A variance is a means by which citizens may be granted relief from the strict application of the provisions of certain land use regulations. The process is intended to review situations where uniform requirements would unduly burden one property more than other properties in the vicinity. When is a Noise Variance Required? What Fees are Required? The City of Renton code requires that a fee be paid for the review of all variance applications. Payment must be received before the application can be reviewed. For information on applicable review fees, click here. Who Can Apply? The applicant requesting a noise variance must be the owner or jurisdiction in charge of the project. In no cases shall the applicant for the noise variance be the contractor for the construction project. A noise variance is required when work occurs outside permissible construction hours and exceeds the following maximum permissible sound levels below. Any surrounding resident or property owner within the boundary (300 feet) of a receiving property that will experience an increase in noise, or potentially have an increase in noise, shall need to be notified. The following items are all required at the Pre -Screen meeting ( may be included in the project narrative): ❑ The nature, source, intensity and location of the noise. ❑ Specific dates, hours and timeframe for which the variance is being sought. ❑ The ambient sound levels during the day or/and night for which the variance is required. Step 9 Public Hearing Held Hearing Examiner Decision City Held Meetings ❑ Mitigation conditions the applicant will implement to minimize the sound level violations and provide alternative mitigation measures, address the specific efforts that the developer and/or contractor take to reduce any noise, other adverse impacts to or interferences with residential or other uses in the zone for which this exception is sought in the application. List use of construction equipment to be used at night, motorized equipment or heavy machinery such as tractors, compressors, generators, etc. Please specify type, size, and number with associated sound level in decibels (dBa) Clearly state the reasons why development activity and/or operation of heavy equipment cannot be conducted within the hours of 7:00 am to 10 pm. ❑ Any additional information or studies regarding any aspect of the requested variance that is deemed necessary to complete the review of the variance request. Step 4: Receipt of Application Following receipt of a complete variance application containing all the required information, City Staff will accept the application and mail a letter of acceptance to the Applicant. If required, the acceptance letter will include the date of the Public Hearing. . If the City determines the Applicant has not provided a complete submittal, a letter of incomplete application will be mailed to the Applicant. Submittal packet shall be collated. The Waiver Form and Submittal requirements forms shall match. Step 5: Public Comment Period Timeline for public comment: two (2) weeks from acceptance A public comment period is required for all noise variance applications. Step 6: Administrative Decision (if applicable) If the duration of the Noise Variance is two (2) days or less, then the application/approval is handled via an Administrative Decision. The Administrator, or his/her designee, will either approve or deny the Noise Variance and approval will NOT require a public hearing. Approval of the variance request is issued and work can proceed. Stop Here. OR If the duration of the Noise Variance is greater than two (2) days, then the application requires a Public Hearing and a Hearing Examiner Decision. Skip Step and proceed to Step 7. Step 7: Publication Notice The Hearing for a Noise Variance shall be a Public Hearing, the date for which shall not be more than forty-five (4S) days form the date of filing and acceptance of the application for the variance. The City has the responsibility to provide Notice of the time and place of the Public Hearing. Such Notice shall be given in at least one (1) publication in the City's legal newspaper (Renton Reporter). Said publication shall not be less than ten (10) business days prior to the date of said Public Hearing. Step 8: Review Period Timeline for review: two (2) weeks from Intake. The Applicant shall be required per City Renton Code to provide written notice in the form of mailing and posting to the surrounding property owners that will experience an increase in noise, or potentially have an increase in noise, such that this variance will increase the quantity of noise received by that property owner or resident. The City of Renton will provide the Applicant with a list of addresses. The Applicant will be responsible for the mailing. MAILING Written notices of such public hearing shall be mailed at least ten (10) business days prior to the Public Hearing. The Applicant shall provide the Planning Division with a notarized "Affidavit of Mailing" certifying that said mailings have been provided to the surrounding property owners or residents within three hundred feet (300') of the property. vncITNr A minimum of three (3) written notices of such public hearing shall be posted at least ten (10) business days prior to the Public Hearing within, on or about the location which will generate the noise, unless City staff determines, that due to the extent of the project, additional postings are necessary. All posters shall be visible to pedestrian traffic and remain in the right-of- way. The Applicant shall provide the Planning Division with a notarized "Affidavit of Posting" and a neighborhood detail map marked with an "X" to indicate the locations of the postings. The applicant is required to maintain the postings in good condition until the applicable appeal period has ended; after which, the applicant must remove the sign within seven days. NOTE: The hearing Examiner shall not consider any variance for which written notices have not been given, or grant any variance what would cause an increase in Page 3 of 10 Draft: 10/6/2016 NOISE VARIANCE PROCESS AND REQUIREMENTS (CONT'D) noise levels beyond that permitted in Renton Municipal Code unless the affected property owner ore resident has been notified. Step 9: Public Hearing Held Public Hearing shall be held at Renton City hall within 45 days from the date of filing and acceptance of the application. Step 10: Hearing Examiner's Decision Timeline for Decision: two (2) weeks from the Public Hearing When the Public Hearing is completed, the Hearing Examiner shall reduce his or her decision to written findings, conclusions and a decision. The written findings, conclusions and decision shall include a section noting the right of appeal from the decision to the City Council. The Variance Approval can be revoked at any time by the City if any of the conditions of approval outlined in the Decision are not met. Step 11: Appeal Period Timeline for Appeals: two (2) weeks from the Hearing Examiner's Decision An appeal period is required after hearing Examiner's Decision. Step 12: City Council Meeting (only if appealed) Any party participating in the Public Hearing feeling aggrieved by the decision of the Hearing Examiner may appeal the decision to the city Council within fourteen (14) calendar days of the decision. The appeal document shall note the errors I findings or conclusions which the appellant believes are material to the appeal. The City Council shall consider the appeal and shall affirm the decision of the Hearing Examiner unless the City Council finds that here are material errors in the findings or conclusion, or that the decision is not supportable by the findings and conclusions. If the City Council finds such errors it shall reduce its decision to writing specifying the findings and conclusion that are in error or stating that the decision is not supportable by the findings and conclusions. Any party remaining aggrieved by the decision of the City Council any further appeal to the King County Superior Court within twenty-one (21) calendar days from the date of the City Council's decision. The burden of proof as to the appropriateness of the application lies with the applicant. In order to approve a variance request, the Reviewing Official must find ALL the following conditions exist: • The applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, and location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification; • That the granting of the variance will not be materially detrimental to the public health, welfare or safety, or unduly injurious to the property or improvements in the vicinity of the location for which this variance is sought; • The approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated; • The approval is the minimum variance that will accomplish the desired purpose; • That the variance sought is the minimum variance which will accomplish the desired purpose; • That the variance contains such conditions deemed to be necessary to limit the impact of the variance on the residence or property owners impacted by the variance. Specific requirements for notification to nearby residents; i. Required cash security to pay for inspection services to verify compliance; j. Required access to the project by the City to verify compliance with the noise variance conditions; k. Specific program to allow for temporary hotel vouchers to effected residents; I. Requirements for written verification that all workers understand the noise variance conditions for the project; and m. Provision allowing the City to immediately revoke the variance approval if the variance conditions are violated. • The importance of the services provided by the facility creating the noise and the other impacts caused to the public safety, health and welfare balanced against the harm to be suffered by residents or property owners receiving the increased noise permitted under this variance. • The availability of practicable alternative locations or methods for the proposed use which will generate the noise. The extent by which the prescribed noise limitations will be exceeded by the variance and the extent and duration of the variance. ❑ Plat Certificate or Title Report: of a current Plat Certificate or Title Report obtained from a title company documenting ownership and listing all encumbrances of the involved parcel(s). Change Order #1 was due to additional time and materials because of unknown large quantities of buried construction debris within the pipe corridor which required removal by hand to avoid damaging other existing utilities. There is sufficient funding in the project budget to cover all costs. The project was awarded on June 22, 2015, to Road Construction Northwest, Inc. Construction began on August 8, 2016, and was completed on October 10, 2016. The construction start date was delayed approximately one year because the maker of the special sewer manhole did not complete its construction prior to the rainy season. The project was delayed until the following summer because sanitary sewer bypass pumping during peak wet weather significantly increases the cost and the possibility of sewer overflows. All work was performed at night because construction required the closure of Sunset Blvd North as well as the 1-405 Exit 4 off -ramp that required extensive traffic control and detours. The construction for this project also required extensive sewer bypass pumping. Therefore the additional working days resulted in increased costs. The increase of $160,807.85 was for one authorized change order in the amount of $151,379.41 and the remaining $9,428.44 was due to an increase in time and materials. Change Order #1 was due to additional time and materials because of unknown large quantities of buried construction debris within the pipe corridor which required removal by hand to avoid damaging other existing utilities. There is sufficient funding in the project budget to cover all costs. SUMMARY OF • The project was awarded on June 22, 2015, to Road Construction Northwest, Inc. Construction began on August 8, 2016, and was completed on October 10, 2016. The Construction start date was delayed approximately one year because the maker of the special sewer manhole did not complete its construction prior to the rainy season. The project was delayed until the following summer because sanitary sewer bypass pumping during peak wet weather significantly increases the cost and the possibility of sewer overflows. All work was performed at night because construction required the closure of Sunset Blvd N as well as the Exit 4, 1-405 off -ramp that required extensive traffic control and detours. The construction for this project also required extensive sewer bypass pumping. Therefore, the additional working days resulted in increased costs. Project close-out has taken longer than usual due to the contractor's delay in acquiring all the necessary paperwork from their sub -contractors. A. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to the applicant's property or project, and that the strict application of this Chapter will deprive the subject property owner or applicant of rights and privileges enjoyed by others. Staff Comment: The proposed sewer rehabilitation work will temporarily plug the side sewer to adjacent business. If the sewer rehabilitation work was done during the daytime, the adjacent business will not be able to function. The adjacent business has requested the applicant do the sewer rehabilitation work after the business working hours of 10:30 pm to reduce impact on their business. Considering the request of the adjacent business, the applicant proposes the nighttime work to not impact adjacent business during the rehabilitation work. b. That the granting of the variance will not be materially detrimental to the public health, welfare or safety, or unduly injurious to the property or improvements in the vicinity of the location for which this variance is sought. Staff Comment: Noise impacts would occur during nighttime hours during construction. However, the night work would occur only on two non-consecutive nights, and mitigation measures are proposed by the applicant. Public notification was also provided to residents of the proposed noise variance request. Noise mitigation measures are proposed by the applicant to mitigate the nighttime noise due to the sewer rehabilitation work. Staff recommends that the applicant shall notify the City of Renton noise project manager with the date and areas of expected night work prior to commencement of night work, a minimum of 24 hours in advance of the work. ✓ c. That the approval is a minimum variance that will accomplish the desired purpose. Restrictions to specific times and days; g. Specific requirements for documentation of compliance with the noise variance conditions; h. Specific requirements for notification to nearby residents; i. Specific program to allow for temporary hotel vouchers to effected residents; I. Requirements for written verification that all workers understand the noise variance conditions for the project; and m. Provision allowing the City to immediately revoke the variance approval if the variance conditions are violated. Staff Comment: Staff believes that the request for two nights work is the minimum needed to accomplish the work associated with phase 1 of the Renton Highlands Sewer and Manhole Rehabilitation Project. The applicant has proposed a noise mitigation program that includes providing advance notification of proposed work to residents within 300 feet of the nighttime work area, implementation of a noise mitigation training program for all field work supervisors, providing a contact number to residents for reporting any nighttime noise concerns, providing disposable ear plugs to residents who have noise concerns, and if all other measures are insufficient to address the concern of the affected residents, providing hotel vouchers to nearest residents during the nighttime rehabilitation work. Staff recommends the implementation of the applicant proposed noise mitigation measures as a condition of approval. Furthermore, the applicant shall provide a summary of any complaints within the City of Renton to the City's project manager, Rohini Nair, rnoir@a rentonwo.gov within 3 days of the complaint. The importance of the services provided by the facility creating the noise and the other impacts caused to the public safety, health and welfare balanced against the harm to be suffered by residents or property owners receiving the increased noise permitted under this variance. Staff Comment: Staff believes that the request is the minimum needed to accomplish the proposed sewer rehabilitation work, as the night time work is for a limited duration of only two nights. The sewer rehabilitation work will plug the side sewers to the adjacent business which will impact the operations of the business during the work day. Performing the sewer rehabilitation work during nighttime will enable the adjacent business to continue its operations without impacts from the rehabilitation work. The applicant is also proposing noise mitigation measures to address any potential noise impacts due to the nighttime work. f. The availability of practicable alternative locations or methods for the proposed use which will generate the noise. Staff Comment: There are no other alternative locations for the Phase 1 of the Renton ,i Highlands Sewer and Manhole Rehabilitation work. The sewer main will be rehabilitated using a process known as "Cured -in -Place Pipe" (CIPP). This process will allow the contractor to rehabilitate all 750 linear feet of this sewer main without any excavation. Staff believes that the request for the two nights of work is the minimum needed to accomplish the necessary work. g. The extent by which the prescribed noise limitations will be exceeded by the variance and the extent and duration of the variance. Staff Comment: Staff believes that the request for the two nights work is the minimum needed to accomplish the necessary sewer rehabilitation work of Phase 1 of the Renton Highlands Sewer and Manhole Restoration Project. The noise generated within 300 feet of the sewer rehabilitation site is approximately 69 dBA. The maximum allowed nighttime Environment Designated Noise Abatement (EDNA) in a commercial receiving property is 47 dBA. The applicant has proposed noise mitigation measures to address the nighttime noise concern. Staff recommends that the applicant's proposed noise mitigation measures be included as a condition of approval. E. CONCLUSIONS: THE SEWER REHABILITATION NIGHTTIME WORK 1S PROPOSED ON JEFFERSON AVENUE, NORTH OF THE INTERSECTION WITH NE 10TH STREET. THE WORK WOULD OCCUR ON 2 NON-CONSECUTIVE NIGHTS OVER TWO MONTHS. 1. The Renton Highlands Sewer and Manhole Rehabilitation Phase 1 Project is proposed on Jefferson Avenue, north of intersection with NE 101h Street. The requested variance meets the seven criteria to be considered in making a decision on a variance request as specified in RMC 8-7-8 if all conditions of approval are met. We are asking for relief from the requirements of the Renton Municipal Code, Title Vill — Health Sanitation — Chapter 7 and Noise Level Regulations, as per section 8-7-2 and the Washington State Administration Code (WAC) Chapter 173-60, allowing the City's contractor to work at night. The rehabilitation of these two sewers are scheduled to occur between June 16, 2017 and July 15, 2017. Project Narrative: Insituform Technologies, LLC is currently under contract with the City of Renton to rehabilitate approximately 750 linear feet of old concrete sanitary sewer main in the 1000 block of Jefferson Ave NE. This sanitary sewer main was installed in 1942 and it shows signs of significant corrosion along with many cracks and holes. This sewer main will be rehabilitated using a process known as "Cured -in -Place Pipe" (CIPP). This process will allow the contractor to rehabilitate all 750 linear feet of this sewer main in one day without any excavation. However, during this process, the adjacent side sewers are plugged for up to eight hours and therefore sewer service is unavailable. Special Circumstances: There is a laundromat at 2804 NE 101h Street that is adjacent to the sewer main that will be rehabilitated. Since the CIPP process will temporarily plug their side sewer, it is impossible to keep the laundromat in operation during its business hours of 10:00 AM- 10:30 PM. In order to keep the Laundromat in operation, the City is proposing to perform the rehabilitation of the adjacent sewer at night. The other mitigation measures listed below can be considered as part of a best management practice plan. • Give at least 72 hour advance notice to nearby residents of the time periods when particularly noisy work and potential nighttime construction activities (e.g. pullback) will be occurring through mailers, door hangers, or other similar notification methods. • Create and utilize a noise mitigation training program, which shall be implemented for all field -worker supervisory personnel including sub -contractor supervisors. • For residents near the construction, provide disposable ear plugs at their request. • Provide the City of Renton's inspector's phone number to nearby residents in case of construction related issues. • If the above measures are determined to be insufficient, provide hotel vouchers to the nearest residents during nights when the construction activity would occur.
