be required on S.E. 76th St. to the east property line plus modifications to the intersection as deemed necessary by Traffic Engineering. The following represent questions or unknowns which need to be resolved in conjunction with this project. The Committee might provide direction to the applicant on some of these questions: 1. Who will maintain pond? 2. Where will pond be located? 3. Denny's does not control entire frontage. How is entire storage amount to be distributed? 4. Is the required storage amount still available? 5. If right-of-way is used for drainage, is a use permit required? 6. Provide detailed storm drainage calculations supporting proposed revisions to system. Street Improvements. Street improvements are required on Lake Washington B vd. and S.E. 76th St. including curb, gutter, side- walk, storm drainage, street lighting and intersection improve- ments. The southerly portion of Lake Washington Blvd. still remains in the ownership of the Washington State Department of Transportation. The City Public Works staff has been discussing transfer of this right-of-way from WSDOT to the City. 3. Storm Run-off & Storage. The storm detention and flood storage e ements are the critical part of this project. The elements of size of flood water storage, location, maintenance, accommodation with street use can be best accommodated by this proposal: The major pond here and on adjacent Sea -Belle properties, be up -graded and built to City standards by the developer, either by developer or L.I.D. procedures. When Sea Belle propertics was given a fill permit, they were required to maintain the volume ofstorm•,,rater storage that naturally existed on the site. This storage, including retention for the property, amounted to approximately 100,000 cubic feet. This requirement was necessary because the downstream system is inadegjate to handle the runoff from the upstream basin. Any proposed changes should not decrease the amount of storage available or alter the hydraulic characteristics of the sys- tem. Also, a derision creeds to be made regarding using the public right-of-way for most or all of this required storage, If the use of the public right-of-way is allowed, provisions will be needed for main- tenance of the pond Ly one of the adjacent property owners. 10. If the required storage is not maintained the risk: of flooding increases and would result in the closure of Lake Washington Blvd. during high water conditions. Besides the loss of access to the north ar.d possi- ble property damage, the roadway is susceptible to structural damage when it is 3ve-topped and the subgrade is saturated. 16. The plan-s submitted do not provide adequate detail as to how sewer ser- vice is to be provided and if the necessary rights across private prop- erty have begin secured. The storm drainage is of major concern and will require careful e.aluatior. Off -site imrrovements would be required on S.E. 76th St. to the east property line plus modifications to the intersection as deemed necessary by TrL-ffic Engineering. The following represent questions or unknowns which need to be resolved in conjunctio;i with this project. As you are well aware, there has been a major problem with storm water r.atentioo on the subject site. The Engineering Department is concerned that the approved storage system as designed will remain intact. however, with dividing the property into four new lots, what will be the responsibility of the individual property owner. Therefore, an analysis of how much on -site storage per lot is necessary and 'now it may be affected by ailowmg accessing points across the detention pond. it is apparant that the construction of roadways in the form of causeways would reduce the storage capacity design and new designs would have to be approved. The short plat map should show the location ci the detention pond on the site. In addition, the number of cubic feet of storm water storage on each lot should be caicutated and a proposal of how each lot will be responsible for storm water retention be developed. Lake Washingto.} Boulevard creates another problem. In the subdivision ordinance it would require a minimum of a seventy foot (701) right-of-way for a secondary arterial. Presently there is only fifty feet (5011 of right-of-way. This would modify the configuration of the detention pond along; with the right-of-way configuration. 'rhe Public Works Dep,irtrnent wants to see the adjacent improvements including (i) the monumented center line of Lake Washington Boulevard, (2) the distance to the property line from that center line, (3) the Iocation of existing improvements on Lake Washington Boulevard, N1t' 44th, and SE 76th Street, and (4) the location of FAI-405 fence line. From a land use point of view, we are having difficulty in seeing why the property should be divided into four lets. It multiplies the problerns associated with access and storm water retention by suggesting, development potential more than ,-anticipated. It would appear, based on the location of the subject parcel adjacent to a major interchange, that the site would be developed as one total unit or possibly at the most two units. The 24" concrete pipe was extended as Structure Note 56-73 under Contract 7532. The original length was installed under Contract 4128 in 1952. Apparently you have had discussions regarding its operations with the City of Renton and the occurence of a nearby ponding area is a factor in the grading of your client's parcel. The grading is apparently necessary for the implementation of the highest and best land use. The Department of Transportation takes the position that storm water has been handled by this culvert with no reported damage or flooding of the road to date. For this reason, no improvement of the drainage crossing is currently proposed. We recognize, as you know, that the storm water management is the responsibility of the City. In addition, legal remedies are occasionally available for resolution of storm water routing issues. A copy of this letter will be sent to the City for their administrative information. We hope this letter will assist in your proposed development or re-evaluation of the land for tax purposes. Referencing Condition No. 4, design and construction of intersection improvements at S.E. 76th Street and Lake Washington Boulevard N. to meet public works standards, Mr. Freiheit indicated concurrence in providing required off -site improvements, but felt that it is not within the scope of the developer to design the intersection. He suggested instead that the developer conform to the city's design. The Examiner requested further testimony in support of the application. Responding was: Paul Butrim 3711 Lake Washington Boulevard N.E. Kirkland, WA 98033 Mr. Butrim clarified several matters regarding sewer line extension, water mains and storm drainage retention. He roted that the Denny's site is a one -acre separate legal lot, and provision of utilities to the entire 13-acre site at this time would create an unreasonable SA-050-82 Page Two burden on the rerlainder of the property owners. Storrs drainage requirements have been met in accordance with the special permit approved some tines ago, and the three retention ponds will servc t�,e Denny's facility and are part of the total requirement placed or, the property by the cIcy. Responding to the Examiner's inquiries regarding whether the three ponds are at the end of the drainage chain or the beginning, Mr. Butrim advised that the ponds constitute the end of the chain prior to channeling water under Lake Washington Boulevard, and they are capable of accepting water from Chi other 70 acres in the area as required by conditions of the fill permit. Addressing the subject of sewer and water utilities, Mr. Butrim noted that a 12-°nch water line a-ists down S.E. 76th to Lake Washington Boulevard ane ",yen to the north, wnich is of sufficient capacity to se,ve t`;e Denny's facility; and. therefor , Condition No. E, which requires extension of sewer and water mains from N.E. 44th to S.E. 76th, is excessive at the current time. He also noted approval of a sewer LID ir: the area two to three years ago which provides capacity for the subject site, and a pump system can ce designed by the applicant for submission to the city to pro•ide installation in connection �Vith the development. The Examiner noted that storm drainage ponds are built on state right-of-way, and if the state rejects the request for construction of those facilities, they wouid require construction on the subject site. Mr. Butrim advised agreement by the state to transfer that property to the city, and a letter of intent has been written f,r LransmiLtal at this time. He note, that if roads require widening in the future to include that retention area, further solutions such as extending large pipes under Lake Washington Boulevard and I-405 to tie in with the Quendall development are available. The Examiner requested testimony in opposition to the proposal. Responding was: June Huson 11030 S.E. 76th Renton, WA 98056 Although M-.. Huson indicated she is not in opposition to the proposal, she is concerned regarding potential sliding in the area due to the proposed development. She cited previous incidents of slippage due to location of a large fault approximately 2,000 feet above the subject site, and advised that the area is designated on sensitive area maps of King County as a land slide area wnich contains elevations in excess of 15 degrees. Ms. Huson concluded her comments by requesting assurance that as a result of the development and change in pervious surfaces that similar land slides do not recur. Representing [he Public Works Department was* Bob Bergstrom Engineering Supervisor Responding to the discussion regarding storm water retention, Mr. Bergstrom explained the history of the area, noting that existing pipes which were installed by the Department o` Transportation under 1-405 are inadequately sized to accommodate rainfall. Consequently, the applicant was requested not to fill the areas next to the highway which retain approximately 100,000 cubic feet of storage to which the applicant complied. Currently, negotiations with the Department of Transportation are occurring to transfer owner -ship of that portion of Lake Washington Boulevard N. back to the city. He also indicated that further discussions with property owners may be required to assure conformance with public safety requirements regarding sanitary sewer and maintenance of the storage ponds. Responding to the Examiner's inquiry regarding the water main on S.E. 76th, Mr. Bergstrom advised that the water main had been installed through a local Improvement District formed in 1975. Responding to the Examiner's. inquiry regarding the desire of the applicant to pump to an existing sewer Iine, Mr. Bergstrom stated that it would be possible for the applicant to pump to the sewer line in 11. E. 44th street; however, the deiign will require review. A north -south line crosses the N.E. 44th Street interchange ramp which turns east at the south property line, and is a closer connection. Mr. Butri.n submitted the Jones Avenue Sanitary Sewer LID 284, which on page two illustrates the exact location of the sewer line. The areas surrounding the subject site are a mir of uses and vacant land. Commercial and industrial uses are located south and west of the site. Multifamily units are east of the site. Single family uses are also located east and north of the site on the hillside east of the site and 1-405. The staff recommends the site and roof of the building be screened by evergreen vegetation and arr_hitec:ural additions, respectively, from the residential uses rear and topographically above the site. 11. The site will 'nave to be served Ly a combination of utility extensions according to the Department of Public Works. Water lines are nortf� of the site and a punp station would serve the site's sewer needs. 12. The subject site is only one portion of the larger acreage invclved in the previous fill and grade permit. The applicant's predecessor in interest indicated the current applicant should not have to bear the entire burden of utility extensions. 13. The areas above and east of the subject site are subject to slippage, but development of the subiect site would not appear to have any physical impacts on these upslope areas. 114. The proposed reuse of the filled and graded site appears to serve the public use and interest as well as permitting the applicant to make reasonable use of the site. 2. The site at the N.E. 44th Street interchange cf i-405 is well located for the restaurant, but in keeping with the goals of the Comprehensive Plan, this highly visible site must be adequately screened as recommended by the staff. The site is visible from Loth the e:est along 1-405 and the residential areas north and east. it must be screened differently for different effects and to minimize the site's visual impact, especially ;o the east. Plantings such as evergreens approved by the city's landscape architect must be utilized to shield the site constantly on the east, while smaller flowering trees can De used on the Lake Washington Boulevard property line. 3. The ponds now located on state right-of-way must be constructed to city standards, and the right-of-way acquired. 4. The eevelopment will require certain standard improvement, of the right-of-ways abutting the site. Additionally, while only a portion of the total grade and fill site is under review, utility lines must be extended in an orderly fashion pursuant to the Comprehensive Plan. It is not unusual or unreasonable for the first developer in an area to extend utilities as determined necessary to service an area and apply for latecomers' fees. Therefore, the applicant will have to provide those utilities and easements determined necessary by the Departments of Public Works and Policy Development. 5. Rather than constrain the applicant's site plan, the applicant will be required to modify whatever aspects of the proposal they determine necessary to correct the south driveway's improper location abutting a property line. 6. The roof which will have roof mounted equipment will have to be screened to preserve the v�ews of the upslope residential areas. The proposal is to construct a 6,300 square foot restaurant on a 44,700 square foot lot. Sixty-five parking spaces are provided of which two are handicapped parking spaces. 4. Reviea, of the original special permit to fill and grade, and the subsequent development of the site, is specifically limited by t::e location of the retention ponds necessary to 2ontinue on -site storm water storage that existed prior to the original filling of the subject site. Th. Environmental Review Committee has specifically conditioned approval of the State of Washirgton to allow the retention ponds to remain on their property. It appears that after the approval of the original drainage plan and construction of the retention ponds, an error was discovered in the original. survey which, in actuality, placed the majority of the retention ponds eapon the State tight -of -way. The City of Renton is presently attempting to ;acquire those rights -of -way to he directly under City control and review. The site itself is a commercial site of high visibility. This is primarily the reason that Denny's Restaurant chose the location to develop. However, the site also focuses upon the retention ponds and special consideration needs to be given to all phases of site planning in relationship to the storm water issue. The Public Works Department sees the storm water runoff and storage issue as a critical part of the entire project. They recommend that the ponrl here and on the adjacent PRELIMINARY REPURT ,0 THE HEARING EXAMINER DENNY'S INC. AUGUST 10, 1982 PAGE FOUR Sea_BclJe properties be upgraded and built to City standards by the developer. The intent is that the City then can take over the maintenance of the .turm water storage pond, since it is un public right-of-way. The a^.;umptiun of maintenance of retention/detention facilities is specifically delineated under Section 4-2913 of the Renton Municipal Code. 5. The primary issue of the entire storm water drainage system was .he limitation of the outfall from the site. Presently, there is an eighteen culvert which runs underneath Lake Washington Eoulevard. It may be necessary to increase this culvert depending upon the final drainage plans. In addition, the plans show the public sidewalk adjacent to the det^nLiun ponds. If the slope is over a certain percentage by design manual criteria, then a handrail or guardrail will be required to protect pedestrians and the general public. 6. The Public Works Department advises that both water main and sanitary sewer extensions will be necessary. In the case of the water main, it will be required along Lake Washington Boulevard front S.E. 76th Street to N.E. 44th Street. sanitary sewer extensions will be required along the cast lot lines to S.E. 76th Street from the existing :sanitary :ewer on N.E. 44th Street. The site plan only addresses a portion of the required public improvements. The property fronts on both Lake Washington Boulevard and S.E. 76th Street. The intersection of S.E. 76th Street needs to be improved and will be required as a condition of the building permit. The applicant has nut specifi- cally requested a waiver from those improvements to the Hearing Examiner or deferral rrom the Board of Public Works. Lake Washington Boulevard N.E is envisioned as a three lane street intersecting with a three lane intersection for S.E. '6th Street. Intersection plans need to be approved by the Fiblic Works Department prior to issuance of the building permit. In addition, the sidewalk should lie continued around the intersection Lurner to the northeastern property line. The applicant shows in their plot plan widening of Lake Washington Boulevard which would appear to be sufficient to meet the immediate needs of the restaurant. Some widening will have to take glace as the State of Washington develops their property on the vest side of Lake Washington Boulevard into a Pack-n_Ride lot. Both the Building Division and Policy Development Department are concerned with the landscaping treatment of the subject site. The subject site can be viewed from the north and east by single family residential uses and immediately to the north is a proposed multiple family residential use. Specific care should be taken to buffer the site with landscaping. Policy Development recommends that the northern and eastern property lines be screened with evergreen trees instead of the deciuuous trees proposed on the landscaping plan. The Building Division envisions a similar problem with maintenance and landscaping of the detention ponds. Instead of hydraseeding the detention punds, Lite Building Division recommends that the ponds be sodded and maintained in grassy areas as part of the landscaping fur the restaurant complex. In any case, some landscaping treatment should be utilized along the public right-of-way to buffer the ponds and blend them into both the street scape and the building site. It is possible to utilize some type of dwarf flowering tree immediately behind the proposed sidewalk on Lake Washington Boulevard. This would not limit the visibility of the rc:;tai.rant from the interstate, but provide a more tranquil settiny and buffer between Lite land uses. The parking lot as proposed meets dimensional requirements for both parking stalls and aisle. however, the curb cuts do not meet the recommended width required per comments from the Public Uom s Department. These will have to be increased from 24 feet to 30 feet to allov adequate ingress and egress. t In addition, the plot plan shows a common driveway on the i southern property line with a curb euL nn the property line. I This is specifically not allowed by the Parking and Loading Ordinance and the applicant has nut sought a variance. Therefore, approval must be cunditioned upon moving the property line 17 foot to the south to comply with City standards. It i.s al3o recommended that the five feet along the southern property line then be landscaped with some type of temporary materia: such ac phuLenia to buffer the site until development occur:; on the southern lot. 10. Since the subject site is adjacent to residential uses, extra care should be taken for both visual and light intrusions From the site into the residential areas. The Policy Development Department recommends that all lighting be directed inward away from the northern and eastern property lines. Based upon the site plan, it appears that the applicant has accomplished this. In addition, replacing the deciduous landscaping along the northern and eastern property lines with evergreen landscaping would limit the diffusion of the light if the standards were kept below 25 feet in height. In most cases, the City has not been concerned about the visual screening of roof mounted equipment. However, in this specific case, single family residences will be looking directly onto 'the roof of the subject building, therefore, all roof mounted equipment should be enclosed within a structure.
