We plan to utilize this information to supplement the work to be performed for this project. We have also reviewed the Record of Survey prepared by Robert Mullen in Vol. 39, page 250, which delineates the property line to be staked. Based on this information and the map you provided, we offer this following proposal. DESCRIPTION OF PROPOSED WORK Purpose: Property line staling for new fence construction Area of Coverage: The north line of Tax Lot No.'s 793100-0126 in King County (A.K.A. Watershed Park Property). Total staking = approx. 1286 lineal feet of property line. The area to be staked is as shown on attached Exhibit Map. Description: All surveying will be tied to City of Renton NAD 83/91 horizontal control points. All survey work shall be conducted in accordance with City of Renton requirements. A control traverse will be run to tie in existing control. The north property line of Watershed Park property shall be brushed out and staked at 100' intervals and/or inter -visible points set along the property lines along with all angle points in said north line. In a subsequent conversation with you, Stephanie was informed that there is a second judgment lien against'the property While all of this.was.going on was contacted by James Lanphere at 253=854-8269 and Ms. Minh Nguyen at 2537773-258.1. Bothiof;these people claim some'sort of a possessory interest in the property through adverse possession oroiherwise. This City .of Renton's sole purpose in acquinngthis property. was to have it serve as open space and a buffer from our springs.: The City does not require the property at all. Therefore, it has been determined that the City will not.pursue this acquisition further unless and:until.the. Gallagher Estate or a subsequent owner takes care of the two liens and the two.claims just mentioned. I will calendar my file ahead for six months and contact you at that point. If clean title:can be delivered, at a reasonable.price; then the City:may elect to pursue this acquisition. As I explained in my letter of August 21, 2002, the City does not need this property. Further, there is an issue that needs to be addressed immediately regarding the placement of a fence around the City's property, which cannot wait until the liens and other clouds on the title can be cleared in order to purchase the Gallagher property. (P.A.C.E.). The City has decided not to purchase the Gallagher property adjacent to the Springbrook Springs site due to recent liens and claims against the property. We are now requesting P.A.C.E., to survey and stake the existing City -owned property boundary abutting the Gallagher property in order to reroute the security fence. F & H Fencing, Inc, the low bidder for the fencing contract, has agreed to realign the fence route at the original unit price bid. There are sufficient funds in the revised 2002 CIP budget to cover the costs of the additional survey and the fence installation. Purpose 1.1 The purpose of this specification is to provide a lionally recognized standard of quality for metallic -coated jel chain link fence fabric and when combined with rramework and accessory items, as specified in this publica- tion, shall provide a nationally recognized standard of quality for complete fence. 2. Scope 2.1 This specification gives the nomenclature, definition, and general requirements for metallic -coated steel chain link fence fabric and framework for industrial usage, as covered by ASTM A392 or ASTM A491. Residential usage is covered by ASTM F573. 3. Description of Terms 3.1 Chain Link Fence Fabric — A fencing material from steel wire helically wound and interwoven in such a manner as to provide a continuous mesh without knots or ties except in the form of knuckling or of twisting the ends of the wires to form the selvage of the fabric. 3.2 Knuckling — This term is used to describe the type of selvage obtained by interlocking adjacent pairs of wire ends and then bending the wire ends back into a closed loop. 3.3 Twisting — This term is used to describe the type of selvage obtained by twisting adjacent pairs of wire ends together in a closed helix of 1112 machine turns, which is equivalent to three full twists, and cutting the wire ends at a sharp angle to provide sharp points. The wire ends beyond the twist shall be at least 1/4 inch long. 3.4 Diamond Count — A term used to designate the num- ber of mesh openings in each height of fabric. Requirements 4.1 Materials 4.1.1 Base Metal— The base metal of the fabric shall be a good commercial quality of steel wire of the gages specified in Table I. The wire shall withstand the following breaking loads: No. 6 gage, 2,170 Ibs; No. 9 gage, 1.290 Ibs; No. 11 gage, 850 Ibs; No. 11112 gage, 750 Ibs. The break strength of the wire shall be determined in accordance with the requirements of 5.5.1. 4.1.2 Zinc Coating — The fabric shall be zinc -coated by the hot -dip process after fabrication. The weight of zinc coating shall not be less than 1.2 oz. per sq. ft. of actual surface covered when tested in accordance with 5.5.2. The zinc used for the coating shall conform to the grades specified in ASTM Designation 86 Standard Specification for Slab Zinc. 4.1.3 Aluminum Coating — The wire shall be aluminum coated by the hot -dip process before weaving into the fabric. The weight of aluminum coating for 6 gage and 9 gage shall not be less than 0.40 oz. per sq. ft. and for 11 gage shall not be less than 0.35 oz. per sq. ft. of actual surface covered when tested in accordance with 5.5.3. 4.2 Fabric Sizes — The height, diamond count, size of mesh, and wire diameters of chain link fabric shall be as given in Table I. The methods of measurement and tolerances are given in 4.2.1, 4.2.2 and 4.2.3 respectively. 4.2.1 Height of Fabric — The height of the fabric shall be the overall dimension from ends of twists or knuckles. The tolerance of the nominal height shall be plus or minus one ;--h. 2.2 Mesh Sizes — The size of mesh shall be determined uy measuring the minimum clear distance between the wires forming the parallel sides of the mesh, measured in either direction. The tolerance of the size of mesh shall be plus or minus Va inch. 4.2.3 Wire Diameter — The diameter of the coated wire shall be determined as the average of two readings measured to the nearest 0,001 inch taken at right angles to each other on the straight portion of the parallel sides of the mesh. The tolerance in the diameter of the coated wire shall be plus or minus 0.005 inch. 4.3 Selvage — Fabric 60 inches high and under shall be furnished with knuckling on both selvages. Fabric 72 inches high and over shall be furnished with knuckling on one selvage and twisting on the other. All 13/4 inch mesh fabric shall be furnished with knuckling at both selvages. Special selvages may be specified by the purchaser. 4.4 Workmanship — Chain link fence fabric shall be pro- duced by methods recognized as good commercial practice. The metallic coating shall be applied in a continuous process and shall not be applied to the fabric in roll form. Excessive roughness, blisters, sal ammoniac spots, frozen joints, bruises and flaking shall be noted. These and other obvious defects, if present to any considerable extent, may provide a basis for fabric rejection. 5. Inspection and Testing 5.1 General— The tests given herein are intended primari- ly for use as production tests in conjunction with manufactur- ing processes, inspection methods and with other tests if needed, according to 5.2, so as to insure the conformity of the chain link fabric with the requirements of this specification. 5.2 Production Inspection and Testing — During the proc- ess of manufacture, the manufacturer shall make such inspec- tions and tests as are needed to maintain the quality of the product so as to be consistently in conformity with this speci- fication. The inspection and tests given herein (see 5.3 and 5.5) shall be made regularly during production for all chain link fabric furnished as being in conformity with this specification. 5.3 Inspection — The chain link fabric shall be visually inspected to determine its conformance with the workman- ship, design and dimensional requirements of this standard. 5.4 Sampling — One roll from every 50 rolls or fraction thereof shall be selected at random for test purposes, but in no case shall less than 2 samples be selected from a shipment. The specimens for test purposes shall consist of individual pieces of wire taken from the outside end of the sample rolls. 5.5 Test Procedures 5.5.1 Breaking Strength —The break strength of the fabric shall be determined in accordance with the method described in ASTM Designation E8 Tension Testing of Metallic Mate- rials, using one specimen from each sample roll. Specimens to establish conformance to this requirement shall constitute individual pickets from a section of the fence fabric of a suffi- cient length so as to measure 15-18 inches after straightening. The straightened portion of the specimen shall be inside the jaws of the tensile testing machine so that the actual test is performed on the underformed section between the jaws. If fracture takes place, other than between the grips, the test shall be discarded. 5.5.2 Weight of Zinc Coating — The weight of zinc coating on the fabric shall be determined in accordance with the method described in ASTM Designation A90, using one piece of wire removed from the fabric of each sample roll. 5.5.3 Weight of Aluminum Coating — The weight of alumi- num coating on the fabric shall be determined in accordance with the method described in ASTM Designation A428, using one piece of wire removed from the fabric of each sample roll. 5.5.4 The specimen tested may be of any continuous length over 12 inches but preferably should be about 24 inches long. 2 5.6 Noncompliance — If any specimen tested fails to meet the requirements of this specification the roll represented by the specimen shall be rejected and two additional rolls shall be tested, both of which shall meet the requirements in every respect; otherwise the lot represented by the samples may be rejected. 2.13(d)ChL Applicable Documents: The following documents form a part of these specifications to the extent specified herein. MATERIALS— Posts, gate frames, braces, rails, stretcher bars, truss rods and tension wire shall be of steel. Gate hinges, post caps, barbed wire supporting arms, stretcher bar bands, and other parts shall be of steel, malleable iron, ductile iron or equal except that post tops, rail ends, ties and clips may be of aluminum. 4 �j4% 1.1 Intermediate post shall be Type I or Type II round pipe or 'C' roll formed section conforming to the dimensions and weight shown on Table Il. 1.1.1 Type I round post shall be hot dipped galvanized produced to conform with ASTM A-120 standard weight (Schedule 40) except the hydrostatic testing requirement is waived. 1.1.2 Type 1l round post shall be manufactured from steel conforming to ASTM A-569. cold rolled, welded and have a minimum tensile strength of 50,000 psi, given corrosion pro- tection by an exterior triple coating consisting of 1.0 ± 0.1 ounce per square foot zinc, 30 ± 15 micrograms chromate, 0.5 ± 0.2 mils clear polymer coating. The inside surface shall be given corrosion protection. The internal coating shall pro- tect the metal from corrosion when subjected to the salt spray test of ASTM B-117 for 350 hours with the end point of 5% Red Rust External corrosion test for Type II post. ZINC COATING — All steel and iron parts shall be zinc dated by the hot -dipped method, using zinc Grade "E." The weight of zinc coat on Type I rail, post and brace shall have not less than 1.8 ounces per square foot, zinc coating as specified in section 1.1.1. Type II steel rails, post and braces shall have an average weight of not less than 0.90 ounces per square foot as specfied in 1.1.2. Zinc weight shall be determined in accordance with ASTM A-90. 3. GATES — Gates shall be swing or sliding as specified, complete with latches, stops, keepers, hinges, or rollers and roller tracks, and when so specified, with provision for three strands of barbed wire above the fabric. 3.1 Gate Frames shall be constructed of tubular members welded at all corners or assembled with fittings. On steel, welds shall be painted with zinc -based paint. Where corner fittings are used gates shall have truss rods of Vie inch mini- mum nominal diameter to prevent sag or twist. Gate leaves shall have vertical intermediate bracing as required, spaced so that no members are more than 8 feet apart. Gate leaves 10 feet or over shall have a horizontal brace or one Vie inch minimum diagonal truss rod. When barbed wire top is speci- fied the end members of the gate frames shall be extended one foot above the top horizontal member to which 3 strands of barbed wire, uniformly spaced, shall be attached by use of bands, clips or hook bolts. Dimensions and weights of gate frames shall be as shown in Table If. 3.2 Gate Fabric shall be the same type as used in the fence construction. The fabric shall be attached securely to the gate frame at intervals not exceeding 15 inches. 3.3 Gate Hinges shall be of adequate strength for gate, and with large bearing surfaces for clamping in position. The hing- -%s shall not twist or turn under the action of the gate. The gates call be capable of being opened and closed easily by one person. 3.4 Gate Latches, Slops and Keepers shall be provided for all gates. Latches shall have a plunger -bar arranged to en- gage the center slop, except that for single gates of openings less than 10 feet wide a forked latch may be provided. Latches shall be arranged for locking. Center stops shall consist of a device arranged to be set in concrete and to engage a plunger bar of the latch of double gates. No stop is required for single gates. Keepers shall consist of a mechanical device for secur- ing the free end of the gate when in the full open position. 4. POST BRACES shall be provided for each gate corner, pull, and end post for use when top rail is omitted or with fabric 6 feet or more in height, and shall consist of a round tubular brace extending to each adjacent line post at approximately midheight of the fabric, and a truss consisting of a rod not less than 5/,6 inch nominal diameter from the line post back to the gate, corner, pull, or end post, with a turnbuckle or other equivalent provision for adjustment. Truss rods may be elimi- nated in any line of fence where there is a continuous center rail. 5. POST TOPS shall consist of ornamental tops or combina- tion tops with barbed-wire supporting arms, as specified. When so specified or when a top rail is to be provided, the top shall be provided with a hole suitable for the through passage of the top rail. The post tops shall fit over the outside of posts and shall exclude moisture from posts. 6. BARBED WIRE SUPPORTING ARMS, when specified to be furnished, shall be at an angle of approximately 450 or vertical as specified, and shall be fitted with clips or other means for attaching three strands of barbed-wire. With 45° ims the top wire shall be approximately twelve inches hod- intally from the fence line and the other wires spaced uni- formly between the top of the fence fabric and the outside strand. Barbed-wire arm shall be of sufficient strength to with- stand a weight of 250 pounds applied at the outer strand of barbed-wire. Six line barb wire V arm .may be specified if desired. 7. TOP RAILS shall be in lengths not less than 18 feet, and shall be fitted with couplings or swedged for connecting the lengths into a continuous run. The couplings shall be not less than 6 inches long, with .070 minimum wall thickness, and shall allow for expansion and contraction of the rail. Open seam outside sleeves shall be permitted only with a minimum wall thickness of .100 inches. Suitable ties or clips shall be provided in sufficient number for attaching the fabric securely to the top rail at intervals not exceeding 2 feet. Means shall be provided for attaching the top rail to each gate, corner, pull, and end post. Tension wire is required at top of fence if top rail is omitted. See paragraph 11. 8. TENSION BARS shall not be less than 3/,e by 3/4 inch and not be less than 2" shorter than the nominal height of the fabric with which they are to be used. One tension bar shall be provided for each end and gate post, and two for each comer and pull post. 9. TIES OR CLIPS of adequate strength shall be provided in sufficient number for attaching the fabric to all line posts at intervals not exceeding 15 inches; and not exceeding 24 inches when attaching fabric to top rail or tension wire. 10. BANDS OR CLIPS of adequate strength shall be pro- vided in sufficient number for attaching the fabric and stretcher bars to all terminal posts at Intervals not exceeding 15 inches. Tension bands shall be formed from flat or beveled steel and shall have a minimum thickness after galvanizing of 0.078 inch; and minimum width of 3/4 inch for posts 4" O.D. or less; and 0.108 inch thickness by 7/e inch for posts larger than 4" O.D. Brace bands shall be formed from flat or beveled steel and shall have a minimum thickness of 0.108 inch after galva- nizing; and minimum width of 3/4 inch for post 4" O.D. Standard mill tolerances of ±0.005 inch on thickness and .010 inch on width shall apply — attachment bolts shall be 5/,e x 11/4" galva- nized carriage bolts with nuts. 11. TENSION WIRE shall be Marcelled (spiralled or crimped) #7 gage (.177 in) plus or minus 0.005 inches in diameter. 11.1 Tension Wire Coating. Zinc -coated tension wire shall be Class III (0.80 oz. of zinc per square foot of uncoated wire surface). Aluminum coated tension wire shall have 0.40 oz. of aluminum per square foot of uncoated wire surface. 12 BARBED-WIRE shall consist of two strands of twisted wire with 4 point barbs on 5 inch spacing. I really don't want to contact the fence company, as this is your project rather than mine. At this point no one has contacted us from the fence company or made any noticeable difference to the property. In response to your letter I have made some comments, as your view is quite different from mine. Rebuttal to your No. 1: you are correct in the fence company removing some of my fence, as some fence is still present in the east section of the property where the fence company erected a new fence on your property. Contrary to your claim that the fence had no supports, it did have supports and most of them have been removed. They were stacked in a pile with the fencing near the trees that were removed. And as for your comment of the our fence being on city property that is an issue for an impartial survey and a court to decide not you since our surveys do not agree and you have not responded to the prior survey that you took the numbers from and had the opportunity to research yourself. The fence company installed the fence on city property on the east end of the property it did not on the west end. Rebuttal to your response No. 2: The iron pipe appeared to be a line marker of the existing line that was carelessly removed while clearing the ground cover on my side of the property. Rebuttal to your response No. 3A5 & 6: The ground cover included hazelnut trees that were up to approximately12 feet tall and are now in the pile of rubbish on the city side of the fence. You have suggested a remedy but have not followed through as far as I can see and your three feet varies to my fifteen feet. That is not very close. Rick, I would like to know by what authority that you might remove an existing fence to replace it with yours without the owner's permission! You write of encroachment and you require removal of structure and landscaping. By what authority do you ask for clearing and what law(s) do you cite to support your claim. At this time I have not seen any response to my remedies only rhetoric and I will not be satisfied by words alone. You are only speaking and writing and there has been no action to resolve the outstanding issues. As for the rest of the responses, you have made them technical and smaller in nature but they are still the same in my mind. As we observed together in the walkthrough the fence installed does indeed reside on my property on the east end. Had the fence been installed on the cities side of the property as we were told before it was installed this would not be an issue. I am asking that you take care of all of my remedies and move the city's fence to reside on city property only as on the west end of the property. If this is not resolved in a timely manner it will push me to refer this to someone else to handle this matter as you are not taking care of it yourself and consuming my time instead. Response to your claim No. 1: Damage to my property- "Removal of my fence " and your proposed remedy: "Move fence on east end of property line and replace your fence with like ". The City's contractor removed about 80 feet of your old galvanized 3-foot high -wire fence with no support posts. The wire fence was located within City property and our contractor removed it to install the new fence. We informed you by letter dated August 7, 2003, to remove any structures and landscaping that encroached on City property by September 15, 2003; otherwise the City would have it removed as part of our installation of the new fence. We are not relocating the new fence since it is installed on City property. Response to your claim No. 2: Damage to my property- "Removal of property line pipes and previous survey line markers. " The contractor removed a galvanized iron pipe marker in the vicinity of a property corner, which is in conflict with the new fence. Our surveyor has verified that the iron pipe is not a property corner and that your original property corner remains intact. We can install a new iron pipe near the undisturbed property corner. Upon finalization of this transaction, it is the intent of the City to install an 8-foot high chainlink fence, which will include a three -strand barbed wire arm extension (10-foot total height). The fence will be placed with a 2-foot setback inside of the City property line. The 2-foot set back will provide space to construct your own fence in the future or maintain your existing fence. Enclosed is a property survey map showing the location of our mutual property line. The map is provided so that you may identify structures, landscaping or personal property that you own which is encroaching on the City property. Structures, landscaping, or personal property encroaching on the City property must be removed by the owner or abandoned to allow for construction of the City's fence. Structures, landscaping, or personal property, which may contaminate the City's watershed may not be abandoned on City property but must be removed by the owner at the owner's expense. You have until Sunday, September 15, 2002, to remove any structures, landscaping or personal property which is encroaching on the City property, otherwise these items will be considered as abandoned an demolished as necessary to make way for the new fence. Construction of the fence is scheduled to begin in September 2002. You will be notified within two weeks of the actual construction start date. SyS7tMcr Although this matter has been on my mind, this is the first opportunity I have had to respond. I really don't want to contact the fence company, as this is your project rather than mine. At this point no one has contacted us from the fence company or made any noticeable difference to the property. In response to your letter I have made some comments, as your view is quite different from mine. Rebuttal to or response No. 1: you are correct in the fence company removing some of my fence, as some fence is still present in the east section of the property where the fence company erected a new fence on your property. Contrary to your claim that the fence had no supports, it did have supports and most of them have been removed. They were stacked in a pile with the fencing near the trees that were removed. And as for your comment of the our fence being on city property that is an issue for an impartial survey and a court to decide not you since our surveys do not agree and you have not responded to the prior survey that you took the numbers from and had the opportunity to research yourself. The fence company installed the fence on city property on the east end of the property it did not on the west end. Rebuttal to your response No. 2: The iron pipe appeared to be a line marker of the existing line that was carelessly removed while clearing the ground cover on my side of the property. Rebuttal to your response No. 3,4,5 & 6: The ground cover included hazelnut trees that were up to approximately12 feet tall and are now in the pile of rubbish on the city side of the fence. You have suggested a remedy but have not followed through as far as I can see and your three feet varies to my fifteen feet. That is not very close. Rick, I would like to know by what authority that you might remove an existing fence to replace it with yours without the owner's permission! You write of encroachment and you require removal of structure and landscaping. By what authority do you ask for clearing and what law(s) do you cite to support your claim. At this time I have not seen any response to my remedies only rhetoric and I will not be satisfied by words alone. You are only speaking and writing and there has been no action to resolve the outstanding issues. As for the rest of the responses, you have made them technical and smaller in nature but they are still the same in my mind. As we observed together in the walkthrough the fence installed does indeed reside on my property on the east end. Had the fence been installed on the cities side of the property as we were told before it was installed this would not be an issue. I am asking that you take care of all of my remedies and move the city's fence to reside on city property only as on the west end of the property. If this is not resolved in a timely manner it will push me to refer this to someone else to handle this matter as you are not taking care of it yourself and consuming my time instead.
