PUMP STATION AGREEMENT AND RECIPROCAL EASEXMfTS
This Regional Detention Facility Pump Station Agreement and
Reciprocal Easements ("Agreement") is made as of this day of
1995 by and among the Seattle Area Plumbing
and Pipef tt ng Apprentice and Journeyman Training Trust
("Trust"), Eland Building Limited Partnership ("Eland"), o
.Jefferson Smurfit Corporation ("JSC"), B & G Partnership ("B&G"),
and King County Department of Metropolitan services ("Metro"). �.

RECITALS
^� A. Eland, JSC, Trust, B&G, and Metro -own parcels of real
property located adjacent to or near each other in King
7 County, Washington, described respectively in Exhibit A
(the "Eland Property"), Exhibit B (the "JSC Property"),
Exhibit C (the "Trust Property"), Exhibit D (the "B&G
Property"), Exhibit E (the "Metro Property") (all of
the foregoing are collectively referred to herein as
the "Properties").
B. Surface water runoff from the Properties drains into
portions of the Trust Property and the Eland Property,
including a detention pond located on the Trust.
Property (hereinafter referred to as the "Detention
Pond"). -'
C. As a result of the.volume of surface water runoff from
the Properties during certain storm events, water col-
lected in the Detention Pond overflows onto portions of
the Eland Property and the Trust Property.
D. In order tV—zci3ow -for future development, and to pre-
vent further overflow, it is necessary to design, con-
struct, and maintain a Regional Detention Facility and
Pump Station, together with all appurtenances, pipes'
and easements (the "System"), which will evacuate water +
from the Detention Pond when it reaches a certain
level.
The parties hereto desire to jointly fund the design,
construction and maintenance of the System in accordance with the

parameters set forth by the City of Renton and the terms of this
Agreement.
NOW, THEREFORE, it is agreed:
1. Trust Supervision. The Trust shall perform the
following duties:
(a) The Trust shall supervise, manage and pay all
costs and expenses (subject to the right to reimbursement as
provided in Section 2(a) below).in connection with the design and
construction of the System. Without limiting the generality of
the foregoing, the Trust shall cause all permits and easements
necessary for the System to be obtained, shall cause the prepara-
tion of all construction documents and plans, shall cause the
competitive bidding of all major portions of the work, and shall
cause the System to be constructed and completed in a good and
workmanlike manner in accordance with all applicable governmental
requirements. The design and construction of the System shall be
in substantial accordance with the Bush, Road & Hitchings, Inc.
proposal dated December 22, 1994. The estimated budget for the
design and construction of the System is set forth in Exhibit F
hereto.
(b) After completion of construction of the System,
the Trust shall cause the System to remain in good operating
condition and shall cause all maintenance, repair and necessary
reconstruction of the System from time to time to be accom-
plished. The Trust-ahall pay all such costs and expenses (sub-
ject to the right to reimbursement as provided in Section 2(b)
below) .
(c) The Trust shall maintain all accounts, con-
struction records and operating data and allow access -to all
parties upon reasonable notice.
__(_d) The Trust shalt distribute invoices to the parties
for the payments_nequired under Section 2 below not less than
twenty (20) days prior to the respective payment date. The -
invoices will be accompanied with copies of invoices from con-
tractors, suppliers and other vendors substantiating the request
for payment.
(a) The Trust shall perform its duties and obligations
herein in good faith with reasonable diligence and care. The
Trust shall be paid no compensation or fee for any of its ser-
vices hereunder. It is understood that the Trust may contract
with consultants and contractors in connection with the per-
formance of.its duties hereunder.

2. Payments by Parties.
(a) With respect to the costa and expenses of design,
construction, permitting, obtaining necessary easements and all
portions of the work in constructing the System as generally
described in Section 1(a), the parties shall reimburse the Trust
for such aggregate costs and expenses as follows:
B&G: Balance of aggregate costs and expenses
JSC: 5% of aggregate costs and expenses
Metro: 5% of aggregate costs and expenses
Eland: $25,000 lump sum payment
Trust: 30% of aggregate costs and expenses
Eland shall pay $5,000 upon the execution of this agreement and
the balance upon completion of the System. The Trust shall
invoice the other parties on a monthly basis upon accrual of
expenses. All invoices shall be due within thirty (30) days of
receipt. overdue payments shall bear interest at twelve percent
(12%) per annum from the due date.
(b) With respect to the costs and expenses of operat-
ing, repairing and any necessary reconstruction of the System
after completion thereof as generally described in Section 1(b),
the parties shall reimburse the Trust as follows:

Metro shall have no obligation for the costs and expenses of
Qj operating, maintaining, repairing and any necessary recon-
struction of the System. The Trust shall invoice the other
parties not more often than twice per calendar year for these
costs and expenses and all invoices shall be due within thirty
(30) days of receipt. overdue payments will bear interest at
twelve percent (12%) per annum.
3. Aeciorocaj Easements. In consideration of the mutual
promises set forth herein, •for other good and valuable considera-
tion, receipt is which is hereby acknowledged, Eland and the
Trust hereby grant and convey to each o her and to the other
parties hereto, a nonexclusive, perpetual easement along, in,
upon and under the Trust Property and the eland Property in the
locations as legally described on the attached Exhibits G and
Exhibit H, respectively, and as depicted on the sketch attached
hereto as Exhibit I (the "Easement Areas"), for the purpose of
installing, constructing, operating, maintaining, repairing and -
replacing the System, together with nonexclusive rights of
ingress and egress to and from the Easement Areas for said pur-
poses. Eland and the Trust may use the surface of the Easement
Areas granted herein for any purpose which is not inconsistent

with installing, constructing, operating, maintaining, repairing
and replacing the System.
4. Insurance. The Trust shall require all parties per-
forming the work on the System to provide a Certificate of
Insurance naming the parties hereto an additional insureds. The
level and scope of insurance shall be set at commercially reason-
able limits depending upon the type and scope of services or
goods provided.
5. operator. Except as otherwise provided in para-
graph 6(c), the Trust shall be designated the operator and
Permittee of the System.
6. General provisions.
(a) Binding _Effect. The bovenants contained in this
Agreement shall run with the land and shall be binding upon and
inure to the benefit of the parties hereto and their respective
successors and assigns.
(b) Enforcement. In the event of a breach of any of
the covenants or agreements set forth in this Agreement, the
parties hereto shall be entitled to any and all remedies avail-
able at law or in equity, including but not limited to the equit-
able remedies of specific performance or mandatory or prohibitory
injunction issued by a court of appropriate jurisdiction. The
parties hereto agree that in the event it becomes necessary for
any party to defend or institute legal proceedings as a result of
the failure of either party to comply with the terms, covenants,
agreements and/or conditions of this Agreement, it is understood
and agreed that the prevailing party in such litigation shall be
entitled to be reimbursed for all costs incurred or expended in
connection therewith, including, but not limited to, reasonable
attorneys' fees (including appellate fees) and court costs.
If any of the parties fails to make the payments to the
Trust set forth in Section 2 within thirty (30) days after the
due date, the Trust shall have the right impose a lien upon the
real property of such defaulting party which shall become
effective upon recording a notice in the recording records of
King County, Washington, stating the amount due and the legal
description of the defaulting party's property. Such lien may be
enforced and foreclosed by the Trust by an action in like manner
as a mortgage of real property.
(c) Amendment. This Agreement may not be modified,
amended or terminated without the prior written approval of the
parties hereto. Provided, however, if the Trust or its successor
or assign ceases to exist or otherwise fails after written notice
from any party for a period of ninety (90) days to perform the
duties set forth in Section 1, the parties other than the Trust
by a vote of such parties obligated to make not less than fifty
percent (50%) of the reimbursement payments set forth in

Section 2(b) may elect another person or party to perform the

replacement, the approving parties may amend or modify this
Agreement as may be reasonably necessary to accomplish the
purposes of this Agreement.

this Agreement shall be effective unless it is in writing and
signed by the party against whom it is asserted, and any such
written waiver shall only be applicable to the specific instance
to which it relates and shall not be deemed to be a continuing or
future waiver.
(e) Captions. The captions and paragraph headings
contained in this Agreement are for convenience and reference
only and in no way define, describe, extend or limit the scope or
intent of this Agreement, nor the intent of any -provision hereof.'
(f) Cgunterparts. This Agreement may be executed in
counterparts, and each counterpart hereof shall be deemed to be
an original instrument, but such counterparts together shall
constitute but one Agreement.

Dear Mr. Anderson:
We request that you notify Lenora Blauman in the Planning Division of your
review of our proposed method to control the peak rate of runoff for the above
mentioned project. We propose to use the totally contained wetland to store
the peak runoff until the ground can absorb the flood water.
This 16 acre development is located in a closed depression at the lower end of
a 31 acre drainage basin consisting of one manufacturing building, an arterial
road, but mostly undeveloped land. Presently the contributing 100 year inflow
to the 3 acre wetland creates a shallow pond with depths of 6 to 24 inches.
Post development inflow will increase the depth of the pond by 6 inches which
is about 5 feet below the lowest elevation of the spur line which created this
closed depression.
Enclosed are the calculations and support data for the existing and future
drainage flows and wetland storage capabilities.

Dear Mr. Roed:
I have checked over your proposed control of runoff for the Blume Distribution Facility,
given to me by Dick Anderson. Based upon King County Drainage Standards, which are
accepted by the City of Renton, the storage requirements for a closed depression are a
100 year/7 day design storm, by use of the SCS Hydrograph method.
The calculations that you sent were for wetland storage, with infiltration of the soil
taken into account. These calculations will have to be revised to accommodate a 100
year/ 7 day storm. The infiltration rate must be supported by a Soils Engineer Report.
Since there will be significant impervious area added to this development, it will be
necessary to provide baffled oil/water separators before the runoff enters the wetland
area.

CONTAINER CORPORATION FACILITY ENCIRCLES THIS SITE FORMING A DIKE WITH NO
OUTLET FROM THE LOW AREAS. THE RAILROAD TRACK LOW ELEVATION IS 15.2 AND THE
SITE LOW ELEVATION IS 8.5. THIS SITE IS AT THE BOTTOM END OF A 34.1 ACRE
DRAINAGE BASIN CONSISTING MOSTLY OF UNDEVELOPED WOODS, BRUSH AND GRASS WITH A
PORTION CONSISTING OF MANUFACTURING AND ROADWAYS. THE DRAINAGE BASIN CONSISTS

b. A 3:1 aspect ratio between the trap length and width of the trap Is desirable. Length is
defined as the average distance from the Inlet to the outlet of the trap. This ratio is
Included in the computations for Figure 5.4.4C for the surface area at the interface
between the settling zone and sediment storage volume.
C. Determine the bottom and top surface area of the sediment storage volume to be
provided (see Figure 5.4.4C) while not exceeding 1.5' in depth and 3:1 side slope from
the bottom of the trap. Note the trap bottom should be level.
d. Determine the total trap dimensions by adding an additional 2' of depth above the
surface of the sediment storage volume, while not exceeding 3:1 side slopes, for the
required settling volume. (see Figure 5.4.4C)

HYDROLOGIC SOIL GROUP CLASSIFICATIONS
A (Low runoff potential). Sods having high infiltration rates, even when thoroughly wetted, and consisting
chiefly of deep, well-to-excesslvely drained sands or gravels. These soils have a high rate of water
transmission.
B. (Moderately low runoff potential). Soils having moderate infiltration rates when thoroughly wetted, and
consisting chiefly of moderately fine to moderately coarse textures. These soils have a moderate rate of
water transmission.
C. (Moderately high runoff potential). Soils having slow infiltration rates when thoroughly wetted, and
consisting chiefly of soils with a layer that Impedes downward movement of water, or soils with moderately
fine to fine textures. These sops have a slow rate of water transmission.
D. (High runoff potential). Soils having very slow Infiltration rates when thoroughly wetted and consisting
chiefly of day soils with a high swelling potential, soils with a permanent high water table, soils with a
hardpan or clay layer at or near the surface, and shallow soils over nearly Impervious material. These soils
have a very slow rate of water transmission.

1. Puget Power still requires complete application for electric service.
2. Puget Power has preliminary service design, which was distributed to several
attendees including City inspector.
3. Puget Power needs to relocate existing power pole and needs to excavate in City
right-of-way to intercept existing underground electrical facilities. Puget Power has
a permit in to City to perform this work.
4. Puget Power will require a short power outage to King County Flood Control
Facility - need to contact King County SWM. City will try to provide Mr. Rempe
with a contact person.
TELEPHONE. CABLE TV. WASHiNGTON NATURAL GAS:
1. No representatives from above three utilities were present, although they had been
informed of meeting by applicant, according to Mr. Garrison.
METRO WASTEWATER:
1. Mr. Mustereo of Metro's Wastewater Division was present at the meeting. Mr.
Mustereo mentioned presence of 96-inch Metro interceptor running through
property and Blume utility lines entering easements for this line at several points.
FIRE PREVENTION:
1. General Contractor will be SDL, address above.
2. Mr. Cole has a list of fire prevention comments he needs signed by the applicant
and returned.
3. A paved access road around the perimeter of the site is needed for fire vehicle
access around the building. Applicant stated that he believes ATB all weather

surface has been approved for this access road by fire prevention. Applicant should
make sure that any alternates to paving are approved by the Fire Marshall.
4. All existing fire hydrants must remain in service. All new hydrants should be
wrapped with burlap until accepted by the City.
5. Permits will be required for all on -site fuel storage tanks.
6. 24-hour advance notice should be given to Fire Prevention in preparation for
witnessing sprinkler system hydro test.
7. All closures of existing City water valves must be coordinated with the City of
Renton construction inspector in advance. A double check valve assembly will be
required on fire hydrant for construction Rater use. This may be obtained from the
City by contacting the 4th floor Customer Service counter and posting an $800
deposit.
8. Emergency vehicle access throughout the site must be maintained at all times.
9. Don Cole mentioned that the sprinkler system designer expressed concern about
having sufficient pressure available via the single 10-inch fire water line to the
building as designed. Don recommended that the applicant touch bases with the
sprinkler designer regarding this issue. A redesign might be required.
WATER:
1. TRI-M Construction is the utility contractor.
2. The City went through the required procedure for testing, flushing, and
chlorinating the water lines prior to connection to the City mains. Items discussed
include:
A) Vertical crosses are required at ends of water lines - these serve as pig launches
and sediment traps.
B) Water lines must be pigged out using polypig.
C Water lines must be pressure tested at 150 psi plus static head, which usually
works out to 200-220 psi.
D) Water lines must be chlorinated. No dry chlorine is allowed. Applicant rents a
pump and obtains chlorine from the City.
E) Water purity tests are required. City lab picks up purity samples on
Wednesdays. Applicant will need to use courier service to submit samples on
other days.
3. Water line flushing water should be drained into sanitary sewer only.
4. Water lines and fittings are to be polywrapped.
5. Thrust blocks must be formed. Concrete used must be delivered to the job (no on -
site mixes).

6. Construction staking is required for easements. Staking shall be marked so as to be
understandable to the inspector.
7. Applicant must sign authorization of special billing and water service application
forms.
8. Connections to City mains are made by the City. Contractor performs excavations
and supplies materials and the City crew makes the connection.
9. Crushed rock backfill to grade is required in City right-of-way.
10. The City asked who will be submitting as -built drawings. This was not yet
determined. All changes must be shown on as-builts.
11. 24-hour in advance inspection request is required. Inspection number is 277-5570.
All work must be inspected by City prior to backfill.
12. Major changes should be submitted to the City engineers from the applicant's
project engineer.
STORMNVATER:
The City expressed concern about which piping materials the applicant would use
for storm drain lines. The design calculations were performed around concrete
pipe, therefore, rougher pipe such as CMP is not an acceptable substitute. PVC
pipe is discouraged by the City in paved areas with less than 3' of fill. An acceptable
product would be CPEP (high density polyethylene pipe, corrugated exterior,
smooth interior). Fill depth is not as critical for this type of pipe. ADS N-12 or
Hancor Hi-Q are acceptable types of CPEP pipe. CPEP pipe only requires pea gravel
bedding to springline whereas PVC pipe requires pea gravel over the crown of the
pipe. The Contractor stated they will get back to the City on proposed pipe
materials after completing pricing comparisons.
2. The biofiltration swale should be the first order of work. Planting must take place
before biofiltration swales are placed into service. Overflows should be used until
biofiltration swales grasses are well enough established to accept flow.
3. An inspection tee is required on the downstream side of the oil/water separators.
4. Final adjustments to grade must be made on inlets and catch basins prior to paving.
5. Backfilling requirements are the same as for water mains: 95% compaction under
pavement, and crushed rock to grade in City right-of-way.
6. Applicant must continue to use previously approved temporary erosion control
plans.

SANITARY SEN ER:
1 Class 50 ductile iron pipe is required for sanitary sewers where fill is less than 4'
deep. The private portion of the sanitary sewer line should be ductile iron. For
applications where fill is between 4' and 15' deep, PVC may be used.
2. Changes must be submitted by the engineer to the City for approval.
3. Applicant is scheduled to start work Thursday on the sewer line.
4. Crushed rock backfill is required in City right-of-way. The City needs to receive an
analysis indicating that the proposed material meets WSDOT standards. Backfill
must be compacted to 95% in paved areas.
5. TV inspection will be required for both private and public portions of the new
sanitary sewer.
6. The note on the drawings where the new line connects into the City manhole
should read "12" core drill".
7. All sanitary sewer notes on plan drawings apply.
8. A submittal of the sewage pump shop drawings and plan drawings will be required
prior to connecting the sewer force main into the system.
9. Trench shoring and safety is the Contractor's responsibility. The appropriate
agencies will be notified if the City inspector sees significant safety violations.
10. Manholes must be channeled.
11. Final adjustments to manhole rims must be made prior to paving.
12. Plug existing manhole during construction.
13• If old septic tank or drain field is encountered during construction, applicant must
coordinate construction activities with the King County Health Department.

TRANSPORTATION:
NO.overloaded vehicles will be allowed. The City may optionally weight trucks to
make sure they are in compliance with load limits.
2. Truck hauling is restricted during the following hours:
7:00 - 8:30 a.m.
3:30 - 6:00 p.m.
3. Street cleaning bond of $5000.00 is required (building permit issue).
4. A commuter information center will be required within the building.
5. The TBZ mitigation fee is required (building permit issue).
6. The applicant must complete their agreement with the City to waiver protest of
formation of an L.I.D. for future improvements to Monster Road.
7. Applicant must submit an acceptable traffic control plan to the City (Phil Chase)
prior to construction. Mr. Garrison has been given informational material on this
item.

The following two provisions are being written into the construction permit:
A) No work will be allowed in the City right-of-way until adequate performance
bond has been posted.
B) Occupancy will not be granted until closure of the agreement between the
applicant and the City on the waiver to protest formation of an L.I.D. for future
improvements to Monster Road.
2. As -built drawings: survey records are very important. The City requires certified,
approved as-builts. All bends on waterlines should be shot, and horizontal and
vertical control for all bends established. Backfill should not be placed prior to
survey of waterline. The sewer line can be surveyed after backfill because
manholes give access to the lines.

I. Project Description
A. Location
The abandoned Diamond Mine is located in the SE1/4 SW1/4 Sec. 13,
T. 23 N., R. 4 E. The subsidence hole over the mine is located on
an active construction site of a flood control project in Renton,
Washington adjacent to Monster Road.
B. Pr•obl em
Subsidence occurred July 26, 1984, and was reported by the Soil
Conservation Service (SCS) to the Washington Department of Natural
Resources. The SCS is currently constructing a flood control
project in the area, and the site where subsidence occur•r•ed was
being used to stockpile fill material. The collapse occurred
after about 7 ft. of fill material had been placed on the site.
The hole was 25 ft. in diameter, 10 ft. deep, and had about 1 ft.
of water in the bottom.
C. Objective
The hazard would be abated by filling the hole with gravel.
II. Project Documentation
A. The subsidence occurred on July 26, 1984. Oal and the Washington
Department Natural Resources conducted a site investigation on
July 31, 1984.
B. On August 16, 1984, the Washington Attorney General declared the
Diamond Mine eligible for reclamation funding under P.L. 95-87.
C. The Right -of -Entry was signed by the city of Renton Public Works
Director- on August 9, 1984.
D. A construction contract was awarded to Renton Sand and Gravel on
August 9, 1984, and construction began and was completed on
August 10, 1984.
III. Costs
The anticipated project cost was $1,300. Renton Sand and Gravel completed
the construction for a total project cost of $1,280.
IV. Conclusion/Accomplishments
The subsidence hole was completely filled with 220 cubic yards of pit run
gravel. The total acreage reclaimed was less than .01 acres, but resulted
in the continued safety of the construction crew of about 30 men working in
the area.

I am in receipt of your inter -office memo dated March 21, 1990
regarding the environmental appeal filed by the Audubon Society
(letter dated March 19, 1990).
You have asked me if their appeal is timely. Their letter of
appeal is not timely because the Environmental Review Committee
imposed specific mitigation measures with the Determination of
Non -Significance. Because there were conditions, a fifteen (15)
day comment period was required by the City to solicit comments
from various agencies, jurisdictions, individuals and parties of
record. The 15 day comment period extended until March 20, 1990.
The comments we have received, including the concerns addressed
by the Audubon Society, will be evaluated by the Environmental
Review Committee, and then the Environmental Determination will
be finalized and the start of a fourteen (14) day appeal period
will commence. At that time their appeal would be valid. You
may want to ask them to put it on hold pending the outcome of the
ERC's reconsideration of this item at their next regular meeting
on April 4, 1990.

Seattle Audubon Society is comprised of 5,000 members and is
incorporated as a non-profit organization under the laws of the
State of Washington. The Society i-s dedicated to the
protection, preservation and enjoyment of wildlife, plants and
their supporting habitats, and to the wise use .of natural
resources. We are concerned about environmental issues
throughout King County including the City of Renton.
The above captioned proposal is being planned for 601 Monster
Road which is across the street from the Renton Heron Rookery.
The great blue herons associated with the rookery use the site
for feeding and foraging. The great blue heron is extremely
sensitive to the intrusion of human related activity. A variety
of other wildlife exists on and/or uses the site including
migrating, resting, foraging and nesting waterfowl; amphibians
and raptors. There are no mitigation measures .for the
significant adverse effect on wildlife.
The proposal is to fill .99 acre of the on site wetland.
Mitigating conditions for the loss of this portion of wetland
require the applicant to provide a revised wetland landscaping
plan.
The loss of this wetland area has not been fully considered and
evaluated. Alternatives to the proposal have not been
considered that would minimize the loss of the wetland area.
Since the City has not provided appropriate mitigating measures
in its declaration, Seattle Audubon Society formally appeals.the
Determination of Nonsignificance (Mitigated) of February 28,
1990.
