Right of Way Acquisition and Relocation Services
The Local Agency of City of Renton
desires to supplement the agreement entered into with Universal Field Services, Inc.
and executed on 5/6/2014 and identified as Agreement No. CAG-14-074
All provisions in the basic agreement remain in effect except as expressly modified by this supplement.
The changes to the agreement are described as follows:

Task Element- Right of Way Services for West and Sons Towing Offer
Background
The City of Renton (CITY) has had meetings with West and Sons Towing (WEST) to gauge their willingness
to sell their parcel to the CITY and subsequently purchase the adjacent fire District parcel as a replacement
site. To date, WEST has stated they have no interest in purchasing the fire District property and would only
be interested in a property swap with no money out of pocket. As such, the CITY has asked Universal Field
Services, Inc. (UFS) to provide this Scope of Work (SOW) to make a written offer and provide the minimal
required negotiations to purchase a portion of the WEST'S parcel for the project. If WEST is still
uninterested, the CITY may elect to put the project on hold.
Additional Work Completed
A previous SOW was presented for Sub-Task B of the project which included right of way services for all
parcels. Due to the uncertainty involving the WEST parcel, the CITY was unwilling to fund the entire SOW
for services that may not be needed. The CITY acknowledged that additional work must continue while
developing the appropriate SOW and strategy for the project. The CITY committed to reimburse UFS for
the additional items outlined below.
• Plan right of way schedule with KPG
• Revision of SOW, Fee Estimates and Supplemental Agreement
• Revise subconsultant agreements (appraiser and review appraiser
• Participate in discussions with CITY staff on WEST acquisition strategy
The costs associated with these work items are included in the fee estimate presented with this SOW.
Property Rights to be Acquired
The CITY acknowledges that the appraisal and written offer to WEST will be made prior to receiving a
letter from FHWA authorizing the use of federal funds to acquire Right of Way. As such, FHWA
reimbursement for right of way services associated with this SOW may not be available and condemnation
cannot be used for the acquisition of the property and/or property rights.
Based on the Right of Way Plan dated October 2013, review of schematic drawings and exhibits and
discussions with CITY staff, property and/or property rights will be required from the WEST parcel as
shown in Table A below. Additional parcels or real property rights other than those shown in Table A will
require an amendment to this scope of work and related fee estimate.
This scope of work is based on the following:
I.) Discussions with CITY staff.
2.) Recent tour of the project limits
3.) Review of limited public on-line information (mapping/ ownership information)

Preparation and Administration - Discuss, strategize and plan overall process with CITY,
UFS and other consulting staff. Attend up to two (2) progress meetings via telephone conference.
Provide one (1) monthly progress report indicating the work completed for the invoiced month,
anticipated work for the following month, and identify issues requiring the CITY's input or assistance.
Deliverables:
• Attend two (2) teleconference Progress Meetings
• Provide one (1) Monthly Progress Report
• Prepare parcel acquisition file for negotiations
2 Appraisal—Appraisal of the property has been completed by CITY under separate contract
with the appraiser.
3 Appraisal Review — UFS will subcontract and manage the Appraisal Review process with an
appraisal firm previously qualified by WSDOT and certified by the State of Washington. The Appraisal
Review report will be prepared in accordance with the Uniform Standards of Professional Appraisal
Practices, Washington State Department of Transportation (WSDOT) Local Agency Guidelines, current
WSDOT Right of Way Manual (in particular, Chapters 4 and 5), and the URA. It is assumed one (1)
Appraisal Review report will be required.
Deliverables:
• One (1) Appraisal Review report in accordance with the Uniform Standards of Professional
Appraisal Practices, Washington State Department of Transportation (WSDOT) Local Agency
Guidelines, current WSDOT Right of Way Manual (in particular, Chapters 4 and 5), and the
URA.
4 Acquisition Negotiation — UFS will provide services for the acquisition of real property
rights from one (1) separate tax parcel as shown in Table A below. The Appraisal Review will be
submitted to the CITY for written approval establishing the amount of Just Compensation to the
property owner. Upon written approval from the CITY, UFS will prepare the offer package and
promptly present offer to purchase all the required real property interests.
Offer will be presented via certified mail and regular US mail. Negotiations will be limited to making
three (3) significant contacts with the property owner in accordance with statutory and regulatory
requirements. If the property owner shows willingness to negotiate in good faith, the CITY and UFS
will supplement this SOW to include further right of way services.
Negotiations shall not be deemed to have failed until at least three significant meaningful contacts have
been made and documented with the owner and/or their representative through direct personal
contacts. If negotiations reach an impasse, UFS will provide the CITY with written notification.
Deliverables:
• Acquisition Negotiation services with owner of one (1) separate tax parcel.
• Parcel file including necessary records of all Right of Way Acquisition services.
5 Relocation — It is assumed WEST may be eligible for relocation as a result of this project.
Therefore, relocation assistance and advisory services may be required if the project proceeds.
Relocation services are not a part of this SOW and fee estimate. Relocation services will require an
amendment to this SOW.

• None. For informational purposes only.
6 Parcel Closeout — Escrow Closing — This SOW does not include parcel closeout and
escrow closing.

Additional Work - If other tasks are required to be performed or there are changes in pertinent
information or if negotiations exceed the industry standard for a good faith effort to negotiate (three "in-
person" landowner contacts), UFS reserves the right to request additional compensation as an equitable
adjustment. UFS shall not be responsible for delays caused beyond its control.
CITY will provide the following
I. Right of Way Plans and Drawings, Maps, Exhibits, Right of Way Staking, etc., as necessary.
2. Legal descriptions in electronic format for all real property rights to be acquired.
3. Form approval, in electronic format, of all legal conveyance documents prior to use (i.e. offer letters,
purchase and sale agreements, escrow instructions, easements, deeds, leases and permits).
4. Review and approval of determination of value, established by the project appraisers, and provide
written authorization prior to offer being made to property owners.
5. Payment of any and all compensation payments to property owners, recording fees, relocation
payments, legal services and any incidental costs which may arise necessary to complete each
transaction.
