HomeMy WebLinkAboutAdden 5 • CAG-12-086, Adden #5-15 racy„f, f �µ DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT ADDENDUM # 05-15 TO CAG-12-086 Between CITY OF RENTON and EAI BLUMEN ADDENDUM#05-15 This addendum ("Addendum # 05-15") to CAG-12-086 is agreed to on this //day of March, 2015 ("Effective Date"), by and between the City of Renton, a noncharter code city under RCW 35A, and a municipal corporation under the laws of the State of Washington ("Renton"), and EAI Blumen, licensed to do business in the State of Washington ("Consultant"). Renton and Consultant are collectively referred to as the "Parties". The Parties mutually agree to amend their Consultant Agreement related to Quendall Terminals Phase 3B FEIS and Mitigation Agreement work, under CAG-12-086. Prior Addenda to CAG-12-086 Addendum#01-12 increased the Original Contract Sum of Thirty Nine Thousand Seven Hundred Sixty Five dollars ($39,765.00) set forth in Paragraph 4 of the original Agreement by One Thousand Six Hundred dollars ($1,600.00)to an Amended Contract Sum of Forty One Thousand Three Hundred Sixty Five dollars($41,365); Addendum #02-13 increased the Amended Contract Sum of Forty One Thousand Three Hundred Sixty Five dollars ($41,365) set forth in Paragraph 4 of the Addendum #01-12 by Forty Three Thousand Two Hundred Twenty Five dollars ($43,225.00) to an Amended Contract Sum of Eighty Four Thousand Five Hundred Ninety dollars ($84,590); 1 Addendum #03-13 increased the Amended Contract Sum of Eighty Four Thousand Five Hundred Ninety dollars ($84,590) set forth in Paragraph 4 of the Addendum #02-13 by Seventeen Thousand Two Hundred Eighty Five dollars ($17,285.00) to an Amended Contract Sum of One Hundred One Thousand Eight Hundred Seventy Five dollars ($101,875) and extended the term set forth in Paragraph 3 of the Addendum #02-13 to December 31, 2013. Addendum #04-14 increased the Amended Contract Sum of One Hundred One Thousand Eight Hundred Seventy Five dollars ($101,875) set forth.in Paragraph 4 of the Addendum #02-13 by Ten Thousand Four Hundred Fifteen dollars ($10,415.00) to an Amended Contract Sum of One Hundred Twelve Thousand Two Hundred Ninety dollars ($112,290) and extended the term set forth in Paragraph 3 of the Addendum#03-13 to December 31, 2014. NOW, THEREFORE, in consideration of the mutual terms and covenants previously exchanged and to be exchanged in the future,the Parties agree to the following amendments: SECTION 1. Paragraph 1, entitled Scope of Services, shall be amended as follows: Exhibit A of the Consultant Agreement is edited to the extent required to add additional services for Consultant to perform. Thus, Exhibit A's language shall remain the same except for the additional language contained in Exhibit A of this Addendum. SECTION 2. Paragraph 5, entitled Consultant Agreement Sum, shall remain the same except for the following modification: The total amount of this Agreement shall not exceed the sum of Nineteen Thousand Six Hundred Ninety Dollars and no cents ($19,690.00) (with a 5%contingency). SECTION 3. Paragraph 4, entitled Term of Consultant Agreement, shall be amended as follows: The Parties mutually agree to extend the term of this Consultant Agreement to 5:00 p.m. on December 31, 2015. The Parties may agree to extend this Consultant Agreement with another Addendum, if necessary. 2 IN WITNESS WHEREOF, the Parties agree that this addendum, once executed, takes effect on the Effective Date noted above. To date, EA and our team have prepared two versions of the FEIS and two versions of the full Mitigation Document (there have been multiple versions of the mitigations list) for the City of Renton's and Century Pacific's (Century) review and comment. However, our Scope of Work for these services has expanded beyond what we anticipated in our last contract amendment and substantial schedule delays have occurred. As of March 6th, we had approximately $1,150 remaining in our Phase 3B budget. This budget will not be sufficient to complete and issue the FEIS and Mitigation Document. As such, EA is proposing a contract amendment to complete our services on Phase 3B. This amendment is required for several reasons, including: 1) the substantial time and effort required to finalize the Mitigation Document; 2) the additional transportation analysis required by the City, given the change to the anticipated project build-out year; 3) the need to update the FEIS to reflect the changes to the Mitigation Document; and,4) the additional printing costs required due to increases in vendor printing rates over time (approximately two years since the last contract amendment was prepared). Following is our proposed Scope of Work and Budget for the additional work that will be required for EA to complete and issue the FEIS and Mitigation Document. Scope of Work EA will complete the following tasks in Phase 3B — Prepare and Issue FEIS and Mitigation Document: • Task 1: Prepare the For-publication Mitigation Document for the City's final review. This document will incorporate the final mitigation measures list received from the City on 2.12.15. • Task 2: Prepare the For-publication FEIS for the City's final review. This document will address the City's comments on the 2nd FEIS, include the final list of mitigation measures, and, as appropriate, provide references to the final mitigation measures. The document will also incorporate the updated transportation analysis prepared by TENW, and summarize the results of the analysis in the Key Topic Areas section of the document. We assume that the City's comments on the For-publication FEIS will be minimal/edit level (i.e., limited to very minor corrections and clarifications). • Task 2: Coordinate printing and CD production of the published FEIS and Mitigation Document. We assume preparation of 25 hardcopies of a one-volume, approximately 600-page FEIS and of an approximately 35-page Mitigation Document, and 46 CDs of both documents. We will also assist the City in placing the FEIS and Mitigation Document on their website. • Task 7: Meetings. Participate in up to one (1) additional, up to 2-hour meeting with the City and Century associated with the FEIS and Mitigation Document. • Task 8: Coordinate and communicate with,the City, Century, and EA's technical team via telephone and email throughout Phase 3B. Note: this budget amendment does not include additional professional services and expenses provided by EA should an appeal be filed on the EIS and Mitigation Document. The provision of services to prepare for and attend appeal hearing(s) would be billed on an hourly basis at EA's current billing rates at the time. Budget • Based on the above Scope of Work, we will need an adjustment of $19,690 to our Phase 3B Prepare and Issue FEIS and Mitigation Document budget (see the budget breakdown below). We propose to continue to provide services on an hourly basis during Phase 3B according to our current Fee Schedule (see Attachment A). We will bill you for labor and expenses on a monthly basis. Quendall Terminals 2 Phase 3B—Complete and Issue Final EIS &Mitigation Document Proposed Contract Amendment Schedule EA anticipates submitting the For-publication FEIS and Draft Mitigation Document to the City and Century in late-March/early April. Publication of the FEIS and Mitigation Document could occur in late April, assuming minimal comments from the City and Century on these two documents. If there are substantial delays in the schedule that are beyond the control of EA, further adjustments to our Scope of Work and Budget could be necessary. All of the terms and conditions specified in our Phase 3B Contract with the City still pertain unless modified herein. If the Scope of Work and Budget in this proposed contract amendment are acceptable to the City and Century, please proceed with authorizing this adjustment. We are prepared to continue with our Phase 3B services upon your authorization. Please call either of us if you have any questions. Read, PE, Principal TENW SUBJECT: Quendall Terminals FEIS Completion A Proposal This proposal addresses the known addendum items to the FEIS to reflect recent planning, growth projections, mitigation plans, and other components related to the Transportation elements for Quendall Terminals. Our scope of work would include: • 1 . Attend and/or participate in Team/City meetings and tel-cons associated with scoping, document review, mitigation revisions and-analytical support on an as needed basis. 2. Prepare a comparative analysis of growth trends between 2010 and 2014 traffic counts at study intersections based on original traffic count assumptions of the DEIS and FEIS analysis in contrast to other recent.traffic counts conducted within the study.jarea by the City of Renton. • . 3. Review and incorporate the necessary components through reference or duplication, study •assumptions, findings, and conclusions into an FEIS supplemental addendum to provide a documentation of recent corridor planning along the Lake Washington Boulevard corridor, Quendall Terminals site access intersections, and the NE 44th Street interchange. Discuss and outline mitigation associated with the Project-Only Buildout Scenario for 2017 (without I-405/NE 44th Street Interchange Improvements) and the Cumulative Buildout Scenario for 2035 (with I-405/NE 44th Street Interchange Improvements) to support the FEIS determination. 4. Review recommended revisions to site access/mitigation conditions and amend the FEIS as necessary or identify appropriate revisions to support project buildout under the two scenarios noted above. Address other Transportation items as appropriate that related to timing of original DEIS analysis and date of FEIS publication (planned improvements, pipeline growth, etc.). 5. Document and reference that the most recent version of the ITE Trip Generation Manual has no updates to rates for uses reviewed in the Quendall Terminals EIS. The total level of effort is estimated not to exceed $4,500 and would be billed on a time and materials basis. Scoping efforts and an initial comparative analysis of recent traffic growth at spot locations meetings have already been completed.
