Provide Contact Numbers to all SPU Contacts prior to Construction Page 1 of 4 FEES: $1,835 Permit Administration Fee 2 640 Right of Way Surface Use Fee. $44 a day, for 60 continuous days. $4,475 TOTAL NOTE: The $1,850 Permit Fee is for up to approximately 16 hours of SPU staff time. As of the signing of this Permit approximately 16 hours of SPU Staff time have been utilized. If during pre - construction meetings, construction, operation or removal of the temporary by-pass it is likely that significantly more SPU staff time is required, Renton agrees to reimburse SPU for those hours at the rate of approximately $100 per hour. SPECIAL TERMS and CONDITIONS: 1. SPU's expects to commence a Cathodic Protection Project at the same time as the Sewer By -Pass construction and operation. SPU's project will begin just West of 124 h Avenue SE, and extend West along the right of way to the exposed SPU water pipelines at Tiffany Park, then extend from the West end of the exposed pipelines for several hundred more feet. 2. The Sewer By -Pass operation could potentially be in conflict with the Cathodic Protection Project. 3. The Sewer By -Pass operation could potentially be a barrier to access to, and along, the pipeline right of way. 4. Therefore, as early as possible, but at least 30 days prior to entering SPU property, the City of Renton must contact SPU's Engineering Section (contacts listed herein) and SPU's Operations, Pipeline Crew Chief to arrange for an pre -construction meeting to determine working protocols during the construction, operation, and decommissioning of the by-pass line. 5. A SITE SECURITY PLAN may be required: Contact Dale Clark, SPU Security (206-386-9061) 6. Contact Kathi Illman, SPU Crew Chief to arrange for gate access and or removal of guard rails. GENERAL TERMS and CONDITIONS 1. SPU reserves the right to stop permitted activities, or ask for a change in the way the activities are being performed, if in the judgement of SPU personnel, there is a risk to SPU facilities, people, or adjacent property. 2. A copy of this permit must be available on -site at all times the permit area is being utilized by the Permittee. 3. It will be the responsibility of the Permittee to police the permit area during the term of this permit. 4. Permittee agrees to comply with all applicable laws and regulations, and is solely responsible for determining the need for and obtaining all permits required in order to complete Permittee's construction activities and use. Terms and conditions contained herein shall not be construed to replace or to be used in lieu of any permit or licenses which may be required, granted or supervised by any other agency or subdivision of government. Permittee shall maintain the Permit Area and City Property in a safe, orderly, fit and sanitary condition during construction and use and upon completion of construction or termination of this Permit. 6. Permittee shall remove all equipment, materials, and debris, and restore any damage to the right of way due to the use authorized by this Permit. 7. Permittee understands and agrees not to allow any vehicles, equipment, or materials within the right of way unless approved in writing by SPU engineering or on -site SPU staff. Page 2 of 6 8. All work to be prosecuted with diligence, and with due respect to all property, contracts, persons, rights and the interests and convenience of the public. 9. Permittee shall ensure that no erosion, excavation, runoff, pollution, siltation or turbidity from its activities shall adversely affect the right of way or the surrounding environment. 10. Permittee shall restore City's survey monuments or right of way markers if such monuments are damaged, destroyed or moved as a result of its activities within the Permit Area. 11. Permittee has not relied on City for assessing site conditions or determining the suitability of the site conditions to accommodate Permittee's construction activities. 12. Permittee shall maintain and agrees that its contractor shall also at all times maintain commercial general liability insurance and excess/umbrella liability insurance if necessary with an insurer approved by the City, naming the City as an additional insured, with minimum limits of $5,000,000 each occurrence combined single limit bodily injury and property damage with per project aggregate per ISO CG 25 03 (Aggregate Limits of Insurance per Project) or equivalent with no exclusion for acts of independent contractors. "The City of Seattle" shall be an additional insured for primary and non-contributory limits of liability including products additional insured for a period of not less than three years following completion of work. In addition, the CGL insurance shall not exclude XCU or subsidence perils. Certification shall be issued to, and approved by, the City prior to mobilization of any contractor on site. Certification shall be issued to: Seattle Public Utilities, The City of Seattle, P.O. Box 34018, Seattle, WA 98124-4018, and shall be emailed in PDF format to bob.gambill@seattle.gov. Certification shall include an actual copy of the policy provisions documenting additional insured status with products and completed operations. Failure to maintain said policy shall terminate this Permit Agreement. Permittee may self -insure or provide commercial insurance. 13. REQUIRED SEPARATION OF INSURED PROVISION; CROSS -LIABILITY EXCLUSION AND OTHER ENDORSEMENTS PROHIBITED: Both Permittee's and Contractor's insurance policies shall include a "separation of insureds" or "severability" clause that applies coverage separately to each insured and additional insured, except with respect to the limits of the insurer's liability. Permittee's and Contractor's insurance policies shall not contain any provision, exclusion or endorsement that limits, bars, or effectively precludes the City of Seattle from coverage or asserting a claim under the Permittee's and Contractor's insurance policies on the basis that the coverage or claim is brought by an insured or additional insured against an insured or additional insured under the policy. Permittee's and Contractor's CGL policies shall NOT include any of the following Endorsements (or their equivalent endorsement or exclusions): (a) Contractual Liability Limitation, (CGL Form 2139 or equivalent), b) Amendment Of Insured Contract Definition, (CGL Form 24 26 or equivalent), (c) Limitation of Coverage to Designated Premises or Project, (CGL Form 2144 or equivalent), (d) any endorsement modifying or deleting the exception to the Employer's Liability exclusion, (e) any "Insured vs. Insured" or "cross -liability" exclusion, and (f) any type of punitive, exemplary or multiplied damages exclusion. Failure to comply with any of the requisite insurance provisions shall be a material breach of, and grounds for, the immediate termination of the Agreement with the City of Seattle; or if applicable, and at the discretion of the City of Seattle, shall serve as grounds for the City to procure or renew insurance coverage with any related costs of premiums to be repaid by Permittee or reduced and/or offset against the Permit. 14. Permittee and Contractor shall provide two separate documents that we refer to as "Certification": (Copy Attached) a. A Certificate of Insurance — usually referred to as an ACORD Certificate — issued to "The City of Seattle" in the box in the lower right-hand corner that says Certificate Holder. This should be Page 3 of 6 addressed to Seattle Public Utilities, The City of Seattle, P.O. Box 34018, Seattle, WA 98124- 4018. b. Evidence of additional insured status for the City. The box above the certificate holder's name may say that the "certificate holder is included as an additional insured — see form CG 20 12" or similar verbiage. The insurance Broker must also provide an actual copy of the CG 20 12 form that documents that the City of Seattle has been added to the schedule as an additional insured. All Permittee's operations or activities on or occupancy of the right of way including without limitation any use or occupancy by any employee, agent, representative, licensee, consultant, contractor or licensee of Permittee, shall comply with all Environmental Laws (as defined in section 16.13), including those governing, or in any way relating to, any Hazardous Substance (as defined in section 16.C). If City's property becomes contaminated as a result of actions hereunder by Permittee and/or Permittee's employees, agents, consultants, contractors, representatives or licensees, Permittee shall clean up and remediate such contamination as necessary to bring the property in compliance with Environmental Laws. If Permittee does not so act in a prudent and prompt manner, City reserves the right, but not the obligation, to act in place of Permittee and to take such action as City deems necessary to ensure compliance or to mitigate the violation. All reasonable costs and expenses incurred by City in connection with any such actions shall become immediately due and payable by Permittee upon City's presentation of an invoice therefor. B. For the purposes of this Permit Agreement, the term "Environmental Law(s)" means any local, state or federal law, regulation, ordinance, order or other source of law, now or hereafter in effect relating to the protection of human health or the environment including, but not limited to: the Federal Clean Air Act; the Federal Water Pollution Control Act; the Federal Safe Drinking Water Act; the Federal Comprehensive Environmental Response Compensation and Liability Act, as amended by the Superfund Amendments and Reauthorization Act of 1986; the Federal Resource Conservation and Recovery Act, as amended by the Solid and Hazardous Waste Amendments of 1984; the Federal Occupational Safety and Health Act; the Federal Emergency Planning and Right -to -Know Act of 1986; the Federal Hazardous Materials Transportation Control Act of 1980; the Federal Water Act of 1977; the Federal Insecticide, Fungicide and Rodenticide Act; the Federal Waste Management Recovery and Recycling Act; the Washington Hazardous Waste Management Act; the Washington Hazardous Waste Fees Act; Washington Model Toxics Control Act; the Washington Nuclear Energy and Radiation Act; the Washington Radioactive Waste Storage and Transportation Act; the Washington Underground Petroleum Storage Tanks Act; and any regulations promulgated thereunder from time to time. C. For purposes of this Permit Agreement, the term "Hazardous Substance(s)" means any and all dangerous, hazardous or toxic substances, materials, wastes, pollutants or contaminants regulated under or subject to any Environmental Laws, including but not limited to those substances, materials and wastes listed in the United States Department of Transportation Hazardous Materials Table (49 C.F.R. § 172.101) or by the United States Environmental Protection Agency Page 4 of 6 as hazardous substances (40 C.F.R. pt. 302 and amendments thereto) or in the Washington Hazardous Waste Management Act (Ch. 70.105D RCW) or the Washington Model Toxics Control Act (Chs. 70.105D RCW 82.21 RCW), petroleum products and their derivatives, and such other substances, materials and wastes as become regulated or subject to cleanup authority under any Environmental Law. 17. Permittee shall indemnify City as follows: A. Permittee shall release, defend, indemnify and hold harmless City and its officials, employees, agents, licensees, contractors, consultants and representatives (collectively, the "Indemnitees") from and against any and all claims, liens, demands, actions, costs, including defense costs, losses, expenses, harm, damages, and liability of any kind or character for any damage or injury to any person or property, asserted or arising from, on account of, or caused by (i) Permittee's exercise of its rights or obligations under this Permit Agreement, (ii) the acts or omissions of Permittee and/or Permittee's employees, agents, consultants, contractors, representatives, or licensees in or upon the right of way, or (iii) the existence of, damage to, or failure of any of Permittee's improvements both on and off the right of way; provided, however, nothing herein shall require Permittee to so indemnify and hold harmless City for the sole negligence of City, its officials, employees, agents, consultants, contractors, representatives, or licensees; and provided further, that if a court of applicable jurisdiction, all appeals having been exhausted or appeals periods having run, determines that RCW 4.24.115 applies to this section 17.A, Permittee's indemnity obligations hereunder for damages arising out of bodily injury to persons or damage to property caused by or resulting from the concurrent negligence of the Indemnitees and Permittee and/or Permittee's employees, agents, consultants, contractors, representatives or licensees shall be limited to the extent of the negligence of Permittee and/or Permittee's employees, agents, consultants, contractors, representatives or licensees. B. Permittee shall release, indemnify, defend and hold harmless the Indemnitees from and against all claims, actions, regulatory demands, judgements, liens, damages, harm, penalties, fines, costs, expenses, liabilities or losses (including, without limitation, clean up or remedial costs, injuries to third persons, sums paid in settlement of claims, reasonable attorneys' fees, consultant fees, and expert fees) which are imposed on, paid by, or asserted against the Indemnitees in connection with any violation of Environmental Law by Permittee and/or Permittee's agents, licensees, contractors, consultants or representatives. C. As between the parties and solely for the purpose of effectuating the indemnities contained in subsections A and B of this section 17, Permittee expressly waives any immunity, defense or protection that may be granted to it under the Washington State Industrial Insurance Act, Revised Code of Washington Title 51 or any other industrial insurance, workers' compensation or similar laws of the State of Washington. This section shall not be interpreted or construed as a waiver of Permittee's right to assert any such immunity, defense or protection directly against any of its own employees or such employee's estate or other representatives. This section ITC has been mutually negotiated by the parties. 18. The Permittee is responsible for limiting the use of the right of way to those approved in the Permit. 19. The Permittee agrees that the actions of any contractors, agents or invitees of the Permittee are considered to be the same as if performed or caused by the Permittee. 20. This permit is revocable upon thirty days notice by Seattle Public Utilities. 21. This permit is not transferable. Renton's Contractor requests to utilize the SPU CRPL and ESSL right-of-ways (in the Tiffany Park neighborhood of Renton) for the temporary installation of an above -ground sewer bypass pipeline. I The temporary sewer bypass pipeline will approximately 6,400 feet in length. Size will be 12" to 18" and steel pipe with Victaulic couplings. Attached is a vicinity map of the project area showing the proposed temporary sewer bypass route. SPU Requirements and Other Information: 1. SPU must be reimbursed for its costs associated with this request. The 2016 SPU Standard Charge is $1,835 which equates to approximately 15 hours of SPU staff time for the purpose of intake, project/plan review, document preparation, and a limited amount of on the site inspection. If it is determined by SPU that more significant staff time will be required, time and material may be charged. 2. SPU must be provided for its approval; a schematic of the installation, specifications of the materials to be used, and methods and equipment to be used for the placement and removal. 3. Upon the submission of this Request for Service to SPU will send and invoice in the amount of $1,835. SPU will not work on this request until payment is made. 4. The Use fee will be based on the $ per square value of the neighborhood property. The permit area will be based on a 4 foot wide strip of land x the length of the pipe. EXAMPLE: $10 per square foot x 4' wide = $40 per linear foot x a 50% barrier factor = $20 per foot x a 10% rate of return = $2 per linear foot x 6,400 feet = $12,800 annually, or $35.09 per day. Minimum pricing term is 120 days = $4,210. An invoice will be sent to the City of Renton prior to the start of the Project. 5. A Right of Way Use Permit will be prepared for review by the City of Renton. The Permit will be issued to the City of Renton, not the contractor. 6. $1,000,000 Liability Insurance will be required, as well as indemnification by the City of Renton. 7. E., Administrator August 30, 2016 Mr. Kevin Rose 2709 SE 16th Street Renton, WA 98058 RE: Cascade Interceptor Rehabilitation Project Construction Complaints Dear Mr. Rose: Thank you for your letters dated August 14 and August 24, 2016, regarding the City of Renton's Cascade Interceptor Rehabilitation project. I would like to apologize for the inconvenience that the work created for you and your neighbors and offer an explanation of the project and the specifics of the construction method that was used. The purpose of the Cascade Interceptor Rehabilitation project is to rehabilitate the existing 24" diameter concrete sanitary sewer interceptor that serves the Tiffany Park neighborhood and a large portion of Soos Creek Sewer District's service area. This sewer interceptor, which was originally installed in 1963, is approximately 4,800 feet long and was showing signs of significant deterioration due to the hydrogen sulfide gases that are often present in sanitary sewer systems. To minimize disruption to the neighborhood, the City chose to utilize a trenchless method of rehabilitating the existing sewer interceptor. This method allowed the entire sewer interceptor to be rehabilitated within three weeks where as a traditional open - cut replacement would have taken approximately nine months and closed some of the streets for weeks. The City chose to use Cured -in -Place Pipe (CIPP) as the trenchless method for this rehabilitation work. The advantage of this method is that it allows for the rehabilitation of several hundred feet of sewer main each day without any excavation. The disadvantage is that once the lining process begins, it cannot be stopped until it is completed. Insituform Technologies has installed several thousand feet of CIPP liner for the City of Renton on past projects without any problems. Unfortunately, the lining process that took place on August 13 had issues that doubled its estimated installation time and caused work to continue into the night and early morning. With respect to this project, we did not plan to work at night so no noise regulation requirements were applied to the project. Regrettably, the problems we encountered caused the need for the crew to continue their work through the night. We apologize for the disruption and inconvenience, and will continue to place a high priority on limiting night work on our projects, and mitigating the noise when night work is necessary. However, based upon the assessment of the City Attorney, state and city laws and regulations were not violated due to the exemption provided for work necessary in the interest of health, safety and welfare of the community. I apologize for any unprofessional conduct that the contractor or their flagging subcontractor directed toward you. I have notified Insituform's project manager of this incident and asked him to remind their employees to be respectful of the public and perform their work in a professional manner. I had initially intended to deliver this to you on Monday August 15. Upon awaking on Monday August 15, 1 did not notice any work being performed outside of my home. Even though I felt I had been adversely impacted by a non -emergency repair for 20 hours and 6 minutes, I believed at this time that the work was complete and I was not going to forward the letter to you. But after the events that occurred this past weekend on Saturday August 20 and Sunday August 21, 1 now feel compelled to not only forward to you the letter dated August 14 but also another letter informing you of additional work that I thought was complete being performed by Insituform in my neighborhood. On Saturday August 20 before 7:45 AM I was awakened by construction activity being performed in my neighborhood. Later that day as I was driving through the neighborhood I noticed Insituform performing work about a half a block from my home at the intersection of Lake Youngs Way SE and Index Court SE. As I was driving through the work zone, I observed a driver approaching from the opposite direction stopped in the road and seemingly confused how to proceed through the work zone. At the time 1 did not observe any flaggers on site to safely direct traffic through the work zone. Also at the time, I once again did not see a representative from the City of Renton overseeing the work to speak to regarding this matter. The work concluded around 8:00 PM that day. Later the next day on Sunday August 21 at about 5:15 PM as I was standing outside the front of my home, I observed an Insituform pickup truck driving eastbound on SE 161" Street directly in front of my home with the driver honking his horn at me. I believe that this was possibly the same Insituform worker in the same truck that had driven past my home on Sunday August 14 at 3:21 AM repeatedly sounding his horn as if to get my attention. Even though some individuals may consider this juvenile behavior, I consider this continued retaliation and harassment for notifying Renton Police on Saturday August 13 of a noise ordinance violation and I would like this matter to be investigated as such. In conclusion, once again the City of Renton has legal responsibility for the actions of its employees and contractors. Therefore I request that the following matters be investigated: Why for a non -emergency repair were the contractors allowed to work outside of the noise ordinance when there was no legal notice posted requesting a variance. Why the work being performed is being done in an unsafe manner. Grady Way Renton, WA. 98057 Dear Honorable Mayor Law; This letter is an account of a city contracted job with a subcontractor Insituform in the Tiffany Park neighborhood, a residential area, at the intersection of SE 16`h Street and Lake Youngs Way SE that went horribly wrong. The workers commenced work on Saturday August 13 at 7:15 AM and did not conclude work till Sunday August 14 at 3:21 AM - 20 hours and 6 minutes later. Per City of Renton code 8-7-8; C. Public Notice and Hearing: A public hearing shall be required for all noise variances which are greater than two (2) days in duration. For those variance requests of two (2) days or less in duration, the variance decision shall be made by the Administrator or his/her designee following the public notice process At 7:15 AM on Saturday August 13 1 was rudely awakened by major work being conducted outside of my home. At 7:15 AM I told the worker that there is a noise ordinance on the City of Renton and that work could not proceed till 9 AM and l requested the worker to stop the work immediately. The worker promptly ignored my request. At 7:15 AM I promptly contacted 911 immediately identifying the call as a noise complaint and requesting police officers assistance. As work was still proceeding from 7:15 AM, at 8:30 AM I spoke with the contractor's foreman, Adam. Regarding their work outside of the noise ordinance. At this time there was not a representative from the City of Renton on site overseeing this work to speak to regarding this matter. At 8:38 AM Renton Police Officer Cummins responding to the scene notified me that he was going to look into the matter. The work continued throughout the day. At 6:00 PM I thought the work would have concluded for the day. I walked to the job site and not only did l notice the work still proceeding but at the time I also noticed a lack of adequate traffic control at the job site. This was evidenced by traffic heading eastbound on SE 161h Street stopping at the intersection of SE 16'h Street and Lake Youngs Way SE stopping and confused r how to safely proceed through the intersection. There were two flaggers assigned to the job site. One flagger was stationed in the road on Lake Youngs Way SE on the north side of the intersection of SE 161" Street and Lake Youngs Way SE. The other flagger that could have been directing traffic on the west side of the intersection, where the majority of the traffic observed was travelling from and proceeding eastbound on SE 16'h Street, the flagger was seen constantly standing on the sidewalk on the northwest corner of the intersection and not in the road safely directing traffic through the work zone. As the constant machinery noise and work was still proceeding, I contacted 911 again immediately identifying the call as a noise complaint. The 911 operator had told me that the work was authorized till 8 PM outside of the noise ordinance. After being exposed at this time to constant machinery noise for 11 hours I was horrified. This was a maintenance project, not an emergency repair. Per Renton City Code 8-7-8 C there was no legal notice posted in the Renton Reporter requesting a variance from the noise ordinance. At 8 PM as the constant machinery noise and work was still proceeding, I again contacted 911 immediately identifying the call as a noise complaint. At 8:34 PM Renton Police Officer Jacobs responded. At that time there was not a representative of the city of Renton on site to speak to regarding the matter. I attempted to contact the contractors foreman, Adam, as to why the work was still proceeding. I was told by the contractor's employee that Adam was not on site as well. I requested Renton Police Officer Jacobs to issue a violation of the noise ordinance to the contractor. Officer Jacobs stemly responded to me "Don't tell me how to do my job." Officer Jacobs than requested that I stand aside telling me that he would speak to the workers and later inform me as to what was happening. Renton Police Officer Jacobs later notified me that he was not stopping the work and that the City of Renton had authorized the contractor to work past 8 PM if additional hours were needed. The work did not stop till Sunday August 14 at 3:21 AM. Renton Police Officer Jacobs left the scene at 8:41 PM with work still being conducted. Work proceeded after sunset till Sunday August 14 at 3:21 AM at an extremely dark intersection till Sunday August 14 at 3:21 AM with no additional lighting brought in by the contractor to safely illuminate the work area. I went to bed at 10:50 PM with work still being performed outside of my home. On Sunday August 14 at 2:01 AM I was rudely awoken by the flaggers directly outside of my home. I told the flaggers that they need to stop making noise outside. The flaggers were very rude to me making a joke of the situation. The male flagger responded to me "Happy New Year' and "there goes the neighborhood" while the female flagger sat in the truck laughing about the whole situation. On Sunday August 14 at 2:40 AM the majority of the workers left the area. As a big truck was driving by the driver sounded the hom. I thought that the worker was maybe sounding his horn to notify the other workers that he was leaving. On Sunday August 14 at 2:57 AM another truck had proceeded through the intersection sounding his horn. I had thought that maybe the driver was alerting to other traffic approaching the intersection, but there was no other traffic there. On Sunday August 14 at 3:21 Am the last truck left. There were no other workers on site. The driver drove literally right by my home sounding the horn multiple times as if to get my attention. The work initially commenced on Saturday August 13 at 7:15 AM and after 20 hours and 6 minutes, with constant machinery noise for at least 14 hours, the work concluded on Sunday August 14 at 3:21 AM. Between having Renton Police on site on Saturday August 13 at 8:38 AM and again at 8:34 PM, between the rude comments from the flaggers and the contractors honking their horns, I believe that this was harassment directed towards me by the workers in retaliation for making complaints to the Renton Police concerning the noise ordinance. I am hereby requesting that this issued be investigated as a harassment matter. In conclusion, the City of Renton has a legal responsibility for the actions of its employees and contractors. I would therefore like the following matters to be investigated: Why for a nonemergency repair was the contractors work hours allowed to work outside of the noise ordinance when there was no legal notice posted requesting a variance from the noise ordinance. Why the work being performed was done in an unsafe manner: I did not observe a representative of The City of Renton nor did I observe the contractor's foreman on site for the 20 hours and 6 minutes that the work was being performed. The flaggers were not safely performing traffic control on the site, and after dark for approximately 6 hours and 36 minutes there was not adequate lighting brought in to safely illuminate the work site. And finally I would like the flaggers and contractors actions directed towards me investigated as retaliation and harassment for notifying Renton Police of a noise ordinance violation. Thank you for your attention to this matter; Kevin Rose /�-- 4 /L, August 30, 2016 Mr. Kevin Rose 2709 SE 161h Street Renton, WA 98058 RE: Cascade Interceptor Rehabilitation Project Construction Complaints Dear Mr. Rose: Thank you for your letters dated August 14 and August 24, 2016, regarding the City of Renton's Cascade Interceptor Rehabilitation project. I would like to apologize for the inconvenience that the work created for you and your neighbors and offer an explanation of the project and the specifics of the construction method that was used. The purpose of the Cascade Interceptor Rehabilitation project is to rehabilitate the existing 24" diameter concrete sanitary sewer interceptor that serves the Tiffany Park neighborhood and a large portion of Soos Creek Sewer District's service area. This sewer interceptor, which was originally installed in 1963, is approximately 4,800 feet long and was showing signs of significant deterioration due to the hydrogen sulfide gases that are often present in sanitary sewer systems. To minimize disruption to the neighborhood, the City chose to utilize a trenchless method of rehabilitating the existing sewer interceptor. This method allowed the entire sewer interceptor to be rehabilitated within 3 weeks where as a traditional open -cut replacement would have taken approximately 9 months and closed some of the streets for weeks. The City chose to use Cured -in -Place Pipe (CIPP) as the trenchless method for this rehabilitation work. The advantage of this method is that it allows for the rehabilitation of several hundred feet of sewer main each day without any excavation. The disadvantage is that once the lining process begins, it cannot be stopped until it is completed. Insituform Technologies has installed several thousand feet of CIPP liner for the City of Renton on past projects without any problems. Unfortunately, the lining process that took place on August 13 had issues that doubled its estimated installation time and caused work to continue into the night and early morning. Mr. Kevin Rose Page 2 of 2 August 30, 2016 Even though many Public Works projects are exempt from requiring a noise variance, the Department implements the typical requirements of noise regulations. With respect to this project, we did not plan to work at night so no noise regulation requirements were applied to the project. Regrettably, the problems we encountered caused the need for the crew to continue their work through the night. We apologize for the disruption and inconvenience, and will continue to place a high priority on limiting night work on our projects, and mitigating the noise when night work is necessary. However, based upon the assessment of the City Attorney, state and city laws and regulations were not violated due to the exemption provided for work necessary in the interest of health, safety and welfare of the community. I apologize for any unprofessional conduct that the contractor or their flagging subcontractor directed toward you. I have notified Insituform's project manager of this incident and asked him to remind their employees to be respectful of the public and perform their work in a professional manner. The low bidder was Insituform Technologies, LLC. with a bid of $752,904.32. There were no errors in any of the bids. The project budget amount for the Central Renton Sewer Interceptor Reline & Upsize project (426.465507) is $900,000. The low bid for the Cascade Interceptor Rehabilitation Phase II project is within the amount approved in the 2015 budget for this project. The temporary bypass pipeline would be placed on the surface of the ground along the Seattle Pipeline ROW (See Exhibit 1) and buried where it crosses Kirkland Ave SE and SE 16th PL. The proposed surface work will occur within wetland and stream buffers (near Tiffany Park Subdivision and Ginger Creek), high erosion hazards, moderate and very high landslide hazards, protected and sensitive slopes, and high seismic hazards. No impacts to these critical areas are anticipated with this temporary surface pipeline. The proposed excavation will be within the existing roadways & sidewalks of the streets. No excavation is proposed within critical areas or geologic hazards, however excavation will occur within 50 feet of a moderate coal mine hazard where the Kirkland Ave SE intersects the Seattle Pipeline ROW. No impacts to the moderate coal mine hazard are anticipated. The temporary bypass pipeline will be a combination of 18" and 12" diameter pipes. The existing permanent sewer system that it is bypassing is 24" diameter. The temporary pipeline would be in place for approximately 37 days. Once the maintenance is complete, the temporary pipeline will be removed, and the sewage will once again flow through the permanent downstream system. The project is exempt from SEPA Per WAC 197-11-800 (3). If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility.
