ISSUES: Environmental Elements Whether the applicant has adequately identified and addressed environmental impacts likely to occur in conjunction with this development? a. Housing The subject property is bordered to the east by property in the CBD zoned for multi-family residential use (R-3 and R- 4) . Uses immediately adjacent include one small apartment house build about 1959. Staff recommend that the evergreen trees proposed by the applicant as the landscape barrier at the eastern edge of the property be strengthened by the addition of evergreen shrubs to provide a more aesthetic visual buffer. A sight obscuring chain link fence with wooden slats already exists at that location and will be retained. b. Aesthetics The applicant proposes to construct a building that will be one story in height at the street frontages rising to two stories at the rear. It will have stucco siding, metal roofing , and tinted glass show windows. The structure will be oriented toward Rainier Ave. South and South Seventh Street in order to help define the street edge and contribute visually to the streetscape. Landscaping will be provided on all sides and in five percent of the parking lot behind the building. Staff recommend that: 1) the landscaping on the east side of the subject property be supplemented with evergreen shrubbery and 2) that landscaping be added to the northern boundary of the site. This additional landscaping is recommended in order to provide a stronger visual buffer between the proposed auto dealership and the neighboring properties (e.g. multi-family residence to the east and commercial development to the north) . The existing landscaping between the street and the sidewalk is in poor condition and needs to be restored. Similarly, it is recommended that the fencing on the east side of the property be retained/upgraded and that fencing be added along the northern periphery in order to supplement the landscaping buffer and' enhance noise mitigation between the site and adjacent residential development. Transportation The City's Traffic Engineering Division and Planning Division estimate only minor transportation impacts from this development. The automobile dealership is anticipated to generate approximately 253 AWDVTE, approximately 112 trip ends on Saturdays, and approximately 56 trip ends on Sundays. The anticipated level of traffic is not expected to reduce the currently acceptable level of service on Rainier Ave. South or South Seventh Street. The Traffic Engineering Division states that the curb radius on the Rainier Ave. South side of the corner of Rainier Ave. South and South Seventh Street must be modified to provide greater safety for automobiles rounding this corner from South Seventh Street onto Rainier Ave. South. The curb must be moved back approximately three feet and the sidewalk and landscaping modified accordingly. The required change in the curb radius is illustrated in the attached drawing. In addition, the first driveway east of Rainier Ave. South on South Seventh Street and the first driveway north of South Seventh Street on Rainier Ave. South must be removed and replaced with sidewalks and landscaping. Finally, the Rainier Avenue exit from the site is to be signed and painted for right-turn out only to limit impacts on that right-of- way. d. Public Services/Utilities The Storm Water Engineering Division states that a three chamber, baffled oil/water separator will be required to be installed in the existing storm drain system. -The roof drains of the new building also must be tied directly into the catch basins. Note: The Civil Engineering Division will not approve the application for a Building Permit until final civil engineering drawings are submitted for Department review. With the exception of the requirements stated above, staff report that sufficient service resources and infrastructure/utilities to serve the proposed development are available, with standard improvements (e.g. provision of lighting, signage, building identification, hydrants, secondary access) and with the payment of appropriate system development fees. Environmental Review Committee Staff Report Sound Auto Page 4 June 28, 1989 e. Noise, light and glare The proposed development, an automobile dealership, is anticipated to generate some noise, light, and glare. Operational impacts are discussed in this section; construction impacts are discussed in Section 2. f. of this document. This automobile sales operation is not generally anticipated to generate sound that is more significant than the level or type of sound generated by traffic on Rainier Ave. South, a major arterial. Staff recommend that in the event there is an intent to use a paging system to enhance on-site communications that a "hand-held paging" system be used, rather than a loudspeaker system in order to reduce off-site noise impacts. The applicant proposes to direct on-site illumination so that it does not generate light or glare to other properties nor impact passing vehicles. The applicant also proposes the use of lightly tinted (five to ten percent) glass for the windows,- thus reducing glare impacts from large display windows. Staff recommends the addition of landscaping and fencing to provide a further barrier against light and glare. f. Construction The proponent should be required to provide a construction plan that includes an erosion control plan, a plan for hours of operation and hauling, and a street clean-up bond of $1, 000 to ensure that construction activities do not place an undue burden upon the neighboring properties or the municipality. Note: The City of Renton Fire Prevention Bureau has determined that the underground fuel tanks that served the gasoline station previously occupying this site have been removed and any contaminated soil also has been removed.; C. RECOMMENDATIONS: Staff recommend that ERC issue a Determination of Non-Significance- Mitigated, with the following conditions: 1. That the applicant provide a revised landscaping/screening plan, which increases the number, size and species of plantings along the site perimeters, which improves existing screen fencing as appropriate, and which adds solid fencing along the northern perimeter, in Environmental Review Committee Staff Report Sound Auto Page 5 June 28, 1989 order to mitigate aesthetic impacts, noise impacts (to abutting residences) and light and glare impacts, as well as to provide defined site boundaries for purposes of crime prevention. This plan should be provided in advance of site plan review, and should be subject to the approval of the City's Landscape Planner. (Environmental Review Ordinance 4-2822 - E.1.b and City of Renton Noise Level Regulations - 8-1101-1105) 2. That the applicant be required to post a landscape performance bond in the amount of $3, 000 to be valid for a period of three years, to ensure the maintenance of plantings and irrigation systems to the satisfaction of the City Attorney. (Environmental Review Ordinance 4-2822 - E. 1.b) 3 . That the applicant provide a revised site plan, in advance of site plan review, that meets the Traffic Engineering Division's requirements for a modified curb radius along Rainier Ave. South at the corner of Rainier Ave. South and South Seventh Street. Also, the driveway on Rainier Avenue should be signed and painted for right-turn out only. These revisions are recommended to improve safety and the efficiency of vehicular travel along adjacent corridors. (Environmental Review Ordinance 4-2822 - E. l.b) 4. That the applicant provide a traffic mitigation fee of $18,234. 00 (253 .25 trip ends x $72. 00 per trip per the Grady Way Transportation Benefit Zone) in order to mitigate traffic impacts to the site. (Environmental Review Ordinance 4-2822 - E. l.b. and City of Renton Grady Way TBZ) 5. That the applicant have in operation, in advance of issuance of a Certificate of Occupancy, hand-held paging devices rather than loudspeakers, in order to reduce noise impacts. (Environmental Review Ordinance 4-2822 - E. l.b. ; E. l. f.and City of Renton Noise Level Regulations 8-1101-1105) 6. That the applicant be required to provide a plan for mitigation of construction impacts, including: a) an erosion control plan; b) a plan for wheel washing of trucks on site; c) a plan for periodic watering down of the site; and d) a plan for hauling routes and hauling hours. This plan should be provided in advance of the issuance of a site preparation plan and should be subject to approval by the Public Works Department and the Fire Prevention Bureau. These comments are as follows: Police Department: Probable minor impact - public services. Probability of people "shortcutting" through lot onto Rainier. Poor traffic pattern. Is there adequate parking available for inventory here? Inventory parking along 7th is unacceptable. Fire Prevention Bureau: Probable minor impact - public services. All fuel tanks and/or waste oil tanks are required to meet Fire Dept. approval for installation and containment. Design Engineering: Probable minor impacts - earth, air, water, transportation, and utilities. Have existing fuel tanks from gas station been removed? Traffic Engineering: Probable minor impacts - earth, air, plants, animals, energy & natural resources, transportation, public services, and utilities. That the applicant provide voluntary contribution for traffic improvements of $18,234 . 00 (253 .25 trip ends x $72. 00 per trip for the Grady Way Transportation Benefit Zone) in order to mitigate traffic impacts to the site. (Environmental Review Ordinance 4-2822 - E. 1.b. and City of Renton Grady Way TBZ) c. That the applicant be required to provide a plan for mitigation of construction impacts, including: 1) an erosion control plan; 2) a plan for wheel washing of trucks on site; 3) a plan for periodic watering down of the site; and 4) a plan for hauling routes and hauling hours. Conformance with the Comprehensive Plan, its elements and policies; The proposed commercial development does conform to the Comprehensive Plan Map designation of the property for commercial use. Sound Auto Report and Decision August 16, 1989 Page 3 Development, such as V.A.4. which calls for commercial areas to be located and designed to minimize travel and congestion and to promote safety; V.B.4. which calls for site plan . design to provided for efficient and function use of land, and V.B.S. which calls for developments to be designed to avoid adverse impacts on adjacent properties. Similarly, the project is generally consistent with Urban Design Goals, Objectives and Policies for area growth patterns, for maintenance of district integrity and for improvements such as landscaping and signage. The proposed automobile sales facility is planned to redevelop a site which was previously developed with a gasoline service station which has been demolished, leaving an abandoned site. The automobile sales facility will serve to upgrade the appearance, and, thus, the value of the site, through the creation of attractive structures and grounds. The development is to be located adjacent to S.W. 7th Street and Rainier Avenue, two principal travel corridors, and nearby to numerous commercial and industrial developments. The project, as proposed and/or recommended, is designed and sited on the property in a manner which will ensure compatibility between this development and neighboring commercial uses. Further, the project has been designed in a manner which complements nearby residential uses (See Sections 9.c. and 9.d. for additional information) . b. Conformance with existing land use regulations; The planned automobile sales center has generally been proposed by the proponent to be designed to conform to Zoning Ordinance requirements/development standards for Commercial Use (4-711) , such as lot coverage, setback, height and bulk requirements. Similarly, the development as proposed meets requirements set in the Parking and Loading Ordinance (4-2204) for parking facilities, maneuvering areas and access routes. Finally, the landscaping plan as recommended by the Environmental Review Committee in conjunction with environmental review (See Section 3 above) is consistent with requirements established in the Landscaping Ordinance (4-744) . c. Mitigation of impacts to surrounding properties and uses; Off-site impacts have been identified in the following areas: housing, aesthetics, traffic, noise and light and glare. 1) Housing As previously noted, residential development (primarily multi-family units) exists to the east of the proposed development. Particular efforts have been made -- through recommendations for structural design and location, landscaping/screening, parking and access routes, noise mitigation, light and glare mitigation, and similar measures -- to minimize impacts upon local residents. 2) Aesthetics Potential aesthetic impacts relating to the proposed development have been identified based upon the fact that the site is adjacent to the residential development, as described above, and, also, abuts Rainier Avenue (a State Highway which is an entryway into the City) and S.W. 7th Street (a principal arterial) . In order to mitigate those impacts, the project has been proposed to incorporate a Site••Plan Review Commis e ` Sound Auto Report and Decision August 16, 1989 Page 4 number of features to enhance design and function. For example, the structure is to be located at the junction of the two roadways, so that it is convenient to and visible . from the rights-of-way. It is planned to be one-story in height and its facades of glass/stucco and metal roofing are attractive, durable and compatible with nearby developments. Similarly, landscaping, screening, on site-illumination and signage shall, with redesign, complement the development and mitigate off-site impacts. For example, the landscaping plan will be required to include plantings at the periphery of the site and within the site which are sufficient in size, number and diversity to provide an attractive viewscape and visual buffer to adjoining properties. Screening of the eastern boundary provides a visual and noise buffer to abutting residential uses; screening of the northern boundary similarly mitigates impacts to the adjacent commercial development. Exterior lighting fixtures are to be designed to direct illumination away from abutting sites; additional fixtures will be required to ensure adequate lighting of the outside vehicle showroom as a crime prevention technique. Signage will be required to conform to City regulations, be architectually integral to the building, to be compatible with abutting developments and to be appropriate for location on a principal arterial/entryway to the City. 3) Traffic Off-site traffic impacts will be discussed in Section 9. f. below. 4) Noise, light and glare Noise, light and glare impacts are evaluated below in Section 9.h. d. Mitigation of impacts of the proposed site plan to the site; On-site impacts from the proposed development have been identified in the following areas: aesthetics, traffic, noise, light and glare. 1) Aesthetics The proposed design of the retail sales facility (e.g. glass/stucco facades, convenient access, visible entries) , the proposed location of the facility and the outside vehicle storage area, the recommended landscaping plan, the recommended screening plan, the recommended exterior illumination plan and the proposed signage plan should combine to provide an attractive, efficient project for users and passersby. 2) Traffic On-site traffic impacts will be reviewed in Section 9. f. below. 3) Noise, light and glare Noise, light and glare impacts are evaluated below in Section 9.h. -Site-Plan Review Commi e Sound Auto Report and Decision August 16, 1989 Page 5 e. Conservation of area-wide property values; The planned office project is not expected to have a negative impact on property values in the area since development is proposed/recommended to be designed to: 1) improve the attractiveness and efficient use of the site; and 2) be compatible with uses on neighboring properties. f. Safety and efficiency of vehicle and pedestrian circulation; The ITE Report states that an automobile sales facility of the type and size of the proposed development can be estimated to generate approximately 254 ADWVTE; a similar number of trips could occur on weekends. Staff report that off-site impacts from the projected number of vehicle trips can be mitigated by participation in local and regional transportation improvement projects, as recommended in conjunction with the environmental review for this project (See Section 3 above) . On-site impacts have been mitigated by the proposal for a parking and loading system which conforms to the City's Parking and Loading Ordinance requirements for numbers of spaces, dimensions, maneuvering areas and ingress/egress points. This plan, together with a plan for pedestrian linkage and proposed exterior illumination, allows for safe, efficient passage by vehicles and pedestrians on the site. g. Provision of adequate light and air; The development has been proposed/recommended to be designed and sited so that the structure and the outside storage area for new vehicles are well-separated and screened (by landscaping and fencing) from the neighboring commercial development to the north and the neighboring residential uses to the east. The design/location of the project is such that there are no significant interference to light or air to those abutting properties. The site is separated from developments to the south by S.W. 7th Street and separated from development to the west by Rainier Avenue. h. Mitigation of noise, odors and other harmful or unhealthy conditions; 1) Construction Construction activities will generate some noise, dust and debris to the site and the surrounding area. Mitigation measures recommended in conjunction with environmental review (See Section 3 above) are sufficient to address impacts upon adjacent residential and commercial developments and upon Rainier Avenue and S.W. 7th Street as well. 2) Operation The proposed automotive sales development is anticipated to create some noise and light and glare impacts upon surrounding residential and commercial developments. Site•-Plan Review Commi Sound Auto Report and Decision August 16, 1989 Page 6 Noise generated by operation of this development to residential properties to the east is of particular concern. Mitigation measures required in conjunction with environmental review and with this land use review -- fencing, hand-held paging systems rather than loudspeakers -- and location of the showroom/office well-away from the residences are anticipated to limit sound to a level no greater than that emanating from S.W. 7th Street which abuts those residential properties. Noise generated by routine operation of this facility is determined to be no different in type or greater in intensity than those sounds generated by the commercial development to the north, or the roadways to the west and south of the site. An accoustic wall will limit noise impacts to the property to the north. Hand-held paging systems will reduce distraction to persons travelling on the right-of-way and limit interruption of activities taking place on the nearby commercial uses. Light and glare to abutting properties can be mitigated through screening, landscaping, and the direction of on-site illumination to the interior of the site. Automobile service operations are not scheduled to take place on this site, so staff anticipate no significant odors or spill contamination. i. Availability of public services and facilities to accommodate the proposed use; and Development of the proposed retail sales complex, with recommended environmental conditions (see Section 3) and land use mitigation measures is not generally expected to create an undue burden on public services and facilities in the area. Neither the Police Department nor the Fire Prevention Bureau has indicated that the proposed facility would place a major burden on their respective services if code provisions (e.g. signage, lighting) are met. The site is adequately served by utilities lines (water mains, sanitary sewers) with connection requirements as stipulated by City Ordinance and Code. Storm drainage management, similarly, can be achieved through standard improvement systems, as specified by the Public Works Department. j . Prevention of neighborhood deterioration and blight. The proposed facility is expected to have a generally positive impact on surrounding properties and on the local area as a whole by providing new development on a formerly developed, now vacated and abandoned site, and by making efficient use of a property which is convenient to nearby arterial streets. Conclusions: 1. The subject proposal generally complies with the policies and codes of the City of Renton. k Site—Plan Review Commit Sound Auto Report and Decision August 16, 1989 Page 7 2 . Specific issues raised by various City departments and focused on were: a. Participation in local and regional traffic improvement plans. b. The provision of adequate landscaping and screening in order to mitigate aesthetic impacts, noise impacts (to abutting residences) , and light and glare impacts, as well as to provide defined site boundaries for purposes of crime prevention. c. The provision of a fully improved storm water management system. d. Noise, light and glare mitigation. 3 . The proposal complies with the Comprehensive Plan designation of Commercial Use. Decision: The site plan for Sound Auto Stores, file no. ECF; SA-057-89 is approved, subject to the following conditions: 1. That the applicant comply with all conditions established by the Environmental Review Committee on June 28, 1989, in advance of the issuance of site preparation/building permits. 2 . That the applicant provide a revised landscaping/screening plan, which increases the number, size and species of plantings along the site perimeters, which improves existing screen fencing as appropriate, and which adds solid fencing along the northern perimeter, in order to mitigate aesthetic impacts, noise impacts (to abutting residences) and light and glare impacts, as well as to provide defined site boundaries for purposes of crime prevention. This plan should be provided in advance of the issuance of site preparation/building permits and should be subject to the approval of the City's Landscape Planner. 3 . That the applicant be required to post a landscape performance bond in the amount of $2, 000 to be valid for a period of three years, to ensure the maintenance of plantings and irrigation systems to the satisfaction of the City Attorney. 4 . That the applicant have in operation, in advance of issuance of a Certificate of Occupancy, hand-held paging devices rather than loudspeakers, in order to reduce noise impacts. 5. That the applicant provide a revised on-site exterior illumination plan, with an increased number of standards in the vehicle show parking area. Their specific concerns related, initially, to the City's requirement that they replace an unsafe curb cut constructed by the City, and the City's request for a contribution of approximately $18,000 for the Grady Way TBZ. (See attached note dated July 17, 1989) The ro onent's concerns p p o cerns were shared with the Traffic Division. On July 25th the Traffic Engineer submitted a response stating that the original mitigating conditions should be retained. (See attached memo from Gary Norris). On July 25th the proponent responded to the' Traffic Division memo, agreeing to replace the curbing, and to contribute to-the TBZ, with the proviso that the cost of curb replacement be deducted from the TBZ assessment. (See note from Scott Miller). • Staff note that the Traffic Engineering Department refers to an agreement with property owners for curb improvements at the time of redevelopment of the site -- however, no written document exists to support the presence of such an agreement. Staff also note that the Grady Way TBZ, to which the applicant is being asked to contribute, has not formally been accepted by the City. Staff recommend that the applicant's suggestion that he provide (or allow the City to provide).improvements to the curb cut, and that those costs be deducted from the TBZ contribution be accepted. The suggestions appear to be appropriate and reasonable in their own right, and a suitable compromise owing to the absence of a written agreement requiring such improvements and the "unofficial status" of the Grady Way TBZ. Miller's correspondence dated July 17, 1989. 1. Information request on new curbing' cutback on northeast corner of intersection. Response: The attached drawing should be forwarded to Scott Miller. South 7th Street Roadway Improvement Project: In exchange for a needed sidewalk easement with the Wolf Brothers, owners of property in question, we agreed not to disturb the driveway on Rainier Ave. South because itiwas the main access to the Serve-U gas station business. Now that the usage of the property is changing, we are requesting a minor adjustment in about 10 feet Of curb curve radius. As is, turning vehicles hit the curb because we had to match the curb radius back into the existing driveway. Now that the driveway is being removed and replaced, we are requiring the developer to match the replaced driveway curb into an improved curb radius. 2. Sound Auto says they paid $30,000 for roadway improvements. Response: As a condition of property development for usage as a truck sales lot, the property owner was required to install off-site improvements which were for curb, gutters, sidewalks, roadway widening and street lighting. These off-site improvements were deferred and were installed as part of a larger City roadway improvement project. Sound Auto says they feel they are ,paying double for improvements if they pay $18,234 on a transportation benefit zone. Response: The charge for the transportation benefit zone is to mitigate the traffic impact in the Grady Way transportation benefit zone corridor. This is an altogether different fee from the off-site improvements. Purpose of the Grady Way transportation benefit zone is to provide necessary roadway improvement needs for the Grady Way corridor to accommodate a full development scenario for the year 2000. This is also a means to provide an equitable public/private cost sharing program with costs distributed fairly among the individual property owners. The transportation benefit zone charge is required if supported by ERC. The charge is voluntary if not supported by ERC. If any other questions arise, please let us know.
