B. CO. CITY OF REMON whose post office address is City ball., Renton, -Washington hereinafter called the "Applicant", WITNESSETH: The Railway Company, for and in consideration of the sum of ten dollars ($10.00) paid by the Applicant on the execution and delivery hereof, the receipt whereof is hereby acknowledged, and of the covenants and promises hereinafter made to be observed and performed by the Applicant, does hereby grant to the Appl.want; license and permission to excavate for, construct, maintain and operate 20` inch casing pipe for carrying a 10- inch (14" at Bell) sanitary sewer hereinafter referred to as .the "facility," across the right of way of the Railway Company underneath the surface thereof, and under the tracks of its railway at or near Renton Station, in the County of tins , State of Washington , to be located as follows, to -wit: Under the Boeing Spur at Away Survey Station 14-65 I wn colored red on the plat hereto attached, marked "Exhibit A", and by this reference thereto made a part hereof. The Applicant in consideration of such license and permission, hereby covenants and promises as follows: 1. The Applicant at Applicant's sole cost and expense, shall excavate for, construct, maintain and repair the facility placing the same at least feet below the top..of tie The Applicant shall fill in the excavation, and restore the surface of the ground to its previous condition. All of the work shall be clone under the direction and subject to the approval of the Superintendent of the division of the Railway Company upon which the facility is located. 2. The Applicant, when required so to do by the Railway Company, at Applir.arrt's sole cost and expense, shall change the location of and reconstruct the facility, to permit and accommodate changes of grade or alignment and improvement in or additions to the facilities of the Railway Company doing allwork in connection therewith under the direction and subject to the approval of the said Superintendent. 3. The Applicant shall give to the said Superintendent due notice of any work to be done by the Applicant in the excavation, construction, maintenance, repair, change of location or removal of the facility, and shall conduct such work in such manner as not to interfere with the maintenance and operation of the railway of the Railway Company. 4. In the event that the Railway Company, at the request of the Applicant, or for the protection of its property and operations, does any work, furnishes any material or flagging service, or incurs any expense whatsoever on account of the excavation for, construction, maintenance, repair, change of location, or removal of the facility, the Applicant shall reimburse the Railway Company for the cost thereof within twenty (20) days, after bills are rendered therefor. The Applicant shall and hereby does release and discharge the Railway Company of and from any and all lia- bility for damage to or destruction of the facility or any other property of the Applicant upon the premises of the Rail- way Company in connection with the excavation for, construction, maintenance, change of location, operation or remov- al of the facility. The Applicant shall assume, and hereby does assume, all risk of and liability for any and all injury to or death of the Applicant while upon the right of way of the Railway Company in connection with the excavation for, construction, maintenance, change of location, operation or removal of the facility. The Applicant shall and hereby does further agree to indemnify and hold harmless the Railway Company of and from any and all liability, damages, recov- eries, judgments, costs, expenses, or other charges and demands on account of injury to or death of one or more persons, or damage to or destruction of the property of one or more persons, resulting from or during the construction, existence, maintenance, change of location, operation or removal of the facility. The Applicant further agrees to appear and de- fend in the name of the Railway Company any suits or actions at law brought against the Railway Company on account of any such personal injuries, death or: damage to property, and to pay and satisfy any final judgment that may be ren- dered against the Railway Company in any such suit or action. The liability assumed by the Applicant herein shall not be affected or diminished by the fact, if it be a fact, that any such suit or action brought against the Railway Company may arise in whole or in part out of the negligence of the R�ilway Company, its officers, agents, servants or employes, or be contributed to in whole or in part by such negligence. 6. The Applicant shall not transfer or assign this license and permission without the written consent of the Railway Company. 7. Nothing herein contained shall imply or import a covenant on the part of the Railway Company for. quiet enjoyment. 8. It is expressly understood and agreed that the Railway Company may at any time cancel and terminate this,. license and permission by giving to the Applicant thirty (30) days notice in writing of its intention to cancel the same and at the expiration of such notice this license and permission shall terminate. Upon receipt of such notice and before the expiration thereof, the Applicant, under the supervision and direction of the said Superintendent, or someone designated by him, shall remove the facility from the right of way of the Railway Company and restore the right of way and. premises of the Railway Company to such condition as shall be approved by the said Superintendent. If the Applicant shall fail to remove the facility and restore the said right of way to such approved condition by the time of expiration of the said notice, the Railway Company at its option may remove the same and restore the said right of way to its previous condition, and the Applicant shall pay the cost and expense thereof to the Railway Company. 9. Upon any failure of the Applicant punctually and strictly to observe and perform the covenants and promises' made herein, the Railway Company may terminate this agreement on ten (10) days notice to the Applicant, remove the facility, and restore the right of way to its previous condition at the cost and expense of the Applicant. 10. Any notices given under the provisions of this agreement shall be good if deposited postpaid in a United States postoffice addressed to the Applicant at Applicant's post office address above stated. 11. Subject to the foregoing provisions, this agreement and all of the covenants and promises thereof, shall inure to the benefit of and be binding upon the executors, administrators, successors and assigns of the parties. This web site is intended to provide you with all the information you should need to apply for a permit to access BNSF's property through JLL. Complete the application, print and mail with the following: • The $600.00 (non-refundable) processing fee, check made payable to BNSF Railway Company. BNSF requires the processing fee be sent with the application, or it will be returned. • Two sets of drawings of the area to be occupied. (Include: streets, distance from tracks and streets, mileposts if available and any distinguishing land marks.) Please ensure all information is accurate, as each change will add $600 to the processing fee. Permit Process: 1. Once received by JLL, the application and drawing will be forwarded to the engineering firm to prepare the Exhibit A drawings for the contract. This process takes approximately 10 to 15 working days. 2. When the Exhibit A is completed, a contract will be prepared and two (2) copies will be forwarded to you for an original signature. A letter will be sent to you that will provide directions regarding insurance. 3. Once received by your office, forward the signed contracts (2 copies with original signatures), along with the appropriate payment to JLL. 4. The final contracts, with original signatures, are presented to BNSF for execution provided payment has been received and insurance has been approved. 5. Once the contract is executed, one original will be returned for your files. 6. Prior to commencing any work on the Premises, Licensee shall complete and shall require its contractor (all parties who will be working on the site) to complete the safety training program at Internet Website http://www.contractororientation.com . This training must be completed no more than one year in advance of Licensee's entry on the Premises. 7. The cover letter for the executed contract will list the Roadmaster's name and phone number. You will need to contact the Roadmaster ten (10) days prior to beginning work. Process Time: Please be advised that the average time period for completion of this process is 45 to 60 days from the time that the application is received. Every effort will be to complete this process in a timely manner. Insurance Requirements for the following Agreements: Pipeline License, License for Overhead Pipe Truss or Conveyor • Commercial General Liability Insurance. Contractual liability with a combined single limit of a minimum of $5,000,000 each occurrence and an aggregate limit of at least $10,000,000. • Business Automobile Insurance. Combined single limit of at least $1,000,000 per occurrence. • Workers Compensation and Employers Liability Insurance. Employers' Liability with limits of at least $500,000 each accident, $500,000 by disease policy limit, $500,000 by disease each employee. • Railroad Protective Liability Insurance. Coverage of at least $5,000,000 per occurrence and $10,000,000 in the aggregate. • Pollution Legal Liability (PLL) Insurance (if necessary) in an amount of at least $5,000,000 per occurrence and 10,000,000 in the aggregate. Said easement is subject to the following terms and conditions: I. The Grantor, its successors and assigns, reserves the right to operate and maintain its present railway tracks and facilities, and to construct, operate and maintain future railway tracks and facilities on said premises. The rights herein reserved by the Grantor shall be superior to the rights herein granted to the Grantee, and the Grantee agrees that it will at its sole cost and expense and in a manner satisfactory to the Grantor make any change in the location or manner of construction or maintenance of said highway on said premises as in the opinion of Grantor may be necessary to permit Grantor to make the fullest practicable use of said premises or Grantor's adjoining lands for railway purposes. That any and all cuts and fills, excavations or embankments 1 ,i VOL 4955 Fu.U'r 639 necessary in the construction, maintenance or future alteration of said highway shall be made and maintained in such manner, form and extent as will provide adequate drainage of and from the adjoining lands and premises of the Grantor; and that wherever any such fill or embankment shall or may obstruct the natural and pre-existing drainage from such lands and premises of the Grantor, the Grantee shall construct and maintain such culverts or drains as may be requisite to preserve such natural and pre-existing drainage, and shall also, wherever necessary, construct extensions of existing drains, culverts or ditches through or along the railway embankment of the Grantor, such extensions to be of adequate sectional di- mensions to preserve the present flowage of drainage or other waters, and of materials and workmanship equally as good as in those now existing. This easement is subject to existing interests in the premises of whatsoever nature, and any and all extensions and renewals thereof. IV. The Grantee shall not use the property granted by this ease- ment for other than highway purposes. The Grantee shall not grant to any other person, persons, or organizations of any sort whatso- ever, including public or private utilities and transportation companies of any sort, permission to maintain any facilities on any portion of the premises described in this easement, the right to grant such permits being reserved to the Grantor; provided such permits shall not be granted where to do so would interfere with the use of the premises by the Grantee as herein provided. On Thursday, May 5, 2011, the City of Renton's Maintenance Shops were informed of an overflowing sanitary sewer manhole at the previously described location. City of Renton sanitary sewer manhole 5308-149 was found to have sewage overflowing out of it. The maintenance crew cleaned out the manhole but having found nothing that plugged it, decided to make periodic checks to monitor its performance. On Saturday, May 7, 2011, the City's maintenance personnel noticed that the manhole was starting to back up again. A decision was made to clean and TV inspect the downstream sewer main the following Monday. On Monday, May 9, 2011, the City's maintenance personnel attempted to clean and TV the sewer main between manholes 5308-149 and 5308-148. At this point, it was determined that there was a plug somewhere in the sewer. The TV camera crew was able to see the plug which was caused by many large rocks and dirt that entered through a broken section of sewer pipe. The location of the break was painted on the roadway surface and a call for utility locates was made. The City's Wastewater Utility Engineering Section contracted with a private contractor, Shoreline Construction Co., to perform an emergency repair. The City's maintenance personnel made periodic visits to the site to monitor the manhole for potential overflows until the sewer repair could be made on May 17, 2011. On May 17, 2011, Shoreline Construction Co. performed the necessary repair to the broken sewer main. An underground conduit was found to have raised the existing concrete sanitary sewer main, causing it to break and allow dirt and rocks to enter and plug the pipe. The utility locates lead from the area of the break to a fiber optic cable marker with "Starcom" on it. This sanitary sewer main was originally installed in 1969 however; it has only had sewage flowing through it since approximately 2008 when a new building with four residential units was connected upstream from it. TO FORM _PARTNERSHIP WITH STAR - COX INTERNATIONAL OPTICS AND XFB NETWORK TECHNOLOGIES TO BUILD TRANSMISSION LINE Greenstar Telecommunications Inc. announced that it has signed a letter of intent with Starcom International optics Corp. and MFS Network Technologies Inc. to form a partnership which will construct and operate a 181 mile fiber optic transmission line between Vancouver, British Columbia, and Seattle, WA. Upon signing a definitive agreement, Greenstar and Starcom will each have a 40 percent interest in the project, while MFS Network Technologies will have a 20 percent interest. The trans- action remains subject to regulatory approvals and further documentation. Starcom International Optics Corp. of Vancouver has already secured the requisite approvals from the Canadian Radio - television and Telecommunications Commission and the Washington Utilities and Transportation Commission to construct and operate the line. MFS Network Technologies will enter into a contract with the partnership to construct the transmission line and re- lated facilities, and, once complete, to operate the network. It is projected that the total cost of the project will amount to approximately US$20 million. When the line is operational, the partnership will offer digital private line and bulk bandwidth services to major inter - exchange carriers and large corporate and government users, for their voice, video and data requirements.
